BALDWIN PARK CITY COUNCIL REGULAR MEETING
MARCH 21, 2018, 7:00 P.M.

These minutes are presented in Agenda order. Various announcements or discussions may
have occurred before or after the title under which they are presented.
CALL TO ORDER
The meeting was called to order by Mayor Lozano at 7:03 p.m.
INVOCATION
The invocation was provided by Pastor Jackson.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Lozano.

REPORT ON CLOSED SESSION
Mayor Lozano reported out of Closed Session that no action was taken on items
discussed.
ANNOUNCEMENTS
This.is to announce, as required by Government Code section 54952.3, members of the
City Council are also members of the Board of Directors of the Housing Authority and
Finance Authority, which are concurrently convening with the City Council this evening
and each Council Member is paid an additional stipend of $30 for attending the Housing
Authority meeting and $50 for attending the Finance Authority meeting.
Council Member Cruz Baca requested that the meeting be closed in memory of: Officer
Gregory Casillas from Pomona and requested that a letter of condolences be sent to the
family; Rudy Escalera who passed away recently; Isabel De La 0 Hernandez long time
Baldwin Park resident who passed away last week; Susie Harper (Nora) from Baldwin
Park High School; and Mayor Cynthia Sternquist from the City of Temple City whose
mother passed away.
Council Member Baca offered her congratulations to Sierra Vista High School for having
won the robotics contest and were going to the Nationals in Kansas City.
Mayor Lozano thanked all the folks involved in the planning of the Homeless workshops
and commented they did a terrific job.
City Clerk Avila reported Jerry D. Holland Middle School had also made it to the finals,
were given an award and were also competing; and offered her congratulations.
PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS
• Proclamation Presentation recognizing March 12— 16, 2018, as Adult Education
Week.
A proclamation was presented declaring the week of March 12-16 as Adult
Education week.
• Certificate Presentation recognizing the Winning Students in the Adult Education
Essay Contest.
Students from the Adult Education program were presented with certificates of
recognition and were offered congratulations. Dr. Kirk made brief remarks regarding
the adult education program and thanked the Council for the great partnership
between the two agencies.
• Plaque Presentation to the Baldwin Park Housing Authority for being awarded
the Distinction of High Performing Agency for the 5th time in 6 years.
Employees from the Housing Authority were recognized for their hard work and
dedication in providing decent and affordable housing programs to Baldwin Park
• residents. Director Romo stated that these accomplishments to date were only
possible because of its employees and their commitment to the community they
serve.
PUBLIC COMMUNICATIONS
Mayor Lozano opened Public Communications at 7:25 p.m. and noted that each
speaker is permitted a total of three (3) minutes to speak.
Steve Chang thanked the Council for considering opening the process for the issuance
of a few more cannabis licenses.

Eduardo Sauceda resides at 3600 Van Wig and spoke about a tree that is between the
yards and that there was a hospital behind it more like a convalescent home Ramona,
he stated that the tree was encroaching on his property and it needed maintenance.
Thomas Kerri spoke against services for the homeless because the more services you
offer, the more homeless people will come into the community.
Roger Magana stated that he was in favor of the additional permits the Council was
considering issuing regarding cannabis; made comments relative to the homeless
stating that he pledged to establish the first Nichen Technologies Company in Baldwin
Park'and as such have a chance to help with the issue of housing for the homeless.
• Christina Larios announced that there will be a decluttering workshop on Saturday,
March 31 at 2:00 p.m. by professional organizer Laura Alice.
Seeing no others wishing to speak, Public Communications closed at 7:32 p.m.
Mayor Pro Tem Pacheco commented and highlighted some of the more recent city
accomplishments.
• Mayor Lozano entertained a motion to move the audit report item No. 15 ahead on the
agenda.
A motion was made by Lozano, seconded by Pacheco, and carried(4 — 0)
to move Item No. 15, the Comprehensive Annual Financial Report ahead
on the agenda.

REPORTS OF OFFICERS
15. THE COMPREHENSIVE ANNUAL FINANCIAL REPORT (CAFR) FOR FISCAL
YEAR 2016-2017. (ITEM TAKEN OUT OF ORDER)
Staff recommends that the City Council receive and file the City of Baldwin Park's
CAFR for fiscal year ended June 30, 2017 and all accompanying reports.
A motion was made by Lozano, seconded by Pacheco, and carried (4 — 0)
to move Item No. 15, the Comprehensive Annual Financial Report ahead
• on the agenda. .

Rose Tam, Director of Finance introduced Independent Auditors Vasquez &
Company.

Peggy McBride Concurrent Review and Quality Control partner for the City's
audit with Vasquez & Company presented the Comprehensive Annual Financial
Report summary and highlights.
A motion was made by Lozano, seconded by Baca, and carried (5 — 0) to
receive and file the Comprehensive Annual Financial Report and to bring
back the Accounting Policies and Procedures item.

