There were no objections and the motion carried by the following vote: AYES: COUNCILMAN HOLMES, BISHOP., LITTLEJOHN, WILSON AND MAYOR COLE NOES: NONE ABSENT: NONE 00- City Clerk Balkus gave the oath to members of the audience who wished to speak at this meeting. 00- Mr. Jackson R. Baker, 13429 East Benbow, Baldwin Park, spoke to the Council. Mr. Baker, owner of the Billiard Parlor in Baldwin Park, requested that the ordinance be amended and the age limit be lowered from 21 to 16, so that minors can enter his place of business. Mr. Baker said the ordinance now pro- hibited anyone under 21 from patronizing the establishment even though they were accompanied by an adult, and this stipulation had impaired his business. Chief of Police Torres reported that the pool hall had never caused the Police Department any concern. Discussion followed. Councilman Holmes moved that Council give consideration to studying a possible amendment to the ordinance as it now affects pool halls and billiard parlors. Councilman Little- john seconded. There were no objections and the motion carried unanimously and was so ordered by Mayor Cole. 00- With reference to the Salvation Army's request for a license, with the fee waived, to operate a Thrift Store at 14411 Ramona Boulevard for the sale of repossessed articles of clothing, furniture and utensils, Chief Administrative Officer Asmus reported that the Salvation Army had decided to pay for their license and not apply for an exemption or refund this year; however, they would request an exemption next year. Continued) BIB] 39589-U01 1958-U02 12-U02 29-U02 CC-U02 MIN-U02 LI1-U03 FO117121-U03 FO117284-U03 DO117319-U03 C4-U03 MINUTES1-U03 5/15/2008-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 CLERK-U06 1958 12 29 CC MINHÄ—@¸—>ƒÍ«308 Adjourned/Regular Meeting of the Baldwin Park City Council in response to Council's request at the-last meeting, City Attorney Gorlick explained the interpretation of the words local institution or organizations" as used in the Baldwin Park Municipal Code.- He advised that the ordinance should be given a liberal interpretation to exempt both the insti- tution or organization that is local because of Its location within the City, and the organization that is local because of its service to the people within the City. Mr. Gorlick further stated that under this interpretation the Salvation Army would appear to qualify as an organization entitled to the exemption, and if Council desired a more restrictive or different inter- pretation, the ordinance should be amended to clearly state the connotation Intended. Discussion followed; however, no further action was considered. With reference to the reapproval of Area D Defense Contract listed on the agenda, Chief Administrative Officer Asmus re- quested that the matter be held over until the January 5th meeting as he had not had an opportunity to-prepare a summary of the changes to be made. 00- Councilman Bishop moved that Item 1, Reports of Officers and Commissions, on the agenda'be taken under discussion at this time. Councilman Wilson seconded. There were no objections and the motion carried unanimously and was so ordered by Mayor Cole. 00- Councilman Holmes reported on the Upper San Gabriel Valley Water Association Fund Raising Campaign and explained the fund they are raising is to impart information and set the ground work for an election to be held throughout the upper San Gabriel Valley which will have to be held within the cities to decide if a municipal water district should be formed. After a municipal water district Is formed, an over- all public agency will be in existence and in a position to take further steps to purchase water from outside sources. Mr. Holmes stressed the seriousness of the water situation and that it will become the responsibility of all municipali- ties to decide what has to be done. The only agency In a position with additional water, at present, is the Metropolitan Water District, and the Upper San Gabriel Valley Basin is the only area not In the district. All the extra water Metropolitan Water District has will be spoken for and allocated by 1970 perhaps sooner. Thereafter supplies will have to be brought in which is the subject of the plan. On that basis", Mr. Holmes concluded, it-is urgent that Baldwin Park comply with the Chairman of the Financial Committee for the area and give due consideration to donating funds for the purpose". Councilman Littlejohn reported he had received a letter listing the cities and various industries who had donated to this fund and that he would bring the letter at the next meeting. He stated that, generally, public funds. gifts of municipal funds are prohibited and there is no authority anywhere in the statutes granting general law cities the power to expend money for school purposes, therefore, he ruled against the validity of the requested donation. A tabulation of the bids received on police cars was presented Bid for five to Council prior to the meeting. Chief Administrative Officer police cars Asmus stated that the bids were received and opened in the awarded to Council Chambers on December 23, 1958. This was done in the presence of several company representatives as well as Chief