Pacific Avenue, Baldwin Park, 91706 Items discussion may occur in any order deemed appropriate by Council and may not be in the same order as they appear on this agenda. CALL TO ORDER The meeting was called to order at 6:05 p.m. by Mayor Lozano. ROLL CALL PRESENT: Mayor Pro Tem Monica Garcia Councilmember Ricardo Pacheco Mayor Manuel Lozano ABSENT Council member Susan Rubio Council member Cruz Baca PUBLIC COMMUNICATIONS Mayor Lozano opened Public Communications at 6:12 p.m. Greq Tuttle, Baldwin Park business owner, inquired as to why this matter was being not taken up in December rather than now; inferred that this investigation should have been conducted internally by Chief Taylor; also noted that there should be two independent investigators representing each party; opined that mediation is not going to resolve the animosity between the parties since one of the two people has anger management issues. Seeing no one wishing to speak, Public Communications closed at 6:15 p.m. CONSENT 1. RECONSIDERATION OF RETENTION OF KAUFMAN LAW FIRM AND PERSONNEL INVESTIGATION It is recommended that the City Council provide Staff and the City Attorney direction. Mayor Lozano began by explaining that, at the last City Council meeting, all Council members were in agreement that there would be a stay on the proposed investigation involving Council member Ricardo Pacheco and Council member Cruz Baca, and that both parties would consider seeking resolution through mediation. Mayor Lozano stated that there was intent at that meeting to make a motion and vote for the stay and, instead, seek mediation but this failed to occur. • Page lof2 Mayor Lozano stated that it was his intent to make a motion to table this item until such time as Council member Baca could be present to vote on whether to move forward with the investigation. Mayor Lozano reaffirmed his statement made to Council member Baca, in response to her asserting that hiring a legal firm to conduct an investigation is ridiculous, that he would suggest that both council members participate in mediation rather than spending $20,000 on legal fees for a formal investigation. Mayor Lozano made a motion to stay the investigation and move this item to the City Council Regular Meeting scheduled for December 7, 2016, at 7:00 p.m. Council member Pacheco seconded the motion. Upon vote, the motion passed (3-0-2; Baca and Rubio absent), to stay the investigation of Council member Ricardo Pacheco and Council member Cruz Baca, and to bring the matter of reconsideration of retention of Kaufman Law Firm for the investigation back for consideration at the Regular City Council Meeting scheduled for December 7, 2016, at 7:00 p.m. ADJOURNMENT There being no further business, motion was made by Lozano, seconded by Garcia, to adjourn the meeting at 6:15 p.m. • Mayor ATTES , c.
