At Mayor Cole's request the title was read and COUNCILMAN BISHOP moved that further reading of Ordinance No. 128 be waived. COUNCILMAN WILSON seconded. This would be Annexation #7, and Mr. Asmus was of the opinion that Annexation #6 would have to be completed before this area would be contiguous. Also, this might require a formal legal opinion from the City Attorney and, too, it could not be submitted to the Boundary Commission until Annexation #6 was completed. Mr. Asmus recommended that the whole matter of this annexation be submitted to the Planning Commission for their study and investigation as to the feasibility of annexing this area to the City. COUNCILMAN HOLMES MOVED that the matter of this annexation and this subdivision be referred to the Planning Commission for study in relation to the feasibility of annexation, with the City Attorney to give a legal ramification opinion on it, and the City Engineer to obtain a map of this subdivision and make a study on it and have the matter reported back to this Council in approximately sixty days. COUNCILMAN BISHOP SECONDED. There were no objections, the motion carried unanimously and was so ordered by Mayor Cole. 00- City Clerk Balkus presented a letter from Donald G. Griffin, Attorney at Law, representing Mrs. Marion A. Newsom, 3809 North Monterey Street, Baldwin Park, stating he has been retained to represent her in her claim against the City of Baldwin Park. COUNCILMAN LITTLEJOHN MOVED that this claim be referred to our Insurance agency for processing. COUNCILMAN WILSON SECONDED. There were no objections and the motion carried by the following vote: AYES: COUNCILMAN LITTLEJOHN, WILSON, BISHOP, HOLMES and MAYOR COLE NOES: NONE ABSENT: NONE 00- Mayor Cole announced it was 8:00 P.M. and the time and place set for opening of bids on Project No. W.-59-5, Street Pave- ment Hook-up. Discussion followed. COUNCILMAN HOLMES MOVED that an allocation in the amount of $1,500.00 be made to the Chamber of Commerce for Christmas decorations for the City and that it be taken from the Publicity and Advertising Funds. MOTION died for lack of a second. Further discussion ensued. City Clerk Balkus administered the oath to Mr. Roy C. Hill, 30411 N. Baldwin Park Boulevard, Baldwin Park, Chairman of the Merchants Association of the City of Baldwin Park. Mr. Hill stated that, this year, it was their hope to put in poles on West Ramona, East Ramona and on East Los Angeles Street. Also, although they own part of the decorations that they had last year, they must be cleaned up, rewired and nearly all the bulbs need to be replaced. COUNCILMAN HOLMES MOVED that Council allocate $1,500.00 to the Chamber of Commerce for Christmas decorations and program, and that the allocation be taken from the funds set aside for Advertising and Publicity; and that this program be carried out on the basis as it was outlined to Council last year. There were no objections and the motion carried by the following vote: AYES: COUNCILMAN HOLMES, BISHOP, LITTLEJOHN, WILSON AND MAYOR COLE NOES: NONE ABSENT: NONE Mayor Cole officially appointed Councilman Wilson and Council- man Bishop, as alternate, on the East San Gabriel Vally Planning Committee. Mayor Cole reported that he had attended the East San Gabriel Valley Mayor's Meeting last Wednesday night in Pomona, and that Mayor Ingram of El Monte asked to arrange a meeting for Tuesday, September 29th, for Mayors, City Managers, City Councilmen, Fire Chiefs, City Attorneys and anyone interested who wants to come-Certain problems re- garding Area D" will be discussed. The subject will be Assembly Bill No. 2280, Mutual Aid to the Cities. The meet- ing will take place at-the Dinnerhorn in Covina, at 6:45 P.M. and dinner will be at 7:30 P.M. Mayor Cole stated he had received a letter inviting Council, Past President's City Officials, families and wives to a meeting and dinner of Club Dinner and the Past President's Club to be held at the Dinnerhorn in meeting at the Covina, Thursday, October 8, 1959, at 7:30 P.M. The Honorable Dinnerhorn in Glenn M. Anderson, Lieutenant Governor of the State of California Covina on Thurs- will be the honored guest and speaker. Judge William Martin is day, October 8, Chairman of this event and will forward tickets to Mayor Cole 1959,at 7:30 P.M. for those desiring to attend. Mr. Gorlick stated that if all councilmen are absent from any regular meeting, the City Clerk shall declare the meeting ad journed to a stated day and hour. She shall cause a written notice of the adjournment to be delivered personally to each councilman at least three hours, before the adjourned meeting". However, since the City Clerk will also be absent on October 19th, her deputy should appear and adjourn the meeting to the date and hour of the next regular meeting. 