REQUEST TO AUTHORIZE THE PURCHASE OF TWO CNG FIXED ROUTE TRANSIT BUSES AND TWO CNG DIAL -A -RIDE BUSES City Council 1) authorized staff to enter into a cooperative public contract purchasing program with Tahoe Transportation District and Sam Trans to use their existing negotiated pricing and proposals; 2) authorized the CEO to enter into a purchase agreement with Creative Bus Sales for the four clean air transit fleet buses in the amount of $676,299; and 3) approved the appropriation of the funds for this purchase. 9. NOTICE OF COMPLETION AND PROJECT ACCEPTANCE OF MORGAN PARK RESILIENT SURFACING INSTALLATION BY PACIFIC CONSTRUCTION, INC. BACKGROUND/DISCUSSION The City of Baldwin Park is a grantee from the Office of Traffic Safety for two (2) traffic safety enforcement grants. The "Sobriety Checkpoint Mini-Grant Program" grant for $73,101.47 and the "Click it or Ticket Mini-Grant Program" grant for $20,221.00, for a total of $93,322.47 in grant funding. Neither grant requires the city to provide any matching funds in order to obtain the grants. These grants are specific for officers to work sobriety checkpoints and seatbelt enforcement details on an overtime basis. These grants will allow the police department to continue its goal of strict traffic enforcement to continue keeping our citizens and streets safe. FISCAL IMPACT: There is no negative impact to the General Fund. RECOMMENDATION: Staff recommends that the City Council: 1. Authorize the release of funds allocated by the Office of Traffic Safety. 2. Authorize the Chief of Police or her designee complete any required documents for processing the purchase of equipment and for acquiring the grant funds. In order to provide a minimum quality level to these affordable units, staff suggested performing a number of improvements based on a HUD Physical Assessment Report. Some of the major improvements are: ■ New roof ■ Replacement of sliding glass doors with French doors ■ Several plumbing upgrades ■ Termite repairs • Solar exterior security lighting • Improve security fencing On May 20, 2009 the City Council approved the plans and specification and authorized staff to advertise the project for construction bids. However, due to inaccuracies to the plans, numerous questions by prospective contractors were raised, and staff realized the technical details of the work needed to be clarified. During the advertisement, a job walk was held on August 26, 2009. On September 9, 2009, the City received 7 bids for construction. Staff has reviewed the bid documents and has verified that the contractor's references are satisfactory. Staff is prepared to perform the construction oversight upon the beginning of the construction. BACKGROUND /DISCUSSION The City of Baldwin Park is a grantee from the Office of Community Oriented Policing Services for a grant of $215,000.00 for the purchase of interoperability radios. This grant does not require the city to provide any matching funds to obtain the grant. This grant was specific for the purchase of 41 mobile radios. These radios allow for interoperability with other public safety agencies for major disaster emergency responses. The emphasis of the law enforcement portion of the grant is creating a network of interoperability among local public safety agencies. Previously, the City of Baldwin Park received grant monies from the Office of Homeland Security for $200,000.00 for the purchase of 38 mobile radios. This grant will allow the police department to purchase 41 mobile radios to equip the remaining police personnel that are still using out dated mobile radios. Motorola radios were specified in the grant because of their compatibility with the Interagency Communications Interoperability System (I.C.I.S.). The Los Angeles County Police Chief's Association has obtained quotes from Motorola for special pricing on joint purchase of these radios. The funds will allow for the purchase of radios to standardize the radio equipment for municipal police agencies throughout Los Angeles County, Alhambra, Azusa, Baldwin Park, Claremont, Covina, Downey, Glendale, Glendora, Inglewood, La Verne, Monrovia, Montebello, Monterey Park, Pasadena, Redondo Beach, San Fernando, San Gabriel, Sierra Madre, South Gate, Vernon, West Covina, and Whittier. This grant is specific for the implementation of technological upgrades to the department's Computer Aided Dispatch System (CAD), Records Management Computer System (RMS) and establishes the implementation of a wireless network system that will encompass both infrastructure upgrades as well as equipping our police cars with a video camera system. Said term is subject to the provisions herein. Section 2 Exhibit A to this MOU sets forth the amount of JAG funds allocated to each Jurisdiction by BJA. Upon the disbursement by BJA to the City of JAG funds allocated to the Jurisdiction, the CITY agrees to disburse to the Jurisdiction that amount set forth on Exhibit A as the "Disbursement Amount" for the Jurisdiction. The Disbursement Amount is the amount of JAG funds allocated to the Jurisdiction by BJA less 10% of such allocated amount to be retained by the City as compensation to the City for its role as applicant/fiscal agent of such JAG funds. The Jurisdiction agrees to use the JAG funds for those projects approved by BJA under the Recovery Act and the JAG program as set forth in the application for the JAG funds submitted by the City to BJA. Prior to disbursement of the Disbursement Amount of JAG funds to the Jurisdiction, the Jurisdiction agrees to enter