Councilman Bishop led the salute to the flag. Roll Call: Present: COUNCILMEN BISHOP, HOLMES, LITTLEJOHN, WILSON AND MAYOR COLE Absent: CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY GORLICK, PLANNING DIRECTOR MANSFIELD, CITY ENGINEER YOUNG AND CITY CLERK BALKUS. 00- COUNCILMAN HOLMES MOVED THAT THE MINUTES OF FEBRUARY I, 1960, FEBRUARY 15, 1960 AND FEBRUARY 25, 1960 BE APPROVED WITH FURTHER READING WAIVED. COUNCILMAN BISHOP SECONDED. There were no objections, the motion carried and was so ordered by Mayor Cole. 00- City Clerk Backus administered the oath to those in the audience desiring to be heard during the meeting. 00- Mr. Edwin Elko, 13057 Bess Avenue, Baldwin Park, stated that he was representing a group of people protesting Zone Case Z-73, being a proposed change of zone from A-1 and R-3 to M-I on property situated at the southwest corner of Baldwin Park Boulevard and Bess Avenue, Walnut Creek Wash on the south and Storm Drainage Ditch on the west. He read a letter of protest which was signed by the majority of the people that were with- in that 5001 radius south of the wash, wherein it was stated that adequate notice and time to appear and protest had not been given; that a change from a residential district to manu- facturing district would work a hardship on them; that the dust, noise, odors and other irritants would be detrimental to a residential district; that such zone change planning was unrealistic; that the change would not benefit the City as a whole, but primarily the buyer and seller only. Mr. Elko also presented and read a petition protesting the action of the Planning Commission and the City Council in their approval of Zone Case Z-73, stating their reasons as: I) there are numerous parcels of land zoned M-I already existing within the City of Baldwin Park, which are primarily set up for manufacturing 2) our City Ordinance as it exists at the present time makes M-I uses incompatible to adjacent residential use. The area adjacent to the proposed Zone Change Case Number Z-73, is primarily a residential district and a change to M-I zoning would jeopardize residential property values. 3) numerous property owners did not re- ceive notification from the City Planning Commission re- garding the proposed Zone Change Case Number Z-73, and were therefore unable to attend the City Planing Commission hear- ing in order to protest. This petition was signed by the same people as signed the letter of protest, with the in- clusion of the name of Edwin Elko. APRIL 4, 1960 FLAG SALUTE ROLL CALL MINUTES OF FEB. As clarification of the legal aspect, City Attorney Gorlick stated that everyone on the assessment rolls was entitled to receive a notice of the hearing, and If even one person did not receive a notice, this, would invalidate the hearing. However, if our records show that notices weremailed even though not received-the hearing would be valid due to presumption under the law. It was stated that decision on this case would be made later in the meeting when the ordinance comes before Council. 00- City Clerk Balkus reported that the Southern California Planning Congress would have their April meeting on Thurs- day, April 14, 1960, at the Rodger Young Auditorium in Los Angeles at 7:00 p.m. 00- Councilman Littlejohn reported that on Friday, April 15, 1960, at 3:00 p.m. at the Monrovia City Hall, a Civil Defense Disaster Meeting, Area D", wherein a proposed budget was submitted, and also that the directors asked that the area maintain an administrative office, and that all radio equipment be kept and maintained with no further purchases of equipment. He further reported that Baldwin Park's share would be $483.74 to participate in the 1960-61 Budget, and elaborated on items listed in the budget. Discussion followed. COUNCIL AGREED THAT OUR REPRESENTATIVE, COUNCILMAN LITTLEJOHN, SHOULD INDICATE THAT WE HAVE INTENT TO PARTICIPATE IN AREA D" CIVIL DEFENSE, AND ALL AGREED THAT THE MATTER OF $150.00 SHOULD BE PROTESTED VIGOROUSLY. $150.00 being cost of car insurance on Executive Officer's car) 00- Councilmen Wilson reported that the Recreation Committee met last Monday evening, March 27, 1960, at which time he and Councilman Bishop indicated that the $36,622.00 budget was not acceptable to the City, but we would go as high as $12,000.00. After much discussion, it was agreed that Mr. Frazier and Mr. Asmus would meet and discuss this matter in an endeavor to arrive at an acceptable budget. 00- City Attorney Gorlick presented a resolution pertaining to supporting the application of Airport Service, Inc. before the Public Utilities Commission. BEFORE THE PUBLIC UTILITIES COMMISSION" I WHEREAS, Airport Service, Inc. has filed an application with the California Public Utilities Commission to perform scheduled limousine service between the communities of San Gabriel Valley and Los Angeles Inernational Airport and Ontario International Airport, and WHEREAS, this type of service is lacking and is needed to make air transportation more convenient to the residents of the San Gabriel Valley. NOW, THEREFORE, the City Council of the City of Baldwin Park does resolve as follows: I. That the California Public Utilities Commission is respectfully urged to grant said application. 2. That the City Clerk is instructed to send a certi- fied copy of this resolution to said Commission. 3. That Airport Service, Inc., Wilton Hotel, Suite 208, Long Beach 2, California, be notified of the action be taken. The can- vass of votes occurs the Tuesday following election, there- by being April 19, 1960. 00- Chief Administrative Officer Asmus presented the matter of reconsideration of Tract 21536, Burl Watson, which was necessitated due to the fact that the signature of Mayor Paulson of Los Angeles was not on the title Sheet. This tract had been accepted by Council on November 16, 1959. City Engineer Young provided further information on this matter and suggested procedure to follow for reacceptance. COUNCILMAN HOLMES MOVED THAT COUNCIL REACCEPT THE DEDICATION OF THE BUREAU OF POWER AND LIGHT IN THE CITY OF LOS ANGELES FOR THE 51 FOR STREET PURPOSES IN CONNECTION WITH THIS TRACT 21536, AND CONFIRM DEDICATION AS OF THIS DATE, AND THAT THE PROPER OFFICIALS BE AUTHORIZED TO SIGN. He gave further explanation of points of issue. Discussion followed. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL ADOPT THE REVISED BUDGET OF THE CITY-SCHOOL RECREATION PROGRAM FOR 1960-61 IN THE AMOUNT OF $12,000.00, AND THAT THIS PRO- GRAM IS TO BE CARRIED ON REGARDLESS OF ANY RESULTS OF THE CITY TAKING OVER THE PARKS. City Attorney Gorlick stated that, if one property owner was not mailed a notice, this would invalidate the Planning Com- mission hearing.
