Home My WebLink About2005 091 CC RESO2005 091 CC RESO ×P@ RESOLUTION NO. 2005-091 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD NOVEMBER 8, 2005, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Baldwin Park, California, on Tuesday, November 8, 2005, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in General Law cities; and WHEREAS, the County Election's Department canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF BALDWIN PARK, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of ballots, including provisional ballots, cast in the precincts except absent voter ballots and provisional ballots was 8052. That the whole number of absent voter ballots cast in the City was 1632, making a total of 9684 ballots cast in the City. SECTION 2. That the names of the persons voted for at the election are as follows: FOR MAYOR RICHARD S. GONZALES MANUEL LOZANO FOR CITY COUNCIL MARLEN GARCIA BILL MR. BILL" VAN CLEAVE RAUL ARREDONDO REYES ANTHONY J. BEJARANO JOSEPH ARMENDARIZ MARINA MONTENEGRO 2005 091 CC RESO ×P@ Resolution No. 2005-091 Page 2 FOR CITY CLERK SUSAN RUBIO KATHRYN VIDALES TIZCARENO FOR CITY TREASURER MARIA ANTONIETA MARIE" CONTRERAS MARGARITA VARGAS FOR MEASURE B SHALL THE CITY OF BALDWIN PARK'S TRANSIENT YES OCCUPANCY TAX, WHICH IS LEVIED FOR THE PRIVILEGE OF OCCUPANCY IN ANY HOTEL OR MOTEL, BE INCREASED FROM TEN PERCENT 10%) TO ELEVEN PERCENT 11 %) AS NO OF JANUARY 1, 2006; AND BE INCREASED FROM ELEVEN PERCENT 11 %) TO TWELVE PERCENT 12%) AS OF JANUARY 1, 2008? SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates and for and against the measure were as listed in Exhibit A" attached. SECTION 4. That the City Council does declare and determine that: Manuel Lozano was elected as Mayor for the full term of two years; Marlen Garcia and Anthony J. Bejarano were elected as Members of the City Council for the full term of four years; Susan Rubio was elected as City Clerk for a full term of four years, Maria Antonieta Marie" Contreras was elected as City Treasurer for a full term of four years; and That as a result of the election, a majority of the voters voting on Measure B relating to an increase in the Transient Occupancy Tax DID NOT vote in favor of it and that the measure WAS NOT carried and SHALL NOT be deemed adopted and ratified. SECTION 5. That the City Clerk shall enter on the official records of the City Council of the City, a statement of the result of the election showing: 1) The whole number of ballots cast in the City; 2) The names of the persons voted for; 3) For what office each person was voted for 4) The number of votes given at each precinct to each person; and 5) the total number of votes given to each person. 2005 091 CC RESO ×P@ Resolution No. 2005-091 Page 3 SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated and that each person elected shall have administered to him/her, an Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 7. That the City clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED, AND ADOPTED this 7th day of December, 2005.
