FISCAL IMPACT The payroll for the last period was $360,055.44 and the attached General Warrants Register were $593,507.13 for a total amount of $953,562.57. LEGAL REVIEW None Required BACKGROUND The attached Claims and Demands report format meets the required information as set out in the California Government Code. Staff has reviewed the requests for expenditures for the appropriate budgetary approval and for the authorization from the department head or its designee. This government claim, and all government claims, should be considered as potential lawsuits in the future. Mayor Pro Tern Garcia also requested that the meeting be closed in honor of Mary Louise Raso, who passed on January 9, 2013. She is survived by her daughter, Diane Martinez, a retired Head Start teacher in Baldwin Park. Council extended condolences to family. PROCLAMATIONS COMMENDATIONS & PRESENTATIONS Recognition of outgoing Recreation & Community Services Student Commissioner, Destiney Singleton. This presentation was continued to the next meeting. City Council Regular Meeting Minutes 2/6/13 Certificate recognition to the Baldwin Park Braves Pop Warner Cheer Team. Mayor Lozano presented a Certificate of Recognition to the Baldwin Park Braves Pop Warner Cheer Team for their winning accomplishments during the 2012/13 Competition season. PUBLIC COMMUNICATIONS Mayor Lozano announced Public Communications as open at 7:14 p.m. and announced that speakers are allowed three (3) minutes for each speaker. Jason Adams, President of the Baldwin Park Police Association, thanked officers and the community for their representation at the Council Meeting; commented on the potential outsourcing of law enforcement to the County Sheriff's Department; opined that the process of determination has been less than transparent; stated that the community should be kept informed and be a part of discussions. Jay Kahn Sanchez, read aloud a letter from State Assemblyman Roger Hernandez which commended the officers of Baldwin Park Police Department and, serving as the Chair of Labor & Employment, Assemblyman Hernandez expressed his hope and encouragement that Council will retain the police department; stated that the true cost savings have not been clearly identified and that the lack of information being circulated is disturbing; expressed support of the Baldwin Police Association and his support for keeping the police department. Cindy Cortez, Monica Leon, Jasmine Torrez, Malina Gomez, Marela Nava, of Baldwin Park High School, announced that, as a project for their Chicano Studies course, they will be hosting a cultural fair on March 1., 2013 at Serra Vista High School; they invited members of the community and Council to attend. Joe Flanagan, Director of the Los Angeles North Chapter of Police Officers Research Association of California (PORAC), spoke in opposition to the potential outsourcing of law enforcement services to Los Angeles County; noted that eliminating the police department does not eliminate costs; pointed out that keeping a local police department keeps control within the city and quickens response to emergencies; opined that there is also political impact that should be considered and urged Council to think long and hard before making a decision to outsource. Rich Randolph, President of the Colton Police Officers Association of the Inland Empire, expressed opposition to the possible outsourcing of law enforcement services and opined that the decision to dissolve the police department would not be a service to the community but that Council should allow the community to decide rather than having five individuals make such a decision. Lillian Rubio, member of the Baldwin Park Police Officers Association, noted that she has served on the Baldwin Park Police Force for 17 years and the personal investment that she and other officers have made in becoming law enforcement representatives; reiterated the commitment of the officers to the community and its safety. Chris Kuberry, Vice President of the Baldwin Park Police Association (BPPA), pointed out that there have been repeated comments about BPPA refusing to negotiate and that the statement are false; noted that BPPA representatives have been willing to negotiate and have even Page 2 of 10 City Council Regular Meeting Minutes 2/6/13 provided cost sharing proposals; encouraged citizens to consider the source of the comments before coming to a conclusion. Peter Hoebe, President of the Azusa Peace Officer Association and President of PORAC, stated that he previously served on the Baldwin Park Police Department and has been in law enforcement for over 17 years; opined that Los Angeles Sheriff's Department will not provide the cost savings expected; stressed the importance of keeping law enforcement local as it serves as an anchor for the community. Ken Woods, Baldwin Park resident and business owner, commented on the `countless' closed session meetings that Council has had, yet it appears no decisions have ever been made in those meeting; opined that decisions are being withheld and pointed out that the community is entitled to knowing the resulting decisions made in closed sessions. Greq Tuttle, Baldwin Park business owner, commented on a written note that was passed to him by another attendee that he alleged was written by a member of Council; commented on allegations against Roger Hernandez; opined that the City Manager has hidden information, has mismanaged CalPERS funds and alleged that illegal documents are being signed under the direction of the current City Manager; stated that the City Manager has done nothing but caused turmoil in the City. Mark Adams, Staff Representative for the Baldwin Park Police Association, acknowledged that declining revenue and other adverse economics have an effect on the city of Baldwin Park but pointed out that Baldwin Park has the lowest crime rate for the area and size of the city; asked why conflicting financial information is being provided to the citizens and asked that accurate information be gathered, reported and provided to the community. There being no additional speakers, Mayor