FLAG SALUTE The invocation was given by Reverend Howard G. Sell of the INVOCATION First Church of God. City Clerk Balkus read the petition, signed by 13 persons, as follows: TO THE CITY COUNCIL: We, the undersigned owners of commercial property representing In excess of 50% of all the commercial property generally shown on the attached map, hereby petition the City Council of the City of Baldwin Park to assist us In forming a Parking District pursuant to the provisions of the Streets and Highways Code, Division 18, Part 1, Sections 31500-31933. Our preliminary investigation indicates that such action is not only desirable but necessary if the pres- ent commercial core area of our City is to grow and prosper for the benefit of the entire community. In presenting this petition the undersigned property owners have not established exact boundaries of the proposed district nor determined what parcels would be obtained Initially for parking purposes. A steering committee of property owners from the area shown on the attached map have been selected and are anxious to proceed if your Honorable Body will author- ize the employment of special legal counsel and fur- nish the necessary engineering assistance required to formally proceed." City Clerk Balkus administered the oath to those desiring to be heard before the City Council. Chief Administrative Officer Asmus presented a breakdown, compiled by the City Engineer,, regarding the area percent- ages, wherein the petition, as presented, represents 85.6% of land area; represents 80.91% of assessed valuation of land only; represents 85.8% of assessed valuation of land and improvements in the area designated by shaded area on map which is attached to the petition. He further stated that all but 5 parcels, as shown on the map, are represented by the petition as presented to Council, and have not regis- tered either approval or disapproval,as yet. Mr. A. 1. Benyas, 4113 North Maine, Baldwin. Park, spoke in favor of a parking district, stating that other cities have parking areas and that it was necessary, in his opinion, one be established here. Mrs. Faye Hickey, 4209 North Maine, Baldwin Park, spoke in favor of establishing a parking district, suggesting the area be from Ramona Boulevard to Palm Avenue, and Palm Avenue to Clark Street, and that a petition would be car- ried, if wanted. Councilman Littlejohn reported, at this tiriJe, on the find- ings resulting from the trip to the City of Pomona parking district, in that parking has been developed behind their stores, thereby providing two entrances; that it has been determined the rear entrances are being used more than the front, therefore, the merchants are making their back doors more attractive; that the people do not like to walk any great distance to do their shopping; that their parking district area is situated very similarly to the one proposed here in Baldwin Park; that the merchants in Pomona have found they have done more business since the establishment of this parking area. Mrs. Nancy June Fordam, 3437 West 77th Street, Los Angeles, 43, California, owner of the property proposed for a parking district, stated that she is willing to consider this area being used as a parking district if that is what the people want, and she would consent to negotiate, meeting with the committee on Thursday, December 8, 1960, at 10:30 a.m. COUNCILMAN HOLMES MOVED THAT COUNCIL ACCEPT THE PETITION AND AUTHORIZE THE CITY ENGINEER TO WORK WITH THE COMMITTEE TO SET UP THE OFFICIAL DISTRICT BOUNDARIES. COUNCILMAN BLOXHAM SECONDED. There were no objections, the motion carried and was so ordered by Mayor pro tem Bishop. Discussion followed wherein Councilman Littlejohn expressed the opinion that there should be a representation of people in the district at the meeting for negotiation with Mrs. Fordam, and asked Dr. Ungar to contact other members of group with regard to attending. Mayor pro tem Bishop appointed Councilman Littlejohn, along with himself, to attend this meeting, to be held in the Council Chambers of the City Hall. COUNCILMAN LITTLEJOHN SECONDED. There were no objections, the motion carried and was so ordered by Mayor pro tem Bishop. 