WARRANTS AND DEMANDS Staff recommends the City Council ratify the attached Warrants and Demands Register. 2. CLAIM REJECTION Staff recommends City Council reject the claim of Installed Building Products /O.J. Insulation (Esteban Ortiz) and direct staff to send the appropriate notice of rejection to claimant. 3. AUTHORIZATION TO PURCHASE A REPLACEMENT STREET SWEEPER It is recommended that the City Council award the bid for the purchase of one street sweeper to MarCo Equipment Company, Pomona, CA for $318,552.50. 4. TELECONFERENCING LIMIT It is recommended that the City Council pass Resolution No. 2014-010 prohibiting Teleconferencing from a remote location based upon the findings set forth in the Resolution. CITY COUNCIL / CITY CLERK / CITY TREASURER / STAFF REQUESTS & COMMUNICATIONS Request by Mayor Pro Tem Ricardo Pacheco for discussion or direction to staff on the following: • Mayor Pro Tern Ricardo Pacheco recognizes the City of Baldwin Park Department of Recreation and Community Services for earning the highest recognition from District 13 California Park and Recreation Society for the Senior Center Prom. The City won under the Health, Wellness and Community Life category and was presented the award at the Diamond Bar Center on March 26 th • On March 22-23, 2014, the Baldwin Park Police Department Participated in the 30th Baker to Vegas Challenge Cup Relay. This is a 120 mile running relay race from Baker CA to Las Vegas. There were over 270 law enforcement running teams from various local, state, and federal agencies along with teams from Europe participating. Each team is made up of 20 runners and a contingency of support staff. The BPPD Department Team finished 8th in its category. This entire purchase will be paid for with Special Fund 231 - Air Quality Management LEGAL REVIEW This item has been reviewed by the City Attorney' ` " BACKGROUND Sweeper No. 91 is over 12 years old and at the end of its useful economic life. The replacement of this sweeper was approved in the recently adopted FY 2013 -2014 Budget. Street sweeping is essential to comply with the Federal Clean Water Act and to conform to the National Pollutants Discharge Elimination System (NPDES) Best Management Practices to protect stormwater quality. A "Notice Inviting Bids" was sent out to multiple vendors and posted to the City's website. The bid opening was February 27, 2014 and four proposals conforming to the specifications were received from three bidders. The bid results listed below include tax. Elgin CNG Crosswind $364,021.85 TO: Honorable Mayor and Members of the City Council FROM: Robert Manuel Nacionales Tafoya, City Attorney DATE: April 2, 2014 SUBJECT: Teleconferencing Limit SUMMARY This proposed Resolution would prohibit the Mayor and Councilmembers from utilizing teleconferencing in order to participate in Council Meetings due to the disruptive nature to Council Meetings and to the public at large. RECOMMENDATION It is recommended that the City Council pass Resolution No. 2014 -010 prohibiting Teleconferencing from a remote location based upon the findings set forth in the Resolution. FISCAL IMPACT "There is no fiscal impact in passing the attached Resolution. LEGAL REVIEW This matter has been reviewed and approved by the City Attorney. BACKGROUND Teleconferencing by the Mayor and Councilmembers from a remote site to a City Council Meeting is permissibly provided for by the Brown Act at California Government Code Section 54953, but it is not required by the Brown Act, Teleconferencing Members into City Council meetings has been done in the past and has caused numerous problems with respect to clarity of connection. In every case where teleconferencing was used, there were problems with the clarity of the phone line and the speaker accessories that were used. In most cases, the Councilmember could not be heard clearly enough to ascertain what was being said. In many cases, the comments made by the Member could not be made out by the members in the meeting in Baldwin Park. In addition, during the teleconferencing, there was often an inability to communicate with the Member on the other line. It was not uncommon for the Mayor to repeat the Members name in order to try and get the Members attention because the telephone communication was so bad. Moreover, since the communication problems often prevented the member from participating in any meaningful way, the same was true for any member of the public from interacting and communicating with the City Council in Baldwin Park. Further, in every case where the teleconferencing was used, the Member did not open the meeting on time at the teleconferencing site. Instead, the meeting was not opened at the teleconferencing site for an hour or more after the actual meeting in Baldwin Park commenced. In short, teleconferencing is disruptive to the actual City Council meeting and in the cases at Baldwin park where it was used the teleconferencing did not permit proper public input as required by the Brown Act. The Brown Act, California Code Sections 54950 et seq., provides for open and transparent meetings wherein the Public has the opportunity to attend the full meeting of the City Council and to participate and question elected Members on all matters within the subject jurisdiction and the Agenda to be considered. Teleconferencing Members only on certain matters does not comply with the requirements of full participation by the Public in all public meetings in that the- remote teleconferencing does not provide for Public Comment, a consideration of all Agendized matters, and the opportunity to inquire or question the matters heard before the City Council, The City of Baldwin Park has experienced in fact, all of the above problems, abuses, and improprieties in the recent past due to Members; teleconferencing into City Council Meetings, and its related entities, for selected items, with poor and inadequate posting and communications devices prohibiting public participation and communication with Members. For this reason, it is proposed to prohibit all teleconferencing from a remote location.
