14403 East Pacific Avenue, Baldwin Park, CA 91706.
Said Special Meeting shall be for the purpose of conducting business in accordance with

Staff recommends that Council waive further reading, read by title only and adopt

D. REORGANIZATION OF THE CITY COUNCIL - SELECTION OF MAYOR PRO
TEMPORE
Staff recommends that the City Council complete the reorganization of the City Council,
and follow the procedure as suggested for the selection of Mayor Pro Tempore as
follows:
1) The City Clerk opens the nominations for the office of Mayor Pro Tempore. Any
Councilmember may nominate and no second to the nomination is required;
2) After receiving all nominations, the City Clerk closes the nominations;

3) The City Clerk then conducts the election of the Mayor Pro Tempore by roll call
vote. If there is more than one nomination, a roll call vote is conducted in the order
in which nominations are received until a Mayor Pro Tempore is elected by majority
vote.

3. APPROVE THE APPLICATION FOR GRANT FUNDS FOR THE WATER QUALITY,
SUPPLY AND INFRASTRUCTURE IMPROVEMENT ACT OF 2014 (PROPOSITION 1),
FOR THE WALNUT CREEK NATURE PARK RESTORATION PROJECT
Staff recommends that Council approve and adopt Resolution No. 2015-103, entitled "A
Resolution of the City Council of the City of Baldwin Park Approving the Application for
Grant Funds for the Water Quality, Supply and Infrastructure Improvement Act Of 2014
(Proposition 1), for the Walnut Creek Nature Park Restoration Project."

SUMMARY
This report is to request adoption of the Resolution certifying the results of the General Municipal
Election held on November 3, 2015.
FISCAL IMPACT
There is no fiscal impact associated with this Resolution.
RECOMMENDATION
Staff recommends that Council:
1) Waive further reading, read by title only and adopt Resolution No. 2015-101 entitled, "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, RECITING
THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD NOVEMBER 3, 2015, AND
DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS PROVIDED
BY LAW."
LEGAL REVIEW
This report and the associated Resolution has been reviewed and approved by the City Attorney as to
legal form and content.
BACKGROUND
On November 3, 2015, a General Municipal Election was held (in consolidation with the Los Angeles
County Uniform District Election). The offices voted upon were the office of Mayor and two
positions for the office of City Councilmember.
As authorized and requested by Resolution No. 2015-069, a count of all ballots cast in Baldwin Park
was made at the office of the Los Angeles County Registrar-Recorder/County Clerk, in Norwalk,
California, on November 3, 2015. Upon completion, the Final Official Statement of Votes Cast and
Canvass of the Votes Cast was prepared and issued with a Certificate of Election. The Certificate of
Election issued by the Los Angeles County Registrar-Recorder/County Clerk is included as
Attachment "A" to Resolution 2015-101.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, RECITING THE FACT OF THE GENERAL
MUNICIPAL ELECTION HELD NOVEMBER 3, 2015, AND
DECLARING THE RESULTS THEREOF, AND SUCH OTHER
MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of
Baldwin Park, California, on Tuesday, November 3, 2015, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided
by law; that voting precincts were properly established; that election officers were appointed
and that in all respects the election was held and conducted and the votes were cast,
received and canvassed and the returns made and declared in time, form and manner as
required by the provisions of the Elections Code of the State of California for the holding of
elections in General Law cities; and
WHEREAS, the County Election's Department canvassed the returns of the election
and has certified the results to this City Council, the results are received, attached and
made a part hereof as "Exhibit A."
NOW, THEREFORE, THE CITY COUNCIL OF BALDWIN PARK, CALIFORNIA,
DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the whole number of ballots cast in the precincts including
provisional ballots was 2691.
That the whole number of absent voter ballots cast in the City was 1577 making a
total of 4269 ballots cast in the City.
SECTION 2. That the names of the persons voted for at the election are as follows:

Monica Garcia and Ricardo Pacheco were elected as Members of the City
Council for the full term of four years;
SECTION 5. That the City Clerk shall enter on the official records of the City Council
of the City, a statement of the result of the election showing: 1) The whole number of ballots
cast in the City; 2) The names of the persons voted for; 3) For what office each person was
voted for 4) The number of votes given at each precinct to each person; and 5) the total
number of votes given to each person.
SECTION 6. That the City Clerk shall immediately make and deliver to each of the
persons so elected a Certificate of Election signed by the City Clerk and authenticated and
that each person elected shall have administered to him/her, an Oath of Office prescribed in
the Constitution of the State of California and shall have them subscribe to it and file it in the
office of the City Clerk. Each and all of the persons so elected shall then be inducted into
the respective office to which they have been elected.
SECTION 7. That the City clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

