The City Council of the City of Baldwin Park met In regular
session at the above place at 7:30 p.m.
Planning Director Mansfield led the salute to the flag.
The Invocation was given by Reverend Gordon H. James of the
First Methodist Church.

COUNCILMAN BISHOP MOVED THAT THE MINUTES OF JUNE 6, 1960 BE
APPROVED WITH FURTHER READING WAIVED. COUNCILMAN BLOXHAM
SECONDED. There were no objections, the motion carried and
was so ordered by Mayor Cole.
City Clerk Balkus administered the oath to those wishing to
be heard during the meeting.
Capt. D. W, Asquith, 13138 East Judith Street, Baldwin Park,
appeared before Council, stating that he was here in the
interest of good government, directing questions to the Mayor
concerning the capabilities and qualifications of the Plan-
ning Director, the length of time involved in preparation of
the amended zoning ordinance, and directed queries of a pers-
onal nature to Mayor Cole.
Planning Director Mansfield presented, for benefit of Capt.
Asquith, a resume of his educational background, and City
Attorney Gorlick gave legal interpretation of Section
9100.134, Interim Zoning Ordinance, as it referenced Chief
Engineer". Mayor Cole and members of Council answered the
questions so directed to the satisfaction of Capt. Asquith.
City Clerk presented and read a letter from Metro-
Goldwyn-Mayer, Inc. referencing our Resolution No. 60-44
which pertained to the type of films presented to the
public, wherein they acknowledged our resolution and ex-
pressed their desire nto cooperate in the presentation and
distribution of films that would merit the approval of
the City Council and the public.
Mayor Cole stated this was a matter'of information only and
no action was required.
City Clerk Balkus presented and read a letter from George A.
Hill, District Engineer, Division of Highways, State of
California, regarding the adoption of freeway routes in or
near the jurisdiction of the City of Baldwin Park, stating
that the City would have the opportunity to present facts,

Regular Meeting of the Baldwin Park City Council
etc., at a public meeting to be held at a later date.
Discussion followed wherein City Engineer Young elaborated
on the studies and investigations that will be conducted,
stating that he would keep Council informed.

City Clerk Backus presented and read a letter from Mr. Elmo
E. Cole, Secretary of the Morgan Park Board, wherein he re-
quested that Council appoint a member to serve on the Park
Board, and listed the qualifications required.
Discussion followed wherein Mayor Cole stated that Elmo E.
Cole was In no way related to him this statement occasioned
by inquiries by Capt. Asquith earlier in the meeting) and
Councilman Littlejohn stated that he would make every effort
to attend the meetings, asking Mayor Cole to serve as an
alternate.

Mayor Cole announced that It was 8:00 o'clock p.m. and the
time and place for public hearing on. Zone Case Z-74, request
for change of zone P" to M-I property situated south of Live
Oak Avenue, east of Sierra Madre Avenue, north of Joanbridge
Street, Jerry Mann and Leonard Moss.
City Clerk Backus stated that the proper publications, postings
and mailings had been accomplished.
Planning Director Mansfield located the area Involved'on the
map for benefit of Council, and presented the findings of the
Planning Convnission and their subsequent recommendations.
Discussion followed.
As there was no one In the audience desiring to speak either
in behalf. of or in opposition to, Mayor Cole declared the
hearing closed.

Regular Meeting of the Baldwin Park City Council

Mayor Cole announced that it was now the time and place for
public hearing on the Budget for the fiscal year 1960-5I.
Chief Administrative Officer Asmus presented to Council re-
vised documents in accordance with the various revisions made
during the meetings held for study of the Budget, wherein the
new figures had been incorporated, with all additions and de-
letions having been made, bringing the toll budget expendi-
ture for 1960-61 to $762,938.00. He further stated that this
figure did not include the sum of $410,000.00 plus that Council
had indicated, some time ago, that was going to be expended
from gas tax funds on major street improvements throughout
the City.
Councilman Holmes stated that he had an item to present at
this time in connection with the Budget, relative to the posi-
tion of Deputy City Clerk, so appointed by the City Clerk,
which is a responsible, detailed job, and as such should have
been included In the salary resolution, affixing compensation
for same.
COUNCILMAN HOLMES MOVED THAT THE CLASSIFICATION OF DEPUTY CITY
CLERK BE ADDED TO THE SALARY SCHEDULE AND THAT REIMBURSEMENT
BE MADE IN THE AMOUNT OF $25.00 PER MONTH FOR THE DUTIES OF THE
DEPUTY CITY CLERK, AND THAT THE CITY ATTORNEY BE INSTRUCTED TO
PREPARE A RESOLUTION TO THAT EFFECT. COUNCILMAN LITTLEJOHN
SECONDED.
With the consent of the second, this motion was held in abey-
ance until the City Attorney prepared the required Resolution.
Mayor Cole stated as a matter of information, that the tax
rate was the same as the last two years.
Mayor Cole asked if there was anyone in the audience wishing
to ask any questions.
Miss Elise Riemer, 13305 East Waco, Baldwin Park, questioned
the use of three year old cars in the Police Department, stating
that it was her feeling they were too old for the strenuous
daily police use. She further questioned the exclusion of a
walkie-talkie", wondering why it was not necessary.
Mayor Cole stated that the 1957 car in service in the Police
Department was used by the detectives in going to court, etc.,
and not used as a pursuit unit. Chief Administrative Officer
Asmus stated that the item of a walkie-talkie" had been re-
instated in the budget.
As no one else in the audience desired to speak, Mayor Cole
declared the hearing closed.

school grounds and other such suitable facilities for use
by the recreational program, if desired by the City, and that
this Board action was approved unanimously by all Board mem-
bers.
Discussion ensued.
Mayor Cole stated that this was a matter of, information only
with no action required.

