Pacific Avenue, Baldwin Park, 91706 These minutes are presented in Agenda order. Various announcements or discussions may have occurred before or after the title under which they are presented. CALL TO ORDER The meeting was called to order by Mayor Lozano at 7:10 p.m. INVOCATION The invocation was provided by Pastor Jackson and Pastor Flores. • PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Lozano. ROLL CALL MEMBERS PRESENT: Council Member Cruz Baca Council Member Monica Garcia Council Member Ricardo Pacheco Mayor Pro Tern Susan Rubio Mayor Manuel Lozano REPORT ON CLOSED SESSION Mayor Lozano reported out of Closed Session that Council approved by a vote of 5—0 to select Laura Thomas for appointment as the Human Resources Manager and that the City has chosen to settle the claim of Clench v Baldwin Park in the amount of$5,000. ANNOUNCEMENTS Mayor Lozano extended thanks to the Baldwin Park Police Department, the Baldwin Park Unified School District and other local agencies for the tremendous turn-out at the "National Night Out" event; Mayor Pro Tem Rubio also thanked local businesses and vendors that donated food and beverages as well as donation of backpacks and bicycles for local children in need. • Council members Pacheco and Baca echoed the appreciative sentiments as well and commented on the generosity of the School District and local business owners who donated; Council member Garcia commented on the great work of the Police Department. Council member Garcia noted that she had heard that Father Jonathon [Meyer] would be leaving Baldwin Park and she would like to recognize him in some way for his service in the church and the community; Council member Pacheco concurred and suggested that the Father be recognized at the upcoming Concerts in the Park. PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS • Recognition of the completion of the Baldwin Park Monument located on Baldwin Park Boulevard at the 1-10 Freeway Interim Director Sam Gutierrez introduced Refugio Dominguez from CalTrans District 7, and designers Valerie Hardman and Dave Lewis from Out There Dimensions, to the podium to accept the recognition and narrate a PowerPoint presentation of the various phases of the project. Veronica Lopez, representative for Assembly member Blanca Rubio, also presented a Certificate of Recognition to the City of Baldwin Park in honor of the installation of the Baldwin Park Monument. • Recognition of Assembly member Blanca Rubio and State Grant Funding for Morgan Park and Walnut Creek Park in the amount of$1,17 Million Veronica Lopez, representative for Assembly member Blanca Rubio, accepted from Mayor Lozano a Certificate of Recognition in appreciation of Assembly member Rubio's assistance in securing State grant funds for the Morgan Park and Walnut Creek Park improvements. • Presentation by Michael Chapin, representative of Connor Energy, regarding the Community Energy Choice Aggregation • Michael Chapin, narrated a PowerPoint presentation which provided an overview of how the Community Energy Choice Aggregation is to be structured and what the fee and billing structure is proposed to look like. Following responses to questions from Council, Mr. Chapin agreed to appear before Council again at a Special Meeting scheduled for August 7, at which the County of Los Angeles will provide similar information and allow for comparison. PUBLIC COMMUNICATIONS Mayor Lozano opened Public Communications at 7:58 p.m. and noted that each speaker is permitted a total of three (3) minutes to speak. Al Contreras, Baldwin Park resident, presented questions regarding the proposed energy consortium; asked about traffic flow on Merced at Puente and asked that traffic markings in this area be corrected; also commented on synchronization of traffic signals on Ramona and on Maine. Arturo Luna, Baldwin Park resident, opined that there are too many sprinklers in the medians along Ramona Boulevard. Ken Woods, Baldwin Park resident, opined that the prospect of the City creating its own energy utility agency is not a good idea as it is very complicated and not a good idea. Daniel Lovanos, One Legacy, provided an update of the latest activities of One Legacy-Donate Life; thanked the community and Council for its support. Greg Tuttle, Baldwin Park business owner, commented on the energy utility agency proposal; commended the Police Department on the "National Night Out" event; stated that he has Regular Meeting of 8/2/17 Page 2 of 7 reported and provided pictures of vandalism and adverse health conditions at Barnes and Hilda Solis Parks; opined that the City spends excessive amount with Sid Mousavi and that expenditures are exceeding the contract amounts. Seeing no others wishing to speak, Public Communications closed at 8:16 p.m. CONSENT CALENDAR Council pulled Item Nos. 2, 4, 5 and 9 from Consent Calendar for further discussion. 