HomeMy WebLinkAbout2008 039 CC RESO2008 039 CC RESOHÄ—@¸—‘mÍ«RESOLUTION 2008-039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE APPLICATION AND DEVELOPMENT REVIEW PROCESS FOR USE BY THE PLANNING DIVISION AND REDEVELOPMENT DIVISION FOR PROPOSED MODIFICATIONS TO PROPERTIES AFFECTED BY CALTRANS ACQUISITION ACTIVITIES FOR THE CURRENT 1-10 SAN BERNARDINO FREEWAY WIDENING PROJECT WHEREAS, the California Department of Transportation CalTrans") is proposing to widen the 1-10 San Bernardino Freeway to include a high occupancy vehicle HOV") lane through Baldwin Park; and WHEREAS, there are properties adjacent to the 1-10 San Bernardino freeway within the Sierra Vista Redevelopment Project Area that will be impacted by the proposed widening activities; and WHEREAS, CalTrans has begun contacting property owners with property adjacent to the 1-10 San Bernardino Freeway with the intent to partially or fully acquire properties in order to complete the widening project; and WHEREAS, the City and the Redevelopment Agency have established development standards, criteria, and processes that would apply to those properties affected by the proposed CalTrans widening activities; and WHEREAS, some of the properties impacted by the freeway widening activities are currently deemed nonconforming for different reasons; and WHEREAS, Section 153.609 B) of the City's Municipal Code states that no building or structure shall be deemed nonconforming where such nonconformity is caused by public acquisition of a portion of the building, structure or the lot upon which such is located; and WHEREAS, it is the intent of the City of Baldwin park and the Community Development Commission to implement all applicable Municipal Code and Sierra Vista Redevelopment Plan provisions WHEREAS, property owners impacted by the freeway widening project should be assisted with processing of any needed modifications to the properties affected as long as the modifications are not made at the property owners' own accord. That the City Council and Community Development Commission shall adopt the following development procedures and submittal requirements in accordance with the Exhibit A" which is attached to this resolution. SECTION 2. That at the discretion of the City Planner, the proposed modifications may be subject to Design Review and Conceptual Review by the CDC depending upon the extent of those modifications. SECTION 3. That the decision of the City Planner shall be subject to the appeal process set forth in the City's Municipal Code. SECTION 4. That the City Clerk shall certify to the adoption of this resolution and shall forward a copy hereof to the City Planner.