SUBJECT: REORGANIZATION OF THE CITY COUNCIL — SELECTION OF
MAYOR PRO TEMPORE
SUMMARY
The purpose of this report is to complete the reorganization of the City Council with the selection of a new
Mayor Pro Tempore as spelled out in the Baldwin Park Municipal Code.
FISCAL IMPACT
There is no fiscal impact associated with this item.
RECOMMENDATION
Staff recommends City Council complete the reorganization of the City Council and follow procedures as
suggested for the selection of Mayor Pro Tempore as follows:
1) The City Clerk opens the nominations for the office of Mayor Pro Tempore. Any Councilmember
may nominate and no second to the nomination is required;
2) After receiving nominations, the City Clerk closes the nominations;
3) The City Clerk then conducts the election of the Mayor Pro Tempore by roll call vote. If there is
more than one nomination, a roll call vote is conducted in the order in which nominations are
received until a Mayor Pro Tempore is elected by majority vote.
BACKGROUND
In accordance with Ordinance No. 1249, which established section 30.02 it is appropriate at this time to
reorganize the City Council and select one of its members as Mayor Pro Tempore, Attachment 1 shows the
recent rotation of Mayor Pro Tem.
§ 30.02 COUNCIL REORGANIZATION.
The Council shall reorganize and select one of its members as Mayor Pro Tempore, on the following
occasions:
(A) In odd -numbered years at the Council meeting at which the canvass of the results of the general
municipal election are declared.
(B) In even -numbered years at the first regular meeting conducted in the month of December.
(C) At such other times as a majority of the City Council shall order.

Government Code. Staff has reviewed the requests for expenditures for the appropriate budgetary approval and
for the authorization from the department head or its designee. Pursuant to Section 37208 of the California
Government Code, the Chief Executive Officer or his/her designee hoes hereby certify to the accuracy of the
demands hereinafter referred. Payments released since the previous City Council meeting and the following is a
summary of the payment released:
1. The payroll of the City of Baldwin Park consisting of check numbers 197562 to 197596. Additionally,
Automated Clearing House (ACH) Payroll deposits were made on behalf of City Employees from
control number 245202 to 245520 for the period of October 25, 2015 through November 07, 2015,
inclusive; these are presented and hereby ratified in the amount of $554,309.40.
2. General Warrants, including check numbers 207545 to 207651, in the total amount of $594,753.62

Presentation of center median landscape design for discussion and selection,
Lacey Withers and Desiree Harboro, representing Withers and Sandgren, provided a
PowerPoint presentation to review various types of trees and vegetation available for the
landscape median project; answered questions and offered suggestions to Council.
After reviewing the options and plant palettes, Council requested that the consultant take
the notes and comments of Council and return with a narrowed palette of plants for final
selection.

Mayor Lozano stated that no reportable action was taken on items discussed during Closed

ANNOUNCEMENTS
Mayor Lozano announced, as required by Government Code section 54954.3, that members of
the City Council are also members of the Board of Directors of the Housing Authority and
Finance Authority, which are concurrently convening with the City Council this evening and each
Council Member is paid an additional stipend of $30 for attending the Housing Authority meeting
and $50 for attending the Finance Authority meeting.
Mayor Lozano asked that the meeting be closed in memory of Nohemi Gonzalez, a student of
California State University at Long Beach, who grew up in EI Monte; noted that she was one of
the 120 people killed in the terrorist attack in Paris, France, on November 13, 2015.
Mayor Pro Tem Baca asked for a moment of silence to recognize the mourning of all those lost
and the loved ones affected by the horrible attack in Paris.
Mayor Pro Tem Baca recognized the Cross Country teams of Baldwin Park High School and
Sierra Vista High School for making the semi-finals and to Baldwin Park Boys Cross Country
team who will be competing in the CIF finals.
Councilmember Rubio extended her appreciation to the Recreation and Community Services
staff for the wonderful Veterans Day event; mentioned that there was an incident with one of the
sky divers and asked Recreation and Community Services Director Manuel Carrillo about the
gentleman who suffered a rough landing.
PROCLAMATIONS COMMENDATIONS & PRESENTATIONS
• Presentation by Kenn Fujioka and Paul Novak, for the San Gabriel Valley Vector Control
District
Kenn Fujiko and Paul Novak, from San Gabriel Valley Vector Control District, narrated a
PowerPoint and then answered questions from Council
Discussion included the impact of the increase in property taxes on residents and
whether the decision to join the District should be taken on a ballot measure.
• Presentation by Steven Sheridan, Los Angeles County Public Works, on the Anticipated
Effect of EI Nino
Steven Sheridan, Los Angeles County Public Works, narrated a PowerPoint
presentation and provided informational pamphlets; noted that emergency preparedness
is essential and that education of the community is important.
• Presentation by Lou Ortega, Pharmacy Director, and Reyna Del Haro, Public Affairs
Director, of Kaiser Permanente on National Drug Take Back Day
Lou Ortega, Pharmacy Director for Kaiser Permanente, narrated a PowerPoint
presentation and noted that this year's event took in over 800 pounds of drugs and
medications.
PUBLIC COMMUNICATIONS
Mayor Lozano opened Public Communications at 8:03 p.m. and noted that each speaker is
permitted a total of three (3) minutes to speak.

