M. Councilman Bishop led the salute to the flag. Roll Call: Present: COUNCILMEN BISHOP, HOLMES, LITTLEJOHN, WILSON AND MAYOR COLE Absent: CITY TREASURER PUGH AND ACTING PLANNING DIRECTOR MANSFIELD Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY GORLICK, CITY ENGINEER YOUNG AND CITY CLERK BALKUS 00- Mrs. Marianne Johnson, 3825 North Foster, Baldwin Park, stated that she would like to have permission of the City Council for the Baldwin Park Beautification Group to start the beautification program on the 101 public parkway on the north side of Ramona Boulevard, from Harlan Avenue to Sierra Madre. There was considerable discussion by Council wherein the responsibilities involved, City-wise, regarding maintenance of these plantings were debated upon. COUNCILMAN HOLMES MOVED that Mrs. Johnson and her group be PERMITTED TO PLANT these trees, as suggested, 251 apart, along the NORTH DRIVE OF RAMONA BOULEVARD from HARLAN TO SIERRA MADRE, and that the CITY ENGINEER BE INSTRUCTED TO CONFER WITH THE GROUP as to the location and type of plant- ing so there will be no interference with the maintenance. COUNCILMAN BISHOP SECONDED. Further discussion ensued with reference to the authority and responsibilities of the City Engineer in relation to the beautification group. Mrs. Johnson also stated that they had a deadline of March Ist to meet, in that they had entered a National Community Improvement Contest financed by the Sears Roebuck Foundation; that Mrs. Valley Knudsen had been a judge of this type of contest several times in the past, and that she had informed her that of all the cities she had judged, Baldwin Park had covered the ten important criteria better than any of them that had received first prize. With this assurance, and the fact that they have qualified in every other instance, the group is most anxious to see what they could do. Discussion continued. Mr. Victor Brown, 14855 E. Clydewood, Baldwin Park, stated that the civic and service organizations are behind this project 100% and willing, not only to commit time, but finances. For his clarification and understanding, the motion, as made previously, was read back. Ross and Roland N. Ross, Edna Lee Davis and Cherry Nash. COUNCILMAN LITTLEJOHN MOVED that the City Council of the City of Baldwin Park REFUSE THESE CLAIMS and that they BE REFERRED TO THE INSURANCE AGENT FOR HANDLING. COUNCILMAN WILSON SECONDED. The motion carried by the following vote: AYES: COUNCILMEN.LITTLEJOHN, WILSON, BISHOP, HOLMES AND MAYOR COLE NOES: NONE ABSENT: NONE 00- Councilman Bishop reported on the Civil Defense Meeting, stating that it was finally agreed upon that all of the City Managers would meet in the next 60 days and try to work out something with regard to Area D", and come up with some plan that would-be acceptable by all cities. Mr. Nell Goedhard, of Covina, was appointed Chairman to this committee. It was Mr. Bishop's opinion that most of them were fighting for one reason.... that was to keep Col. Ming on as a paid salary;'that it was a detriment to buy equipment because if Area D" is dissolved it would go back to the City of Claremont; that-he couldn't see where it would justify this city paying $700.00 $800.00 dues. Councilman Wilson who had also attended the meeting, reported that Mr. Hoover had stated at the meeting that cities who have not paid or signed new agreements were not responsible; that nothing could be done until 60-90 days after the report was made by the Committee, then we could decide whether to stay In or go out". 00- Councilman Bishop reported that he had attended the League of California Cities at Pico Rivera on November 19, 1959. He stated that the meeting was very good and that they had toured the Ford Plant, which was very interesting. 00- Mayor Cole reported that he and Councilmen Holmes and Wilson had attended a P.T.A. meeting at the Vineland Avenue School and had given a tbik about our City": 00- City Attorney Gorlick reported that he had a conference with Mr. James W. Briggs of the County Counsel's office with reference to the revision of the Old Central School. lease.to provide that rents shall be applied to the purchase price of the property. This conference was brought about by a letter which the County Counsel sent to Mr. Asmus in which the County Counsel, stated, in substance, that the new lease could not be executed by the School District because they did not feel that this provision was a valid provision. He also felt that applying past rents to the purchase price would constitute an unlawful gift of public funds on the part of the School District. Mr. Gorlick informed Mr. Briggs that he would study the matter, and, if still in disagreement with him, would let him know. A memorandum on the law will be prepared for the Chief Administrative Officer who, In turn, will send a copy to Mr. Bonelli. Mr. Gorlick will send a copy