Councilman Littlejohn lead the salute to the flag. The Invocation was to have been given by Reverend Gerald 0. Pedersen of the Ascension Lutheran Church, however, due to un- foreseen circumstances, he was unable to attend. 00- Roll Call: Present: COUNCILMAN BISHOP, LITTLEJOHN, WILSON AND MAYOR COLE Absent: COUNCILMAN HOLMES AND CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY GORLICK, CITY ENGINEER YOUNG AND CITY CLERK BALKUS Councilman Littlejohn moved that Councilman Holmes' absence be noted and excused due to sickness. Councilman Bishop seconded. There were no objections and the motion carried unanimously and was so ordered by Mayor Cole. 00- The Minutes of the Regular Meeting of the Baldwin Park City Council on January 19, 1959 were presented prior to the meeting. A correction was noted on Page 9, Division 3 Zone Change No. 51). The vote on this Issue was four to one instead of unanimous Councilman Holmes voted no". Various rephrasings suggested by City Attorney Gorlick were also noted as follows: Page 3, Division I, L.S. No. 157). The motion to read in part, Mr. Hess to sign an agreement'" instead of affidavit'. Page 4, Division 3, Elected Officials in Group Insurance) This will not affect those whose term has not expired when this ordinance takes effect". Page II, Division I, Subdivision Ordinance) to read in part, Furthermore, a tentative map is final under the Planning Commission and does not go to Council for approval. A final map goes only to Council for approval". Councilman Littlejohn moved that the Minutes of January 19, 1959 be approved as corrected and further reading waived. Councilman Wilson seconded. Stephens, beloved resident and citizen of Baldwin Park, has recently re- tired from public service after serving with distinction as-an elected member of the City Council and former Member of the Planning Commission; and WHEREAS, he played an important role in the acquisition of the City Hall and completion of the Big Dalton Flood Control Project; and WHEREAS, he has been a highly respected leader in community affairs, having been Instrumental in organizing the Associated Farm Bureau Members of Baldwin Park and having served the youth of this community by his work in the Little League and other community recreation programs, and by his work in reinstating the 4-H Club and liaison activities with the Baldwin Park School District; and WHEREAS, he has. contributed immeasurably to the growth and development of the City during its early difficult years; and WHEREAS, the City desires to publicly recognize and express its sincere appreciation and grati- tude for his outstanding citizenship and con- structive contributions to the community, NOW, THEREFORE, the City Council of the City of Baldwin Park does resolve.that Edward B. Stephens be, and he hereby is, commended for his devotion and service to the City of Baldwin Park. BE IT FURTHER RESOLVED that he be given a parch- ment copy of this resolution as a token of the City's heartfelt gratitude for the fine example of citizenship he has set for the community.. Councilman Littlejohn seconded the motion. There were no objections and the motion carried by the following vote: AYES: MAYOR COLE, COUNCILMAN LITTLEJOHN, BISHOP AND WILSON NOES: NONE ABSENT: COUNCILMAN HOLMES Mr. Bonnivier stepped forward and City Clerk Balkus gave the Oath of Office. City Clerk Balkus explained a request by Mr. Sam Gurfinkel, 4324 Walnut Street, Baldwin Park, to address the Council regarding a complaint made to the Planning Department by a neighbor living next door, regarding a fence which exceeds the maximum height allowable under the Municipal Code. The Code provides that no fence shall exceed the height of 42" within the 20-foot setback area required in the particular zone in which Mr. Gurfinkel's property is located. The Planning Department formally notified Mr. Gurfinkel of the violation and gave him thirty 301. days in which to reduce the height of the woven wood fence. City Clerk Balkus stated she had given Mr. Gurfinkel copies of the ordinance, however, Mr. Gurfinkel said he would be unable to attend the meeting as planned, but would like to present his story to the next City Council Meeting. Discussion followed. Councilman Bishop said the man was in violation and could see no reason to take up his time or the Council's time and he therefore moved that Mr. Gurfinkel be required to comply with the zoning ordinance. The motion died for the lack of a second and no further action was taken. City Clerk Balkus read a letter from Mr. E. R. Evans, request- ing waiver of curb, gutter and sidewalks at 4422 Center Street. Mrs. Balkus also read a letter from Chief Administrative Officer Asmus stating the owners of the property have not, as yet, taken out a building permit at this location and, according to the City Engineer, the property does not present any unique engineer- ing problem; therefore, it was his recommendation that the re- quest for waiver be denied. Councilman Bishop moved that Council concur with the recommenda- tion of the Chief Administrative Officer and deny the request. Councilman Wilson seconded. Mayor Cote asked that all members of the audience who wished to testify at any time during the meeting, stand and take the oath. City Clerk Balkus gave the oath. City Clerk Backus read a letter from Mr. 0. D. Stalians who had made an application for a taxicab operator's license. City Clerk Balkus also read a letter from Chief of Police Torres, stating that Mr. Stalians had been thoroughly in- vestigated and there did not appear to be any derogatory information which would warrant an objection being inter- posed, therefore, he recommended that a license be granted to Mr. Stalians. Mr. Tom Colwick, 3438 North Maine, owner of the Baldwin Park