This report requests Council's second reading and adoption of Ordinance 1172 approving a zone change from FC to FC (0), BACKGROUND: On February 21, 2001 the City Council approved the first reading of Ordinance 1172 for approval of Zone Change 517 Revision 1 to apply the (0) Overlay Zone to the freeway frontage portion of this particular property; and approved Zone Variance 659 Revision 1 to allow the billboard to exceed the maximum height (from 40' to 65'170' with an occasional 5' appendage) and sign face area (from 600 sq. ft. to 800 sq. ft.) and a six (6) foot encroachment into the required ten (10) foot street side yard area; and Conditional Use Permit 625 to allow one billboard sign for an initial 25- year period. E ANCHEZ , INTERIM DIRECTOR OF FINANCE 5 DATE: FEBRUARY 28, 2001 SUBJECT; RESTRICTED FUNDS FOR YOUTH RELATED SERVICES PURPOSE; The purpose of this report is to recommend to the City Council a method to restrict the use of funds for specific purposes such as for youth related services. 1 . :• .O The City Council has indicated they wish to restrict the use of funds to be received from the settlement agreement with Ken Spiker & Associates and Regency Outdoor Advertising in the amount of $1,225,000 and directed staff to report on how this can be accomplished. The agreement specifies that $625,000 of the settlement be considered as a settlement) contribution for youth related services. The City Council may restrict the use of funds within the General Fund Balance Reserves should they so desire. This is accomplished by a resolution or minute action authorizing the restriction of the use of funds for specific purposes. Once the Council takes this action, funds are set -aside in the General Fund Balance Reserve as "Reserved for Youth Related Services" and can only be appropriated by the Council for those purposes. .Attached is an illustration from a publication by the Government Finance Officers ,Association of the U.S.A. and Canada indicating how Fund Balances may be reserved for restricted purposes. (See highlighted area of "Exhibit 10 — Combined Balance Sheet — Liabilities and Fund Equity„ attached.) It is recommended that the City use this approach to restrict the use of these funds. The current estimated revenue in the budget for billboard signs is $200,000. This amount is included in the $1,225,000 sum to be received from the settlement agreement. This represents an increase in revenues of $1,025,000. Based on the above direction by the Restricted Funds For Youth Related Services February 28, 2001 Page 2 Council to restrict $625,000, this represents an additional $400,000 in revenue not anticipated in the General Fund. The Council may wish to earmark the $400,000 for specific purposes or use these funds to augment the General Fund. RECOMMENDATION: 1) Approve staff recommendation to use the method illustrated and recommended by the Government Finance Officers Association to restrict the use of funds in the amount of $625,000. 2) Direct staff to use the additional revenues to be received to augment the General Fund, or 3) Direct staff to earmark the additional revenues to be received for specific purposes.
