Pacific Avenue, Baldwin Park, 91706 These minutes are presented in Agenda order. Various announcements or discussions may have occurred before or after the title under which they are presented. CALL TO ORDER The meeting was called to order by Mayor Lozano at 7:05 p.m. INVOCATION The invocation was provided by Pastor Jackson. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Lozano. ROLL CALL MEMBERS PRESENT: Council Member Monica Garcia Council Member Susan Rubio Mayor Pro Tem Cruz Baca • Mayor Manuel Lozano MEMBERS ABSENT: Council Member Ricardo Pacheco REPORT ON CLOSED SESSION Mayor Lozano stated that no reportable action was taken on items discussed during Closed Session. ANNOUNCEMENTS Mayor Lozano announced, as required by Government Code section 54954.3, that members of the City Council are also members of the Board of Directors of the Housing Authority and Finance Authority, which are concurrently convening with the City Council this evening and each Council Member is paid an additional stipend of$30 for attending the Housing Authority meeting and $50 for attending the Finance Authority meeting. PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS • Presentation of Certificates of Recognition for Danae Aguirre and Marissa Palomino, students of Baldwin Park High School, for receiving a Music Scholarship from the San Gabriel Valley District Woman's Club. • Mayor Pro Tem Baca presented the Certificates of Recognition, congratulating each student on their accomplishments and encouraged them to continue to pursue their talents. • Presentation of a Proclamation recognizing April 24, 2015, as National Arbor Day. • Mayor Lozano read the Proclamation aloud to recognize April 24, 2015, as National Arbor Day. • Presentation of a Certificate of Recognition to the California Mental Health Connection in recognition of their service to the community by providing out-patient therapy to families, children, adolescents, and adults in Baldwin Park. Council and the audience viewed a brief video provided by the California Mental Health Connection (CMHC) which outlined the many services that are available to citizens of the community. Mayor Lozano presented Certificates of Recognition to outstanding individuals who work with the CMHC and have been of great service to the community. • Presentation of Certificates of Recognition to Students from Sierra Vista High School and Baldwin Park High School for being selected this year's Art Winners by the Woman's Club. Mayor Lozano presented Certificates of Recognition to the students present and asked that they each show their award-winning photographs. • Presentation of Plaques to Baldwin Park Honorees for the 2015 Women of the Year Awards • selected by Assemblymember Roger Hernandez and Congresswoman Grace F. Napolitano. `�" Mayor Lozano presented plaques in recognition of each of the Baldwin Park Honorees of the 2015 Woman of the Year Awards and congratulated each of them for their outstanding work in the community. PUBLIC COMMUNICATIONS Mayor Lozano opened Public Communications at 7:41 p.m. and noted that each speaker is permitted a total of three (3) minutes to speak. Ken Woods, Baldwin Park resident, commented on how nice it has been to park in front of his house now that permit parking on the north side of Badillo Street has been implemented but then pointed out that two weeks later the residents on Badillo Circle On the apartments) have returned to parking on the north side of the street and citations are not being issued; pointed out that those living in the apartments should be parking on the south side of Badillo or even in the school parking lot down the street; opined that there should be another"parking ticket sweep." Al Luna, Baldwin Park resident, opined that certain Councilmembers are making poor decisions and are going to leave the community in debt with the approval of the Montebello project; called for certain Councilmembers to resign. Thomas Kerri, former Baldwin Park resident, commented on the City logo being used on award plaques; pointed out that next year is Baldwin Park's 60th Anniversary and thought it would be better for the City to spend funds on celebrating the anniversary, which will benefit the entire community, rather than the July 4th event. Page 2 of 12 Jim Frye, Baldwin Park resident, resides in the apartments on Badillo Circle; voice his objection to the parking permit program; opined that it is unfair to renters, particularly because home • owners have driveways and garages that can be used for parking; pointed