(28 CFR 34.102.104 ADA TITLE 11) I City Council & Community Development Commission Special Joint Meeting Agenda -- June 13, 2007 II BALDWI.N P, A - R, K FROM: DATE: SUBJECT: PURPOSE: CITY OF BALDWIN PARK STUDY SESSION AGENDA JUN 13 STAFF REIN Honorable Mayor and Members of the City Council Honorable Chairman and Members of the Commission Vijay Singhal, Chief Executive Officer June 13, 2007 Special Study Session for the Downtown Revitalization Project The purpose of this Special Study Session is for: 1) the Community Development Commission ("Commission") to receive an update on the public outreach efforts regarding the proposed downtown revitalization project and provide comments, 2) the City Council to authorize the filing of a co- application by Bisno Development and the Commission to initiate generalized land use entitlements for a specific. plan on a downtown project of 125- acres, and 3) the City Council to waive the filing fees for that co-application. BACKGROUND: On February 7, 2007, the Commission approved an amendment to the Exclusive Negotiation Agreement (ENA) with Bisno Development Co. LLC (developer), which was originally approved December 6, 2006, for the potential revitalization of the downtown as an urban village with pedestrian friendly mixed -uses, including entertainment, restaurant, shopping and residential. DISCUSSION: The developer initiated the public outreach process during the month of March 2007 and will be providing a summary of the results from the public outreach at the June 13th Study Session. Item #7 of the ENA Schedule, as attached, requires the developer to complete by May 31, 2007, the initial public outreach process and a Commission Study Session. Because of scheduling conflicts, the Commission Study Session was not completed by May 31St Good faith efforts were made by all parties to schedule the Study Session. In addition, since this Study Session is being held on June 13th, the completion dates for ENA Schedule Item #8 (the application for Generalized Land Use Entitlements), and Item #9 (Program EIR Notice of Preparation), will also be adjusted, accordingly. Special Study Session — Bisno Development June 13, 2007 Page 2 of 2 According to Section 153.631 (A)(1) of the Baldwin Park Municipal Code, since neither the Commission nor developer own real property in the proposed downtown revitalization area, the initiation of an application for a specific plan and land use amendments in relation to the downtown project may be authorized by motion of the City Council. Pursuant to the ENA (subparagraph 3.C.3.), the Commission is responsible for facilitating all the City Discretionary Actions necessary for the potential development, provided that, the parties agree that nothing in the ENA shall obligate the City to approve any of City's Discretionary Actions. In addition, the Commission is also responsible for seeking a waiver of ordinary application and processing fees for filing that co- application or paying those fees, provided that developer shall pay for City's actual costs for providing those services for processing the City's discretionary actions. ....... Currently, the application fee for a specific plan /development plan is a_ 5,000 deposit, _- which would be charged by the Project Planner at a rate of $70 per hour. As previously stated, in lieu of those fees the developer will still be required to pay the City's actual costs for processing that application. In addition, the waiver request is not intended to apply to building fees, inspection fees, parkland fees, general plan fees, flood control fees, traffic congestion fees, public art fees, or similar fees for issuing permits for actual construction. Based on that, staff recommends the City Council also waive the application fees for filing the co- application. The developer will work with staff to file the necessary application after the June 13�h Study Session. We anticipate the Program EIR Notice of Preparation will be circulated by the end of June instead of by June 5'h as stated in the ENA Schedule. RECOMMENDATION: Staff recommends (i) the Commission consider the developer's public outreach update and provide comments as deemed appropriate, (ii) the City Council make a motion authorizing the filing of a co- application by Bisno Development and the Commission to initiate a review and consideration of a specific plan on a potential project of approximately 125 -acres within the Downtown and adjacent areas and (iii) the City Council waive normal application fees for filing that co- application.
