Mayor Bloxham led the salute to the Flag. Invocation was given by Mr. Eugene Harris. ROLL CALL: Present: Councilmen Cole, Duskin, Littlejohn, Scovotti and Bloxham; City Clerk, City Attorney and City Treasurer. Moved by Councilman Scovotti, seconded by Mayor Bloxham, that Dismissal of Captain Russell Josenhans be dismissed as of 12:00 Midnight Captain Josenhans, tonight, October 15, 1956, and that he be instructed to turn effective mid in his badge, cap and all credentials. night October 15,, 1956. Councilman Littlejohn requested legal opinion in re right of Council to terminate. City Attorney stated that all appoint- ed employees serve at the pleasure of the Council and can be terminated without cause at any time, After further discussion as to the legality of the City Council taking such action and the obligation of giving Capt. Josenhans the right to a public hearing, it was moved by Councilman Littlejohn and seconded by Councilman Cole, that motion made by Councilman Scovotti be amended to provide that the City Attorney give a written opinion of the State Statute regarding such matters. This amended motion was lost by the following vote: AYES: Councilmen Cole and Littlejohn NOES: Councilmen buskin, Scovotti and Bloxham. The original motion was adopted by the following vote: AYES: Councilmen Durkin, Scovotti and Bloxham NOES: Councilman Cole and Littlejohn ABSENT: None After further discussion regarding the fairness of letting Capt. Josenhans have a public hearing, it was mined by Councilman Durkin, seconded by Mayor Blmham, and unanimous- ly carried that a special meeting be set up to discuss the problem if anybody wanted to discuss it. Moved by Councilman Littlejohn that Councilman Duskin's motion be amended to provide that a special meeting be set for Wednesday night, October 17,1956, at 8:00 o'clock P.M. and notice is hereby given. After some discussion and explanation by the City Attorney with respect to proper procedures regarding meetings,.Counciiman Duskin withdrew his motion and Mayor Blxharn withdrew his second to such motion. Councilman Littlejohn then withdrew his amendment to Councilman buskin's motion. The City Administrator brought to the attention of the Renovation of Old Council the matter of renovation of Old Central School. He Central School. further stated that he had now secured the wage scales from the local building trades unions of various kinds neces- sary to prepare a bid notice quoting those rates; that the City Engineer has been working on specifications to go along with the bid.