out that there are more renters than there are home owner; stated that is a question of safety at night when walking from the car; stated that news of the Council demonstrating favoritism towards homeowners could be taken to the local media. Juna Trujillo, representing L.A. Voice and St. John the Baptist Church, asked that Council take notice of the proposed expansion of the hazardous waste plant next to Santa Fe Dam; expressed great concern for the natural habitat that is adjacent to the proposed expansion area; stated that citizens have attended the City of Irwindale Council meetings to request that a community forum be held in order to answer questions and address the concerns of the citizens of Irwindale and surrounding communities; voiced concern regarding the content of the Environmental Impact Study; asked that Council support the efforts of concerned citizens and request that the City of Irwindale hold a community forum for the benefit of everyone. Dayana Partida, Field Representative for Assemblymember Roger Hernandez, announced Mr. Hernandez will be hosting his Community Coffee event in the City of Azusa, and invited members of the community to attend, stated that he will be discussing existing legislation and noted that citizens can bring any questions or concerns to him at that time. Fernanda Sandoval, Baldwin Park resident, voiced concern regarding the proposed expansion of the waste facility located near Santa Fe Dam; noted that there are schools within 1.5 miles of the facility and speculated that there will be detrimental effects to Irwindale and the surrounding communities; asked that Council stand up for the community to protect the Santa Fe Dam. • *Unidentified Speaker, Baldwin Park resident, asked for Council's support in efforts to deter the City of Irwindale from approving the expansion of the waste facility; opined that it will have negative effects on people's health and the environment; asked that Council provide an answer as to whether they will commit to supporting the position of objection; asked that Council reach out to surrounding communities, since a relationship exists, to seek their support as well; opined that the water quality is already poor and there is fear that the water quality would be adversely effected; recognized that the expansion may bring additional jobs but that there is great concern regarding the effect to the environment and asked Council to be champion for the citizens of Baldwin Park. *Speaker testified in Spanish and translation to English was provided by Ms.Trujillo. Jennifer Allen, Baldwin Park resident and property manager of apartments located at 4040 Badillo Circle, stated that the new restrictions will have a detrimental economic affect since it will affects the ability to secure renters; stated that current tenants already have a lengthy walk when parking on Badillo Street; pointed out that property management is very strict about enforcing the existing parking spaces (within the apartment complex) are free from obstructions and are used by tenants; opined that the homeowners along Badillo Street have the availability of parking on their own property and to restrict parking on a public right-of-way is unfair at best; compounding the problem is the fact that permit sales are exclusively to these homeowners; suggested other ways of addressing the problem; urged Council to revise the requirements and allow all residents in the area to purchase permits. Unidentified Speaker, Baldwin Park resident, pointed out that he has multiple vehicles and has been able to manage the parking situation until now; opined that this change was brought about because of one property owner; suggested that there should be a compromise that will be fair to • all of the residents in the area. Page 3 of 12 John Huff, Baldwin Park resident, noted that, because of his career, he arrives home late at night and, while he does not fear for his own safety, he is concerned for his young adult • children; pointed out that this is the first time such restrictions have been implemented in Baldwin Park and it seems to be impractical; suggested that a solution that is fair to everyone be sought and settled on. *Maria Perez, Baldwin Park resident, expressed concern regarding the proposed expansion of the waste facility in the City of Irwindale; stated that her daughter suffers from asthma and she is seeking support from Council on behalf of her daughter and all children who suffer from health issues; voiced concern about the detrimental effects that the