BALDWIN PARK CITY COUNCIL REGULAR MEETING
• OCTOBER 21, 2015, 7:00 P.M.

These minutes are presented in Agenda order. Various announcements or discussions may
have occurred before or after the title under which they are presented.
CALL TO ORDER
The meeting was called to order by Mayor Lozano at 7:10 p.m.
INVOCATION
The invocation was provided by Councilmember Pacheco.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Lozano.

REPORT ON CLOSED SESSION
Mayor Lozano reported that, by unanimous vote, Council approved the settlement of Wilson v
City of Baldwin Park, and directed the City Attorney to finalize the necessary documents. No
reportable action was taken on any of the other items discussed during Closed Session.
ANNOUNCEMENTS
Mayor Lozano announced, as required by Government Code section 54954.3, that members of
the City Council are also members of the Board of Directors of the Housing Authority and
Finance Authority, which are concurrently convening with the City Council this evening and each
Council Member is paid an additional stipend of$30 for attending the Housing Authority meeting
and $50 for attending the Finance Authority meeting.
PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS
None.
A representative from Creative Planet presented a video.

PUBLIC COMMUNICATIONS
Mayor Lozano opened Public Communications at 7:18 p.m. and noted that each speaker is
permitted a total of three (3) minutes to speak.
Mr. Lopez stated that he would be speaking to the Baldwin Park Unified School District
Administration regarding Creative Planet and the video he presented earlier.
Arturo Luna, Baldwin Park resident, commented on Item No. 8, Walnut Creek Nature Park, and
opined that money is being wasted; alleged that it is all a big show that is put on during Election
season.
Thomas Kerri, San Bernardino resident, commented on increases in rent by 75%.
Tony Baca, Baldwin Park resident, commented on the upcoming election and councilmembers
that are participating in the run for Mayor.
Margarita Vargas, Baldwin Park resident, stated that she mailed out letters to all of the
candidates because political signs are becoming unsightly and there are some residential
properties where several signs are located; noted that permission must be obtained prior to
posting a political sign on private property.
Seeing no others wishing to speak, Public Communications closed at 7:43 p.m.
CONSENT CALENDAR
Item No. 6 was held from the Consent Calendar for further discussion.

2. TREASURER'S REPORT—JUNE, JULY AND AUGUST 2015

4. APPROVAL OF MEETING MINUTES
Receive and file:
Meeting Minutes of the Housing Authority, Finance Authority and Special City Council
Meetings held on February 15, 2012.
A motion was made by Lozano, seconded by Pacheco, and carried (4—0; Rubio
absent) to receive and file the minutes.

5. PURCHASE REPLACEMENT SERVER AND BLUE-RAY BACKUP FOR POLICE
41) CAMERA SYSTEM
Staff recommends that Council receive and file this report.
A motion was made by Lozano, seconded by Pacheco, and carried (4—0; Rubio
absent)to receive and file the report.

6. APPROVE AND AUTHORIZE THE PURCHASE OF THREE TRUCKS FOR THE PUBLIC
WORKS DEPARTMENT
Staff recommends that Council:
1) Find that National Joint Powers Alliance (NJPA) meets the requirements of the
BPMC §34.37 Cooperative Purchasing Agreements; and
2) Approve the purchase of a 2016 Ford F550 Truck with an integrated Graffiti
Removal System and a 2016 Ford F450 Truck with an integrated Street Paint
System from Wondries Fleet Group for the amounts of $18,579.61 and
$113,331.26, respectively; and
3) Approve the purchase of a 2015 Isuzu Stake-bed Truck with Dump Body and Lift
Gate from Reynolds Buick-GMC-Isuzu for the amount of$51,212.16; and
• 4) Authorize the Director of Public Works or his designee to sign any necessary
documents to facilitate the purchase and registration of these vehicles.

Public Works Director Dan Wall responded to inquiries by Mayor Pro Tern Baca
• regarding the proposed purchase; following brief discussion, Mayor Pro Tern
Baca was satisfied.
A motion was made by Baca, seconded by Pacheco, and carried (4—0;
Rubio absent) to approve and authorize the purchase pursuant to the
recommends by staff.

7. APPROVE AND ADOPT RESOLUTION NO. 2015-097, ENTITLED "A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AUTHORIZING
APPLYING FOR AN ENERGY EFFICIENCY LOAN FROM THE CALIFORNIA ENERGY
COMMISSION."
Staff recommends that Council waive further reading, read by title only, and adopt
Resolution No. 2015-097, entitled "A Resolution of the City Council of the City of
Baldwin Park, California, Authorizing Applying for an Energy Efficiency Loan from the
California Energy Commission."
A motion was made by Lozano, seconded by Pacheco, and carried (4—0; Rubio
absent) to waive further reading, read by title only, and adopt Resolution No.
2015-097, entitled "A Resolution of the City Council of the City of Baldwin Park,
California, Authorizing Applying for an Energy Efficiency Loan from the California
Energy Commission.".