Taxicab Company, spoke in behalf of Mr. Stalians. No one expressed a desire to speak in opposition and Mayor Cole declared the hearing closed. Considerable discussion followed and Mr. Stalians answered question asked by the Council. Mr. John Rouse, Past President of American Taxicab Association, 127 West B" Street, Wilmington, spoke in Mr. Stolian's behalf and explained other cities methods of operation in relation to taxicab licenses, revenues, etc. Councilman Littlejohn moved that the matter be tabled until Council could meet with Mr. Stalians and his representatives in a special study session in order to obtain more information before making a decision. Councilman Wilson seconded. There were no objections, the motion carried unanimously and was so ordered by Mayor Cole. Councilman Bishop seconded. There were no objections, the motion carried unanimously and was so ordered by Mayor Cole. City Clerk Balkus read a letter from Warren A. Scott of Scottcliff Homes, regarding Tentative Tract No. 24769, appealing the denial by the Planning Commission on January 15, 1959. A second letter from Mr. Scott was read stating that, under Section 11553 of the.State Planning Act, action must be taken withi.n.forty 40) days after filing. The letter stated that forty-five 45) days had elapsed; therefore, the map should be approved by default. City Attorney Gorlick informed the Council that under the present ordinance the Regional County Planning Commission Is the advisory agency and since the map was not filed with the agency specified by the ordinance, there Is no case for a de- fault. Mr. Gorlick stated he had an amendment to the sub- division ordinance prepared to present to Council making the- City's Planning Commission the advisory agency. Chief Administrative Officer Asmus Informed the Council that a meeting was scheduled on Tuesday, February 3, 1959, with Mr. Bousman, Mr. Scott, Acting Planning Director Teater and himself, and that an effort would be made to work out the problem. However, as Indicated by City Attorney Gorlick, the tentative map would have to be resubmitted to the Planning Commission. No further action was required at this time. As authorized at the regular meeting on January 19, 1959, Councilman Littlejohn reported he had attended the Irwindale City Council meeting on Tuesday, January 20, 1959, in refer- ence to Mr. L. G. Mitchell's request to have grades established to set curbs on his property at 15332 Arrow Highway. Councilman Littlejohn said Mr. Johnson, Irwindale City Manager, had not previously discussed the matter with the Irwindale City Council. The City Council requested time to talk over the mutual curb and gutter problem, and stated that the County would inform him how much the grades would cost. The cost would be about $700.00 and that Mr. Johnson had indicated to him that Irwindale would not pay that much money. Discussion followed and it was agreed the matter should be tabled until It was learned whether it was scheduled on the Irwindale City Council Agenda for their February 3, 1959 Meeting. 00- Councilman Bishop reported he had attended the East San Gabriel Planning and Recreation meeting in Azusa on January 29, 1959. Representatives from twelve or fourteen cities also attended. Recreation in our own locality was discussed. The County is out of funds as far as recreation in the county is concerned. Councilman Littlejohn reported he had attended the Upper San Gabriel Valley Water Association meeting on February 2, 1959. To date, $16,000.00 has been raised of their goal of $20,000.00. City Attorney Gorlick presented an amendment to an ordinance requested by Council. City Clerk Balkus read the ordinance in full as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 6106.1 OF THE BALDWIN PARK MUNICIPAL CODE. The City Council of the City of Baldwin Park does ordain as follows: Section 1. That Section 6106.1 of the Baldwin Park Municipal Code is amended to read as follows: 6106.1 EXCLUSION. The crovisions of this chapter shall not apply to the sale of agricultural or poultry products when such products are sold on the premises where they are produced. Section 2. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published or posted in the manner required by law. This ordinance shall take effect thirty days after the date of-its adoption. Mr. Edward Stephens spoke, protesting the adoption of the ordinance just read. Discussion followed. Councilman Littlejohn moved the ordinance be denied. Councilman Bishop seconded. City Clerk Balkus read the ordinance In full as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 9100.638 OF THE BALDWIN PARK MUNICIPAL CODE TO CLARIFY THE NOTICE REQUIREMENTS FOR PUBLIC HEARINGS IN ZONING MATTERS. The City Council of the City of Baldwin Park does ordain as follows: Section 1. That subsection a) of Section 9100.638 of the Baldwin Park Municipal Code is amended to read as follows: a) Cause a copy of a notice of the time and place of such hearing to be published once in a newspaper of general circulation published in the City of Baldwin Park. If there is no newspaper of general circulation published within the City he shall publish such notice in a newspaper of general circulation published in the County and circulated within the City. Section 2. That the City Clerk shall certify to the adoption of this ordinance and cause the same to be published or posted In the manner required by law. This ordinance shall take effect thirty days after the date of its adoption. Councilman Bishop moved that ORDINANCE NO. 103 pass first read- ing. Councilman Wilson seconded. Considerable discussion followed. Councilman Littlejohn said he felt publications would be handled properly by the present personnel and he would vote yes" only on that basis, however, he was