REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL

The City Council of the City of Baldwin Park met in regular
session at the above place at 7:30 P. M.
Councilman Bishop led the salute to the flag.
The Invocation was given by Reverend Richard Hetz of the First
Presbyterian Church.

COUNCILMAN BISHOP MOVED THAT THE MINUTES OF MARCH 21, 1960,
MARCH 24, 1960, and APRIL 4, 1960, BE APPROVED WITH FURTHER
READING WAIVED. COUNCILMAN HOLMES SECONDED. There were no
objections, the motion carried andwas so ordered by Mayor
Cole.

City Clerk Balkus reported that notification had been re-
ceived to the effect that Public Utilities Commission had
changed the date of the hearing regarding the application
of the Airport Service, Inc. from May 24, 1960, to June
27, 1960; Mayor Cole stated this was for information only
and no action required.

City Clerk Balkus stated a letter had been received from the
Los Angeles Board of Supervisors with regard to two annexa-
tions in the vicinity of El Monte, but that neither concerned
Baldwin Park directly. Mayor Cole stated this was for infor-
mation only and no action was required.

City Clerk Balkus presented and read a letter addressed to
the City Council from Mrs. Madelyn P. Linville, wherein she
expressed the desire to lease the property located on the
north side of Ramona Boulevard at Puente Avenue known and
designated as 15023 East Ramona Boulevard, Baldwin Park, for
use as a drive-in theater. This property is presently
zoned M-I for light industrial use, and it was requested
that Council determine that the proposed use is similar to
the businesses permitted in the M-I zone, and is not more
obnoxious or detrimental to the public welfare than enter-
prises enumerated in the M-I section.
City Clerk Backus administered the oath to those in the
audience desiring to speak before Council.
Mr. M. B. Burger of Coldwell Banker and Company, Realtors,
900 Wilshire Boulevard, Los Angeles, California, who rep-
resented both the owner, Mrs. Linville and the Lessee, Mr.
Langford, in an effort to locate a drive-in theater on the
site. He stated that the property is industrially zoned

and proposed to install the theater on the rear approximately
7 1/3 acres of the property, leaving some property, approxi-
mately 2 1/2 acres, fronting on Ramona Boulevard with access
to Ramona Boulevard for ingress and egress to the theater.
He further stated that a theater would be no more detrimental
or objectionable than many other uses found in the M-I zoning;
that much consideration and effort had been effected to sub-
mit this property to every possible individual and company that
might possibly be able to use it but, to date, had not had a
serious proposal for industrial use on the property.
Discussion followed wherein City Attorney Gorlick clarified
the intent of the request with regard to permitted uses
under M-I zoning, and stated that a public hearing would not
be necessary on this particular case, that Council could
make the determinations and findings without referring back
to Planning Commission. Councilman Bt,shop expressed the opin-
ion that the people should be permitted to develop their land
as long as use is permited in M-I zoning. Councilmen Little-
john and Holmes questioned the matter of noise, possible
complaints and the matter of congestion of traffic.
Mr. Burger reassured Council that there would be no congestion
of traffic on Ramona Boulevard itself as the exiting of cars
is late at night when normal traffic is.at a low ebb. He
further stated that the property had been on the market for
4-5 years and that a sign had been up for over a year; that
the property was too far away from the freeway to attract
industrial development; that they had solicited offers and
reduced the price with no serious offers having been received.
City Clerk Balkus administered the oath to Mrs.Madelyn P.
Linville, 15023 East Ramona Boulevard, Baldwin Park, owner
of the property, who stated that at least two years ago she
had talked to,the Baldwin Park Chamber of Commerce about
her ten acres that were available, and was told that the
office did not know there was a large piece of land left
in Baldwin Park.
City Attorney Gorlick stated that Council's action would
automatically place drive-in theaters in M-I zone, and that
it was not necessary for the Planning Commission to take of-
ficial action and actually recommend it as a use in M-1 zone,

Mayor Cole announced that it was 8:00 o'clock p.m. and the
time and place for public hearing on a Special Use Permit to
erect bulk plant facility on Joanbridge Street approximately
670 feet east of Maine Avenue, Shell Oil Company.
Planning DGirector Mansfield presented the findings of the
Planning Commission and that they recommended approval, sub-
ject to the conditions listed in Resolution No. 523.

