session at the above place at 7:30 P.M.
Councilman Littlejohn led the salute to the flag.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK COMMENDING ADOPTED.
JAMES FRANKS FOR BRAVERY"
WHEREAS, on May 25, 1960, James Franks of 4870
Anniston Street was delivering his Wednesday morning papers
when he observed smoke billowing from the home of Mrs.
Genevieve Rowan of 4842 Elizabeth Street; and
WHEREAS, without hesitating, James Franks ran around
the small house and on entering the front door, he saw Mrs.
Rowan, a victim of arthritis, leaning over her flaming bed.
James carried Mrs. Rowan out of her house to the front lawn
and covered her with a blanket; and
WHEREAS, James Franks re-entered the house with a
garden hose and extinguished the flames and then ran across
the street and asked a neighbor to call the Fire Department;
and
WHEREAS, James Franks acted with the highest degree
of efficiency, coordination and dispatch and with complete
disregard for his own personal safety; and
WHEREAS, by his prompt action, James Franks saved
the life of Mrs. Genevieve Rowan and deserves the gratitude
and commendation of the citizens of the City of Baldwin Park;
NOW, THEREFORE, the City Council of the City of
Baldwin Park DOES HEREBY RESOLVE:
That James Franks Is hereby highly commended for his
prompt action in saving the life of Mrs. Genevieve Rowan, a
citizen of Baldwin Park.

At this time Mayor Cole presented James Franks'with a framed
parchment copy of the Resolution coaending him.

City Clerk Balkus presented and read a letter from the
Baldwin Park Chamber of Commerce requesting that Council
allow'the'same budget for promotion and publicity as was
budgeted for the fiscal year of 1959-60, being $6,009.00.
Mayor Cole stated this was a matter of information only
and would be discussed during the budget session.

City Clerk Balkus presented and read a letter from Mr. C.R.
Cook, 14550 East Garvey, Baldwin Park, thanking the officials
of this City for their support and cooperation, and commending
the Planning Commission, City Engineer and the Building Dept.
on their courteous help, including the excellent job of
policing the area done by the Police Department. Mayor Cole
stated this was a matter of information only.
City Clerk Backus presented a letter from the Baldwin Park
Theatre, Mr. A. L. Sanborn, wherein he acknowledged the
receipt of a copy of Resolution. No. 60-44, offered his
thanks" and future further assistonce, if.needed, and en-
closed a list of the major film distributors for use in the
transmittal of Resolution No. 60-44 which pertains to the
urging of exhibition and distribution of motion pictures
which are not a menace to the morals of the people as a
whole. Mayor Cole stated this was a matter, of information
only.

Councilman Littlejohn reported that he had attended a Civil
Defense meeting last Friday, June 3, 1960, at which time the
$150.00 car insurance coverage for the director was deleted
by the Board; that a meeting would be held a week from Satur-
day, in Monrovia, at 9:00 o'clock a.m., for the consideration
of six applic ations for the position of Director of Area 0".

Regular Meeting of the Baldwin Park City Council
City Clerk Balkus stated that two applications for Alcoholic
Beverage License had been received, being: I) Gladys 1. and
Paul E. Larcomb Pee Gee), 14946 E. Ramona Blvd., 2) Donald
Zak, 13847 E. Garvey Avenue. Also, one application for Trans-
fer of Alcoholic Beverage License had been received, being:
Frances D. and Jimmie D. Wood, 14313 E. Garvey Avenue. Mayor
Cole stated this was for information only and ordered that
they be received and filed.