Council Member Baca inquired as to whether or not this was time sensitive as this
was the third time this item was presented on the agenda.
Finance Director Tam indicated that this was one of the recommendations of the
Audit and as such it can't be delay past April 4.
6. ACCEPT PLANS AND SPECIFICATIONS, AND AUTHORIZE PUBLISHING
NOTICE INVITING BIDS FOR CITY PROJECT NO. 2018-0239- CONCRETE
IMPROVEMENTS VARIOUS LOCATIONS CITYWIDE.
Staff recommends that the City Council accept the plans and specifications and
authorize publication of a Notice Inviting Bids for the construction of City Project
No. 2018-0239 Sidewalk and Concrete Improvements, Various Locations Citywide.
A motion was made by Pacheco, seconded by Garcia, and carried (4 — 0)
to approve the item as presented.

Staff recommends that the City Council approve plans and specifications for the
Bus Stop Improvement Project Phase II (City Project No. 2018-0221) and
authorize staff to advertise the Notice Inviting Bids.

FOR FY 2018-2019.
Staff recommends that the City Council adopt City Council Resolution No. 2018-
232 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, CALIFORNIA, AUTHORIZING THE INITIATION OF THE
PROCEEDINGS AND ORDERING THE PREPARATION OF THE ENGINEER'S
REPORT FOR THE FY2018-19 LEVY OF ANNUAL ASSESSMENTS FOR THE
CITY OF BALDWIN PARK LANDSCAPING AND LIGHTING MAINTENANCE

Staff recommends that the City Council adopt City Council Resolution No. 2018-
233 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, CALIFORNIA, AUTHORIZING THE INITIATION OF THE
PROCEEDINGS AND ORDERING THE PREPARATION OF THE ENGINEER'S
REPORT FOR THE FY2018-19 LEVY OF ANNUAL ASSESSMENTS FOR THE
CITY OF BALDWIN PARK PARKS MAINTENANCE ASSESSMENT DISTRICT"

10. RENEWAL OF GRANT WRITING SERVICES CONTRACT WITH CALIFORNIA

Staff recommends the City Council to:
1. Approve the Consultant Services Agreement with California Consulting,
LLC; and
2. Authorize the Director of Finance to appropriate funds to cover the cost
related to the grants applied for including but not limited to General Fund,
Prop A Fund, or Future Development Fund; or
3. Provide staff direction.

to approve renewal of grant writing services contract with California
Consulting.

THE TITLE OF SUBSECTION 153.170.090 RELATING TO ELECTRONIC
READERBOARD SIGNS.
Staff recommends that the City Council adopt Ordinance No. 1405 on second
reading, read by title only, and waive further reading thereof.

BALDWIN PARK POLICE ASSOCIATION (BPPA); AND APPROVE
RESOLUTIONS UPDATING THE PAY SCHEDULES REFLECTING SALARY
AND BENEFIT ADJUSTMENTS IN ACCORDANCE WITH CALPERS
ESTABLISHED GUIDELINES. (PULLED)
Staff recommends that the City Council City Council approve, ratify and adopt:
1. Adopt City Council Resolution No. 2018-234, entitled, "A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK,
CALIFORNIA, APPROVING THE MEMORADUMN OF UNDERSTANDING
(MOU) WITH BALDWIN PARK POLICE ASSOCIATION (BPPA)"; AND

CITY COUNCIL ACTING AS SUCCESSOR AGENCY OF THE COMMUNITY
DEVELOPMENT COMMISSION
CONSENT CALENDAR
All items listed are considered to be routine business by the City Council and will be
approved with one motion. There will be no separate discussion of these items unless a
City Councilmember so requests, in which case, the item will be removed,from the
general order of business and considered in its normal sequence on the agenda.

Mayor Pro Tern Pacheco, Council Member Rubio and Council Member Baca thanked
the POA leadership for their patience and working collaboratively with the City to craft a
good compromise for the next three years.
SA-1 SUCCESSOR AGENCY TO THE DISSOLVED COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF BALDWIN PARK WARRANTS AND
. DEMANDS.
Staff recommends that Council, acting as governing body of the Successor
Agency, ratify the attached Warrants and Demands Register.
Council Member Baca inquired as to the status of the Successor Agency and its
associated funding.
• Rose Tam, Director Finance stated that after the dissolution law was passed,
the directive for RDA agencies was that if they had any on-going projects bonds
that they needed to continue and take care of said project until such time as
when all the outstanding debts were paid off.
A motion was made by Lozano, seconded by Baca, and carried (5 — 0) to
receive and file the Successor Agency's Warrants and Demands.

PUBLIC HEARINGS
13. A REQUEST FOR CONSIDERATION OF A MUNICIPAL (ZONING) CODE
• AMENDMENT BY ORDINANCE TO MODIFY CHAPTER 127 (COMMERCIAL
CANNABIS) BY INCREASING THE NUMBER OF PERMITS PERMITTED
FROM FIFTEEN TO TWENTY-FIVE.
Staff recommends that the City Council conduct a Public Hearing and,
thereafter, waive the first reading and adopt by title only, Ordinance No. 1408,
entitled, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK CALIFORNIA, AMENDING THE MUNICIPAL CODE
CHAPTER 127 — MEDICAL AND ADULT USE OF COMMERCIAL CANNABIS"
• Mayor Lozano opened the public hearing at 8:05 p.m. and entertained public
comment first on anyone opposing the proposal.
Thomas Kerri spoke against approving additional cannabis permits.
Mayor Lozano asked for public comment from anyone in favor of the proposal.