to Mr. Briggs. Chief Administrative Officer Asmus stated there had been no official action on the part of the school board; that they would have to approve, but could not, as long as the County Counsel didn't. He further stated that in any future discussions the School District would be invited to attend any meetings with Supervisor Bonelli, himself and the County Counsel. City Clerk Balkus presented a request for a zone change, Zone Change #69, Albert E. and Mavis Blanchard, from R-I to R-3 at 4946 North Maine Avenue, Baldwin Park, and sug- gested that it be set for public hearing on December 21, 1959. COUNCILMAN WILSON MOVED that ZONE CASE NO. 69 BE SET FOR PUBLIC HEARING ON DECEMBER 21, 1959. COUNCILMAN BISHOP SECONDED. The motion carried by the following vote: AYES: COUNCILMEN WILSON, BISHOP, HOLMES, LITTLEJOHN AND MAYOR COLE NOES: NONE ABSENT: NONE Chief Administrative Officer Asmus presented a letter of request for waiver of sidewalk and curb and gutter at Badillo and Depot Avenue, Mr. J. Calvin Shelton, and re- ported that Mr. Shelton contemplated building a drive-in root beer stand at this location. City Engineer Young submitted a report recommending, after being furnished a plot plan on the proposed development on the railroad right of way, that the curb, gutter and sidewalk be waived, basing his reasoning on the drainage problem in that area. Mr. Young further recommended that driveways on Badillo be asphalt; that the Westerly driveway be a one-way entrance only; the Easterly one an exit only; that parking spaces on Badillo be barricaded; and that the driveway at the most S. Easterly corner be installed over an 18" corrigated metal drainage pipe. City Engineer Young stated that the drainage problem Involved can be handled when Badillo is developed as a major highway. COUNCILMAN HOLMES MOVED that Council ACCEPT THE CITY ENGIN- EER'S RECOMMENDATION of this matter of WAIVER OF CURBS, GUTTER AND SIDEWALKS, and the RECOMMENDATIONS OF THE CUL- VERTS AND DRAINAGE HANDLING° BE APPROVED. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, WILSON, BISHOP, LITTLEJOHN AND MAYOR COLE NOES: NONE ABSENT: NONE 00- Chief Administrative Officer Asmus presented a report, as prepared by City Engineer Young, with reference to a 1942 Mack Tank Truck for the sum of $700.00 plus 4% sales tax. This truck has a 2,000 gallon tank on it, together with a pump which is in poor condition; the tires are good, and it is mobile. This truck would be suitable for the City's needs and. also for watering along the railroad right of way after plantings are made. There was. discussion by Council. COUNCILMAN BISHOP MOVED that Council CONCUR WITH THE RECOM- MENDATIONS OF THE CITY ENGINEER and ALLOW $700.00 PLUS 4% SALES TAX TO PURCHASE THE 1942 MACK WATER TRUCK, 2,000 gallon capacity. COUNCILMAN WILSON SECONDED. The motion carried by the following vote: AYES: COUNCILMEN BISHOP, WILSON, HOLMES, LITTLEJOHN AND. MAYOR COLE NOES: NONE ABSENT: NONE 00- At the request of Councilman Holmes, City Engineer Young reported on the Southern California Water Works meeting on Friday, November 20, 1959, at Montebello, California. He stated that it had to do with the County'of Los Angeles developing an ordinance to regulate any and all water companies within the County of Los Angeles; that there had been much discussion about it, and even the cities that do not have their own water companies have become Interested because it was an apparent effort by the County of Los Angel es to get further control of all the territory that was within the bounds of Los Angeles County; that this would make it virtually impossible for any water company to operate without the approval of the Los Angeles County Engineer. He further stated that there had been a lengthy discussion by some of the best noted water works engineers, profess- ional engineers and water works Managers in the country; that the speakers at the meeting had been Charles Stuart, Vice-President of the Southern California Water Company, Los Angeles, Mr. John R. Patten, Water Superintendent, City Water Department, Santa Monica and Mr. John Skelton, Executive Vice-President, San Gabriel Valley Water Company, El Monte; that the enforcement of this ordinance alone would increase the employees of the County by at least 500; that this ordinance would give the Fire Department and the Forestry Department almost unanimous control over what goes into a water works; that at the meeting which November 23, 1959 Page 4 MOTION made and carried that Council ACCEPT THE CITY ENGIN- EER'S RECOMMENDA- TION of matter of WAIVER OF CURBS, GUTTERS AND SIDE- WALKS and the RECOMMENDATIONS OF THE CULVERTS AND DRAINAGE HANDLING BE AP- PROVED. 1942 MACK TANK TRUCK with 2,000 gallons Report by City Engineer. Continued) BIB] 39589-U01 1959-U02 11-U02 23-U02 CC-U02 MIN-U02 LI1-U03 FO117121-U03 FO117328-U03 DO117359-U03 C4-U03 MINUTES1-U03 5/20/2008-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 CLERK-U06 1959 11 23 CC MINHÄ—@¸—?