section of the Finance and Housing Authority meetings; noted that Council should not be
conducting the meetings so hastily and should allow time for speakers to approach if they wish
to address Council.
Elizabeth Valgvi ,,y, Baldwin Park Resident, asked how she could find out the times and dates
that police patrols are done in her neighborhood.
Hau Lee, Baldwin Park Resident, spoke regarding the mosquito infestation earlier this year and
how it kept him and his family from enjoying their home; stated that his children and
grandchildren no longer come to visit; expressed support for the decision to join the Vector
Control District or address the issue some other way.

2. Authorizing the Finance Director to complete a budget amendment for an amount not
to exceed $15,223.52 from Account 206-30-320-58110-00000-2 and designate
$15,223.552 for restricted purchase of the 9-1-1 system upgrades ($125,819.58 to
be reimbursed by the State); and
3. Authorizing the Chief of Police, or his designee, to complete all appropriate
documentation to complete the modernization.

6. MEMORANDUM OF UNDERSTANDING FOR THE 2016 GREATER LOS ANGELES
HOMELESS COUNT OPT -IN PROGRAM
Staff recommends that Council approve and authorize the Mayor to enter into an MOU
with the Los Angeles Homeless Services Authority.
Councilmember Rubio began discussion by inquiring as to whether there was anyone
present that is representing the Program; noting that there was not, Director Carrillo
responded to questions from the Councilmember.
Councilmember Rubio asked about the Memorandum of Understanding (MOU) that is
associated with this item and whether the City has the resources to meet the obligations
of the agreement.
Director Carrillo stated that it would be best for a representative to explain and respond
to questions, and suggested that the item be tabled to allow time to bring in such a
representative.

Staff and the Planning Commission recommend that, following the public hearing, the

A. Resolution 2015-098 entitled "A Resolution of the City Council of the City of Baldwin
Park Adopting the Findings of Fact and Approving a Transit -Oriented Development
Specific Plan for the Downtown Baldwin Park Area (Location: the Central Business
District Area Generally Bounded by La Rica Avenue to the west, Clark Street to the
north, Park -N -Ride Lot to the east and Downing Avenue to the south, including the
Metrolink Rail Station. Applicant: City of Baldwin Park; Case Number: Specific Plan
15-01 (SP 15-01); and
B. Resolution 2015-099 entitled "A Resolution of the City Council of the City of Baldwin
Park Certifying the Environmental Impact Report for the Proposed Downtown
Transit -Oriented Specific Plan as Adequate and Complete and Adopting a Statement
of Findings of Fact in Support Thereof, a Statement of Overriding Considerations and
Mitigation Monitoring Program (Location: the Central Business District Area
Generally Bounded by La Rica Avenue to the west, Clark Street to the north, Park -N -
Ride Lot to the east and Downing Avenue to the south, including the Metrolink Rail
Station. Applicant: City Of Baldwin Park; Case Number: Specific Plan 15-01 (SP
15-01).
A motion was made by Pacheco, seconded by Lozano, and carried (5 — 0) to
postpone this item and bring it back at a future meeting.

Staff recommends that Council review the submitted Student Commission application(s),
accept nomination(s), appoint the selected individual(s) to the Parks and Community
Services Commission and, following the appointment, adopt Resolution No. 2015-090,
entitled, "A Resolution of the City Council of the City of Baldwin Park Appointing
Qualified Students From Three Baldwin Park High Schools To The Recreation &
Community Services Commission Of The City Of Baldwin Park To Office Numbers 6, 7
And 8."
Mayor Lozano noted that two students, Anthony Grijalva and Madeline Gutierrez, were
present and asked them to stand and be recognized. No other students were present at
the meeting.
A motion was made by Lozano, seconded by Rubio, and carried (5 — 0) to
appoint Madeline Gutierrez, student from Baldwin Park High School, to Office #7,
and Anthony Grijalva, student from North Park High School, to Office #8.