Chief Administrative Officer Asmus presented the matter of
the Street Sweeping Contract with the R. F. Dickson Company,
9455 Washburn Crossing Road, Downey, wherein he recommended
that the Mayor and appropriate City Officials be authorized
to execute on behalf of the City of Baldwin Park, a street
sweeping agreement entitled Street Sweeping Contract" for
the period July I, 1960, through June 30, 1961. Mr. Asmus
further stated that the cost would be $1,225.51 per month;
during the term of this contract, Contractor shall sweep
all the residential public streets in the City at least
once.a week and all the commercial public streets in the
City at least three times a week, and all paved alleys with-
in the City once a month at no charge to the City; any curbs
and gutters installed after July I, 1960, shall be swept
promptly upon notification to the Contractor by the City
Engineer; that the $1,225.51 monthly figure would constitute
full and complete payment for all.services rendered regard-
less.of the number of new curbs and gutters installed during
the term of this agreement.
COUNCILMAN LITTLEJOHN MOVED THAT THE CITY OF BALDWIN PARK ENTER
INTO AN AGREEMENT WITH THE R.F. DICKSON COMPANY, 9455 WASHBURN
CROSSING ROAD, DOWNEY, CALIFORNIA, FOR THE PURPOSE OF STREET
SWEEPING FOR THE PERIOD JULY I, 1960 THROUGH JUNE 30, 1961, AT
A MONTHLY COST OF $1,225.51 PER MONTH, AND THAT THE PROPER CITY
OFFICIALS BE AUTHORIZED TO EXECUTE SAID AGREEMENT. COUNCILMAN
BLOXHAM SECONDED. The motion carried by the following vote:

Chief Administrative Officer Asmus presented the matter of
a request for an allocation for two Econolite Traffic Counters
by City Engineer Young, and recommended that an amount, not to
exceed $1,036.40, plus sales tax, be approved for their pur-
chase. City Engineer Young reported that this counter records
on a polar graphic chart the total number of cars for whichever
timing Is set to be recorded; It will record either for 24 hours
or can be set to record for 7 days; no additional manpower is
needed to total the results.

Regular Meeting of the Baldwin Park City Council
Chief Administrative Officer Asmus presented a request for re-
funds of 1960 business licenses, recommending that 1) a full
refund of $18.00 on business license #4319, issued 5/11/60, be
authorized for return to Mr. John Early, 4223 Filhurst-Street,
Baldwin Park 2) a refund of $4.00 be authorized as partial re-
fund on business license #3311, issued to Bardahl of California,
7565 Melrose Avenue, Los Angeles 46, California.

Mayor Cole announced that It was 8:00 o'clock P.M. and the
time and place for public hearing on Zone case Z-73, H. Via,
Baldwin Park Boulevard and Bess Avenue.
City Clerk Bslkus stated that the proper publications, postings
and mailings had been accomplished.
Planning Director,Mansfield presented a summary of the public
hearing held by the Planning Commission, locating the area in-
vbived.on maps for Council's benefit. He further reported that
Planning Commission Resolution No. 538, which was adopted on
May 19, 1960, being a regular meeting of the Planning Commission
recommended approval of the requested zone change, and that the
proposed gone change ordinance be~adopted.
At this time Mayor Cole requested that everyone wishing to
speak either in behalf of or in opposition to this zone
change, stand and take the oath. City Clerk Balkus then
administered the oath.
Mayor Cole asked if there was anyone in the audience wishing
to speak in behalf of the zone change.
Mr. H. 6. Hamilton, 2005 North Olive Street, Santa Ana, Calif.
representative of the Pine Ridge Lumber Company interests, stated
that since the last meetings there have been no great changes in
their hopes to utilize the area; that they have filed two letters
being: 1) stating their plan to do a certain amount of screening
planting along the wash on the west side of the area 2) sub-
mission of a letter that refuted an allegation that they had been
barred from the City of Industry; that, with concurrence of the
Planning Commission, they had restudied their suggested layout
deriving features that would be of greater benefit to the neigh-
borhood residences; that, as indi-cited before, they expect the
building to have 18' high sideweils, and that by being'almost
continuous, would provide the maximum of baffle from the activ-
ity area within. He further stated that'they had never contended
that this would be a completely noiseless operation; that several
of the Planning Commissioners had made unannounced, unscheduled
visits to both Regal Door Co. and Pine Ridge Ler Co., during
routine operations, and that their approval of Planning Com-
mission Resolution No. 538 was indicative of their observations