Lozano closed public communications at 7:40 p.m. Councilmember Rubio thanked those who attended the meeting to show support for the Baldwin Park Police Department and that she supports them and did not vote to outsource the service. Councilmember Pacheco commented on the commitment of the officers of the Police Department; expressed his desire to continue to look for alternatives; agreed with comments regarding getting accurate financial information which would be used to compare with the Sheriff's contract; acknowledged that there is a perception that a contract with the Sheriff's Department would be a cost saving move but that it cannot be demonstrated without accurate information. Mayor Pro Tern Garcia expressed appreciation to all who spoke in support of the Police Department; stated that the current annual cost of the police department represents a significant portion of expenditures from the General Fund each year; pointed out that the City has had to pull funds from the Reserve Funds; stated that the City is challenged by the ability to afford to have a police department; pointed out that the decisions are focused on sustainability; presented information in support of utilizing the Sheriff's Department and encouraged the community to attend all meetings and to stay informed. Mr. Wall explained that current code restricts construction activities between the hours of 7:00 p.m. and 7:00 a.m., however, this particular construction project, which is to build the pedestrian bridge across the railroad tracks can only be performed at night. Therefore, staff is seeking a one -time waiver of the code to allow nighttime construction on the project. I propose the council to direct the Police Chief and Captain to immediately advertise and seek other cities or public agencies needing police services. Councilmember Pacheco asked that Council consider alternatives, including soliciting other cities that may need law enforcement services which do not wish or are unable to contract with the County Sheriffs, with the intent of possibly offsetting the cost by providing police services to these other areas that are in need. Discuss the Baldwin Park Police Association letter dated January 29, 2013 in regards to the Los Angeles Sheriffs Phase II Study and the October 2012 PERS Public Safety Plan Annual Report. Councilmember Pacheco stated that he will seek clarification on the data and figures provided in the Study and Annual Report; expressed empathy for law enforcement staff who may be anxious and feeling unclear about the future of their jobs; reassured officers that alternatives are being explored and that he will seek guidance from legal counsel to determine what information related to the negotiations can be published in the NOW Newsletter and disseminated to the community. Councilmember Pacheco, as a side note, stated that the agenda was in slight err in that the zoning code amendment he wished to have considered was not for a bus /automotive storage yard in the industrial commercial zone but to allow parking and storage of mini buses. He pointed out that mini bus owners are sometime caught in a difficult situation because of zoning ambiguities and he asked that staff look at the zoning and develop some solutions to bring back for Council consideration. Page 8 of 10 City Council Regular Meeting Minutes RETURN TO COUNCIL REQUESTS 2/6/13 Councilmember Garcia referred back to the first of two items for discussion that Councilmember Pacheco had presented on the agenda; stated that she was under the understanding that Councilmember Pacheco had made a motion on the matter and she expressed her objection to the item. Councilmember Pacheco subsequently made a motion to approve the request of the first item which would entail exploring alternatives and strategies to offset the costs associated with law enforcement services. Councilmember Rubio pointed out that Councilmember Pacheco's request is to explore alternatives and that she is unclear on why there is an objection to this. Councilmember Pacheco inquired as #o whether to objection stemmed from the direction that staff immediately advertise and seek other cities or public agencies needing police services. pon confirmation by Councilmember Garcia, Councilmember Pacheco restated his motion to eliminate the immediate advertisement but to direct staff to look at potential opportunities to provide services to other municipalities to offset costs. Some of the subjects covered included "How to take charge of political and litigation threats from your safety unions;" group communication also included examining cost - saving measured being implemented by fire departments due to the increased medical calls occurring from those who are uninsured or underinsured. Councilmember Garcia also reported that the Council of Governments has hired a full -time executive director who has a very solid professional background. Resident of Vineland Ave. Baldwin Park, opined that the project does not provide any benefit to the citizens; pointed out that a facility at this same location created problems with traffic, parking and a criminal element; offered assistance in supporting the fight against the project. Resident of Vineland Ave. Baldwin Park, commented on the petition circulated in the area; noted that it is disappointed that it had to come to this [litigation] but that residents will continue to fight; opined that the area is not suitable for this type of facility, particularly because there is an elementary school just down the street and that the negative impact of the project will destroy the community feel. Resident of Vineland Ave. Baldwin Park, supported the comments of his father who spoke previously; stated that it is obvious that none of the residents want this to go forth and that he will continue to be the most vocal in opposing this project; inquired with the City Attorney about the requirements of a Conditional Use Permit as it seems the developers are trying to buy their way in; also asked the City Attorney whether, when the case has been adjudicated and should the city win, does the developer