NOTICE IS HEREBY GIVEN that a Special Meeting is hereby called to be held on
WEDNESDAY, SEPTEMBER 2, 2009 at 6:00 PM at City Hall Council Chamber, 14403 E.
Pacific Avenue, Baldwin Park, CA 91706.
Said Special Meeting shall be for the purpose of conducting business in accordance with
the attached Agenda.

Staff recommends City Council appoint Council member Bejarano to represent the City
of Baldwin Park at the Annual Business Meeting of the League of California Cities
conference.

Staff recommends City Council reschedule the September 16, 2009 meeting to
Wednesday, September 23, 2009.
8. REVIEW OF COMMISSION APPLICANTS AND CONSIDERATION OF
APPOINTMENTS TO FILL VACANCIES ON THE HOUSING, PERSONNEL AND
RECREATION & COMMUNITY SERVICES COMMISSIONS
Staff recommends City Council review all Commission applications and:
1) Take nominations and adopt Resolution No. 2009 -039 entitled, "A RESOLUTION

RESOLUTION NO. 2009 -016 APPOINTING INDIVIDUALS TO THE HOUSING

Warrants and Demands
The purpose of this report is for the City Council to allow the payment of Warrants and
Demands against the City of Baldwin Park.
The Finance Department has recently converted to a new financial system. The Claims
and Demands report format has been modified and continues to report the required
information in accordance with the Government Code.
The payroll of the City of Baldwin Park consisting of check numbers 190737 — 190824
Additionally, Automatic Clearing House (A%CH) Payroll deposits were made on behalf of
City Employees from control numbers 202903 — 203182 for the period of July 26, 2009
through August 08, 2009 inclusive, have been presented and hereby ratified, in the amount
of $430,198.00.
General Warrants, including check numbers 176389 to 176471 inclusive, in the total
amount of $736,572.63 constituting claims and demands against the City of Baldwin Park,
are herewith presented to the City Council as required by law, and the same hereby
ratified.
Pursuant to Section 37208 of the Government Code, the Chief Executive Officer or
designee does hereby certify to the accuracy of the demands hereinafter referred to and to
the availability of funds for payment thereof.

PUBLIC COMMUNICATIONS
Thomas Cary, resident spoke about issues related to the city, financial
institutions, actions of the state /Governor, transparency in government
Ana Saldana, LA County Animal Control Officer spoke about the officers being
required to wear boots and that the County did not provide these to them. She
requested the Council's support on the matter
Jorge Pivaral, Housing Commissioner thanked the Council for their support and
offered to be of service to the community
Ken Woods, resident / business owner expressed his support of a downtown
revitalization, but not the vision of the City Council. Felt that the project would not
be for existing residents of the City
Rafael Gonzalez, Baldwin Park Librarian thanked Council member Marlen
Garcia for inviting the Urban Book - Mobile to the Concerts in the Park; also
thanked staff members Armando Nava and Rudolph Galindo for ai ii asst L i�C
Alfonso Contreras, resident expressed greetings from the dignitaries at Taxco,
Guerrero, Baldwin Park's Sister City and shared copies of newspaper articles
published in Taxco during the Sister City's visit
John Rios, resident thanked staff for cleaning up certain portions of the City but
reported other areas that are in need of attention
Fidel Vargas, resident congratulated Recreation & Community Services staff on
the new format of the the Baldwin Park NOW. He expressed concern about the
lack of a pedestrian sidewalk near Bank of the West
Greg Tuttle, business owner spoke about the proposed Exclusive Negotiation
Agreement with the Olson Company; commented about the Acevedo Group and
Bisno Development and the contractor incentive program
Charlie Contreras, HLC Electric expressed his opposition to the staff
recommendation to work with Watry for the design of a transit / parking structure
Cecelia Bernal, resident thanked the Council for their confidence by re- appointing
her to the Commission and expressed her pride in the city
Public Communications were closed at 7:38 p.m.
Mayor Lozano expressed his support of the Animal Control Officers and stated
that a letter of support would be sent. Mayor Lozano had been briefed on the
matter by Mayor Pro Tern Monica Garcia