and findings. Mr. Hamilton's conclusive statement was that
the applicants are prepared to spend many thousands of dollars
with which to build a new and modern plant that would be a
credit to Baldwin Park, contributing materially in drawing
Industry to this City.
Mr. Bud Tucker, 1012 North Baldwin Park Boulevard, Baldwin
Park, stated that he owned approximately 34 acres across the
street from this location, and that he had no objections to
an M-I zone, being an A-I zone at present.
Mr. Burl L. Watson, 13057 East Garvey, Baldwin Park, stated
that he was the major owner of most of the adjacent property
at the back end of the proposed Regal Door and Pine Ridge
Lumber Co. site, with exception of 175 lineal feet, and plan-
ned to Improve that particular acreage with apartments and
income properties. He further stated that as far as his
property was concerned, there were no objections to an M-1
zoning.' In answer to a query from Councilman Bloxham, Mr.
Watson stated that he was a former owner of this property,
but no longer participated in its ownership.
As there was no one else in the audience desiring to speak
in behalf of, Mayor Cole asked for those wishing to be heard
in opposition to the zone change.
Capt. D. W. Asquith, 13138 East Judith Street, Baldwin Park,
spoke in opposition to the zone change request, questioning
how this area could be zoned M-1 when no one knows what the
exact boundaries are and requested clarification.
Planning Director Mansfield stated that he would provide
Capt.-Asquith with a map and legal description of the area.
Capt. Asquith further stated that the average citizen does
not know the technicalities of operating City Government and,
therefore, elects those who, in his estimation, will serve
best; that, at the first meeting there were only 3 or 4
people present in protest to this zone change..then a peti-
tion bearing 39 sigatures in protest was presented..and
another petition in protest bearing 119 signatures was pre-
sented..and now, a petition in protest bearing over 130
signatures was presented and read, as follows:

We, the undersigned, to preserve and
to protect the public peace, health,
safety and welfare within the area
posted by the City of Baldwin Park,
California, Planning Commission, as
well as the area affected, by Zone
Change Case Z-73 and Ordinance No.
149, their successors, if any, hereby
protest to the City Council of the
City of Baldwin Park, California, the
Zone Change Case Z-73 and Ordinance
No. 149 and/or their successors, if
any, regarding the rezoning of A-1
and R-3 property locared near Bess
and Baldwin Park Boulevard to an
M-I zone".
Capt. Asquith continued by stating that everyone signing
that petition, including himself, protested M" zoning as
such and quoted from Section 9100.271, paragraph d" and e"
of the Interim Zoning Ordinance, expressing the opinion that
they are definitely on record as being against the passing

of any zone changes whatsoever until such time as our present,
or future City Government can provide and establish a better
method of zoning the City; that they have waited four years
for the Master Plan, at a cost of $28,000.00, with none in
evidence, as yet; that it was conceivable that an unscrupu-
lous person could approach our City Government for considera-
tion of'special zoning, with such being granted, with or with-
out the people's knowledge.
Capt. Asquith concluded by stating that the City Council, as
their representative government are responsible for the acts
of those appointed, therefore, it is their duty to remove the
members of the Planning Commission for inefficiency due to
their faildre to produce a Master Plan of the City within a
reasonable length of time, with an expenditure of at least
$28,000.00.
Mayor Cole stated that the Master Plan Is not a secret docu-
ment and that public hearings will start. within a very short
time. Chief Administrative Officer Asmus stated that the
first general hearing on the Master Plan, although not a
public hearing, will be held this week, and that the work,
to this point, has not been a secret to anVone...that the
material is available for perusal by.the people.
Councilman Holmes stated that it had only been slightly over
two years that Council had instigated the Master`Plan; that
the amount was $14,000.00, not $28,000.00, and that half of
that amodnt was supplied by the Federal Government, leaving
$7,000.00 to be supplied by the City.
Capt. Asquith further stated, in'response to Councilman
Littlejohn's query as to his protestation of M" zoning
as such", that M-i zoning gives too much privilege with
no restraint; that they did not want Xi" zoning in this
residential area; that they were not protesting industry
itself as much as the M-l" zoning. He also questioned
whether the Planning Commissioners were paid salaries
out of the Master Plan Funds.
Councilman Holmes stated as a mattet^ of information that
the Planning Commissioners do'not.receive compensation for
their services. Mayor Cole stated, as a matter of clarifi-
cation, that the Planning Commission did not reopen the
hearing and that no further testimony was given. City
Attorney Gorlick qualified the clarification by Mayor Cole
stating that the hearing had not been declared reopened
and that the decision of the Planning Commission would
have to be based on the record made at the hearing.
Mrs. Sigmund Lorenz, 4150 Bogart, Baldwin Park, spoke in
favor of the zone change, stating that she had lived In
Baldwin Park almost 24 years, and it was her opinion that
the City could have grown faster if not held back by citizens
protesting Industry.
Mr. Robert Kallemeyn, 13088 East Torch Street, Baldwin Park,
spoke In opposition to the zone change, stated that, with
regard to Mrs. Lorenz, she lives, on the other side of the
Freeway and had nothing to do with the area under discussion;
questioned if the petition spoke for the people or if a
parade of the polls" was necessary; stated that he worked
beside the Regal Door Company and that the plant was ex-
tremely noisy, dirty and cluttered and presented, as a matter
of record, photographs to substantiate his statements; that
the noise from this factory would be heard by them, regard-
less of buffer zone erected.