have to pay the City's legal fees and attorneys' costs; volunteered to provide whatever assistance may be useful in fighting the project. City Attorney Tafoya noted that many of the questions asked here will be addressed at the community meeting scheduled for December 15th Page 1 of 3 Terry Muse, Vineland Ave. resident, pointed out that the property has been blighted for many, many years and residents do not trust that the project will be a benefit to the community; also pointed out that the building is aged and suffers from structural damage from a fire, likely has asbestos and lead paint; questions why the property is not being used to develop more homes or some other use that would benefit the community. Christina Rodriquez, Vineland Ave. resident, pointed out that she has lived in her home since 1967 and that she fears that the increase in traffic, noise and pollution will taint the neighborhood; stated that she supports the other residents in opposing the project. Olivia Sasueta a resident living on Stitchman for 35 years, opined that the traffic is already too busy and that she is concerned when walking with her grandchildren; stated that she does not feel the facility is right [for that area]. Walter Jovell a resident living on Stitchman, wanted to add that the property has never been cared for properly and that the facility does not belong there [in that neighborhood]; opined that it doesn't make sense for two similar facilities to be so close together; echoed the comments of other residents in that it presents a risk to the elementary school. Javier Ramon resident on Stitchman, expressed appreciation for Council's support in fighting the project and affirmed his commitment to fighting it as well; provided a suggested alternate location for the facility; expressed hopes that the City Attorney will identify case law to support a decision in favor of Baldwin Park. Mike Duran a resident on Vineland Ave., stated that, as a pastor, he would prefer that the property be used for a housing development; echoed the feelings of other residents who have spoken previously. Unidentified resident on Stitchman, having lived the same neighborhood for her entire life, expressed her gratitude to Council for fighting against the development and her opposition to the project. Mayor Lozano pointed out that the courts will make the final decision but that Council will do everything in their power to battle the project and receive a favorable ruling in litigation. City Attorney Tafoya restated the date and time of the community meeting and asked that residents bring their questions to that meeting where the Council can answer questions more specifically. PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS Presentation by Teri Muse, Waste Management, Inc., reporting on the Commercial Recycling Program in Baldwin Park. Ms. Muse narrated a PowerPoint presentation in which she highlighted some of the features of the Commercial Recycling Program, how the program was introduced and what progress has been made since implementation. Ms. Muse also introduced members of the Commercial Recycling Program task force and each presented a brief status report on progress made in each area. The council meeting was called to recess at 7:27 p.m. due to a medical emergency and dispatch of paramedics. The meeting reconvened at 7:40 p.m, and Council discussion resumed. Thomas Kerri, resident of San Bernardino, commented on the emergency that had just taken place; also commented on the actions of protestors in reaction to the events in Ferguson, Missouri. Al Luna, local resident, commented on the soccer league equipment being stored on City property; stated that Council was not following the agenda in the order; questioned why some meeting minutes being presented for Council approval are aged. John Rios, a local resident, opined that the soccer league and Council were taking up the 'buddy system;' commented that he believes there is something more to the arrangement other than just storing the soccer league's equipment; expressed his hope that Council would "make the right decision." Greq Tuttle, Baldwin Park business owner, opined that Councilmember Garcia's comments about "dirty little businesses" were inappropriate and objected to the "belittling comment;" stated that he had done research on the Baldwin Park Youth Soccer League and he found that the league has been reporting to the IRS fees paid to the school district for field use but that the school district has indicated that the league has never had to pay for use of the fields; opined that the league should be paying for the use of fields, whether they are City fields or School District fields, and that the league should be paying for storing equipment at the City yard. Diana Partida, Field Representative for Senator Hernandez, introduced herself and extended her availability to Council if they should have any issues or concerns that need to be brought to the attention of the Senator. Greg Tuttle, Baldwin Park business owner, pointed out that there is a $300,000 grant that is pending and that Council should await the outcome before making and decisions about development; opined that the City seems to be willing to give property away and is not being patient. Al Luna, Baldwin Park resident, opined that developers are getting free land and not paying taxes while the citizens get nothing; stated that with a drop in revenues, the lack of funds will eventually effect everyone and benefits will start to suffer; said that more schools ande housing are needed and that the City does not have land to throw away. John Rios, Baldwin Park resident, stated that the City should be putting land use issues (such as Vineland) up for a vote by the people and opined that the Council an City Attorney are not involving the citizens as they should be; stated that the City is not provide sufficient notice about the potential development and citizens need to know what is happening. MONTEBELLO HOUSING PROJECT PRESENTATION Robert Monzon, President of Montebello Housing, began by showing a PowerPoint and providing a narrative of the