BACKGROUND AND DISCUSSION: The attached Claims and Demands report format meets the required information in accordance with the Government Code. Staff reviews requests for expenditures for budgetary approval and for authorization from the department head or its designee. The report provides information on payments released since the previous City Council meeting; the following is a summary of the payments released: The payroll of the City of Baldwin Park consisting of check numbers 193133 — 193176. Additionally, Automatic Clearing House (ACH) Payroll deposits were made on behalf of City Employees from control numbers 212630 — 212888 for the period of December 26, 2010 through January 08, 2011 inclusive; these are presented and hereby ratified, in the amount of $459,623.50. 2. General Warrants, including check numbers 183959 to 184190 inclusive, in the total amount of $69,422.00 constituting claims and demands against the City of Baldwin Park, are herewith presented to the City Council as required by law, and the same hereby ratified. Espanto. The officer was in the act of randomly stopping people to ask if they had driver's licenses. The officer observed our Caterpillar Skidsteer moving along eastbound on Live Oak to our storage yard, also located in the City of Irwindale. We were stopped by the officer who asked the driver of the equipment to produce a driver's license. The equipment operator did not have a driver's license and explained that he was not aware that one had to be licensed to operate equipment. Our foreman attempted to explain to the officer that we were moving the equipment from the nearby jobsite to our yard and had a permit to be on the street, however our foreman was rebuffed. Several explanations later and after our requests to have the equipment picked up by our equipment hauler, the skidsteer was impounded. Supplement to Item 14; Why do you think the City of Baldwin Park is responsible ?: Despite our attempts to convey to the officer that we had a permit to be on the street, our equipment was impounded anyway. In addition, it is our understanding that a motor vehicle can be impounded if being driven by an unlicensed driver in the City of Baldwin Park, however this incident took place entirely in the City of Irwindale at a check point set up in the City of Irwindale. Also, we are not aware of any law in California that states one has to have a drivers license to operate a piece of equipment. A verification of our permit to be on the street is attached. We contend the equipment had a right to be on the street and the officer had no right to impound the equipment nor detain our driver with a questionable check point set up outside Baldwin Park city limits while enforcing Baldwin Parks city laws. Financial Report: December 2010 PURPOSE The purpose of this report is to provide City Council with a monthly financial report for the period ended December 2010. BACKGROUND The City's Fiscal Accountability Policy requires that a monthly financial report be presented to the City Council from September thru May. This report provides data up to December, which is when some of the major revenues begin to be received. DISCUSSION The Monthly Financial Reports provides the City Council and staff with a monthly budgetary status. Although we thought we would begin recuperating from the economic crisis this year, the crisis continues to impact all aspects of the local economy. This is evident by the lower revenue receipts being experienced by the City; these are discussed further below. On the expenditure side we expect our expenditures, including transfers, to be lower than budget at the end of the year. In order to combat the impact of revenue reductions, staff is analyzing its options, which include assessing the level of expenditure savings and possible re- allocation of certain expenditures to other eligible sources. We will be providing a detailed report of our revenues, expenditures and proposed changes in a detailed Mid -year budget report later this month. It is our priority to maintain the level of services and programs offered and we are hopeful that the City will be able to maintain a balanced operation during the fiscal year. The following provides an overview of those revenues: 1. "Use of Money and Property" and "Charges for Services" Currently there is an expected shortfall expected of about $250,000. This amount results from A} a decrease in construction activity that affects construction permits and building plan checks; these revenues were actually increasing last year but are starting to decline along with home prices, which are once again falling and B) a decrease interest income due to reduced LAIF rates, which is currently at .46 %. 2. "Utility Users Tax" and "Franchise Tax" These revenues are anticipated to be lower by about $200,000. These revenues are anticipated to be lower due to a decrease in collectability by the utility companies, mainly cell phone companies, and a decrease in collections from Waste Management customers. 3. "Franchise Tax" and "Fines and Penalties" Related to Police Revenues The greatest revenue shortfall of approximately $800,000 is expected in these revenues, which is due to the following three major factors: Monthly Financial Report: December 2010 Page 3 The first is related to revenues from vehicle code fines related to Red -Flex camera enforcement systems, which is anticipated to be lower by about $220,000. These revenues continue to come in lower due to low collections and from reduced citations at several of the current installations. Second, the decrease in vehicle release fees and police franchise fees are lower as compared to the same time last year because of the decrease in the number of check points that are now being conducted. This amount, which is the most significant is expected to be lower than budget by about $500,000. • The third factor is a decreased in the collection of regular and truck parking citations; these are expected to be lower by about $80,000. There are some revenues which are coming in a little higher than expected. These are "Sales Tax" and "Vehicle License Fees In Lieu of Property Taxes" which might be over by about $150,000, if the positive trend continues. Therefore, the total decrease in revenues is expected to be about $1.1 million. Although revenues