into a contract with the City setting forth the Jurisdiction's and the City's assurances and obligations regarding the use of JAG funds, which shall include without limitation compliance with all applicable laws and reporting requirements under the Recovery Act in connection with the use of the JAG funds (the "Contract"'). Section 3 Nothing in the performance of this MOU shall impose any liability for claims against the Jurisdiction other then claims for which liability may be imposed by the California Tort Claims Act, or claims by the State or Federal Government for unallowable expenditure of the funds provided by this MOU. Section 4 Nothing in the performance of this MOU shall impose any liability for claims against CITY other than claims for which liability may be imposed by the California Tort Claims Act, or claims by the State or Federal Government for unallowable expenditure of the funds provided by this MOU. Section 5 Funding for all periods of this MOU is subject to the continuing availability of Federal funds for this program. The MOU may be terminated immediately upon written notice to the Jurisdiction of a loss or reduction of Federal grant funds. Any change in the terms of this MOU, including any increase or decrease in the amount of JAG funds awarded, shall be incorporated into this MOU by a written amendment properly executed and signed by the person authorized to bind the parties. Section 6 Upon the disbursement of funds to the Jurisdiction, the Jurisdiction shall provide performance reports on a quarterly basis demonstrating progress in achieving desired goals and outcomes in a form and manner as required under the JAG program and the Recovery Act. Such reporting requirements shall also be set forth in the Contract, which shall also provide dates on which these reports shall be submitted to the CITY. Recovery Act JAG MOU 2 06/09 Section 7 Each of the parties to this MOU is a public entity. In contemplation of the provisions of Section 895.2 of the Government Code of the State of California imposing certain tort liability jointly upon public entities, solely by reason of such entities being parties to an MOU as defined by Section 895 of said Code, the parties hereto, as between themselves, pursuant to the authorization contained in Section 895.4 and 895.6 of said Code, will each assume the full liability imposed upon it or upon any of its officers, agents, or employees by law, for injury caused by a negligent or wrongful actor omission occurring in the performance of this MOU, to the same extent that such liability would be imposed in the absence of Section 895.2 of said Code. To achieve the above stated purpose, each party indemnifies and holds harmless the other party solely by virtue of said Section 895.2. The provision of Section 2778 of the California Civil Code is made a part hereto as if fully set forth herein. The Jurisdiction certifies that it has adequate self insured retention of funds to meet any obligation arising from this MOU. CITY also certifies that it has adequate self- insured retention of funds to meet any obligation arising from this MOU. Each party to this MOU will be responsible for its own actions in providing services under this MOU and shall not be liable for any civil liability that may arise from the furnishing of the services by the other party. Section 8 The parties to this MOU warrant that they will abide by all the Federal, State and other governmental rules and regulations applicable to the JAG funds and the Recovery Act. The Jurisdiction shall be liable to the City, as fiscal agent, for any sums spent under the JAG grant found to be ineligible by the State or Federal government. The Jurisdiction shall cooperate and assist the City in any audit, or administrative or judicial actions brought by the State or Federal government concerning the activities funded by this MOU. Section 9 The parties to this MOU do not intend for any third party to obtain a right by virtue of this MOU. Recovery Act JAG MOU 6 06/09 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK EXPRESSING SUPPORT FOR AND APPROVING THE APPLICATION FOR THE RECOVERY ACT EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT PROGRAM WHEREAS, the United States Department of Justice, Office of Justice programs will provide funds to local governments to support actives to prevent and control crime; WHEREAS, the City of Baldwin Park is allocated funds through the Recovery Act Edward Byrne Memorial Justice Assistance Grant Program (the "JAG Program ") as part of the Office of Justice Programs; WHEREAS, the procedures established by the JAG Program require the City Council to adopted a resolution expressing support for the application after holding a public hearing for the same; WHEREAS, the City Council held a public hearing on this matter on October 7, 2009, to hear all comments from the public and to consider this matter; and WHEREAS, the City, if successful in its request for the grant, will enter into a contract with the United States Department of Justice, Office of Justice Programs for the grant; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Expresses support for the project; and Section 2. Consent to the project and accept the work, goods, or services provided through the project, and Section 3. Approves the filing of an application for the JAG Program, and Section 4. Commission received and filed. 2. MINUTES Commission approved the regular meeting minutes of August 5, 2009 and the special and regular meeting minutes of September 2, 2009. 3.