00- Mayor pro tem Bishop announced that it was now the time and place for public hearing-on Ordinance No. 162, Amending the Municipal Code to Prohibit Vehicles Exceeding 6,000 lbs. from Using Certain City Streets. City Clerk Backus again administered the oath to those de- siring to be heard. As there was no one in the audience wishing to speak in favor of Ordinance No. 162, Mayor pro tem Bishop asked if there was anyone in the audience wishing to speak In-opposition to this ordinance. Before-testimony in opposition was taken, Chief Administrative Officer Asmus elaborated on the intent of the ordinance, and located the streets involved on a map for benefit of those in the audience. Mr. H.G. Feraud, Executive Secretary of the Southern Calif. Rock Products Association and the Southern California Ready Mixed Concrete Association, 1811 Fair Oaks, South Pasadena, stated that there are those in the area that will remember him as Father of Rivergrade Road"; that there are 1,120,000 trucks in the State of California, of which 17% are for hire' trucks and 83% are privately owned by business-people; that trucks-are assessed by the State for a weight fee, which is set by the State Legislature for repair of-weight damage to streets...this fee is in addition to registration fees; that without funds coming from the trucks, there would be-no free- ways; that 17% of the registered vehicles in the State of California pay over 1/3 of the Highway Users Taxes; that the great majority of truck travel uses Rivergrade-Road, and will continue to do so...especially when the San-Gabriel River Freeway is built scheduled to be completed within 5 years); that the trucks using the streets of the City bring necessary materials to the people; asked if Council would consider a postponement of this enactment until Irwindale Avenue is settled. Mr. Thomas J. Wallace, 16129 Doublegrove Avenue, Covina, owner of one truck, stated that if he is forced to travel an indirect route, his costs increase; cited-the traffic haz- ards that would be involved; pleaded a cost of transportation hardship' factor; felt that the enactment of this ordinance would be unconstitutional; that the trucks are well covered with Insurance; that the trucks make no more noise that the so-called jalopies' and hot-rods'. Mr. Joseph Geidr, 822 East Herring Avenue, West Covina, stated that such an ordinance would necessitate an added police force; that such enforcement would create poor public relations;-believes there should be a north and south access through the City; that he would not have purchased land for investment purposes if truck traffic was to be routed away from the business areas. Mrs. Drobish, 4002 North Baldwin Park Boulevard, Baldwin Park, spoke in opposition to the preceding testimony, stat- ing that the noise from the trucks traveling on Baldwin Park Boulevard at Sierra Madre, at 4:45 a.m, was causing her to lose tenants. Mr. Alfred Davis, 12614 Magnolia, Chino, stated that if he would not be permitted to use the streets for truck travel he would spend no more money in the City; that, it was his suggestion that the travel be routed Arrow Highway to Sierra Madre, across Ramona Boulevard to Baldwin Park Boulevard and on out. Mr. Bob Brierley, 4869 North LaRica, Baldwin Park, stated that he has lived in Baldwin Park about 15 years; that he moved here,primarily to have a place to park his truck; that he drives home empty' and leaves empty'; wondered whether this ordinance would preclude his continuing this procedure. City Attorney Gorlick stated that this ordinance would pre- vent him from taking his truck home, and, If he did continue to do so, would be held in violation. Mr. H. G. City Engineer Young after review of this Final Tract Map, as modified, recommended acceptance with the suggestion, however, that the City acquire the drainage easement and that the City Council require a $2,000.00 cash deposit be made by the subdivider to guarantee purchase and improve- ment of the drainage easement. Discussion ensued with legal clarification offered by City Attorney Gorlick relevant to the matter of posting a cash deposit. Mr. Tracy Bousman, 212 South Ist.Avenue, Arcadia, stated that there is on file, at this time, a bond in the amount of $14,000.00 which covers the storm drain improvement. Mrs. Loretta Ord, owner of the subdivision, stated she would have a $2,000.00 deposit into the City Hall by 3:00 p.m., December 6, 1960, together with a letter stating the purpose for its use. Considerable discussion ensued with City Attorney Gorlick offering legal clarification as to the proper procedures for presentation and approval of Final Tract Maps. COUNCILMAN HOLMES MOVED THAT FINAL MAP, TRACT 23407, BE APPROVED SUBJECT TO THE RECOMMENDATION OF THE CITY ENGINEER AND COMPLIANCE WITH THOSE REGULATIONS, AND THAT THE NECESSARY LETTER STIPULATING PROCEDURE RE STORM DRAINS BE FILED; AND AFTER COMPLETION THEN THE PROPER OFFICIALS BE AUTHORIZED TO SIGN.