of Police Torres, Assistant Chief Administrative Officer Willardson, City Clerk Backus and Chief Administrative Officer Asmus. Mr. Asmus submitted the bids for inspection by the Council and City Attorney Gorlick, and recommended that Council accept the bid of J. V. Baldwin Motor Company who offered the low bid for five regular police unit Chevrolets in the amount of $11,509.11. Discussion followed concerning when the bids were advertised, the legality, according to the municipal code, of submitting the specifications and opening bids outside of a Council meeting.. Councilman Holmes called attention to a discrepancy In the tabu- lation sheet and moved that since there were errors in the figures that all the bids be rejected and new bids called for. Councilman Bishop seconded. Chief, Administrative Officer Asmus explained that the figures were taken directly from the proposals and were accurate and the only error was in the guide notation which should have read **Total cost, excluding Sales Tax" instead of **Total cost, including Sales Tax." Discussion continued concerning the specifications required; the time element regarding the contract and the legality of the bids. City Attorney Gorlick verified the legality of the procedure as there are no statutory requirements covering this particular purchase. City Attorney Gorlick examined the bids and Informed council the amounts shown on the bids were the same as those shown on the tabu- lation sheet; however, he did not find a bid bond for Bid No. 9 and Bid No. 10 listed on the sheet. Chief Administrative City's Group Officer Asmus explained the benefits offered by Intercoast Mutual Insurance for Life Insurance Company and read a letter from Assistant Chief Employees Administrative Officer. Willardson who, after reviewing and con- awarded to sidering the twenty-two proposals received, recommended that the Intercoast proposal be granted to Intercoast Mutual Life Insurance Company. Mutual Life Ins. Co. Mr. Seymour Lichtman, 3739 North Ardilla, local agent for Inter- coast Mutual Life Insurance Company, explained the various bene- fits and provisions of the policy his company offered, and answered questions during Council's discussion. Councilman Wilson made a motion to accept the recommendation of the Chief Administrative Officer to accept the bid proposal of Intercoast Mutual Life Insurance Company for a group health and hospitalization plan for the employees of the City of Baldwin Park. Councilman Littlejohn seconded. There were no objections and the motion carried by the following vote: AYES: COUNCILMAN WILSON, LITTLEJOHN, BISHOP, HOLMES AND MAYOR COLE NOES: NONE ABSENT: NONE Chief Administrative Officer Informed the Council that this Group Insurance plan would have to be In effect by January I, 1959 so there would be no lack of coverage and therefore requested authori- zation to execute the necessary contract, and a warrant in the amount of $100.00 to bind the proposal. Councilman Holmes moved that the Chief Administrator be authorized to execute the contract and prepare a warrant In the amount of $100.00. Councilman Bishop seconded. There were no objections and the motion carried unanimously and was so ordered by Mayor Cole. 00- City Engineer Young reported on Palmrose Street at present a 50 ft. private street) and that on one of the lot splits In the middle of the block the Planning Commission recommended a 30 ft. street dedication. This will leave a street 40 ft., from curb to curb, with a 10 ft. parkway. Mr. Young explained that where the library is located the curb is set at 18 ft. from the center I-ine, making a 36 ft. street at that point and with a 7 ft. side- walk there would not be much chance to widen the street there. Apartments have been built across from the parking lot and the owner is anxious to get a final inspection and to install curbs and gutters. Discussion followed. Councilman Littlejohn moved that a minimum of 40 ft. from curb to curb be set with a 10 ft. parkway and sidewalks making a 60 ft. street. Councilman Holmes seconded. There were no objections and the motion carried unani mously and was so ordered by Mayor Cole. 00- City Engineer Young. presented a map of Borel Street and explained that the original intent of the County map was that 30. ft. be taken off the east side of the street, and the school give another 30 ft. up toward Nubia. The school gave the 30 ft. and that was improved, however, the easterly half of the street has not been improved. Last May the Planning Commission recommended the alignment shown on this map, taking 12 ft. off the west side and 10 ft. off the east side and warping it in a curve to the existing 30 ft. right Palmrose St. curb and gutter grades set. Additional 15 ft. to be requested to establish a 40 ft. street from curb to curb on Borel Street. This would constitute an alignment change on the street. Discussion followed and it was the consensus of opinion that, If possible, 15 ft. additional dedication should be requested in order to establish a 40 ft. street.width from curb to curb. 00- City Engineer Young presented a resolution.for the Mayor's signa- ture. Councilman Holmes moved that RESOLUTION NO. 58-148 be adopted. Councilman Bishop seconded.