1. WARRANTS AND DEMANDS Staff recommends City Council ratify the attached Warrants and Demands Register. A motion was made by Lozano, seconded by Pacheco, and carried {5 — 0) to ratify the Warrants and Demands Register. AYES: Baca, Garcia, Lozano, Pacheco, Rubio NOES: None. ABSENT: None. ABSTAIN: None. 2. REJECTION OF CLAIMS • Staff recommends that Council reject the following claim(s) and direct staff to send appropriate notice of rejection to claimant(s): • Elizarraraz, Alicia Claimant alleges that the intersection of Puente Avenue and Merced poses a dangerous condition of public property. Salcedo, David (Amended) Claimant alleges breach of contract, wrongful termination and whistleblower retaliation. Amended claim includes defamation, coerced self-defamation, • labor code violation, private attorney • general act violation, emotional distress, negligence, civil rights violations, fraud, violation of POBR, et al. Tarin, Alejandro Claimant alleges that the intersection of Puente Avenue and Merced poses a dangerous condition of public property. • Council member Garcia and Mayor Lozano announced that they would be abstaining from the vote on this item since each of them objected to the dismissal of David Salcedo and. A motion was made by Baca, seconded by Pacheco, and carried (3 — 0 — 2; Council member Garcia and Mayor Lozano abstained) to reject the claims and direct staff to send appropriate notice of rejection to claimants. Meeting Minutes of the Special City Council Meeting held on June 6, 2017. B. Meeting Minutes of the Special and Regular City Council Meetings held on June 7, 2017. A motion was made by Lozano, seconded by Pacheco, and carried (5 — 0) to receive and file the minutes. AYES: Baca, Garcia, Lozano, Pacheco, Rubio NOES: None. ABSENT: None. ABSTAIN: None. 4. CONTRACTUAL ANNUAL RATE ADJUSTMENT FOR SOLID WASTE FEES DUE TO CPI INCREASE Staff recommends that Council approve and adopt Resolution No. 2017-197 "A Resolution of the City Council of the City of Baldwin Park, California, Adopting the Amended Fee Schedule for Solid Waste Collection and Recycling Services, to Reflect Consumer Price Index Increases." • Council member Baca asked that this item be brought back at the next Regular meeting to allow sufficient time to review the increase and how it may impact the residents and business owners. A motion was made by Baca, seconded by Pacheco, and carried (5— 0) to bring this item back at the next regularly schedule Council meeting. AYES: Baca, Garcia, Lozano, Pacheco, Rubio NOES: None. APPROVAL OF THE AN AMENDMENT TO THE AGREEMENT WITH LEARNING ENRICHMENT AFTERSCHOOL PROGRAM, INC., FOR THE AFTERSCHOOL SUPPER PROGRAM Staff recommends that Council authorize the Mayor to execute the Amendment to the Agreement with the Learning Enrichment Afterschool Program, Inc., (LEAP) and authorize the Director of Recreation and Community Services to execute all Afterschool • Supper Program documents. A motion was made by Baca, seconded by Pacheco, and carried (5 — 0) to authorize the Mayor to execute the Amendment to the Agreement with the Learning Enrichment Afterschool Program, Inc., (LEAP) and authorize the Director of Recreation and Community Services to execute all Afterschool Supper Program documents. • AYES: Baca, Garcia, Lozano, Pacheco, Rubio • NOES: None. APPROVAL OF AN ADDENDUM TO THE HVAC MAINTENANCE SERVICES AGREEMENT WITH HONEYWELL BUILDING SOLUTIONS ' Staff recommends that Council approve and authorize the Mayor to execute the Addendum to the contract with Honeywell Building Solutions. A motion was made by Lozano, seconded by Pacheco, and carried (5 — 0) to approve and authorize the Mayor to execute the Addendum to the contract with Honeywell Building Solutions. APPROVAL OF AN AGREEMENT WITH CHRISTIANSEN AMUSEMENTS FOR CARNIVAL SERVICES Staff recommends that Council approve the Agreement with Christiansen Amusements for Carnival Services and authorize the Mayor to execute the necessary documents. A motion was made by Lozano, seconded by Pacheco, and carried .