Mayor Cole, as a matter of record, stated that various members
of Council had gone through the factory now in operation in
E l Monte.
Mr. Edwin Elko, 13057 Bess Avenue, Baldwin Park, spoke in op-
position to the zone change, taking exception to a statement
in the Planning Commission Minutes, being, the feeling among
the residents did not appear to object to the zoning, but the
intended use"...that it was a false statement inasmuch as
they had no way of knowing what would happen once they got
the zoning, that it would then be impossible to control it;
referenced Section 9100.271, paragraph c", regarding ferti-
lizer plants, in pointing out the need for more than an M-I
zone; questioned the type of operation of the Regal Door
Company and the Pine Ridge Lumber Company, calling attention
to the hazards involved; made reference to Webster's Diction-

of millwork(; referenced the Interm Zoning Ordinance, Section
9100.271, item b", number 189, regarding not permitting a
Planing mill; that they were never against the use as presented
but the entire M" zoning; referenced Planning Commission
Resolution No. 538, Page 2, paragraph 8, regarding the number
of people speaking in favor of Z-73; made correction of
paragraph 10 of said resolution regarding the total number
of signatures presented; felt that those living on the
fringe area" should also be represented; that the address
as given by Mr. Burl Watson was that of his business and
not residence; commented regarding the space buffer" as
proposed and on the eyesores" located on Dalewood at the
west end of town, south of the Freeway, adjacent to the
Freeway fence and showed photographs for substantiation;
that better categories under M-1 are needed for protection
and cited examples; that all the people were not allowed to
offer testimony due to some being outside the 500' radius.
Councilman Littlejohn stated that a person owning land has
the privilege of establishing the price...that the problem
was whether the land is of greater value to the City as M"
land or as A-i and R-3. He also questioned the validity of
the statement. that the Planning Commission absolutely re-
fused testimony from people beyond the 500' radius.
Councilman Holmes questioned, as a matter of clarification if
the zone R-3 was in effect when Mr. Elko and neighbors built
single-family residences that, if the people wanted to, they
could still develop heavy residential multiple units on the
back end of those lots and nothing could be done about it;
and stated that, at the last hearing, emphasis was not on
zoning as much as the type of industry...although it was
understood that what occurred at the previous hearing had no
bearing now.
Mr. Elko further stated that, probably, at the time people
purchased these lots financing was not available to them,
nor the trend not yet developed for multiple residences as
it is today; that until the M" zoning is revised, it would
be dangerous to make a change, even on the north side.
Mrs. Dorothy Soffee, 13013 E. Torch St., Baldwin Park, spoke
in opposition to the zone change, stating that, at the last
meeting of the Planning Commission it was stating that the
piece of machinery to be installed was definitely a planer";
that the term planing mill" had been used on 2 or 3 occasions,
wherein parties so using the term were reprimanded and in-
structed to use the word planer"; provided the definition of
planing mill" and referenced the Interim Zoning Ordinance,
Section 9100.270, Item 189; stated that industry does not bring
in employment; questioned Council's control of the zoning
ordinance.