WATER QUALITY, SUPPLY AND INFRASTRUCTURE
IMPROVEMENT ACT OF 2014 (PROPOSITION 1), FOR THE
WALNUT CREEK NATURE PARK RESTORATION PROJECT
SUMMARY
The purpose of this staff report is for the City Council to consider applying for a grant and adopting Resolution
No. 2015-103 to make improvements at Walnut Creek Nature Park (WCNP).
FISCAL IMPACT
There is no impact on the General Fund.
RECOMMENDATION
Staff recommends the City Council:
1) Waive further reading, read by title only and adopt Resolution No. 2015-103 entitled "RESOLUTION
OF CITY COUNCIL OF THE BALDWIN PARK CITY COUNCIL APPROVING THE
APPLICATION FUNDS FOR THE WATER QUALITY, SUPPLY AND INFRASTRUCTURE
IMPROVEMENT ACT OF 2014 (PROPOSITION 1), FOR THE WALNUT CREEK NATURE
PARK RESTORATION PROJECT"; and
2) Authorize the Director of Recreation and Community Services to execute any further documents.

BACKGROUND
In late 2012, staff began to have a series of discussions of local stakeholders to identify potential funding
opportunities. After several letters to the San Gabriel & Lower Los Angeles Rivers and Mountains Conservancy
(RMC), they agreed to provide a small planning grant to develop a conceptual design for WCNP. On September
23, 2013, the RMC Governing Board approved a $35,000 planning and design grant for WCNP. This grant
provided the City money to hire Restoration Design Group, an architectural firm to develop a conceptual design
for the park. In October 2013, the City received $200,000 from the Los Angeles County Regional Park and Open
Space District and $220,000 from the California Natural Resources Agency to implement the first construction
phase of the project. Phase I construction bids are scheduled to open on Thursday, December 10 at loam.
Construction is expected start late January 2016.
Phase II includes funding from the Los Angeles County Regional Open Space District in the amount of
$308,446.24, scope of work consist of irrigation, landscaping, and playground apparatus. Additionally a $480,000
grant was received from the National Park Service, scope of work includes; renovation of observation structure,
restrooms and American Disability Act (ADA) accessible parking stalls as well as numerous improvements.

Walnut Creek Nature Park Grant
This grant application will request funding to make the following improvements; expand parking lot, create
ADA pedestrian access entrance to park, complete north walking path, add distance markers along path, provide
north Hensel Street access gate and complete landscaping as well as irrigation. This grant does not require any
matching funds.

RESOLUTION OF CITY COUNCIL OF THE CITY OF
BALDWIN PARK APPROVING THE APPLICATION
FOR GRANT FUNDS FOR THE WATER QUALITY,
SUPPLY AND INFRASTRUCTURE IMPROVEMENT
ACT OF 2014 (PROPOSITION 1), FOR THE WALNUT
CREEK NATURE PARK RESTORATION PROJECT
WHEREAS, The people of the State of California have enacted the Water
Quality, Supply and Infrastructure Improvement Act of 2014 (Proposition 1), which
provides funds for the San Gabriel and Lower Los Angeles Rivers and Mountains
Conservancy (RMC) Grant Program; and
WHEREAS, The RMC has been delegated the responsibility for the
administration of the grant program in its jurisdiction, setting up necessary
procedures; and
WHEREAS, said procedures established by the RMC require the Applicant's
Governing Body to certify by resolution the approval of the Application before
submission of said Application to the State; and
WHEREAS, the Applicant will enter into a contract with the State of California
for the Walnut Creek Nature Park Restoration Project;
NOW, THEREFORE, BE IT RESOLVED THAT THE BALDWIN PARK CITY
COUNCIL HEREBY:
1. Approves the filing of an Application for local assistance funds from the RMC
Proposition 1 Grant Program for the Walnut Creek Nature Park Restoration
Project under the Water Quality, Supply and Infrastructure Improvement Act
of 2014 (Proposition 1); and
2. Certifies that the Walnut Creek Nature Park Restoration Project is consistent
with local or regional land use plans or Programs (or if it is not, that the
project is still approved); and
3. Certifies that the Project is consistent with the goals of Proposition 1 including
multi -beneficial and multi -jurisdictional ecosystem and watershed protection
projects in accordance with statewide priorities; and
4. Certifies that the Application has or will have sufficient funds to operate and
maintain the Project that is being submitted for funding consideration; and
5. Certifies that the Applicant has reviewed and understands the General
Requirements and General Policies of the RMC Proposition 1 Grant Program
Guidelines; and

6. Appoints the Director of Recreation and Community Services, or designee, as
agent to conduct all negotiations, execute and submit all documents
including, but not limited to applications, agreements, payment requests and
so on, which may be necessary for the completion of the aforementioned
project.
This resolution shall take effect immediately upon its adoption by the City Council,
and the City Clerk shall certify the vote adopting this resolution.

City of Baldwin Park at this meeting of December 2, 2015 by the following vote.