City Clerk Balkus presented and read a letter from Frank C.
Campuzano, 3327 Vineland Avenue, Baldwin Park, Chairman,
Baldwin Park Youth Center Committee, requesting a permit to
operate a carnival from August 24, 1960 through August 28,
1960, on the property between McDaniel's Market and the
Baldwin Park Bowl. It was further stated that their three
aims in this project were I) to raise money for the building
of a youth center in Baldwin Park, with all profits from the
project to be deposited to the Baldwin Park Youth Center
Fund 2) to put into effect one of the points in the Governor's
14-Point Program to coordinate the efforts of the City, churches
and service clubs In an active youth program for our City 3)
to stimulate business for the merchants of Baldwin Park.
City Clerk Balkus administered the oath to Frank C. Campuzano.
Mr. Frank C. Campuzano, 3327 Vineland Avenue, Baldwin Park,
elaborated further on the aims and endeavors of this project
and the manner in which they intended to operate the carnival.
He further stated that the K AND K SHOM OF SHUNS", operated
by Mr. Kimberling, incorporated a 7-act clown circus; that
concessions would be controlled by the K and K Show of Shows
and himself; that there is a stipulation in the contract
against the operation of any Illegal games; that the merchants
would be handling the sale of tickets, thereby deriving a
benefit in increase in business.
Discussion followed wherein Chief Administrative Officer Asmus
stated that Chief of Police Torres had checked with other
cities regarding the operation of this K and K" Show of Shows,
with the determination that they run a clean" show, with no
complaints being recorded, to his knowledge.
COUNCILMAN HOLMES MOVED THAT THE PERMIT BE GRANTED TO HOLD THE
CARNIVAL AUGUST 24, 1960 THROUGH AUGUST 28, 1960, AND THAT THE
FEE OF $50.00 PER DAY BE WAIVED. COUNCILMAN BLOXHAM SECONDED.

City Clerk Balkus presented and read a letter from Mrs.
Ernest Blankinship, 811 North Frazier, Baldwin Park, re-
questing that Council waive the demand of a sidewalk in
front of their property due to the location and usage of
the walk. The lot is only 26' frontage plus a 60' lot
and would be the only walk on the property, serving no
use.
City Engineer Young further clarified the location of the
property, presenting photographs taken of the area.

Mrs. Maryann Huetinck, 13059 East Torch Street, Baldwin Park,
stated that there were quite a few children walking over that
bridge, and that they have just the gravel to walk on.
COUNCILMAN BISHOP MOVED THAT THE REQUEST FOR WAIVER OF SIDE-
WALK AT 811 NORTH FRAZIER BE GRANTED, WITH THE STIPULATION THAT
WHEN THE CITY DESIRES TO INSTALL SIDEWALKS ON THE NORTH PORTION
THAT MRS. BLANKINSHIP WILL SIGN AN AGREEMENT THAT SHE, TOO, WILL
INSTALL SIDEWALKS. COUNCILMAN HOLMES SECONDED. The motion

Gentlemen:
Rather than make a final decision on Zone Change
Case Z-73 at this time, I would like to suggest that
the Planning Commission be given 60 to 90 days to re-
view and recommend a change in the M-I zone classifi-
cation.
I believe the City Council has the authority to
delay final decision for at least 90 days, and in, this
way all* parties involved will be protected.

Í«Regular Meeting of the Baldwin Park City Council
Mayor Cole reported that he had represented the City of
Baldwin Park at Mt. San Antonio College last night, July 4,
1960, at the fireworks display put on by the West Covina
Chamber of Commerce.

Councilman Littlejohn reported that Mr. Longshore III had been
offered the position of Area D" Director, but that there had
been no further meetings.

Councilman Holmes reported that there had been no further
meetings by the Upper San Gabriel Valley Water Association,
but that there would be one held next month.

Mayor Cole reported that there would be a meeting of the
League of California Cities on Thursday night, July 7, 1960.
00-
City Attorney Gorlick reported that the Board of Directors
of the League of California Cities have decided to oppose
legislation violating the home rule prinicple, and It was
unanimously agreed that cities be urged to advise their state
legislators by resolution that any mandatory state legislation
pertaining to city employees' wages, benefits and conditions of
employment is a violation of the home rule prinicple and should
be opposed on this general basis.
Mayor Cole Instructed City Attorney Gorlick to prepare a reso-
lution for presentation at the next regular meeting with regard
to legislation violating the home rule principle.