expansion will have on air and water quality. *Speaker testified in Spanish and translation to English was provided by Ms.Trujillo. Veronica Monson, Baldwin Park resident, stated that, while she realized that parking would be a challenge when she moved in, it had never been a problem until now; noted her husband works very early hours and, as a result of these new restrictions, she often has to shuttle her husband to his vehicle, which creates a problem because she has three small children that she cannot leave alone; pointed out that this has created a hardship in her household and asked that Council reconsider the current restrictions. Ricardo, Baldwin Park resident, sought Council's support in objecting to the expansion of the waste plant in Irwindale; opined that the expansion will have a negative effect on Santa Fe Dam and the surrounding nature area; stated that his children participate in outdoor activities in the Santa Fe Dam area and he is concerned for their safety. Manuel Hernandez, representative for the "Save Santa Fe Dam Recreational" campaign; echoed the sentiments of the citizens present and asked for Council support; asked the Council • reach out to elected official in Irwindale to discuss the results of the Environmental Impact Study and the impact that the expansion will have on the environment and the community. John Rios, Baldwin Park resident, commented on the permit parking issue on Badillo Street; noted that the addition of apartments that are currently under construction are going to exacerbate the problem; voiced concern that the labor negotiations are still not concluded; opined that Council and staff members should be paying close attention to citizens during meetings; objected to the recent reversal of the Planning Commission's decision on the Chevron project. Kimberly, Baldwin Park resident, stated that she has resided in communities where permit parking existed and she never objected to purchasing a permit; voiced her objection to the current restriction of selling parking permits to homeowners only, noting that parking should be on a first-come-first-serve basis. Angelina, Baldwin Park resident, stated that she lived adjacent to the Santa Fe Dam and that she and her family frequently participate in outdoor recreational activities in the area; stated that the risk associated with the a potential contamination of the environment and water is not worth it; pleaded for support in the effort to stop the proposed expansion of this waste facility. Francine Wilson, Baldwin Park resident, opined that Badillo Street it is a public street and it should not be restricted; stated that the restriction is one-sided and that all residents should be allowed to purchase a permit • Carol Woods, Baldwin Park resident, stated that many of the homes along Badillo Street do not have driveways or garages; expressed objection because homeowners are not able to park in Page 4 of 12 front of their own homes and that it creates a hardship for those who are handicapped; opined that homeowners deserve to be able to park in front of their own houses. • Eddie Monzon, Baldwin Park resident, expressed empathy for the homeowners; stated that everyone is aware of the difficult parking situation but that issuance of parking permits should be fair and all residents should be allowed to purchase permits. Unidentified Speaker commented on the proposed expansion of the waste facility at Santa Fe Dam; noted that it may cause the annual production of the Renaissance Faire to be moved elsewhere, which would result in a significant drop in revenue and available recreational activities for the communities. Carmen Caminos, Baldwin Park resident, voiced her objection to the permit parking implemented on Badillo Street; pointed out that apartment tenants are tax payers too and should not be banned from parking on a public right-of-way; stated that property owners pay for the property they purchase and not the street. Greg Tuttle, Baldwin Park business owner, opined that the parking issues are going to be exacerbated with the additional of new apartments being built in the area; stated that parking permits are not the answer and homeowners should be allowed to park in front of their own homes; commented on the ongoing labor negotiations and the failure to use a consultant for the negotiations. Marguerite Vargas, Baldwin Park resident, asked whether any progress has been made with the installation of traffic signals at La Rica and Los Angeles Street, and Ohio Street and Baldwin Park Boulevard; noted