CLAIMS AND DEMANDS (300 -30) Recommendation: Waive further reading, read by title only and adopt Resolution No. 2002 -105 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK ". Councilman Bill Van Cleave abstained on all warrants to Mr. Bill's Hardware (financial conflict of interest). C. TREASURER'S REPORT FOR THE MONTH OF OCTOBER, 2002 (320 -20) Recommendation: Receive and File. D. CLAIM REJECTION — GILDARDO GARCIA III (01 016A) (170 -70) Recommendation: Reject the claim of GILDARDO GARCIA III (01 016A) and direct staff to send the appropriate notice of rejection to claimant. E. RESOLUTION ADOPTING VACATION OF GARVEY AVENUE LOCATED BETWEEN BIG DALTON AVENUE AND MERCED AVENUE, V1 -2002 AND SET DATE FOR PUBLIC HEARING (670 -40) Recommendation: 1) Waive further reading read, by title only and adopt Resolution No. 2002 -103 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, DECLARING ITS INTENTION TO VACATE A PORTION OF STREET RIGHT -OF -WAY ON GARVEY AVENUE BETWEEN BIG DALTON AVENUE AND MERCED AVENUE, PROJECT V1- 2002;" and 2) Set a public hearing on January 15, 2003, which will allow sufficient time for proper notification. F. APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO ADVERTISE AND SOLICIT BIDS FOR THE INSTALLATION OF PLAY EQUIPMENT AT THE DAY CARE CENTER (600 -30) Recommendation: 1) Approve the plans and specifications and authorize staff to solicit bids for the installation of play equipment; and 2) Authorize the City Clerk to advertise said project. AWARD OF CONTRACT FOR THE INSTALLATION OF TRAFFIC SIGNALS AT RAMONA BOULEVARD AND MONTEREY AVENUE AND BALDWIN PARK BOULEVARD AND CALAIS STREET, CIP 881 AND CIP 882 (600 -30) Recommendation: 1) Award the contract to L.A. Signal in the amount of $141,975 for the installation of traffic signals at Ramona Boulevard and Monterey Avenue and Baldwin Park Boulevard and Calais Street, CIP 881 & 882; 2) Authorize the Mayor to execute the Agreement; 3) Authorize the City Clerk to process the Agreement; and 4) Authorize the Director of Public Works to execute any necessary change orders in an amount not to exceed ten percent (10 %) of the original contract amount. H. ANNUAL STATEMENT OF INVESTMENT POLICY (320 -10) Recommendation: Receive and file. AWARD OF CONTRACT FOR THE CONSTRUCTION OF THE 2002 -03 CDBG SIDEWALK PROJECT, CIP 863 (600 -30) Recommendation: 1) Award the contract to Gentry Brothers, Inc., in the amount of $116,066.20 for the Construction of the 2002 -03 CDBG Sidewalk Project, CIP 863; 2) Authorize the Mayor to execute the Agreement; and 3) Authorize the Director of Public Works to execute any necessary change orders in an amount not to exceed ten percent (10 %) of the original contract amount. J. SALARY RESOLUTION AMENDING BASIC SALARY PLAN FOR THE EMPLOYEES OF THE CITY OF BALDWIN PARK (700 -20) Recommendation: Waive further reading, read by title only and adopt Resolution No. 2002 -107 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION 2002 -102 A BASIC SALARY PLAN FOR THE EMPLOYEES OF THE CITY OF BALDWIN PARK (Director of Recreation and Community Services)." K. AMENDMENT TO THE JOINT POWERS AGREEMENT WITH INDEPENDENT CITIES LEASE FINANCING AUTHORITY (ICLFA) (600 -30) Recommendation: 1) Approve Amendment No. 3 to the Joint Powers Agreement with Independent Cities Lease Financing Authority (ICLFA); 2) Waive further reading read by title only and adopt Resolution No. 2002- 106 entitled, " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AMENDMENT NO. 3 TO THE JOINT POWERS AGREEMENT CREATING THE INDEPENDENT CITIES LEASE FINANCE AUTHORITY AND PROVIDING OTHER MATTERS PROPERLY RELATING THERETO;" and 3) Authorize the Mayor to execute the Agreement. APPROVAL OF A PROFESSIONAL SERVICES AGREEMENT WITH SYLVIA SCHARF FOR CONSULTING SERVICES WITHIN THE PLANNING DIVISION (600 -30) Recommendation: Approve a Professional Services Agreement with Sylvia Scharf, in an amount not to exceed $45,000 for the purpose of providing consultant services within the Planning Division and authorize the Mayor to execute the Agreement. M. APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO ADVERTISE AND SOLICIT BIDS FOR THE INSTALLATION OF A LIGHTING SYSTEM AT BASEBALL LITTLE LEAGUE FIELDS, CIP 724 (600 -30) Recommendation: Approve the plans and specifications and authorize staff to solicit bids for the construction phase of this project. 