spoke In opposition to the zone change, stating that she had
circulated the petition and, in so doing, had talked to the
home-owners in that area, and that they were definitely against
the M" zone...that they did not want M-I In there; that they
all respected Mr. Via but would appreciate hisrespect in return,
and be considered in the sale of his land, in that It would not
be detrimental to the homeowners In the area; that there were
approximately 100 homes in this area, 200 children and it was
a lovely quiet neighborhood; wondered why so much consideration
had been given the prospective buyer thought that It should
be between the people and the owner; stated that they repre-
sented 98% of the people in this area as being against the zone
change; that they appreciated Council hearing them and giving
consideration to their expressions of opposition.

Mrs. T. Gilliam, 13135 E. Judith, Baldwin Park, spoke in
opposition to the zone change, stating that she has lived at
this address for 12-13 years, which was very close to the
proposed change of zone; that when they purchased this prop-
erty they were seeking peace and quiet; she requested that
her letter of protest; addressed to the City Council be
read In full.

Gentlemen,
I attended the last meeting of the Planning Commission in
which one of the main subjects-of discussion was the rezoning of
property from A-I & R-3 to M-I,.Case No. Z-73.
It seemed quite certain to me that a 50' sound barrier of
wash was a chief element in the case, but are you gentlemen aware
that the rains of former years have cut that wash to less than
100' of our home. When you speak of a company planting and putting
building with equipment fifty feet back on this property that means
It's less than 200' of our back door not-ofr property line. Part of
our property line is only 25' distance from this proposed zoning.
Also, wouldn't that type of machinery or any electrical machinery
of this type) require an excess of electrical voltage which I feel
certain would hinder our electric appliances.
I have maintained our home, 13135 E..Judith with my folks for
the past twelve years and more, the last 6 with only my Son and
Mother. My mom's bedroom is toward the back of the house, her
home is her rest and enjoyment; also our television and radio are
main source of entertainment.
When my Dad bought our property from Mr. Watson, he had been
promised a row of trees along the wash to hide the view. Since
you can see there are no trees or shrubs planted, we are doubtful
about the promises.
We are opposed to this zone change and request that you re-
view this case very seriously.

Regular Meeting of the Baldwin Park City Council
Mrs. Alice Elko, 13057 Bess Avenue, Baldwin Park, spoke
in opposition to the zone change, questioning if Council
could exercise any control in protecting the people in resident-
ial areas in the event of proposed zone change; that she was in
complete opposition to a change of zone; that their area was
one of the nicest in Baldwin Park and to allow M-1 zone would
destroy the beauty.
Councilman Holmes clarified the point of control, with further
elaboration by both Councilman Bishop and Littlejohn.
Mrs. A. C. Marsicovete, 13067 Bess Avenue, Baldwin Park, spoke
in opposition to the zone change, stating that she preferred
It remain residential, due to Its beauty; that homes would be
more beneficial to the City than manufacturing; that the Code
was not strong enough to protect the interests of the home
owners.
Mr. Clyde Soffe, 13013 East Torch Street, Baldwin Park, spoke
in opposition to the zone change, stating that he has lived
in the area for 51 years, having moved there because of its
beauty and being residential; protested changing the A-I and
R-3 zoning to an M-l zoning.
Mr. Gerald Smith, 13025 E. Judith St., Baldwin Park, spoke in
opposition to the zone change, stating that he was not in
accord with the M-1 zoning as it was,not compatible next to
R-3; that he had purchased the property in order to provide
a large place for his children to play off the street; that
the purchase had been made in good faith, without the thought
of any possibility of a zone change.
Miss Elise Riemer, 13305 East Waco, Baldwin Park, expressed
her opinions regarding the zone change by stating that the
City is a unit since incorporation; that the people should
consider the benefits derived through M" zoning...that
manufacturing elements ease the tax burden; that a zone
change in the City does not affect just the people within
the 5009 radius, but all citizens; that she wanted to see
business come into the City...that it would aid our income
and prestige.
Mrs. Maryann Huetinck, 13059 E. Torch St., Baldwin Park,
spoke in opposition to the zone change, stating that we should
strive for better things..not worse; that little would be
derived in taxes from a plant that size.
Mrs. T. Gilliam, 13135 East Judith, Baldwin Park, spoke again
stating at one time, her father had been active in stopping
a petition for the riddance of Mr. Visa turkeys...but this
time there was no awareness of what he had in mind.
Mr. Robert Kallemeyn, 13088 East Torch Street, Baldwin Park,
again spoke, stating that they had sent a letter to the
Attorney General being that the petition was on file, and