2. PROPOSED RECOGNITIONS BY THE MAYOR AND CITY COUNCIL FOR
THE PERIOD OF AUGUST 5, 2009 THROUGH AUGUST 18, 2009
City Council approved the preparation and presentation of the plaques and
certificates as outlined in the staff report.
3. MINUTES
City Council approved the minutes of the regular meeting of July 1, 2009 and
the special and regular meetings of July 15, 2009.
4. CITY TREASURER'S REPORT - JUNE 2009
City Council received and filed.
5. REQUEST TO HIRE A TECHNICAL FIRM TO ASSIST THE CITY WITH
REVIEW OF THE DRAFT ENVIRONMENTAL IMPACT REPORT BY THE CITY
OF IRWINDALE FOR THE MATERIALS RECOVERY FACILITY AND
TRANSFER STATION (MRF/TS)LOCATED AT THE INTERSECTION OF LIVE
OAK AVENUE AND ARROW HWY
City Council 1) authorized the Chief Executive Officer to enter into a Consultant
Services Agreement with ESA for a not to exceed amount of $31,540 to provide
the City with technical expertise in reviewing the City of Irwindale's DEIR for the
MRF/TS located at the intersection of Arrow Highway and Live Oak Avenue and
2) authorized a transfer of funds from 100.00.299.53999.00000.2 in the amount
of $31,450 into account 100.40.440.51100.00000.2
6. RENEWAL OF AGREEMENT WITH ALL CITY MANAGEMENT SERVICES
FOR PROVIDING SCHOOL CROSSING GUARD SERVICES FOR FISCAL
YEAR 2009/2010
City Council 1) approved the FY 09/10 contract with All City Management
Services for crossing guard services and 2) authorized the Mayor to execute the
agreement to continue services with All City Management Services.
7. RESOLUTION NO. 2009-035 AUTHORIZING THE EXECUTION OF A
MASTER AGREEMENT AND PROGRAM SUPPLEMENTS FOR FEDERALLY
FUNDED PROJECTS
City Council adopted Resolution No. 2009-035 entitled, "A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA,
AUTHORIZING THE EXECUTION OF A MASTER AGREEMENT AND

8. APPROVAL TO ADOPT AND ADHERE TO THE LOS ANGELES COUNTY
GREEN RESOLUTION, RESOLUTION NO. 2009 -032, CREATION OF AND
ACCESSIBILITY TO REGION -WIDE PASSIVE / ACTIVE GREEN SPACE AND
CONNECTORS
City Council adopted Resolution No. 2009 -032 entitled, "A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AUTHORIZING THE
ADOPTION AND ADHERENCE TO THE LOS ANGELES COUNTY GREEN
RESOLUTION, CREATION FO AND ACCESSIBILITY TO REGION -WIDE
PASSIVE / ACTIVE GREEN SPACE & CONNECTORS" and authorized the
Mayor to execute any other associated documents related to this initiative.
9. NOTICE OF COMPLETION AND PROJECT ACCEPTANCE OF FIRE
DAMAGE REPAIRS TO THE ESTHER SNYDER COMMUNITY CENTER
City Council 1) accepted the construction improvements by Simgel Company,
Inc.; 2) considered the project complete and authorize the recordation of a
Notice of Completion; and 3) authorized the payment of retention funds to
Simgei Company Inc. upon expiration of the 35 -day lien period.
The following item was pulled by Council member Pacheco for spearate
discussion:
10. AUTHORIZE STAFF TO ENGAGE WATRY DESIGN, INC. FOR
ARCHITECTURAL AND ENGINEERING SERVICES FOR THE TRANSIT
CENTER PARKING STRUCTURE AND AUTHORIZE THE CHIEF EXECUTIVE
OFFICER TO FINALIZE A CONSULTANT SERVICES AGREEMENT IN AN
AMOUNT NOT TO EXCEED $595,900
Council member Pacheco commented about the history of this project and
was looking forward to this being approved
Motion: Approve hiring Watry Design, Inc. for Architecture and Engineering
Services for the Transit Center Parking Structure and authorize the Chief
Executive Officer and City Attorney to finalize a Consultant Services
Agreement with Watry Design, Inc for Design and Construction Support for an
amount not to exceed $595,900.
Moved by Council member Pacheco, seconded by Council member Bejarano.
11. PUBLIC HEARING TO ADOPT A RESOLUTION AND THE CITY'S 2009
CONGESTION MANAGEMENT PROGRAM LOCAL IMPLEMENTATION
REPORT
City Planner Harbin presented the report. Mayor Lozano opened the public .
hearing for those wishing to speak in favor or opposition. Seeing no interest the
public hearing was closed

CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING THE CITY TO
BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT
PROGRAM (CMP) AND ADOPTING THE CMP LOCAL DEVELOPMENT
REPORT IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE
SECTION 65089."