00- City Attorney Gorlick reported that regarding the Igna Case the Plaintiff has until October I, 1959, to amend her com- plaint. 00- Chief Administrative Officer Asmus presented a request for waiver of curb, gutter and sidewalks on a development that is going to be developed on Puente and Francisquito. This request was referred to the City Engineer and he has recom- mended that he agrees with the developer of this property and the engineering frim that is handling It, and that we should accept a bond, preferably a cash bond, in lieu of put- ting in the curb, gutter and sidewalk. Discussion followed. COUNCILMAN LITTLEJOHN MOVED that this matter be referred to the City Attorney for a written opinion as to the proper procedure of bonding and liability of parties in- volved regarding the City putting in curbs and gutters, and that opinion to be returned one week from tonight at the regular adjourned meeting. COUNCILMAN WILSON SECONDED. There were no objections, the motion carried and was so ordered by Mayor Cole. 00- Chief Administrative Officer Asmus presented a request for an allocation of a sum not to exceed $725.00, plus tax, for the purchase of the following Civil Defense equipment: 1. Two 2) Gonset 20 meter communicators. 2. 200 Ft. of Coaxial Cable. 3. 20 Coaxial Cable Fittings. COUNCILMAN WILSON MOVED that Council concur with the recom- mendations.of the Chief. Administrative Officer and approve an allocation in the sum of, and not to exceed, $725.00,-plus tax, for the purchase of Civil Defense equipment. COUNCILMAN HOLMES SECONDED. COUNCILMAN BISHOP MOVED that Council concur with the recom- mendations of the Chief Administrative Officer except that $800.00 be allowed in order to be able to buy a 2 h.p. air compressor, with a sum not to exceed $500.00 allocated from the Police Department Maintenance Budget and a sum not to exceed $300.00 allocated from the Public Works Maintenance Budget. COUNCILMAN HOLMES SECONDED. There were no object- ions and the motion carried by the following vote: AYES: COUNCILMAN BISHOP, HOLMES, LITTLEJOHN, WILSON AND MAYOR COLE NOES: NONE ABSENT: NONE Chief Administrative Officer Asmus requested permission to bring three items which were not listed on the Agenda, be- fore Council. COUNCILMAN BISHOP MOVED that the items be brought on the Agenda. COUNCILMAN WILSON SECONDED. There were no objections, the motion carried and was so ordered by Mayor Cole. The first item to be presented, Chief Administrative Officer Asmus stated, was a matter of zone change case of J. Guy Johnson, Zone Case No. Z-49, which Council adopted by Ordi- nance No. 122 on August 17, 1959. In an application for a building permit that was filed by Mr. Blanchard, one of the parties in the zone change, it was discovered that his en- tire property was not, through an error, included in the zone change. It was Mr. Asmus' recommendation to Council that the Planning Commission be instructed, on their own motion, to process the rear half of Mr. Blanchard's property for R-3 zoning. Chief Administrative Officer Asmus offered Council an ex- planation of the origination of the error and discussion followed. Mr. Albert E. Blanchard, 9428 E. Lemon Avenue, Temple City, California, appeared before Council and stated that, due to financial commitments, he was most anxious to commence con- struction. Mr. Blanchard said he would be agreeable to assume some of the costs involved in order to expedite the matter of rezoning the rear half of his property. Mr. Richard Duncan, 331 N. Chapel, Alhambra, California, Builder, appeared before Council and for Mr. Blanchard to clarify the type of development involved, costs, locations, etc. Further discussion ensued. COUNCILMAN HOLMES MOVED that Council concur with the recom- mendation of the Chief Administrative Officer to instruct the Planning Commission, on their own motion, to start processing the zoning of the balance of this property that was split in error on the original matter and gxpedite the matter as soon as possible, and that applicant would bear 50%, but not to exceed $100.00 of the costs. COUNCILMAN BISHOP SECONDED. Council guidance was re- quested by Mr. Asmus. Discussion followed. COUNCILMAN LITTLEJOHN MOVED that the City Attorney bring back an opinion in writing on the removal of trees in right- of-ways. COUNCILMAN HOLMES SECONDED. There were no object- ions, the motion carried and was so ordered by Mayor Cole. Discussion continued. City Clerk Balkus administered the oath to Mr. Harley Stauffer, 4728 N. Landis, Baldwin