Dear Captdin and Mrs. Asquith:
I am in receipt of the Termofax copy of a letter
addressed to Attorney General Stanley Moak, re-
garding the zoning problem you are having in Baldwin
Park.
As I am certain you are aware, zoging is strictly a
local matter, involving either the.city or county, as pro-
vided for in various sections of the government Code. There
is no immediate action that I might,take to alleviate this
situation;
In the past, I have found the City Councilmen and the
City Administrator in Baldwin Park'to be responsive to the
needs and wishes of the community, and I sincerely hope
that this situation may be resolved in good faith to the
mutual satisfaction of all concerned.

It seems rather unusual to me that's group of elected
City officials find it their duty to so completely disregard
the will of their constituents;—
I vilently oppose the proposed zone change on the property
directly behind the home I live in! Of course, being a rental
tenant and not a tax payer, my opposition is a very minor con-
cern of yours. But it seems you fall to realize it is of great
concern to the property owner, Mr. Otto Gall.
I pay this property owner S1100.00,per year for the use of a
home that is located In a choice residential district. It
would be impossible for anyone to live in-this home if the
proposed manufacturing concern were allowed to build on that
site. Do any of you on that City Council have any idea of
the noise a power saw or planer are capable of making? Have
any of*you ever been near any type of concern that employs
a power planer to manufacture this product? That one machine
alone transmits enough noise to-be easily heard•A to # mile
away.
I can easily believe that you are capable of doing this to
these people. 1, then, also find your integrity of a questionable
natu*e. For s minor faction to achieve their aims against the
majority is'supposed to be almost unheard of, particularly in
city government.
I am a resident in this neighborhood, therefore, I feel my
opposition should be as prime a concern as any property owner
in this vicinity. Thank you.

Mr. H. G. Hamilton, 2005 North Olive Street, Santa Ana,
California, spoke in rebuttal, stating that he represented
the people who are interested in acquiring this piece of
property; that they did not circulate a petition as they
felt that the people in the area would represent themselves
and the elected officials would represent the rest of the
citizens of the City; that, in clarification of the dirty
and uncluttered appearance of the Regal Door Company as pre-
viously referenced, said condition was because the present
ownership and interests of Regal Door Company have had title
for about one year, and furing that time, isich of that year
has been spent in planning a new location and the layout of
a new modern plant; that a great deal of time has been spent
in trying to locate a piece of property that would be suitable;
that it was not good business to spend time, money and effort
in cleaning up an Inherited mess; that there has been an er-
roneous Impression as to the nuisance value of the piece of
equipment that would be operated; that if they were able to
acquire the property, they would do everything possible to
minimize any inconvenience to the neighbors; that the electric
company has given assurance that they would install the proper
power lines, etc., to double their expected requirement...
100% safety overload; that they are bound by the same City
ordinances and code that the rest of the citizens are, and
have every intention of complying with the code;that the
plant they would construct would be one of which the City
could be proud and would greatly contribute to the City.
Capt. Asquith again spoke, taking exception to the time of
operation of the machines that would be in use; that this
type of operation should be an M" zone...not in a resi-
dential area.
As there was no one else desiring to be heard, Mayor Cole
det4ared the hearing closed.
AT 11:00 O'CLOCK P.M. COUNCILMAN HOLMES MOVED THAT A FIVE
MINUTE RECESS BE DECLARED. COUNCILMAN BLOXHAM SECONDED.
There were no objections, the motion carried and was so
ordered by Mayor Cole.
Mayor Cole announced that the decision of zone case Z-73 was
now up to Council.
Councilman Littlejohn stated that it was his opinion the City
Council should take this matter under submission..study the
Master Plan, as being presented at a general study meeting on
Thursday night, regarding zoning, etc., before any action Is
considered on this case.
COUNCILMAN LITTLEJOHN MOVED THAT THIS CASE BE TABLED IN ORDER
TO MAKE STUDIES OF THE PROS AND CONS AND THE PROPER RECORDS PRE-
SENTED WITH A DECISION BEING RENDERED ON JUNE 20, 1960, AT THE
REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK.
COUNCILMAN HOLMES SECONDED.
Before the vote was taken Councilman Blexham stated that he ob-
jected to the matter being tabled, that he felt a decision could
be rendered tonight, thereby eliminating further prolongation of
the case. Councilman Bishop stated that the people concerned
should be notified when a decision will be made.