that traffic control is important in this area because she does not feel • safe walking her daughter to school, despite the crossing guard. Al Contreras, Baldwin Park resident, commented on the implementation of the parking permit program on Badillo Street; asserted that property owners pay more in taxes that renting tenants and should be able provided priority for parking in front of their own home; suggested that some kind of compromise be worked out; also noted that the Water District is aware of the proposed expansion of the waste facility at Santa Fe Dam and they will be looking into the matter to determine whether there should be concern of possible contamination of water. Eric Sorrel, Baldwin Park resident, spoke in opposition to the proposed expansion of the waste facility in the City of Irwindale; voice objection to the proposed waste facility expansion so near a natural resource that provides so much benefit to the community; stated that there should be great concern regarding contamination of the environment and the water. Seeing no others wishing to speak, Public Communications closed at 8:36 p.m. Mayor Lozano responded to some of the comments made before Council this evening; empathized with those dealing with the parking issues on Badillo Street and Badillo Circle; stated that staff has been directed to investigate why the current apartment complex on Badillo Circle does not have the number of parking spaces as is recorded in the official property records; stated that the matter will be pursued further to seek a reasonable solution. Mayor Lozano went on to say that, while he cannot speak for all Councilmembers, he • objects to the proposed expansion and he intends to agendize this matter so that action can be taken to formally object to the project; stated that he strongly opposes that project as Page 5 of 12 well; called for the citizens of the community to come together to voice opposition the facility expansion. Mayor Pro Tem Baca stated that she attended the last City Council meeting of the City of Irwindale and she would like to hold a public forum at which additional information can be presented, questions can be answered and the community will have the opportunity to provide input. Councilmember Rubio translated into Spanish the comments and information provided by Mayor Pro Tem Baca. Councilmember Garcia suggested that Council prepare a letter to be sent to the City of Irwindale to express the concerns of the community and seek collaborative effort with other communities, through the Council Of Governments, to take a strong stance against this proposal; also commented on the parking issues on Badillo Street, noting that the purpose of building standards is to deter situations like this from happening. Mayor Pro Tem Baca asked that the letter be held until after Councilmembers have an opportunity to gather additional information, tour the facility and be in a position of holding first-hand knowledge to bring back for a public forum and fight the project. After additional discussion, Council agreed that the City will take a position of opposition to waste-related projects. CONSENT CALENDAR Prior to vote, Mayor Pro Tem Baca requested that Item No. 5 be taken separately for discussion and Mayor Lozano requested that Item No. 6 be taken separately for discussion. • 1. WARRANTS AND DEMANDS Staff recommends City Council ratify the attached Warrants and Demands Register. CONDUCT A SECOND READING, BY TITLE ONLY AND WAIVE ANY FURTHER READING, AND FOLLOWING SUCH READING, ADOPT ORDINANCE NO. 1371, ENTITLED "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTIONS 153.170.060.A AND B, AND 153.170.090, ADDING SECTIONS 153.170.060.0 AND 153.170.090.C, AMENDING TABLE 153.170.080, • RELATING TO ELECTRONIC READERBOARDS AND TEMPORARY SIGNAGE FOR NEWLY ESTABLISHED BUSINESSES." SUPPORT OF ASSEMBLY BILL 857, CALIFORNIA CLEAN TRUCK ACT Staff recommends that Council authorize the Chief Executive Officer to prepare and • send letters of support for Assembly Bill 857, The California Clean Truck Act. A motion was made by Lozano, seconded by Baca, and carried (4— 0; Councilmember Pacheco Absent) to bring this item back at a future Council meeting, the date to be determined. APPROVE A CONTRACT WITH CABALLERO PRODUCTIONS, INC., FOR A FAMILY CIRCUS TENT SHOW Staff recommends that Council approve the agreement with Caballero Productions, Inc., for a family circus tent show, and authorize the Mayor to sign the agreement and any additional documents as necessary. Mayor Lozano