are not received evenly throughout the year, all departments are ultimately expected to closely monitor their departmental revenues to ensure that they come in as budgeted. In addition, the departments need to identify sources such as grants that can possibly offset expenditures that could cover revenue shortfalls, if any, so that the net impact is zero. In addition, police overtime is expected to be over by about $200,000 and this amount Monthly Financial Report: December 2010 Page 4 would be Eligible to be charged to other funding sources, thus increasing the possible to savings to about $800,000. Every department is expected to and committed to maintaining their budget. Some departments are expected to generate savings during the fiscal year which are a result of lower spending and /or vacancies. Additionally, we expect our transfers to be lower than budget. While the above discussion focuses on the General Fund, the trends for other funds are positive. General fund transfers money to these other funds to support their operations. These transfers are anticipated to be lower than budgeted because these other funds have lower expenditures and will require a lower subsidy. The expected expenditure savings of $800,000 will offset the $1.1 million in anticipated revenue reductions; thus resulting in a net reduction of $300,000. In order to offset this amount, staff is in the process of evaluating if additional expenditure savings can be realized between now and the end of the year and if additional transfers can be made to other eligible funding sources, including the asset forfeiture fund and/or other funds. We will be presenting the various options at the upcoming Mid Year Budget review. Summary As discussed above and based on current trends, we anticipate a revenue shortfall which might be offset by both expenditure savings and transfers to eligible sources. However, this is still being analyzed and more information will be provided by the end of this month. In addition, problems with the State budget and its growing deficit along with efforts by the State and the County to grasp local revenues and now to eliminate Redevelopment Agencies may cause greater impacts. Staff will continue to closely monitor revenues and expenditures and proposed necessary changes if warranted. Staff will be bringing a detailed Midyear review this month for council review and approval. FISCAL IMPACT None RECOMMENDATION Staff recommends that the City Council receive and file the monthly financial report for the period ended December 2010. BACKGROUND The City currently uses the Business License Module from HDL Companies, which it has had for a number of years. The City has reviewed a number of other business license modules, which included a module from our current general ledger accounting system (GEMS), in order to compare other products currently in the market. As a result of this review, the City found that the cost of two of the vendors was over $20,000. The City also reviewed the product from another start up company "E2G2" which stands for "Easy To Get To." E2G2 has asked the City to be one of their pilot cities. In exchange for being a pilot city, the City will not incur any cost other than staff time. However, should the City incur any overtime related to testing the product, E2G2 has agreed to reimburse the City. DISCUSSION Both Finance and Community Development staff met with representatives from E2G2 in order to review demos of their product over the course of the year to see how it was developing. Staff has found that the product, which is also being tested at the City of Hawaiian Gardens, is a very interactive product which is easy to use and is web based. The following are some of its benefits: Enhanced customer service by providing an on -line business renewal system with 24 hours a day /7 days a week accessibility via the web E2G2: Business License Hub Software Pilot Test February 2, 2011 Page 2 • Business License Directory that will offer businesses options to advertise, promote and market themselves • Provides a bilingual (English & Spanish) online Licensed Business Directory • Increased efficiency for business licensing processing • On -line access by the code enforcement officers while on the field • Facilitates use of information by departments thus increasing effectiveness • No cost to the City of Baldwin Park and no annual maintenance fee • Potential for generating additional revenues An additional benefit of being a test city is that the City will be able to customize the product based on its needs. This is very important since various vendors require a fee in order to make any upgrades or add forms to the product. The on -line Business Directory that will be provided to all businesses that have an active business license with the City will offer businesses an opportunity to promote and market themselves while simultaneously providing the community basic information via the web site, such as hours of operations, a map, and phone numbers about current businesses. In addition to the basic listing, businesses will have an option to enhance information advertised in the Business Directory for an additional cost. E2G2 has agreed to share some of the proceeds (currently at 20 %) it receives, thus increasing the additional revenues for the City. Based on the benefits of this product, the zero cost, and the potential to generate revenues, staff recommends that the City participates in their program. If satisfied, the City can enter a final agreement with E2G2, again at no cost to the City FISCAL IMPACT No cost. The City will save approximately over $3,000 in maintenance cost that it currently pays, it will eliminate over $20,000 for a new product, and will have the potential to increase its revenues from the revenue sharing agreement that will be in place. RECOMMENDATION It is recommended that the City Council: 1) Authorize staff to enter into the Business licensing Hub Software Pilot Test Agreement with E2G2, Inc. 2) Direct staff to bring back a final contract if the test results are positive and the City is satisfied with the results. Giffords, and was a social worker before serving with Rep. Giffords; and WHEREAS, Rep, Gabrielle Giffords was the target of this attach, and is on the road to a long and grueling recovery; and WHEREAS, 13 