2. PUBLIC HEARING FOR USE OF THE 2002 LOCAL LAW ENFORCEMENT BLOCK GRANT ( LLEBG) FUNDS (390 -35) Recommendation: Conduct Public Hearing pursuant to the special conditions of the 2002 Local Law Enforcement Block Grant process and authorize staff to continue with the LLEBG process. B. PUBLIC HEARING REQUESTING APPROVAL OF A COMPREHENSIVE GENERAL PLAN UPDATE AND ADOPTION OF A CITYWIDE ENVIRONMENTAL IMPACT REPORT; CASE NO.: AGP -104; LOCATION: CITYWIDE; APPLICANTS: CITY OF BALDWIN PARK (420 -25) Recommendation: Following public hearing, waive further reading, read by title only and adopt Resolution No. 2002 -104 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A COMPREHENSIVE GENERAL PLAN AMENDMENT, ADOPTING THE FINDINGS OF FACT AND STATEMENT OF OVERRIDING CONSIDERATIONS AND CERTIFYING THE ENVIRONMENTAL IMPACT REPORT (APPLICANT: CITY OF BALDWIN PARK; LOCATION CITYWIDE; CASE NO.: AGP- 104." 3. REPORTS OF OFFICERS A. APPROVAL OF A CONSULTANT SERVICES AGREEMENT FOR UPDATING THE CITY'S ZONING CODE AND DESIGN GUIDELINES — COTTON /BRIDGES & ASSOCIATES (600 -30) Recommendation: Approve a Consultant Services Agreement with the Cotton /Bridges & Associates in an amount not to exceed $140,587 for updating of City's Zoning Code and Design Guidelines and authorize the Mayor to execute the Agreement. AWARD OF CONTRACT FOR CITYWIDE LANDSCAPING SERVICES (Continued from November 6, 2002 City Council Meeting) (600 -30) Recommendation: 1) Award the contract to Mariposa Horticultural Enterprises, Inc., in the amount of $113,679 per year which includes appropriation of $20,000 from Prop "A" Park grant funds for the Little League field maintenance; 2) Authorize the Finance Director to appropriate said funds; 3) Authorize the Mayor to execute the Agreement; and 4) Authorize the Director of Public Works to execute any necessary change orders in an amount not to exceed ten percent (10 %) of the original contract amount. D. ORDINANCE AMENDING SECTION 122 OF THE BALDWIN PARK MUNICIPAL CODE TO PROVIDE FOR SAFER VENDING FROM VEHICLES (530 -60) Recommendation: Waive further reading, read by title only and introduce for first reading Ordinance No. 1199 entitled, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 122 OF THE BALDWIN PARK MUNICIPAL CODE TO PROVIDE FOR SAFER VENDING FROM VEHICLES." E. APPROVAL OF DEPARTMENT REQUESTS FOR PERSONNEL RECLASSIFICATIONS (700 -20) Recommendation: Authorize staff to implement the recommended staffing reclassifications. 4. CONCEPTUAL APPROVAL FOR THE INSTALLATION OF A WIRELESS COMMUNICATION TOWER WITHIN THE OS, OPEN SPACE ZONE; (CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT AREA); LOCATION: 4100 BALDWIN PARK BOULEVARD (MORGAN PARK); APPLICANT: MAREE HOEGER, REPRESENTING CINGULAR WIRELESS; CASE NO.: PR -02 -29 (450 -20) Recommendation: Modify the Agency's original approval provided at the November 6, 2002 meeting and conceptually approve the installation of a wireless communication facility located at 4100 Baldwin Park Boulevard (Morgan Park) in the form of Option A — a sixty -five (65) foot tall multi - carrier mono -pine, subject to Cingular Wireless and the City of Baldwin Park reaching a lease agreement. 4. AWARD OF CONTRACT FOR THE MINOR PHYSICAL IMPROVEMENTS OF ALL MCNEILL MANOR PUBLIC HOUSING UNITS (600 -30) Recommendation: 1) Award the contract to Barrow Construction Company, Inc., in the amount of $16,266 for minor physical improvements to the 12 McNeill Manor units of public housing; 2) Authorize the Chairman to execute the Agreement; and 3) Authorize the Director of Housing to execute any necessary change orders in an amount not to exceed ten percent (10 %) of the original contract amount. 2.