announced that this contract would generate revenue for the City in the fixed amount of$11,000 plus a percentage of concession sales. A motion was made by Rubio, seconded by Garcia, and carried (4—0; Councilmember Pacheco Absent) to approve the agreement with Caballero Productions, Inc., for a family circus tent show, and authorize the Mayor to sign the agreement and any additional documents as necessary. APPROVE A CONTRACT WITH CGI VIDEO PRODUCTIONS, INC., FOR COMMUNITY SHOWCASE VIDEO SERVICES Staff recommends that Council approve the agreement with CGI Video Productions, Inc., for the production of community showcase video services. A motion was made by Lozano, seconded by Rubio and carried (4 —0; Councilmember Pacheco Absent) to approve the agreement with CGI Video Productions, Inc., for the production of community showcase video services. AN APPEAL OF THE PLANNING COMMISSION'S DECISION TO DENY A REQUEST FOR A CONDITIONAL USE PERMIT FOR THE OFF-SITE SALES OF BEER AND WINE (TYPE 20) IN CONJUNCTION WITH A CONVENIENCE STORE PURSUANT TO SECTION 153.120.050.A.1 IN THE CITY'S MUNICIPAL CODE. (LOCATION: 3160 BALDWIN PARK BOULEVARD; APPLICANT: BOB ABBOTT WITH STANTEC ARCHITECTURE, REPRESENTING CHEVRON CORPORATION; CASE • NUMBER: CP-818.) Staff and the Planning Commission recommend that, following the de novo public Page 8 of 12 hearing, held in accordance with Section 153.210.150.E of the City's Municipal Code, the City Council open the public hearing, receive any public comment, close the public • hearing, and adopt Resolution No. 2015-063, entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING THE FINDINGS OF FACT AND DENYING A CONDITIONAL USE PERMIT TO ALLOW THE OFF-SITE SALES OF BEER AND WINE IN CONJUNCTION WITH A CONVENIENCE STORE PURSUANT TO SECTION 153.120.050.A.1 OF THE CITY'S MUNICIPAL CODE. (LOCATION: 3160 BALDWIN PARK BLVD.; APPLICANT: BOB ABBOTT WITH STANTEC ARCHITECTURE REPRESENTING CHEVRON CORPORATION; CASE NUMBER: CP- 818). Prior to discussion and opening of the Public Hearing for this item, City Attorney Robert Tafoya announced that this is a De Novo Hearing which means that Council will hear and make any decisions on this item independent of the Planning Commission hearings and that any decisions made by Council on this item would be binding. City Planner Amy Harbin began by reviewing a PowerPoint presentation in which she reviewed the Planning Commission's findings and decision, and noted that the applicant has revised its application to incorporate changes that will mitigate the findings of the Planning Commission. Rob Spackler, Public Affairs Officer for Chevron Corporation, narrated a PowerPoint presentation which illustrated the demographics of the area in question; opined that it is by design that there is a concentration of retail store fronts in the area, therefore, the request is reasonable and in line with the surrounding area; noted that Chevron • independently circulated a petition in the commercial and residential neighborhood, which was well received and gained a consensus of signatures in support of granting the requested permit; Mr. Spackler noted that Chevron has proactively committed to eliminate promotional materials for any alcoholic beverages and to locate the products in an area of the store where exposure to minors would be minimized. Mr. Spackler also illustrated where additional security cameras will be installed and noted that the cold case is in the direct line-of-sight of the cashier's counter. Mr. Spackler then offered to answer any questions of Council. Following Mr. Spackler's presentation, Mayor Lozano opened the Public Hearing at 9:11 p.m. and invited those wishing to speak in opposition to the appeal to come forward. Seeing no one, Mayor Lozano invited those wishing to speak in favor of the appeal to come forward. Seeing no one wishing to speak, Mayor Lozano closed the Public Hearing at 9:11 p.m. Following the Public Hearing Councilmember Garcia made a motion, which was seconded by Mayor Lozano, to approve the appeal and grant the Conditional Use Permit; directed staff to bring back a Resolution to Council to approve a Conditional Use Permit for Chevron at the location specified. A motion was made by Garcia, seconded by Lozano and carried (4— 0; • Councilmember Pacheco Absent) to approve the appeal and direct staff to Page 9 of 12 prepare a resolution to grant a Conditional Use Permit, and bring it before Council at a future meeting for approval. • AYES: Baca, Garcia, Lozano, Rubio NOES: None. ABSENT: Pacheco. ABSTAIN: None. 