Seeing no other speakers, Mayor Lozano closed the public hearing at 8:10 pm.
A lengthy discussion ensued relative to the proposed ordinance and centered
around Tier 1 and Tier 2 applicants and allowing them also to participate; and

adding more of the Tier 3 businesses; postponing approval until the second
meeting in April; the number of sites that were still in question, which had not
been approved.
•
Mayor Pro Tern Pacheco suggested for staff to come up with a plan to be able
to manage all the work associated with the buildings to be used for cannabis as
well as all the other new buildings in the city and the workload that these issues
represent for staff.
A motion was made by Pacheco, seconded by Garcia, and carried (4 1)
to waive further reading and adopt by title only Ordinance No. 1408
increasing the number of permits permitted from Fifteen to Twenty.

Council Member Baca stated for the record that as a small business friendly
person that she was in favor of including Tier 1 and Tier 2; and that the Council
was making a mistake by not including them.
14. A REQUEST FOR CONSIDERATION OF A RECOMMENDATION OF
APPROVAL BY THE PLANNING COMMISSION TO THE CITY COUNCIL ON
MULTIPLE ZONING AND GENERAL PLAN LAND USE CHANGES WHICH
WOULD ACHIEVE CONSISTENCY BETWEEN THE GENERAL PLAN LAND
USE MAP AND ZONING MAP FOR SPECIFIC PLAN 13-01. (ROEM
PROJECT-RAMONA BLVD./BOGART STREET), SPECIFIC PLAN 14-01
(INDIGO PROJECT-BALDWIN PARK BLVD./MERCED AVENUE), SPECIFIC
PLAN 15-01 (DOWNTOWN TRANSIT ORIENTED SPECIFIC PLAN) AND
SPECIFIC PLAN 16-01 (PACIFIC VILLAS-PACIFIC AVENUE) (LOCATION:
VARIOUS: CASE NUMBERS: AGP-119 AND Z-556).
Staff and the Planning Commission recommend that the City Council open the
public hearing, accept testimony and following the public hearing:
1. Adopt City Council Resolution No. 2018-230, entitled, "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN
PARK, CALIFORNIA, ADOPTING THE FINDINGS OF FACT AND

Amy Harbin, City Planner presented the staff report.
Mayor Lozano opened the public hearing at 8:23 p.m. and entertained public
comment.
Seeing no one wishing to speak, Mayor Lozano closed the public hearing at
8:23 pm.
A motion was made by Garcia, seconded by Lozano, and carried (5 — 0) to
bring item back at the meeting of April 4.

COMMUNICATIONS
Request by Council Member Susan Rubio for discussion and consideration:
• Direction for staff to start a planning process for aging members of our
• community covering topics such as transportation, housing, and in-home care.
Council Member Rubio stated that this was an issue the City was not prepared to
handle and given the statistics with the baby boomer population, it was appropriate to
engage and look into putting together a master plan to address these issues such as
transportation, access to health care, etc.; directed staff to move forward with such
master plan.
Council Member Baca commented that she was in favor of such proposal with the
caveat that staff [city employees] would need to exercise caution in terms of the legal
ramifications of providing such level of help due to the exposure to fraud and someone
taking advantage of these vulnerable populations.

. ■ Establish a City partnership with the School District in an intervention program for
returning Veterans and for students in regards to education, employment, and
housing.
Council Member Rubio stated that there was a crisis in jobs available as well as
funding for education; that her proposal had to do more with the population that
. had been out of the armed forces such as those between 25 — 30 years old who
end up without a job and subsequently on the street; she stated that she wanted
to build a partnership with the School District to fill the educational need of these
individuals and have the School District subsidize the cost.
She spoke about the issue of the kids of homeless individuals who have a hard
time to attend school, which attributes to the high drop-out rate; that they move
around often and became transients. She asked if the City Could reach out to
organizations such as Lift and Uber and partner with them to provide
transportation to these kids on a temporary basis until the family figures out their
situation.
Council Member Rubio commented that we need to be moving on the issue of
jobs resulting from the Cannabis operations in Baldwin Park because she had
not seen any movement in that respect.
Council Member Baca commented on the issue of scams that vulnerable
populations and seniors were subject to and caution that there were scams
currently going on in the area.
Mayor Pro Tern Pacheco also commented on the issue of jobs in relation to the
cannabis operators and he too stated that we need to see more progress in that
regard; stated that we need to have a process to review their plans timely and
that we need to do what we can to assist in this process so that they can start
• hiring folks. •

a motion was made by Lozano, seconded by Baca, to adjourn the meeting at 8:48 p.m.