and have, or will provide certificates of public liability

Council's attention to Section 3100.1212 k) of the Municipal
Code which limits the number of stands to be located In the
City at eight, and recommended that Council grant permits to
eight of the nine applicants, with waiver of fee, subject to
all applicable provisions pertaining to the sale of fireworks.

Chief Administrative Officer Asmus presented the matter of the
annual review of the Examining Service Contract with the State
Personnel Board, stating that under the proposed agreement, the
City contracts with the State Personnel Board for the prepara-
tion and scoring of written examinations as requested in the
recruitment of new personnel; that the cost of this service is
billed according to actual cost, bvt will vary according to the
type of examination given; that execution of the contract will
mark the third year this service has been provided by the State
Personnel Board; that the City does not have the staff, nor the
talent, to prepare these examinations. He recommended that the
contract, known as Cost Service Contract, Form A" between the
City of Baldwin Park and the State Personnel Board for the

Chief Administrative Officer Asmus presented the matter of an
emergency amendment to the Municipal Code relative to holidays,
with special attention to that of June 7, 1960 primary"
election day, due to many of the employees being under the im-
pression it was a holiday. He stated that in checking Resolu-
tion No. 59-70, the Municipal Cade-and the State Code, It was
discovered there was a discrepancy between the Municipal Code
and the salary resolution Res. No.-59-701; that, in knowing
the intent of Council, as per Resolution No. 59-70, he had,
City Attorney Gorlick prepare an-emergency ordinance amending
Secton 2602 of the Baldwin Park Municipal Code to exiude
election day as a legalholiday.

No. 153 in full as follows:

AN EMERGENCY ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF BALDWIN PARK
AMENDING SECTION 2602 OF THE BALDWIN
PARK MUNICIPAL CODE"
The City Council of the City of Baldwin Park does-ordain
as follows:
Section I. Section 2602 of the Baldwin Park Municipal
Code is amended to read as follows:
2602. City Office Hours_ The general-City offices shall
be closed on Saturdays and on the following legal holidays:
Sundays, January 1, February 22, May 30, July 4, the first
Monday in September, September 9, November 11, December 25,
Good Friday from 12:00 noon until 3:00 p.m. and every day
appointed by the President or Governor for a public fast,
Thanksgiving or holiday.
Section 2. This ordinance is declared to be an
emergency ordinance for the public peace, health and safety.
The facts constituting the emergency are as follows: The
City Council, in Resolution No. x-70, adopted July 20,
1959,'provided for City offices 1-0 be closed on certain
specified holidays, thereby requiring that they be.opened
on all other holidays enumerated in, Section 6700 of the Govern-
men Code. Election day Is one of the legal holidays on which
it Ls intended that City offices be open. At the time
Resolution No. 59-70 was adopted, Section 2602 of the Baldwin
Park Municipal Code was inadvertently not amended to delete
election day therefrom as a holiday. Due to the fact that
Tuesday, June 7, is an election day, it is urgent that
Section 2602 be amended, to take effect Immediately.
Section 3. The City Clerk shall certify to the adoption,
of this ordinance and cause the same to be published as re-
quired by law. This ordinance, shall take effect immediately
upon its adoption.