9. PUBLIC HEARING REGARDING FIVE YEAR CONSOLIDATED PLAN, FISCAL YEAR 2015-2016 ANNUAL ACTION PLAN, THE CITIZEN PARTICIPATION PLAN AND ANALYSIS OF IMPEDIMENTS TO FAIR HOUSING CHOICE/FAIR HOUSING PLAN. Staff recommends that Council conduct the public hearing and, following the public hearing, approve the allocations for the FY 2014-2015 CDBG public service programs by selecting one of the following options: Option No. 1: Approve the Joint Commission's recommendations for funding as revised by staff; or Option No. 2: Revise allocations as the City Council deems appropriate. Housing Manager Suzie Ruelas narrated a staff report and, following her presentation, offered to answer any questions of Council. Mayor Lozano opened the Public Hearing at 9:33 p.m. and invited those wishing to speak in opposition to come forward. Seeing no one, Mayor Lozano invited those wishing to speak in support to come forward. Connie Brimm, representing East San Gabriel Valley Coalition for the Homeless, spoke of the various programs that are available to those in need; expressed • appreciation for the support that the City of Baldwin Park provides. Martha Lue, representing the Emergency Assistance Center, provided a narrative of data demonstrating services provided to Baldwin Park citizens in need; expressed thanks to Council for support to the Center and its continued operation. Dr. Paul Florez, representing Church of the Redeemer, provided a brief history of the programs that are offered through the Church of the Redeemer and the services provided to those in need; expressed gratitude for the assistance provided through the City of Baldwin Park and the continued support of Council. Michael Ward, representing St. John the Baptist Social Services, spoke of the services offered through the Social Services program and pointed to some situations in which Social Services staff were able to reach out and save lives; voiced gratitude for the generosity and support of Council and the City of Baldwin Park. Seeing no others wishing to speak, the Public Hearing was closed at 9:44 p.m. A motion was made by Lozano, seconded by Garcia and carried (4 — 0; Councilmember Pacheco Absent) to approve the allocations for the FY 2014-2015 CDBG public service programs by approving the Joint Commission's recommendations for funding as revised by staff. FORMATION OF MEDIAN LANDSCAPE DESIGN AD-HOC COMMITTEE Staff recommends that Council form a Median Landscape Design Ad-hoc Committee and appoint two City Councilmembers to serve on this committee. Mayor Pro Tem Baca requested that this item be taken from the agenda and brought back at the next Council meeting scheduled for May 6, 2015. 11. DISCUSSION ON RESTORING PREVIOUS CITY EVENTS Staff recommends that Council provide direction to staff as to which events to implement and return with the appropriate funding and allocations. Recreation and Community Services Director Manuel Carrollo provided a brief overview and recap of the matters discussed at the earlier Special Meeting. There was discussion as to whether to move forward with the July 4'h celebration and fireworks; whether the parade could be brought back and that integrating two events into one may be a reasonable way of approaching it (such as combining the Street Fair with the Concerts In The Park, the City's anniversary with the parade, etc.) Council then determined that they would vote of each of the three proposals separately; 1) Concerts in the Park; 2) July 4th Celebration; and 3) Street Fairs. 1) A motion was made by Lozano, seconded by Rubio and carried (4 — 0; . SELECTION OF PRINTING OPTIONS AND AWARD OF CONTRACT FOR PRINTING OF THE BALDWIN PARK NOW • Staff recommends that Council: 1) Award the contract for printing of the Baldwin Park NOW to iColor Printing & Mailing, for a period of one year; and 2) Select printing option job specifications; and 3) Select printing frequency; and 4) Authorize the Mayor to execute the contract. Recreation and Community Services Director Manuel Carrollo provided a brief overview and recap of the matters discussed at the previous Council Meeting. After brief discussion, Council selected Option No. 3 with regard to the media format and frequency of printing and mailing. A motion was made by Rubio, seconded by Baca and carried (4 — 0; Councilmember Pacheco Absent) to approve the contract for printing of the Baldwin Park NOW to iColor Printing & Mailing, for a period of one year; and approve the media and frequency of publishing and mailing as provided in Option No. 3 in Attachment A.
