Staff recommends City Council waive further reading and adopt Resolution No. 2013-

PARK, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL
ELECTION HELD NOVEMBER 5, 2013 AND DECLARING THE RESULTS AND SUCH
OTHER MATTERS AS PROVIDED BY LAW'.

E. REORGANIZATION OF THE CITY COUNCIL - SELECTION OF MAYOR PRO
TEMPORE
Staff recommends that the City Council complete the reorganization of the City Council,
and follow the procedure as suggested for the selection of Mayor Pro Tempore as
follows:
1 The City Clerk opens the nominations for the office of Mayor Pro Tempore. Any
Councilmember may nominate and no second to the nomination is required;
2. After receiving all nominations, the City Clerk closes the nominations;
3. The City Clerk then conducts the election of the Mayor Pro Tempore by roll call
vote. If there is more than one nomination, a roll call vote is conducted in the
order in which nominations are received until a Mayor Pro Tempore is elected by
majority vote.
ANNOUNCEMENTS
This is to announce, as required by Government Code section 54954,3, members of the City
Council are also members of the Board of Directors of the Housing Authority and Finance
Authority, which are concurrently convening with the City Council this evening and each
Council Member is paid an additional stipend of $30 for attending the Housing Authority
meeting and $50 for attending the Finance Authority meeting.

SUBJECT: RESOLUTION NO. 2013 -040 DECLARING THE RESULTS AND
RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION
HELD NOVEMBER 5, 2013
This report requests City Council approval and adoption of a resolution declaring the
results of the General Municipal Election held November 5, 2013.
BACKGROUND /DISCUSSION
On November 5, 2013, a General Municipal Election was held (in consolidation with
the Los Angeles County Uniform District Election (UEDL - School Election)). The
offices voted upon were for the Office of Mayor, two positions for the Office of
Councilmember, Office of the City Clerk and Office of the City Treasurer.
As authorized and requested by Resolution No. 2013 -016, a computer count of all
ballots was made at the Los Angeles County Registrar- Recorder's Office - Central
Counting Center in Norwalk on November 5, 2013. The Registrar- Recorder /County
Clerk has completed an official canvass and has verified that all ballots have been
correctly counted and accounted for. The Final Official Statement of Votes Cast and
Canvass of the Votes Cast is attached as Exhibit "A" to Resolution No. 2013 -040.
The canvass of this election verifies that a majority of the voters elected Manuel
Lozano for Mayor; Cruz Baca and Susan Rubio for City Council; Alejandra Avila for
City Clerk and Maria "Marie" Antonieta" Contreras for City Treasurer.
RECOMMENDATION
Staff recommends City Council waive further reading and adopt Resolution No.

CITY OF BALDWIN PARK, RECITING THE FACT OF
THE GENERAL MUNICIPAL ELECTION HELD

PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of
Baldwin Park, California, on Tuesday, November 5, 2013, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided
by law; that voting precincts were properly established; that election officers were appointed
and that in all respects the election was held and conducted and the votes were cast,
received and canvassed and the returns made and declared in time, form and manner as
required by the provisions of the Elections Code of the State of California for the holding of
elections in General Law cities; and
WHEREAS, the County Election's Department canvassed the returns of the election
and has certified the results to this City Council, the results are received, attached and
made a part hereof as "Exhibit A."
NOW, THEREFORE, THE CITY COUNCIL OF BALDWIN PARK, CALIFORNIA,
DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the whole number of ballots cast in the precincts including
provisional ballots was 2693.
That the whole number of absent voter ballots cast in the City was 1642 making a
total of 4335 ballots cast in the City.
SECTION 2. That the names of the persons voted for at the election are as follows:

NATALIE M. YBARRA
CRUZ BACA
SUSAN RUBIO
FOR CITY CLERK

SECTION 3. That the number of votes given at each precinct and the number of
votes given in the City to each of the persons above named for the respective offices for
which the persons were candidates and for and against the measure were as listed in
Exhibit "A" attached.

SECTION 4. That the City Council does declare and determine that:
• Manuel Lozano was elected as Mayor for the full term of two years; and
• Cruz Baca and Susan Rubio were elected as Members of the City
Council for the full term of four years,
• Alejandra Avila was elected as City Clerk for the full term of four years,
and
• Maria Antonieta "Marie" Contreras was elected as City Treasurer for
the full term of four years.
SECTION 5. That the City Clerk shall enter on the official records of the City
Council of the City, a statement of the result of the election showing: 1) The whole
number of ballots cast in the City; 2) The names of the persons voted for; 3) For what
office each person was voted for 4) The number of votes given at each precinct to each
person; and 5) the total number of votes given to each person.
SECTION 6. That the City Clerk shall immediately make and deliver to each of
the persons so elected a Certificate of Election signed by the City Clerk and
authenticated and that each person elected shall have administered to him/her, an Oath
of Office prescribed in the Constitution of the State of California and shall have them
subscribe to it and file it in the office of the City Clerk. Each and all of the persons so
elected shall then be inducted into the respective office to which they have been
elected.
SECTION 7. That the City clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

MAYOR PRO TEMPORE
The purpose of this report is to complete the reorganization of the City Council with
the selection of a new Mayor Pro Tempore,
BACKGROUND /DISCUSSION
In accordance with Ordinance No. 1249, it is appropriate at this time to reorganize the
City Council and select one of its members as Mayor Pro Tempore.
RECOMMENDATION
Staff recommends City Council complete the reorganization of the City Council, and
follow the procedure as suggested for the selection of Mayor Pro Tempore as follows:
1) The City Clerk opens the nominations for the office of Mayor Pro Tempore. Any
Councilmember may nominate and no second to the nomination is required;
2) After receiving all nominations, the City Clerk closes the nominations-,
3) The City Clerk then conducts the election of the Mayor Pro Tempore by roll call
vote. If there is more than one nomination, a roll call vote is conducted in the
order in which nominations are received until a Mayor Pro Tempore is elected by
majority vote.

SUBJECT: Warrants and Demands
The purpose of this report is for the City Council to ratify the payment of Warrants and
Demands against the City of Baldwin Park.
BACKGROUND AND DISCUSSION:
The attached Claims and Demands report format meets the required information in
accordance with the Government Code. Staff reviews requests for expenditures for
budgetary approval and for authorization from the department head or its designee. The
report provides information on payments released since the previous City Council meeting;
the following is a summary of the payments released:
1. The payroll of the City of Baldwin Park consisting of check numbers 195904 —
195933. Additionally, Automatic Clearing House (ACH) Payroll deposits were made
on behalf of City Employees from control numbers 232103 - 232346 for the period
of October 13, 2013 through October 26, 2013 inclusive; these are presented and
hereby ratified, in the amount of $348,349.43.
2. General Warrants, including check numbers 197859 to197988 inclusive, in the total
amount of $313,333.02constituting claims and demands against the City of Baldwin
Park, are herewith presented to the City Council as required by law, and the same
hereby ratified.
Pursuant to Section 37208 of the Government Code, the Chief Executive Officer or
designee does hereby certify to the accuracy of the demands hereinafter referred to and to
the availability of funds for payment thereof.
RECOMMENDATION:
Staff recommends City Council ratify the attached Warrants and Demands.