Regular Meeting of the Baldwin Park City Council
At this time Mayor Cole asked if there was anyone in the
audience desiring to speak either in behalf of or in op-
position to this request for Special Use Permit.
Mr. Ralph A. Canaday, 1236 Siesta, Anaheim, representative of
Shell Oil Companu, 1085 North Palm Street, Anaheim, California
spoke in behalf of the request asking that this proposal be
approved as submitted; that this was for consumer and commercial
business... that there would be no large deliveries to service
stations.
Considerable discussion followed wherein Council questioned
if the proposed alley, as shown on the plot plan, would be
improved.
City Clerk Balkus administered the oath to Bill Zachary,
276 W. San Bernardino Road, Covina, Realtor, representing
the seller, who stated that there would be no increase in
insurance rates in the area in the event this special use
permit was granted.
Mr. Chan La Fey of Shell Oil Company, 1085 North Palm,
Anaheim, California, stated that it was unfortunate that
the proposed alley was shown on the plot plan, as it was
simply a method of enabling them to lay out their plant,
and not proposed as a dedicated alley; that ingress and
egress to the bulk plant will be from Joanbridge street;
that they do not propose using this property.
City Clerk Balkus stated that the proper publications, mail-
ings and notices had been made and that no letters of protest
had been received.
Mr. Leon F. Edwards, 14508 California Avenue, Baldwin Park,
questioned the effect this would have, in the future, on real
estate adjoining this property, and if it would cause de-
preciation.
Planning Director Mansfield stated that the property to the
south is largely vacant and would probably be constructed
upon thereby providing a screen for the bulk plant, and
that no direct effect would be suffered.
As there was no one else in the audience wishing to speak
in behalf of or in opposition to, Mayor Cole declared the
hearing closed.
COUNCILMAN HOLMES MOVED THAT COUNCIL INSTRUCT THE CITY
ATTORNEY TO PREPARE THE PROPER RESOLUTION, THAT THE NEC-
ESSARY CITY OFFICIALS BE AUTHORIZED TO SIGN, AND THAT THEY
ARE IN CONCURRENCE WITH PLANNING COMMISSION RESOLUTION NO.
523, WITH THE EXCLUSION OF THE ALLEY. COUNCILMAN BISHOP

Planning Director Mansfield explained the findings of the
Planning Commission and that they recommended approval of
the proposed amendment to the zoning ordinance.
City Clerk Balkus stated that the proper publications,
mailings and postings had been made.
Mayor Cole asked if there was anyone In the audience de-
siring to speak in behalf of or in opposition to the amend-
ment of this ordinance.
Mr. Robert C. Larson, 4331 North Cutler Street, Baldwin Park,
stated that his wife has a day nursery and had asked for an
increase to ten 10) children being six 6) besides their
own four).from the State and was granted it, but now they
wondered if they would be in violation of the City's ordi-
nance. He also questioned if a license was required; stated
that he felt that restrictions were being placed on day
nurseries; wondered who would be policing the day nurseries
with regard to licensing.
Chief Administrative Officer Asmus stated that the City was
not in conflict with the State's regulations, that our only
Intention is to regulate as far as zone Is concerned; that a
variance can be requested, if desired, and processed for
$100.00; that licenses were required from those operating
day nurseries at a fee of $24.00 yearly. Mayor Cole stated
that the City would work with the State in policing" the
operators of day nurseries as to licenses.
As there was no one else in the audience desiring to speak
either in behalf of or In opposition to, Mayor Cole declared
the hearing closed.