City Attorney Gorlick reported that there was a bill now
being considered by the Interim Committee on Transportation
and Commerce which will amend the Vehicle Code to provide
that ordinances which would reduce the maximum gross wei§ht
limit of any vehicle on streets shall not be effective with
respect to such street unless provided an alternate route in
the same area. It was his suggestion that he obtain copies of
this bill for presentation to Council, and then, If desired,
particular views could be expressed to the committee.

City Attorney Gorlick reported on a ruling of the Attorney
General In connection with public works contracts, in that
contractors recently have been using a bid depository instead
of a bonding company, and in that way have created a situation
whereby the City Is not getting the protection that it should
have. He suggested that Council authorize, for inclusion in
all future specifications on public works contracts, a clause
that will preclude contractors from resorting to a bid deposi-
tory, stipulating clause to be so inserted.
Council. authorized City Attorney Gorlick to supply the City

Í«Regular Meeting of the Baldwin Park City Council
Councilman Holmes stated that, before any action was taken on
this letter from Mr. Via, he would like to be given the oppor-
tunity to present the findings be derived from a thorough study
of the case and all its involvements. He further stated that
he had reviewed the property several times; checked Into the
business that was proposed for that area; reviewed the testi-
monyy given, both before the Planning Commission and the City
Council, likewise, the written letters submitted; examined
the petitions and checked their validity; made a comprehensive
study of Section 9100.271 M-1 Zone, Interim Zoning Ordinance),
finding a total of 192 specific uses listed, 41 of which could
not be compatible adjacent to residential areas; that the M-I
zoning Ordinance, as it is now, could not be properly applied
to the property in question; that both the residents in this
area and the City should make a real effort to cooperate with
this property owner so that a compatible development can be
evolved.
Planning Director Mansfield stated that an entire revision of
the zoning ordinance could not be accomplished within 60-90
days, but that an amendment to this ordinance establishing a
new M zone, to include M-I, M-I4, could be effected.
Considerable discussion followed wherein it was the general
consensus of opinion that the M" zoning interpretation in
the Interim Zoning Ordinance needed revision to encompass a
CM, M-I, M-l4 zoning, that, as it presently exists, it is
too broad.
COUNCILMAN BLOXHAM MOVED THAT ZONE CASE Z-73 BE DENIED.
Discussion ensued wherein Councilman Bishop stated that he
would second the motion only if Mr. Via would be granted a
waiver of fee, so including this stipulation in the motion.
City Attorney Gorlick stated that, at the present time, there
is no provision in our zoning ordinance for waiver of fee, and
until there is, Council has no authority to waive a fee.
MOTION DIED FOR LACK OF A SECOND.
Mr. Edwin Elko, 13057 Bess Avenue, Baldwin Park, expressed
thanks to Mr. Via for the consideration shown to the residents
regarding this problem, and stated that he would rather have a
decision tonight, but under the circumstances, would have no
objections to holding it over until revisions of the zoning
ordinance could be made. He also felt that another public
hearing, before the Planning Commission should be held.
Capt. D. W. Asquith, 13138 East Judith Street, Baldwin Park,
stated that he felt that Mr. Via could develop something
beautifuly yet profitable on his property, such as a multiple
unit, etc. He further stated that, although he is tired of
waiting for a decision on this matter, if the suggested in-
vestigation and ultimate revision of the zoning ordinance
as it pertains to M" zoning is a sincere effort on the part
of the City, he would have no objections to the period of
waiting.
Discussion followed wherein Councilman Bishop clarified his
reasoning in not seconding the previous motion and elaborated
on the necessity of revising the M-zoning.

Mr. David Marcus, 215 West Fifth Street, Los Angeles, re-
quested information on the latest zoning master plan map
available and if it contained the proposed zoning areas.
City Attorney Gorlick stated that this Is just a Master Plan
and does not accomplish any rezoning of property...it repre-
sents goals that the City will try to achieve but does not
affect the existent zoning of any property in the City.
Mrs. Eugenia Igna, 12819 East Garvey Avenue, Baldwin Park,
stated that it has been five years since the start of the
Mastet Plan; questioned why one side of the freeway is zoned
one way and the other side another zone... wondered when it
would be made conforming.
Mayor Cole endeavored to make clarification to the satisfaction
of Mrs. i gna.
Mr. David Marcus stated that it was his opinion that you cannot
amend an emergency zoning ordinance for any legal use; question-
ed the validity of the emergency zoning ordinance... If there had
been an adjudication as yet, in the courts; questioned how long
it will take to adopt a Master Plan; questioned the percentage
of property in the City as to nonconforming use; questioned
whether there would be a limit on the value of property in cer-
tain areas.
City Attorney Gorlick answered the questions of Mr. David
Marcus, and stated that he could not say when the Master
Plan would be adopted, but that it would be at least three
months.
Clarification was made that the Master Plan does not in any
way place a limit on the value of property in any area in
Baldwin Park.