â Í«Adjourned Regular Meeting of the Baldwin Park City Council was attended by some 3-4000 engineers.... some licensed professionally, some not...they adopted a resolution which was presented to the Board of Supervisors, which occasioned a general feeling of question as to whether the Board of Supervisors were fully aware of the dictatorial powers in- volved; why should they go to the Los Angeles County 117 section control when the American Water Works Association and The Southern California Water Associations modified ordinance, with only 14 points, would make amendments easy for the County Board of Supervisors. Councilman Holmes stated that he had talked to Chief Klinger on this matter and that he had admitted that the Board of Supervisors could not pass such an ordinance over the legis- lative powers that they have in the charter, but that the County Counsel had determined that the Board of Supervisors could pass such an ordinance under their police powers which are granted in their charter from the State. Any of the water companies that were able to operate, even under a revised ordinance, would mean an almost immediate increase in water costs delivered to the people throughout the County.. minimum would be double, and in soem cases would be 3-4 times what people are paying now. He further stated that this matter merits much consideration from the people of Baldwin Park and other cities from that standpoint alone; that the hearing for action before the Board of Supervisors had been postponed from the original date to January 7, 1960, and that was when they were going to decide whether to pass the ordinance or not. Council took the matter under study to decide on a course of action before the meeting called for on January 7, 1960. Chief Administrative Officer Asmus presented the matter of Donald K. Schneider, 205 Segovia, San Gabriel, regarding setbacks on Bleeker Street. At the time, a stop work order was in effect on the house that was being built on the north side of the property. He stated that the City Engin- eer had granted, under the authority given in the ordinance, an exception to build up to within 5' of the property line which meant that the adjoining property, being a poultry ranch, would be less than 35' from the dwelling that would be constructed. Mr. Donald K. Schneider, 205 Segovia, San Gabriel, Calif- ornia, stated that he had talked to Mrs. Lautenbach who had the chicken ranch next door, and that she had volun- teered the information that she and her husband would not continue in the chicken business very much longer, and that they were willing to give 30' off the back of the property for Downing Street to continue on through. He further stated that the hardship" involved would be that of the person who would live in the home, as they would not have a chance to make a decent turn with their car in getting it off the street. There was considerable discussion by Council wherein Council- man Littlejohn stated that this was not a street, but merely an easement to permit ingress and egress. Councilman Bishop stated that he had talked to the man in the poultry business and that he had no complaint on the 5' setback....that it was perfectly all right with him...and that he intended, when the house was built, rented or sold, to put in a 6' masonry fence, but that he would not do it until then. When he went to see about the stop work order, it was then that Mr. Wood pointed out the section of the ordinance pertain- ing to a 151 setback, so, at that time, he looked further in the ordinance and read where the City Engineer had the right to grant a variance. He then went to see Mr. Young, and after a discussion between Mr. Young and Mr. Wood, was granted an exception. Mr. Hatfield felt that if the City had an ordinance they wanted enforced, it should be checked out when plans were submitted for approval and not after the work had been done. Discussion continued wherein it was the general consensus of opinion that Council was interested only in the pro- tection of both parties. City Attorney Gorlick stated that after the City Engineer had granted this exception, he found it difficult to see how the City could deny the man the right to go ahead, even though a stop order had been issued. The City Engineer could state that the exception had been granted under a mistaken understanding of what the facts were", and he might reverse the granting on that basis, but this would place the City in a very difficult position. He further stated that he had serious doubt as to whether or not the provision in the zoning ordinance giving the City Engineer the right to grant this exception was valid because we have a provision in our zoning ordinance that says that exceptions, in order to be granted, must