The City Council of the City of Baldwin Park does
ordain as follows:
Section I. That paragraph 5 of subsection b of
Section 9100.207, paragraph 5 of subsection b of Section
9100.212 and paragraph 14 of Section 9100.231 of the Bald-
win Park Municipal Code are amended to read as follows:
Day nurseries, child care homes and foster homes,
provided the occupant of the premises is licensed to operate
such nursery or home by the County Welfare Commission, has
complied with all of the requirements for operating such
nursery or home, has registered his name, location of resi-
dence, and number of children cared for with the Planning
Department, and provided further that such licensee of a
day nursery limits the number of children kept on the

premises to seven, including his own, and that such
licensee of a child care home or foster home limits
the number of children kept on the premises to five
including his own.
Section 2. That three new sections are added to
said Municipal Code, to read as follows:
Section 9100.129.1 Child Care Home. Child Care
Home" means a public nursery where children are kept and
trained during the day.
Section 9100.132.5 Day Nursery. Day Nursery"
means a privatehome in which children are cared for while
their parents are at work.
Section 9100.135.2 Foster Home. Foster Home"
means,a home in which a foster childais reared.
Section 3. The City Clerk shall certify to the
adoption of this ordinance and cause it to be published as
required by law. This ordinance shall become effective
thirty days after the date of its adoption.

Councilman Littlejohn reported that he had attended the COUNCILMAN
Civil Defense Meeting and stated that Councilman Ingram LITTLEJOHN REPORTED
of El Monte was now temporary chairman of the group, RE CIVIL DEFENSE
until they meet again, at which time they will attempt MEETING.
to select another Area Director; that the budget had not
been adopted, and would not be until it was decided what
they would do regarding the administrative officer; that
anumber of things would be discussed at that meeting,
i.e., $150.00 insurance for the director's car; that
he believed they would meet on the 27th of May and in-
vited other members of Council to attend.

Water Association meeting last Wednesday, May II, 1960, REPORT ON UPPER
wherein a complete report on the water problems in the Upper SAN GABRIEL VALLEY

Regular Meeting of the Baldwin Park City Council
City Attorney Gorlick reported on the Bringle case in Orange
County that involved a variance in which the Board of Super-
visors required that, as a condition of the variance, the
property owner dedicate a portion of the property and Im-
prove it. The District Court of Appeals held that the con-
dition was invalid. However, the California Supreme Court
has reversed the decision of the District Court of Appeals,
holding that the dedication was a valid condition.

City Clerk Balkus requested that the following be set for
hearing on June 6, 1960; I) Zone Case Z-7-3, H Via, and
2) Amendment to Section 9100.251 of the Baldwin Park Muni-
cipal Code to permit trampoline centers in C-2 zones.

Planning Director Mansfield presented Lot Split Case No.
257, a request by Maurice Stern for a lot split at 13649
Monterey Avenue, Baldwin Park. Mr. Mansfield explained
the findings of the Planning Commission and that they
recommended approval of the lot split subject to the
conditions in Planning Commission Resolution No. 534.
Discussion followed wherein Mr. Mansfield was instructed
to inform the applicant to pick up the Code Section which
defines setbacks where poultry ranch exists.

Planning Director Mansfield presented Lot Split Case No. 258,

the findings of the Planning Commission and that they recom-
mended approval of the lot split subject to the conditions
in Planning Commission Resolution No. 535.

COUNCILMAN HOLMES MOVED THAT THE FINDINGS OF THE CITY

how many were planning to attend the League of California
Cities in Glendora on May 19, 1960, at the Palms. Council-

attend.
Chief Administrative Officer Asmus presented the matter of
an ordinance authorizing issuance of citations for ordinance
violations, which Council had requested the City Attorney to
investigate, a report of which was provided them.

