A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, CALIFORNIA, PROHIBITING
TELECONFERENCING FROM A REMOTE SITE BY
MAYOR AND COUNCILMEMBERS AT CITY COUNCIL
MEETINGS AND ITS RELATED PUBLIC ENTITIES
The City Council of the City of Baldwin Park, California, does hereby resolve as
follows:
WHEREAS, teleconferencing by a Member from a remote site to a City Council
Meeting is permissibly provided for by the Brown Act at California Government Code
Section 54953; and
WHEREAS, teleconferencing Members into Meetings has caused numerous
problems with respect to clarity of connection, inability to communicate with the Member,
and an inability for the Public to interact and communicate with the teleconferencing
Member either at City Hall or the remote site; and
WHEREAS, the Brown Act, California Code Sections 54950 et seq., provides for
open and transparent meetings wherein the Public has the opportunity to attend the full
meeting of the City Council and to participate and question elected Members on all matters
within the subject jurisdiction and the Agenda to be considered; and
WHEREAS, teleconferencing Members only on certain matters does not comply
with the requirements of full participation by the Public in all public meetings in that the
remote teleconferencing does not provide for Public Comment, a consideration of all
Agendized matters, and the opportunity to see and question the absent Member.
WHERES, the City of Baldwin Park has experienced in fact, all of the above
problems, abuses, and illegalities in the recent past due to Members teleconferencing into
City Council Meetings, and its related entities, for selected items, with poor and inadequate
posting and communications devices prohibiting Public Participation and communication
with Members.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK
HEREBY RESOLVES AS FOLLOWS:
Section 1. The City Council of the City of Baldwin Park does hereby prohibit
Teleconferencing by the Mayor and Councilmembers from remote location to City Council
Meetings, and its related entities; and
Section 2. That all Resolutions inconsistent herewith are hereby repealed and
rescinded; and
Section 3. That the City Clerk shall certify to the adoption of this Resolution and
that this Resolution shall take effect immediately.
