A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK APPROVING AND ADOPTING THE
MITIGATED NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT FOR A GENERAL PLAN
AMENDMENT, A ZONE CHANGE, A SPECIFIC PLAN TO
FACILITATE THE DEVELOPMENT OF A 47-UNIT SINGLE-
FAMILY DETACHED GATED CONDOMINIUM PROJECT,
AND FOR A TENTATIVE TRACT MAP. (LOCATION: 14837-
14839 PACIFIC AVENUE; ASSESSOR'S PARCEL
NUMBERS: 8438-015-037, -043, -047, -059, -065
THROUGH -103, -060, -061, -062, -105; APPLICANT: CAL
33 PARTNERS, LLC; CASE NUMBERS: AGP-118, Z-555,
TM-73354, AND SP 16-01)
WHEREAS, in connection with the proposed general plan amendment,
zone change, specific plan, and tentative tract map was prepared on behalf of the
Planning Division, a Mitigated Negative Declaration of Environmental Impact, pursuant
to the California Environmental Quality Act (CEQA).
WHEREAS, the Mitigated Negative Declaration, which is attached hereto
as Exhibit A and incorporated herein as if fully set forth, was made available for public
review and comment pursuant to law.
WHEREAS, the Mitigated Negative Declaration has been prepared
incorporating any comments received during the review period and any responses to
those comments.
WHEREAS, the City Council has read and considered the Mitigated
Negative Declaration.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN
PARK DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find, determine and declare
that:
a) An Initial Study and Mitigated Negative Declaration of
Environmental Impact were prepared for the Project in accordance with
the provisions of the California Environmental Quality Act (CEQA) and the
State CEQA Guidelines.
b) The Initial Study and Negative Declaration were made
available to the public for review and comment from August 18, 2016 to
September 8, 2016 as required by law.

c) A properly noticed public hearing was held by the Planning
Commission of the City of Baldwin Park on September 28, 2016, October
26, 2016, and November 9, 2016, at which time evidence was heard on
the Initial Study and Mitigated Negative Declaration. At the hearing, the
Planning Commission fully reviewed and carefully considered that
evidence and the Planning Commission recommended approval of the
mitigated negative declaration for the Project.
d) A properly noticed public hearing was held by the City
Council of the City of Baldwin Park on December 21 2016, at which time
evidence was heard on the Initial Study and Mitigated Negative
Declaration. At the hearing, the City Council fully reviewed and carefully
considered them, together with any comments received during the public
review period.
SECTION 2. The City Council reviewed and considered the Mitigated
Negative Declaration of Environmental Impact and determined the Project will not have a
significant impact on the environment. The Mitigated Negative Declaration of
Environmental Impact is therefore hereby approved.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution
and forward a copy hereof to the Secretary of the Planning Commission.