be granted only after a public hearing. There was further discussion by Council. COUNCILMAN BISHOP MOVED that Council AUTHORIZE THE CITY ENGINEER'S EXCEPTION TO THE ORDINANCE and GRANT THIS VARIANCE, COUNCILMAN WILSON SECONDED. The motion carried by the following vote: AYES: COUNCILMEN BISHOP, WILSON, HOLMES, AND MAYOR COLE NOES: COUNCILMAN LITTLEJOHN ABSENT: NONE 00- Chief Administrative Officer Asmus presented the matter of child day care centers which had been discussed at a previous meeting, with the request of Council that a report be brought back regarding what other cities do with regard to licensing; he reported that such ordinances state that they are not to exceed five without appearing before the Planning Commission for a special use permit; that the permit, fee appeared to be the big problem involved in the City of Baldwin Park, in that it requires a filing fee of $100.00; that the City Attorney had been asked for his opinion regarding this question from the standpoint of State and County regulations, which was that as far as legal problems Involved, there were none what- soever; that it was purely a zoning matter, and that the City may draw their ordinances as they wish, where they,will permit this type of operation and where they will not. Puente Avenue, Baldwin Park, stated that their problem was that they were only allowed five, which included their own, but the State allows six, and they wanted a variance whereby they could take care of seven or eight children. Also, the fee of $100.00 was a matter of concern. She further stated that the State and County would still have the say as to how many they could care for according to their facilities how many bedrooms, beds, windows, etc. they had available. There was discussion by Council wherein it was the general feeling that those operating a child day care center should pay an annual business license, as do other businesses in the City, and that the number of seven children appeared to suit both the applicants and the needs of the City of Baldwin Park. COUNCILMAN HOLMES MOVED that Council DIRECT THE CITY ATTORNEY TO DRAW AN AMENDMENT TO THE ORDINANCE DEFINING THE THREE CATEGORIES OF DAY CARE, FOSTER HOMES and CHILD DAY CARE", stipulating that CHILD DAY CARE MAY HAVE SEVEN CHILDREN, IN- CLUDING THEIR OWN, FOR COUNCIL'S CONSIDERATION, STUDY AND RECOMMENDATION BEFORE GOING TO PLANNING COMMISSION FOR PUBLIC HEARING. COUNCILMAN BISHOP SECONDED. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, BISHOP, LITTLEJOHN, WILSON AND MAYOR COLE NOES: NONE ABSENT: NONE It was noted that it would be at least 60 days before the ordinance would be In effect. 00- Councilman Holmes stated that he firmly believed that septic tanks should be required to be placed in the front of houses Instead of in back yards. He further stated that being in the front would simplify hook-ups and, also, that when they have to be serviced, there was the problem of getting equipment between the houses. Chief Administrative Officer Asmus stated that the matter would be on the Agenda of the December 7, 1959, meeting and that action would entail the amendment of the Plumb- ing Code. Discussion ensued. At the request of Mayor Cole, Chief Administrative Officer Asmus read in full a proposed ordinance amending Section 1110 of the Uniform Plumbing Code, which would require the location of private sewage disposal systems in the front yard setback area. At Mayor Coles request, Chief date set for Administrative Officer Asmus was to discuss a tentative November 30, 1959. meeting date of November 30th with them, and then inform Council of their decision. Chief Administrative Officer Asmus informed Council that the Bureau of Census was seeking space as headquarters for the San Gabriel Valley, and was very interested in using Baldwin Park. The most suitable housing they had found was City Hall, using Room 100 and the Auditorium. There would be 70 people involved...35 permanent people here in the City Hall for at least 5 months, from January 10, 1960 until May, 1960, and 35 people would be working in the field. After the 5-month period they would desire usage on a month to month basis. He stated that the Bureau has to solicit bids, and if we were interested, they would send us the form for completion. They would give one to the Post Office, three to the real estate offices in town and one to the City Hall. It was the opinion of Mr. Asmus that Council should be very inter- ested in having them here as it would give the local people a better opportunity to be employed by them, and that housing them here would actually denote Baldwin Park as being the center or hub"....of the San Gabriel Valley. COUNCILMAN HOLMES MOVED that Council INSTRUCT THE CHIEF ADMINISTRATIVE OFFICER TO NEGOTIATE WITH THE BUREAU OF CENSUS REGARDING HOUSING AT THE CITY HALL AT A MINIMUM FIGURE OF $350.00 PER MONTH.