Park, California. Mr. Stauffer stated that he has been held up for two weeks waiting for removal of a-tree that has never been on his property. It was his opinion that the tree, lo- cated in the right-of-way at Francisquito and Robinette, was a hazard. There was additional discussion. COUNCILMAN HOLMES MOVED that the tree be removed forth- with by the City of Baldwin Park, and then any further, ramifications or legalities involved could be clarified when City Attorney presents his opinion to Council; and that the final on this particular piece of property be approved if it has met all the necessary requirements otherwise. COUNCILMAN BISHOP SECONDED. There were no objections and the motion carried by the following vote: AYES: COUNCILMAN HOLMES, BISHOP, LITTLEJOHN, WILSON AND MAYOR COLE NOES: NONE ABSENT: NONE Chief Administrative Officer Asmus was instructed to give a list of questions to the City Attorney for his opinion. Councilman LittleJohn suggested that before this tree is removed, a record should be made as to its location, etc., in the event that we should come up against any legalities in the future, then we have something to defend our case with. There should also be some pictures taken of it and dimensions made laying out the exact location, showing it in the dedicated property. Mr. Cameron was going to Sacramento Friday, September 25th and would return on Sunday, September 27, 1959, and he thought he might be able to come back with information from the Attorney General's office. The meeting with Supervisor Bonelli is scheduled for September 30, 1959, at 9:30 a.m., and Mr. Cameron stated that he may attend that meeting with us and Supervisor Bonelli. Councilman Holmes suggested that Mayor Cole and Councilman Littlejohn be our representatives at that meeting. Chief Administrative Officer Asmus Informed Council that the auditors were ready to go over the Annual Audit Report with Council, at Council's convenience. Council set the time of 7:00 p.m., September 28, 1959, which will precede the Ad- journed Regular Meeting. City Clerk Backus presented and read City Engineer Young's report on Project W-59-5, Pavement Hook-ups, which recom- mended that the low bid of American Asphalt Paving Company, 1010 S. Shamrock, Monrovia, in the amount of $5,976.90, be awarded the bid. COUNCILMAN LITTLEJOHN MOVED that the City Council grant to the American Asphalt Paving Company, 1010 S. Shamrock, Monrovia, the AWARD OF BID on Project W-59-5, Pavement Hook-up, in the amount of $5,976.90, as per the recommendations of the City Engineer, and that the proper signatures of the City Officials necessary to sign the con- tract be authorized. COUNCILMAN HOLMES SECONDED. There were no objections and the motion carried by the following vote: AYES: COUNCILMAN LITTLEJOHN, HOLMES, BISHOP, WILSON AND MAYOR COLE NOES: NONE ABSENT: NONE COUNCILMAN LITTLEJOHN MOVED that all other Bid Bonds be returned to their respective bidders. COUNCILMAN WILSON SECONDED. There were no objections, the motion carried and was so ordered by Mayor Cole. In the absence of-City Treasurer Pugh, City Clerk Balkus read the Treasurer's Report as of August 31, 1959. COUNCILMAN LITTLEJOHN MOVED that the Treasurer's Report be received and filed. COUNCILMAN HOLMES SECONDED. There were no objections, the motion carried and was so ordered by-Mayor Cole. Chief Administrative Officer Asmus reported to Council the opinion of City Attorney Gorlick with reference to the bid of Fry and Fry, Inc., being that; the bid of Fry and Fry can be legally acceptable to Council, pro- viding the Council can waive certain minor defects in the bidding process. Inasmuch as the City Attorney had indicated that the bid was a legal bid, the Public Works Director recommended that since Fry and Fry, Inc. are the low bidder, that their bid be accepted and the contract be awarded. COUNCILMAN LITTLEJOHN MOVED that all bids be thrown out and they be put up for bid again, to come in all in the proper manner and within the proper length of time. MOTION DIED for lack of a second. At council's request, City Clerk.Balkus read in full the bid of Fry and Fry, Inc. Discussion ensued. Raymond E. Fry, of Fry and Fry, Inc., 1021 S. Lark Ellen Ave., West Covina, appeared before Council and explained that extras, as shown in his bid, were necessary to make a full and complete job. Questions regarding these extras were answered by Mr. Fry. Discussion continued. COUNCILMAN HOLMES MOVED that the bid of Fry and Fry, Inc. be accepted for the Improvement of the Police Department in the amount of $17,995.00, and that the necessary City Officials be authorized to sign the contract. COUNCILMAN BISHOP SECONDED.