others were also wounded in the shooting, including Ron Barber and Pamela Simon, both staffers to Rep. Giffords; and WHEREAS, several of those in attendance at this event including Patricia Maisch, Roger Sulzgeber, Joseph Zimudie and Daniel Hernandez Jr., helped apprehend the gunman and assist the injure, thereby risking their lives for the safety of others, and are commended for their bravery. BACKGROUND As part of its 201112 budget proposal, the Governor has proposed to permanently abolish California's more than 400 local redevelopment agencies. ANALYSIS According to the California Redevelopment Association and the California League of Cities, this proposal is an attempt by the state to capture local tax dollars against the will of the voters who have repeatedly said local taxes should fund local services. Eliminating redevelopment agencies would provide little financial gain for the state, yet would cause significant difficulties in communities throughout California. Each year, redevelopment directly supports 300,000 jobs, more than $40 billion in statewide economic activity, and $2 billion in local tax revenues. 1? This proposal to eliminate redevelopment represents another attempt by the state to capture local funds that voters have repeatedly and overwhelmingly acted to stop, • Last November, 61 % of voters, 5.7 million voters, passed Proposition 22 to prevent the sate capture of local government funds, including redevelopment funding. • The Administration's proposal ignores the will of the voters and again, proposes to capture local government resources to solve the State's budget problems. Elimination of Redevelopment Agencies Page 2 of 2 February 2, 2011 2) Little financial gain, huge economic difficulties. The State own numbers show that eliminating redevelopment will bring very little financial relief for the State. That is because redevelopment agencies have more than $87 billion in bond and other contract obligations in place that must be repaid before funds are available for other purposes. In fact, after this budget year, the State Department of Finance acknowledges zero State savings from shutting down redevelopment. • However, eliminating redevelopment will cause serious and permanent economic damage at the local level. Annually, redevelopment activities in California: • Support 304,000 jobs • Contribute over $40 billion to California's economy o Generate more than $2 billion in state and local taxes o In Baldwin Park: • Have generated over 1,010 jobs. • Provided for the elimination of 65.24 acres of blight properties. 3) This proposal is bad for our environment and bad for working families. • Redevelopment is a valuable tool to focus housing, jobs and infrastructure in the urban areas, and to meet the land -use goals to focus development on the urban core. Redevelopment is also the second largest funding source of affordable housing behind the federal government. Since 1993, redevelopment has built 98,000 units of affordable housing. And by revitalizing downtrodden and rundown communities, redevelopment helps reduce crime and make safer, more vibrant communities for families. FISCAL IMPACT There is no impact on the General Fund in adopting this Resolution. RECOMMENDATION Staff recommends that the City Council adopts Resolution 2011 -005 in opposition to the Administration's Proposal to Abolish Redevelopment Agencies in California. Attachment: 1. Resolution #2011 -005 RESOLUTION 2011 -005 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK IN OPPPOSITION TO THE ADMINISTRATION' S PROPOSAL TO ABOLISH REDEVELOPMENT AGENCIES IN CALIFORNIA. WHEREAS, as part of its 2011 -12 budget proposal, the Governor has proposed permanently abolishing California's more than 400 local redevelopment agencies; and, WHEREAS, this proposal represents more of the same misguided and illegal State budget raids of local government funds that voters have repeatedly sought to end, most recently in November 2010 when an overwhelming 61% of voters elected to stop State raids of local government funds, including redevelopment funds; and, WHEREAS, this proposal will bring very little financial benefit to the State. According to the State Controller's Office, redevelopment agencies have more than $87 billion in bond and other contractual obligations that legally must be repaid before revenues are available to any other purpose. In fact, according to the State Department of Finance's own budget documents, there will be zero State savings in out years from shutting down redevelopment; and, WHEREAS, this proposal will destroy local economic development, including hundreds of thousands of jobs and billions of dollars in local economic activity throughout California. In fact, in Baldwin Park, abolishing redevelopment will destroy 376 jobs in construction and project related functions, based on the California Redevelopment Association statistics. Also, in Baldwin Park, redevelopment has created 1,010 jobs among various completed projects including the Target center, Walmart center, Home Depot center, Laidlaw's motor center, and the Smart & Final retail center. These projects provided for new economic prosperity on 65.24 acres of formerly blighted areas; and, WHEREAS, throughout California, redevelopment activities support 304,000 jobs annually, including 170,600 construction jobs, contribute over $40 billion annually to California's economy in the generation of goods and services, and generate more than $2 billion in state and local taxes in a typical year; and, WHEREAS, eliminating redevelopment will take away one of the few tools local governments have to comply with state requirements to plan for more compact urban development supported by transit- oriented development, housing, jobs and infrastructure; and, WHEREAS, eliminating redevelopment will destroy the development of affordable housing in California. Redevelopment agencies are the second largest funder of affordable housing, behind only the federal government, responsible for over 98,000 units of affordable housing since 1993; and, WHEREAS, shutting down redevelopment agencies is a violation of multiple State and Federal constitutional provisions. THEREFORE, BE IT RESOLVED that the City Council of Baldwin Park formally opposes the Administration's proposal to abolish redevelopment in California.
