RESOLUTION NO. 2012-006
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK DETERMINING THE
CITY OF BALDWIN PARK SHALL RETAIN THE
REDEVELOPMENT RELATED HOUSING ASSETS
AND FUNCTIONS FORMERLY EXERCISED BY
THE COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF BALDWIN PARK, PURSUANT TO
HEALTH AND SAFETY CODE SECTION 34176
WHEREAS, on December 29, 2011, the California Supreme Court issued
its opinion in the case of California Redevelopment Association, et at v. Ana
Matosantos, etc., et at, Case No. S194861, and upheld the validity of Assembly
Bill X1 26 ("AB 26") and invalidated Assembly Bill X1 27; and
WHEREAS, the Court's decision results in the implementation of AB 26,
which dissolves all redevelopment agencies in the State of California as of
February 1, 2012; and
WHEREAS, pursuant to a provision of AB 26, codified as Health and
Safety Code Section 34176, the city, in the case of a redevelopment agency of a
city, may elect to retain the housing assets and functions of the dissolved
redevelopment agency; and
WHEREAS, the Community Development Commission of the City of
Baldwin Park ("CDC") functions as both the redevelopment agency and the
housing authority of the City; and
WHEREAS, under AB 26, the redevelopment authority and functions of
the CDC will be terminated effective February 1, 2012, while the CDC remains in
existence as the City's housing authority; and
WHEREAS, the City Council, having considered the matter, has
determined, in its legislative discretion, it is in the best interests of the City of
Baldwin Park for the City to retain the redevelopment related housing assets and
functions formerly exercised by the CDC;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK AS FOLLOWS:

SECTION 1. The City Council hereby affirmatively determines the City of
Baldwin Park elects to, and shall, retain the redevelopment housing assets and
functions former exercised by the CDC.
SECTION 2. The Chief Executive Officer and his authorized designees
are hereby authorized and directed to take such other and further actions and
sign such other and further documents as is necessary and proper to implement
this Resolution on behalf of the City.