Chief Administrative Officer Asmus presented the matter of a
request for a refund, Lot Split Case No. 252, J.W. Gaffney,
4742 N. Center Street, Baldwin Park. He stated that the ap-
plicant had applied for and filed maps with the Planning
Commission requesting a lot split creating four parcels, and
paid the required fee; that after investigation and study
the Planning Commission approved the proposed four parcel
lot split as revised by the'Planning Department, but this
was not acceptable to the applicant; that applicant later
revised the proposed split into two parcels which both
the Planning Commission and City Council approved; that,
although the ultimate split developed two parcels rather
than four, as originally requested by the applicant, it
would appear reasonable and just that the original fee
paid be retained; that the request for refund of $20.00
be denied because no refund is authorized by either
Municipal Code. Sections 9300 through 9306 or Municipal
Code Section 2528.
Further clarification was given by City Attorney and
Planning Director Mansfield.

Chief Administrative Officer Asmus presented a. report sub-
mitted by City Engineer Young pertaining to the ingress and
egress to Lome Lane from Earl Avenue, which was requested by
Council at a previous meeting.The City Engineer recommended
that no condemnation of subject area be undertaken at this
time, the reasons being:(I)that Loma Lane, a half street offers
ingress & egress off Corak Street to three parcels of land(2)
that a 5* easement completely fenced with a chain link fence,
offers school children ingress and egress to Earl Avenue 3)
that there is an existing building in the area of the requested

Regular Meeting of the Baldwin Park City Council
extension of Loma Lane 4) that the cost of the right of way
for a half street is estimated at'$3,500.00 including the
building 5) that the estimated cost of a 601 right of way
is $5,250.00 6) that the estimated cost of street construct-
ion, including curb, gutter and sidewalks for a half street
is $1,000.00 plus $500.00 for a removal of the existing build-
ing. It was the recommendation of the City Engineer that
No Parking' signs be placed on the north side of Loma Lane
to relieve any possible congestion.
City Clerk Backus read the petition containing 34 signatures
in full as follows:
We the undersigned residents of the
City of Baldwin Park, California, hereby
petition the City Council of the City of
Baldwin Park to condemn for right of way
purposes, across, and for ingress and
egress to Loma Lane from Earl Avenue, a
strip of land 60 feet wide adjacent to
the Northeasterly edge of Tract 24769
and off the Northwesterly edge of the
property at 13364 Earl Avenue. This
would provide the residents in this area
access to Earl Aveln,ue from Loma Lane"
Discussion followed wherein City Engineer proffered further
clarification locating area under discussion on the map.
COUNCILMAN BISHOP MOVED THAT COUNCIL CONCUR WITH THE CITY
ENGINEER'S RECOMMENDATION THAT NO CONDEMNATION OF SUBJECT
AREA BE UNDERTAKEN AT THIS TIME, AND INSTRUCT THE CITY
ATTORNEY TO.PREPARE A RESOLUTION REGARDING THE PLACING OF
NO PARKING" SIGNS ON THE NORTH SIDE OF LOA LANE. COUNCIL-
MAN HOLES SECONDED. There were no objections, the motion
carried and was so ordered by Mayor Cole.
Chief Administrative Officer submitted copies of the Pre-
liminary Work Budget to Council at this time.
Planning Director Mansfield presented Lot Split Case No. 264,
a request by James and myrtle I. Yates for a lot split at
12825 Cheisfield Street. Mr. Mansfield explained the findings
of the Planning Commission and that they recommended approval
of the lot split subject to the conditions in Planning Com-
mission Resolution No. 540.

on February 6, 1956, until his appointment to the City Council;
and
WHEREAS, he had contributed immeasureabiy to the growth
and development of the City during its.early formative years;

able time and effort on behalf of the citizens of Baldwin Park;

WHEREAS, the City desires to publicly recognize and express
its sincere appreciation and grbtitude for his outstanding citi-

Park does resolve that Arthur F. Wilson be, and he hereby is,

Mayor Cole announced that this was the time and place for
public hearing on amending Section 9100.257, pertaining to
permitting trampoline centers in C-2 zones.
Planning Director Mansfield presented the findings of the
Planning Commission and that they recommended approval of
this amendment In Planning Commission Resolution No. 533.
As there was no one in the audience desiring to be heard either
on behalf of or in opposition to, Mayor Cole declared the public
hearing be closed.