City Attorney Gorlick reported on the matter of retaining
outside counsel for the Hopkins-Caillier case, with the
recommendation that Council employ the firm of Musick,
Peeler and Garrett, 631 Hope Street, Los Angeles, Calif.,
who specialize in appellate work. He further stated that
the standard-rates charged by all firms in that category,
on an hourly basis, was $25.00 per hour for associates in
their office, $35.00 per hour for junior partners and
$50.00 per hour for the senior partners; that a senior
partner would actually appear in court on the day of the

Gorlick stated that, after discussion of the case with this
firm, and based upon what should occur in court, it was be-
lieved that the cost would be around $1,500.00. However, if
unforeseen difficulties develop, fees could go as high as
$5,000.00.
Discussion followed wherein Councilman Littlejohn expressed
the opinion that, due to his familiarity with the case, Mr.
Gorlick should represent the City;'that help would be pro-
vided him, if needed; that he had confidence in the ac-
complishments of Mr. Gorlick.

Chief Administrative Officer Asmus presented a letter from
the Citizen's Committee for the Betterment of Baldwin Park,
signed by nine people, wherein they submitted the name of
Mr. Morris Coppersmith, Attorney, 211 South Beverly Drive,
Beverly Hills, California, for consideration in the employ-
ment of outside legal assistance, due to his familiarity
of the many aspects of the case. Councilman Holmes com-
mended Mr. Coppersmith on his fine job of representation
of the Citizen's Committee at previous public hearings and
publicly recognized his ability as an able attorney, express-
ing gratitude for his interest in City matters.
Chief Administrative Officer Asmus reported that he had had
a call from Chief Robinson of the Fire District, in which he
had asked that the City of Baldwin Park send a telegram. to
the Board of Supervisors opposing the reduction of the work
week from 62.9 hours per week to 56 hours per week. Both
Chief Robinson and Chief Klinger are very much opposed to
this as it would increase the tax rate over the entire
district.
COUNCILMAN BLOXHAM MOVED THAT A TELEGRAM BE SENT TO OPPOSE
THE COUNTY FIRE PROTECTION DISTRICT'S FIREMAN'S UNION PRO-
POSAL TO REDUCE THE WORK WEEK FROM 62.9 HOURS PER WEEK TO
56 HOURS PER WEEK. COUNCILMAN BISHOP SECONDED. The motion

on the Los Angeles Street Channel be employed by the City
to draw plans for the improvement of Los Angeles Street
at the same time the channel is put in. Inasmuch as the
reports were lengthy and involved, Mr. Asmus felt that
Council needed time to study them, so suggested that a
study meeting or an adjourned meeting be set for decisive
action.
Council suggested adjourning this regular meeting to next
Monday night, May 23, 1960, at 8:00 o'clock p.m., in order
to render decisions on these two matters.

Councilman Littlejohn mentioned the matter of the clean-up
campaign, suggesting to Council that this be a yearly pro-
gram; that the accumulation of debris was a hazard to the
health and welfare of the citizens and degenerates the ap-
pearance of the City. Chief Administrative Officer Asmus
stated that the site for the disposal of this accumulation
was in the process of being prepared; that a news release
pertaining to the city-wide clean-up campaign had been
issued; that a mass distribution of notices throughout the
schools was being prepared for release tomorrow.

City Clerk Balkus clarified for Council's information, the
fact regarding the Madelyn P. Linville request earlier on
the Agenda wherein Council was asked to determine that a
drive-in theatre be permitted under M-I zone at Ramona
Blvd. and Puente Avenues, that Mr. Burger did go to
the Planning Department first; that he also talked with
City Attorney Gorlick, and he was told to refer the matter
to the City Council...therefore, his appearance before their
body tonight.

Chief Administrative Officer Asmus presented the matter of
the approval of the specifications for the painting of the
Interior of the Municipal Auditorium, giving clarification
of the items of work to be accomplished, and stated that
probably, a call for bids could be set for the 20th of June.