not in concurrence with the. wording of the ordinance. The motion carried by the following-vote: AYES: COUNCILMAN BISHOP, WILSON, LITTLEJOHN AND MAYOR COLE NOES: NONE ABSENT: COUNCILMAN HOLMES With reference to license fees and penalties in relation to the ordinance amending Section 6106.1 of the Municipal Code just presented and denied by Council, City Attorney Gorlick stated there was no authority in the ordinance, as It was, to waive the penalty. An emergency amendment to the license ordinance could be adopted to give the Council the power to waive penalties. Considerable discussion followed. City Clerk Balkus read the ordinance in full as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING DEFINITION OF ADVISORY AGENCY AND CITY ENGINEER IN SUBDIVISION REGULATIONS. The City Council of the City of Baldwin Park does ordain as follows: Section 1. That Sections 9200.2 and 9200.8 of the Baldwin Park Municipal Code are amended to read as follows: 9200.2 ADVISORY AGENCY. The Planning Commission of the City of Baldwin Park is hereby designated as the Advisory Agency referred to in the Sub- division Map Act. 9200.8 CITY ENGINEER. City Engineer" shall mean the City Engineer of the City of Baldwin Park. Section 2. That Section 9200.6 of said Municipal Code is repealed. Section 3. That the City Clerk shall certify to the adoption of this ordinance and cause the same to be published or posted'in the manner required by law. This ordinance shall take effect thirty days after. the date of its adoption. Councilman Littlejohn moved that ORDINANCE NO. 104 pass first reading. Councilman Wilson seconded. Councilman Littlejohn moved that City Attorney Gorlick be in- structed to prepare the emergency clause to be added to this by amendment for presentation and adoption at the next meeting. A pre-trial is set in two weeks and Mr.. Gorlick recom- mended that the City continue to retain Cooke and Velpmen as it would not be economical for him to take over the case at this point. Councilman Wilson moved that the City continue to retain Cooke and Velpmen Attorneys to handle the Richards case. Councilman Bishop seconded. There were no objections and the motion carried by the following vote: AYES: COUNCILMAN WILSON, BISHOP, LITTLEJOHN AND MAYOR COLE NOES: NONE ABSENT: COUNCILMAN HOLMES 00- With reference to the McCauley condemnation proceedings, City Attorney Gorlick Informed Council there was a hearing on Friday, January 30, 1959. A hearing set for March 3, 1959 must be re- set to April 1, 1959., Mr. Gorlick stated the McCauley's had approached him and were to meet with him on February 13, 1959 to discuss a settlement. He requested Council's guidance. It was unanimously agreed by the Council that City Attorney Gorlick use his best judgment in negotiating a settlement. 00- City Attorney Gorlick informed Council he had made plans to go to Washington, and expected to return by Thursday, February 5, 1959. 00- Chief Administrative Officer Asmus reported on the Street Pave- ment Hook-up W-58-4) bids opened and read earlier in the meeting and referred to City Engineer Young for. recommendation and report. Mr. Asmus stated that Harvey Construction Company had submitted the lowest bid, however, it was 33% higher than the estimate of City Engineer Young. Discussion followed and it was the consensus of opinion the award of contract should be denied on all bids and the City Engineer should review the specifications and requirements and consider the possibility of reserving some of the street work for the City forces. Councilman Wilson moved that the bids received on Street Pavement Hook-up, W-58-4, be rejected. Coencilman Bishop seconded. There were no objections and the motion carried unanimously and was so ordered by Mayor Cole. 00- Chief Administrative.Officer Asmus presented a resolution authorizing him to seek advance federal money for planning a city-wide sewerage system including trunk lines and laterals. Two bids were re- ceived one from Davis Piping in La Puente for $632.00 and one from Morrow Heating Company of Baldwin Park for $598.00 for complete repair of the system. Mr. Asmus recommended that an allocation of $598.00 be authorized for this work. Councilman Bishop moved that Council concur with the recom- mendation of the Chief Administrative Officer and award the bid to Morrow Heating Co. of Baldwin Park in the amount of $598.00. The bid was awarded to Fred Swanson's Richfield Station, 14336 E. Pacific Avenue at the City Council meeting on January 5, 1959. At that time this quotation represented the low bid. On January 7, 1959 a Rich- field representative informed the Purchasing Agent that due to an increase in posted prices their quotation had to be raised two cents per gallon on each quality of gasoline. Krelle, Assistant Chief Deputy, Los Angeles County Engineer's Office, stated they had no objections if Baldwin Park wished to extend the line. If a request to build by heavy water users is made it will probably be necessary to construct a relief sewer. Mr. Young recommended that the City permit the sewer con- struction and the use be limited to 10 cubic feet per second of domestic sewage only; that when the line is determined that an agfeement be prepared between the City and West Covina relating to the sale of excess sewer capacity and allowing hook-up by adjacent property owners. Discussion followed and it was the consensus of opinion City Engineer Young and Chief Administrative Officer Asmus should study the matter more thoroughly and determine the charges before permission is given to hook-up on the exist- ing sewers. 00- Chief Administrative Officer.Asmus stated there would be a Traffic and Safety Commission meeting on Wednesday, February 4, 1959 for further study and discussion on the Traffic Ordinance.