12. PUBLIC HEARING FOR PROPOSED INSTALLATION OF MULTI -WAY
STOP SIGN CONTROLS AT FOUR RESIDENTIAL INTERSECTIONS
Public Works Director Galvez presented the report. Mayor Lozano opened
the public hearing for those wishing to speak in favor or opposition.

Seeing no further interest, the public hearing was closed.
Council member Pacheco spoke about the importance of the installation of
these stop signs, requested that areas with high traffic and near schools be
prioritized; Mayor Pro Tern Monica Garcia congratulated and thanked staff for
prioritizing this project. She asked that the residents in the immediate areas be
contacted so that they can take credit for this joint accomplishment; Council
member Bejarano thanked staff, noting that constitutents have brought this
problem to his attention. Requested that staff be vigilant about traffic situations

patrolled because drivers had been running the sign. Council member Marlen
Garcia expressed her concern regarding the traffic in the city, noting that it was
perfect timing for the installation of these traffic calming measures because the
traffic in the city would only get worse

to the City of Baldwin Park. Mayor Lozano spoke about the progress that he
has seen during his thirty years in Baldwin Park and that the Council had
worked to clean up the city. He congratulated the veteran officers for being part

Thomas Cary, resident addressed comments previously made by Council

Susan Reyes, representative for Assemblymember Ed Hernandez congratulated
the Chief for the selection of new police department staff members and
announced the the 2nd Annual Tools for School Drive
Edgar Ontiveros, Covina resident/member of the Tobacco Free coalition thanked
the Council for considering the tobacco retail licensing fees
Xavier Gonzales, resident appealed the denial of his business license. He
moved his business from one location to another and the type of business that he
conducted was not a permitted use in the new location. He further spoke about
the hardship that this had caused him.
Hugo Antonio Tzec, resident and candidate for school board addressed
education and some things that he was not happy with such as test scores and
Program Improvement. He spoke about his desire to reform education and
improve test scores for the district and to meet with the Council to discuss
education issues
Laura Becker, student researcher from San Diego introduced herself and
announced that she was conducting an undergraduate thesis on cities in the San
Gabriel Valley
Fidel Vargas, resident spoke about the recent awards that the city had won
including "All American City" in which Baldwin Park placed 9th nationally and the
favorable comments about the city in the Chinese Daily News
Ceci Lee, business owner acknowledged City Clerk Susan Rubio and City
Treasurer Contreras for the work they have done with the Sister City Association

Mayor Pro Tern Monica Garcia suggested having a forum where women
could meet and speak against violence and expressed her hope that the Chief
of Police and other females in the community could participate. It was further
suggested that this type of event take place in October which is Domestic
Violence Awareness Month
Council member Pacheco pointed out that former Congresswoman Hilda
Solis brought forward a resolution against the violence in Juarez. He further
expressed that this was an issue of importance in the community

PURPOSE
The purpose of this report is to request City Council adopt Resolution No. 2009 -038
condemning the kidnapping of young women in Ciudad, Juarez Mexico.
At the meeting of August 19, 2009, Mayor Pro Tern Monica Garcia requested that
Council consider adopting a resolution condemning the ongoing violence against
women in Ciudad Juarez and to express support for the families of recently abducted
teenage women.
DISCUSSION
The Mexican border cities of Ciudad Juarez and Chihuahua City have been plagued
with the abduction, sexual assault, and brutal murders of more than 400 young women
since 1993.
On May 2, 2006, the U.S. House of Representatives passed H. Con. Resolution 90 by
voice vote. This resolution condemns the ongoing abduction and murders of young
women in Ciudad Juarez and the city of Chihuahua in the state of Chihuahua, Mexico,
expresses condolences and sympathy to the families of the victims, and proposed a set
of actions to investigate and prevent the crimes.
On April 6, 2006, the Baldwin Park City Council sent a letter to Congressional
Representatives urging their "yes" vote on the passage of H. Con. Res. 90, which
condemned violence against women in Ciudad Juarez. In recent months there has
been a resurgence of violence against women resulting in the kidnappings of many
teenagers and women. The City Council of the City of Baldwin Park is gravely
concerned about this situation and wishes to express its support for these women and
their families.