8. ACCEPT PLANS AND SPECIFICATIONS, AND AUTHORIZE PUBLISHING A NOTICE
INVITING BIDS FOR CITY PROJECT NO. 2015-0106 - WALNUT CREEK NATURE
PARK IMPROVEMENTS
Staff recommends that Council approve the plans and specifications for the Walnut Creek
Nature Park Improvements Project (City Project No. 2015-0106) and authorize staff to
advertise the invitation to bid.
Councilmember Pacheco made a brief inquiry about the project and whether
taxpayers' money would be used to fund the project.
Public Works Director Dan Wall responded by saying that this is an authorization to
receive bids on the project and that no General Fund money is used for this project;
noted that the invitation to bid will require licensed contractors and that funds used
for the project are identified specifically for this use.
4111 Councilmember Garcia thanked Director Wall for providing the explanation, noting
that a great deal of time and effort has been put in to raise funds for the revitalization
of this park.

A motion was made by Lozano, seconded by Pacheco, and carried (4—0; Rubio
• absent) to approve the plans and specifications for the Walnut Creek Nature Park
Improvements Project (City Project No. 2015-0106) and authorize staff to
advertise the invitation to bid.

9. CREATION OF NON-PROFIT ORGANIZATION TO PROVIDE CHARITABLE RELIEF
Staff recommends that Council ratify the Articles of Incorporation filed on August 4, 2015;
execute the organizational documents attached hereto, which will authorize the
organization to begin its business operations; appoint and authorize officers to carry out
those operations; submit federal and state applications for tax exemption; and begin
solicitation of charitable donations for the upcoming holiday season charitable events that
are traditionally carried out in the City of Baldwin Park.
A motion was made by Lozano, seconded by Pacheco, and carried (4—0; Rubio

PUBLIC HEARING
10. CONDUCT A PUBLIC HEARING AND INTRODUCE ORDINANCE NO. 1379 WHICH
AMENDS THE CITY OF BALDWIN PARK MUNICIPAL CODE BY ADDING AND
MODIFYING LANGUAGE IN SUBCHAPTERS 153.160 (WATER EFFICIENT
LANDSCAPING) AND 153.220.120 (L-DEFINITION), AND ADOPTING THE CITY OF
BALDWIN PARK LANDSCAPE DESIGN MANUAL TO BE CONSISTENT WITH THE
GOVERNOR'S EXECUTIVE ORDER B-29-15 INTRODUCES THE MODEL WATER
ELIMINATION LANDSCAPE
Staff and the Planning Commission recommend that the City Council open the public
hearing and following the public hearing:
1) Introduce for first reading, by title only and waive further reading, Ordinance 1379,
entitled "An Ordinance of the City Council of the City of Baldwin Park, California,
Amending Baldwin Park Municipal Code Chapters 153.160 and 153.220.130,
modifying the water efficient landscaping standards and "L-definitions" to be consistent
with the Governor's Executive Order B-29-15;" and
2) Adopt Resolution No. 2015-096, entitled "A Resolution of the City Council of the City of
• Baldwin Park Adopting the Updated Landscape Design Manual to be Consistent with
the Governor's Executive Order B-29-15 (Applicant: City of Baldwin Park; Location:

Citywide; Case Number: DRG15-01)."
• City Planner Amy Harbin provided a narrative and explained that the purpose of this
resolution and ordinance are to bring the City's municipal code in alignment with
mandates changes as a result of the Governor's Executive Orders; noted that there
would be a significant reduction in water use and that an index of drought tolerant
plants (low to very-low water use) is provided
Mayor Lozano opened the Public Hearing at 7:54 p.m. and invited those individuals
wishing to speak against the item to come forward and be heard.
Seeing no one, Mayor Lozano invited those individuals wishing to speak in support of
the item to come forward and be heard.
Seeing no one wishing to speak on this item, Mayor Lozano closed the Public
Hearing at 7:55 p.m.
A motion was made by Lozano, seconded by Baca, and carried (4—0; Rubio
absent) to:
1) Introduce for first reading, by title only and waive further reading,

Staff recommends that Council review the submitted Student Commission application(s),
accept nomination(s), appoint the selected individual(s) to the Parks and Community
Services Commission and adopt Resolution No. 2015-090, entitled, "A Resolution of the
City Council of the City of Baldwin Park Appointing Qualified Students From Three Baldwin
Park High Schools To The Recreation & Community Services Commission Of The City Of
• Baldwin Park To Office Numbers 6, 7 And 8."

12. DIRECTION AND APPROVAL OF THE DESIGN FOR THE BALDWIN PARK GATEWAY
FREEWAY MONUMENT
Staff recommends that Council select and approve a design for the Baldwin Park Gateway
Freeway Monument.
Public Works Director Dan Wall provided illustrations of the artist's renderings of the
monument, including color and material concept options; Director Wall explained that the
monument will be approximately 20-feet tall and will be placed adjacent to the interchange
at Baldwin Park Boulevard and Interstate 10 Freeway.
Council discussion ensued and after further consideration, Concept A was selected as the
final design for the monument.
A motion was made by Lozano, seconded by Baca, and carried (4—0; Rubio
absent) to approve the selection of Concept A for the Baldwin Park Gateway
Freeway Monument.