(5 — 0) to approve the Agreement with Christiansen Amusements for Carnival Services and authorize the Mayor to execute the necessary documents. ADOPT RESOLUTION NO. 2017-200 SETTING THE APPROPRIATIONS LIMIT FOR • FISCAL YEAR 2017-18 Staff recommends that Council approve and adopt Resolution No. 2017-200, entitled "A Resolution Of The City Council Of The City Of Baldwin Park, California, Setting The Appropriations Limit For The Fiscal Year 2017-18," setting the appropriations limit for fiscal year 2017-18 at $75,229,058. A motion was made by Lozano, seconded by Pacheco, and carried (5 — 0) to approve and adopt Resolution No. 2017-200, entitled "A Resolution Of The City Council Of The City Of Baldwin Park, California, Setting The Appropriations Limit For The Fiscal Year 2017-18," setting the appropriations limit for fiscal year 2017- 18 at $75,229,058. AYES: Baca, Garcia, Lozano, Pacheco, Rubio NOES: None. ABSENT: None. ABSTAIN: None. 9. • APPROVE THE 5-YEAR CAPITAL IMPROVEMENTS PROJECT (CIP) BUDGET FOR . FISCAL YEAR 2017-18 TO 2021-22 Staff recommends that Council approve the 5-Year Capital Improvements Project (CIP) Program and approve additional appropriations for Fiscal Year 2017-18. A motion was made by Rubio, seconded by Baca, and carried (5 —0) to approve the 5-Year Capital Improvements Project (CIP) Program and approve additional appropriations for Fiscal Year 2017-18. REVIEW OF CURRENT APPLICATIONS AND CONSIDERATION OF APPOINTMENT OF MEMBERS FOR THE HOUSING COMMISSION OF THE CITY OF BALDWIN PARK Staff recommends that Council review the submitted Commission applications, accept nominations, authorize staff to initiate the appropriate background checks through the Department of Justice (DOJ) and, contingent upon satisfactory clearance by the DOJ, appoint individuals to the respective City Commissions and adopt Resolution No. 2017- 166, entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPOINTING QUALIFIED INDIVIDUALS TO THE HOUSING COMMISSION OF THE CITY OF BALDWIN PARK TO OFFICE NUMBERS 1, 2, 3, 4, 5 and 6." A motion was made by Lozano, seconded by Pacheco, and carried (5=0) to bring this item back for further consideration at a future Council meeting. DESIGNATION AS SISTER CITY TO THE MUNICIPALITY OF NOCHISTLAN DE MEJIA ZACATECAS, MEXICO Staff recommends that Council further consider establishing a Sister City relationship between the City of Baldwin Park and the Municipality of Nochistlan de Mejia, Zacatecas, Mexico, as Sister Cities, and provide further direction to staff. Mayor Lozano noted that the Mayor of Municipality of Nochistlan de Mejia would be arriving in Baldwin Park in the near future; Council expressed support for the proposed partnership and directed staff to move forward with development of a Sister Cities agreement. TIMS.ITEM -'MR DISCUSSION ONLY " ,r r ' CITY COUNCIL/CITY CLERK/CITY TREASURER/STAFF REQUESTS & COMMUNICATIONS Request by Council member Garcia for discussion and consideration: • As follow up to previously agendized items, Councilmember Garcia is requesting a regular report from Public Works related to street improvements, and from the Police Department • related to public safety. Council member Garcia requested that the Police Department provide reports, possibly on a monthly basis, that illustrate incident statistics and the allocation of police department resources; also requested that Public Works continue to provide reports with project status updates. Council member Garcia also suggested that staff move forward with advertisement and recruitment of a Public Works Director. Regular Meeting of 8/2/17 Page 6 of 7 • Council member Pacheco requested that Public Works staff increase efforts to maintain landscaped City rights of way, noting that some areas have an excessive growth of weeds. Council member Pacheco also requested that the Police Department increase patrols in the areas of Barnes Park and Hilda Solis Park, and to address the issues that may exist with cameras at various City locations. Council Member Baca also commented on the security cameras at various City properties and that there may be evidence of vandalism or some type of equipment tampering. Mayor Lozano also commented on complaints received regarding trucks traveling on Olive Street through to Irwindale; pointed out that the problems with dust creates a health hazard for local residents.
