A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BALDWIN PARK, CALIFORNIA, AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE STATE
BOARD OF EQUALIZATION FOR IMPLEMENTATION OF
THE LOCAL PREPAID MOBILE TELEPHONY SERVICES
COLLECTION ACT
WHEREAS, on August 19, 2015, the City of Baldwin Park certified that Ordinance
No. 908 applies its local charge(s) (access to 911 or communication services and/or
utility user tax) to prepaid mobile telephone services; and
WHEREAS, the Local Prepaid Mobile Telephony Services Collection Act,
mandates the Board of Equalization (Board) to administer and collect the local charges
for all applicable local jurisdictions (Rev. & Tax Code section 42103); and
WHEREAS, the Board will perform all functions incident to administration and
collection of the local charges for the City of Baldwin Park; and
• WHEREAS, the Board requires that the City of Baldwin Park enter into an
"Agreement for State Local Jurisdiction Collection and Administration of Local Charges"
prior to implementation' of the Local Prepaid Mobile Telephony Services Collection Act;
and
WHEREAS, the Board requires that the City of Baldwin Park authorize the
Agreement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK
HEREBY RESOLVES AS FOLLOWS:
Section 1. By approval of this Resolution, the City Council of the City of
Baldwin Park hereby approves the attached "Agreement for State Collection and
Administration of Local Charges," attached hereto.
Section 2. By this action, the City Council confers authorization to the Chief
Executive Officer to execute the Agreement with the State Board of Equalization for
implementation of the Local Prepaid Mobile Telephony Services Collection Act and any
related and relevant documents thereto.

• Section 3. That the City Clerk shall certify to the adoption of this Resolution
and the same shall be in full force and effect immediately upon its adoption.
PASSED, APPROVED and ADOPTED this 19st day of August 2015.