WHEREAS, the Mexican city of Ciudad Juarez has been plagued with the

of 13 and 22, and man were abducted in broad daylight in well - populated areas; and

WHEREAS, many of the victims have yet to be positively identified; and
WHEREAS, the perpetrators of most of these heinous acts remain unknown.
WHEREAS, while the number of these crimes has decreased over the past
years, there is still an urgent need for this violence to cease.
THEREFORE, BE IT RESOLVED this City Council of the City of Baldwin Park:
SECTION 1. The City Council of the City of Baldwin Park condemns these
violent crimes and expresses its support to the families and victims of these malicious
acts.
SECTION 2. The City Clerk shall certify to the adoption of this resolution

This year's League of California Cities Annual Conference will be held Wednesday,

conference, the League will be holding the Annual Business meeting on Friday, September

In order for the City of Baldwin Park to participate in the business meeting, it is necessary to
designate a voting delegate who will be present at the meeting to cast votes for the City as it
relates to League business. The voting procedures are attached for the City Council's
review.
Because Council member Bejarano is the only Council member attending this conference,
staff is recommending that he be appointed as the voting delegate to represent the City of
Baldwin Park.

2009 Annual Conference
1. One City One Vote. Each member city has a right to cast one vote on matters pertaining to
League policy.
2. Designating a City Voting Representative. Prior to the Annual Conference, each city
council may designate a voting delegate and up to two alternates; these individuals are
identified on the Voting Delegate Form provided to the League Credentials Committee.
Registering with the Credentials Committee. The voting delegate, or alternates, may pick
up the city's voting card at the Voting Delegate Desk in the conference registration area.
Voting delegates and alternates must sign in at the Voting Delegate Desk. Here they will
receive a special sticker on their name badge and thus be admitted to the voting area at the
Business Meeting.
4. Signing Initiated Resolution Petitions. Only those individuals who are voting delegates
(or alternates) and who have picked up their city's voting card by providing a signature to
the Credentials Committee at the Voting Delegate Desk may sign petitions to initiate a
resolution.
Voting. To cast the city's vote, a city official must have in his or her possession the city's
voting card and be registered with the Credentials Committee. The voting card may be
transferred freely between the voting delegate and alternates, but may not be transferred to
another city official who is neither a voting delegate or alternate.
Voting Area at Business Meeting. At the Business Meeting, individuals with a voting card

BACKGROUND
HOUSING COMMISSION
The Housing Commission consists of seven (7) members. Two (2) members shall be
Public Housing Tenants who serve two -year terms in accordance with Section 32.22(a)
of the Baldwin Park Municipal Code.
For the purpose of this appointment, and in accordance with Section 32.21(b) of
the Baldwin Park Municipal Code, appointment to Office No. 7 shall be a person
over 62 years of age, if the authority has tenants of such age.
When this report was previously before the Council, neither the incumbent nor any
qualifying Housing Tenants had applied for Office No. 7. On July 1, 2009, City Council
directed staff to re -send notices to Baldwin Park resident Housing participants who met
the tenant requirement for Office No. 7 (62+ years of age.) Incumbent Commissioner
Patricia Hogan has now submitted her application for consideration of re- appointment.

RECREATION AND COMMUNITY SERVICES COMMISSION
The Recreation and Community Services Commission consists of eight (8) members.
In accordance with the Baldwin Park Municipal Code, the appointments made to Office
No. 1 - 5 are for a two -year term. The term of office for Recreation and Community
Services Commission Member Office No. 5 (Terrilyn S. Ortiz) expired June 30, 2009.

WHEREAS, at their meeting held July 1, 2009, City Council directed staff to re- notice the

This year, the League of California Cities' Annual Conference will be in San Jose
beginning Wednesday, September 16tH through Friday, September 18tH
DISCUSSION
The second regularly scheduled City Council, Community Development Commission,
Finance and Housing Authority meetings for the month of September falls on the
opening day of the League's Annual Conference. In anticipation of attendance by
Council members and City Attorney, it is recommended that the meeting be
rescheduled.
Staff is proposing that the September 16, 2009 meeting be moved to September 23,
2009.