company's history, it's staff members, and some of its previously accomplished projects; presented four (4) different urban residential concepts, a portion of which would be designated as veterans housing; illustrated four Page 1 of 3 different mixed unit scenarios, explaining the caveats of each. Following the presentation, members of Montebello Housing staff answered questions of Council. Members of Council asked what the percentage of any of the Concepts (A through D) was for veterans - affordable housing and whether the area residents had been canvassed to determine what their vision /desire is for development in the area; Council pointed out that there are already more than one veterans memorials in the city and that some other ideas should be explored; Council also pointed out that there are property tax issues that need to be considered before moving forward with a decision. John Rios, Baldwin Park resident, expressed concern regarding the notification to residents regarding Parks and Recreation events as well as Planning Commission and Housing issues that are not being properly disseminated to the residents; noted that the NOW Newsletter is not an effective way of providing notification since it is not published frequently enough and are often tossed aside; noted that many people of fixed income cannot afford to buy newspaper subscription and that the City should be mailing notices to resident; opined that the City should be working with the community to insure good communication and that the proposed projects are in line with what the people want. Greg Tuttle, Baldwin Park business owner, opined that there is a serious lack of communication with the community; noted that there are CDBG funds available and that City Housing should be working with local churches to identify those who are in need of assistance; echoed the opinion of others with regard to noticing the community about proposed changes; voices strong objection to the current lawsuit with Vineland Keystone and expression confusion as to why the City would spend so much money on a lawsuit over blighted property; stated that the property had previously been an assisted living facility and that those residents who purchased in the neighborhood knew that a the time they purchased; opined that Council should not be promising what can't be done. Magda Torrellas, Planning Commissioner, expressed appreciation for the NOW Newsletter but noted that the publication frequency is insufficient for use as notification source; suggested that distribution electronically would seem to be more cost effective rather than seeing so many of the printed newsletters thrown away; suggested canvassing the community to determine how residents feel about the publication, what method should be used to disseminate it, how frequently it should be published and who is reading it. OF THE BALDWIN PARK MUNICIPAL CODE." LEGAL REVIEW The City Attorney has reviewed and approved this Ordinance as to form. BACKGROUND On April 15, 2009, City Council approved Ordinance 1325, which added Sections 150.250 - 150.261 to the Baldwin Park Municipal Code (BPMC), requiring the owners of vacant and /or abandoned properties to register said property and to maintain the property in accordance with community standards in order to address the issues created by the foreclosure crisis. The adoption of Ordinance 1325 has helped to mitigate some of the issues created by properties in foreclosure that had become vacant and abandoned. Subsequently, the Vacant and Abandoned Property Registration Program (VAPR) was implemented. The City had previously contracted with an outside vendor to assist with facilitating the VAPR Program, but the contract expired in August 2014 and was not renewed. Subsequently, on November 5, 2014, Council approved and authorized staff to recall the duties back from the vendor and administer the VAPR Program in- house. This Ordinance was introduced and read, by title only, at the City Council Meeting of December 17, 2014. The original intent of the code was to apply to properties in Foreclosure whether they are occupied or not. Adoption of this Ordinance will clear up the language and remove any ambiguity. ATTACHMENT Ordinance 1367 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIIN PARK AMENDING SECTION 150.250 ET SEQ. OF THE BALDWIN PARK MUNICIPAL CODE CONCERNING VACANT AND ABANDONED PROPERTY REGRISTRATION WHEREAS, the City Council enacted Ordinance 1325 in 2009 which required registration of vacant and distressed properties as a mechanism to protect neighborhoods and commercial areas from becoming blighted; and WHEREAS, by enacting Ordinance 1325, the City sought to require the maintenance and security of abandoned and vacated property; and WHEREAS, the City Council desires to expand registration to all distressed properties in the City in order to provide a proactive program of inspection and maintenance of said properties; NOW, THEREFORE, the City Council of the City of Baldwin Park does hereby ordain: SECTION 1. Subsection 150.251 "DEFINITIONS" shall be amended as follows: "AEANE.101NED. A property that is: (1) Vacant; (2) Under a current notice of default; (3) Pending a tax assessor's lien sale; (4) Under a notice of trustee's sale; (5) Has been the subject of a foreclosure sale where the title was retained by the beneficiary of a deed of trust involved in the foreclosure; or (6) Has been transferred under a deed in lieu of foreclosure." SECTION 2. Subsection 150.253 "REGISTRATION" shall be amended as follows: "Any beneficiary/trustee who holds a deed of trust secured by a property located within the city which is abandoned shall, within ten days, register the property with the Planning Manager, or his /her designee, on forms provided by the City. (A) If the property is occupied but remains in default, then it shall be inspected by the beneficiary/trustee, or an agent/designee of the beneficiary/ trustee and shall be deemed abandoned, and the beneficiary/trustee shall, within ten days register the property with the Planning Manager, or his /her designee, on forms provided by the city."
