BALDWIN PARK CITY COUNCIL REGULAR MEETING
May 1, 2019, 7:00 P.M.
COUNCIL CHAMBER - 14403 E. Pacific Avenue, Baldwin Park, 91706
These minutes are presented in Agenda order. Various announcements or discussions
may have occurred before or after the title under which they are presented.
CALL TO ORDER
The meeting was called to order by Mayor Lozano at 7:07 p.m.
INVOCATION
The invocation was provided by Pastor Jackson.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Lozano.
ROLL CALL

MEMBERS ABSENT:

MOTION: It was moved by Mayor Lozano, seconded by Council Member Avila to excuse
Council Member Pacheco from the meeting. Motion carried by unanimous consent.
REPORT ON CLOSED SESSION
Mayor Lozano announced direction was provided to staff to continue the recruitment for
the position of Chief of Police until filled. Direction was provided by unanimous consent.
ANNOUNCEMENTS
MOTION: It was moved by Mayor Lozano, seconded by Mayor Pro Tern Garcia to add
Subsequent Need Item A-1 to the agenda and accept corrections to the Special Meeting
Minutes included in Item No. 2. Motion carried by unanimous consent.
City Clerk Ayala explained the corrections made to the Special Meeting minutes of April
17, 2019 included in Item No. 2.
Mayor Lozano invited everyone to attend the Cinco de Mayo Boxing Show on May 4th
and the Community Input Meeting of May 16th.
PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS
• Proclamation for Lupus Awareness Month
The proclamation was introduced by Mayor Pro Tem Garcia and was presented to Estella
Mata an advocate for all Lupus patients who thanked the City Council for the
acknowledgement.
• Proclamation for Older Americans Month/Certificates
The proclamation was introduced by Mayor Pro Tem Garcia and was presented to
seniors involved in teaching various classes.
• Proclamation for National Bicycle Month
The proclamation was introduced by Council Member Hernandez and was presented to
• Proclamation for Mental Health Awareness
The proclamation was introduced by Mayor Lozano and was presented to Diana Rivera
Beltran Educational Outreach Program Coordinator at Kaiser. Ms. Rivera Beltran
commended the students from Sierra Vista High School for their hard work in raising
awareness amongst students and reducing stigma and suicide rates.
Diana Aguilar student at Sierra Vista High provided an overview of their program to raise
awareness.
• Plaque Recognition to Lieutenant Mark Adams for his Years of Service with the
City of Baldwin Park Police Department
The plaque was presented by Mayor Lozano. The City Council thanked Lieutenant Adams
for his years of service to the community.
Lieutenant Adams said it was a pleasure to serve this community and stated the city
would hold a special place in his heart.
PUBLIC COMMUNICATIONS
Mayor Lozano opened Public Communications at 7:38 p.m. and noted that each speaker
was permitted a total of three (3) minutes to speak.
Donna Camou, retired teacher of Baldwin Park Unified School District spoke in opposition
of the proposed Planned Parenthood clinic.

Mr. Rios questioned the qualification requirements applied to the position of Chief of
Police and expressed safety concerns on the construction of curbs around the city.
Eduardo Sauceda welcomed the newly appointed Chief of Police and requested City
Council's assistance in helping the homeless and veterans.
Mr. Luna expressed concerns with the current appointment of Chief of Police and
questioned the actions taken by the Mayor and Council Member's during the dismissal of
former personnel appointed to serve in that capacity.
Mayor Lozano closed public communications at 7:54 p.m.
Mayor Lozano commented on the achievements of a few individuals who have previously
served in the Baldwin Park Police Department.
Council Member Avila thanked Lieutenant Adams for his service and updated the
community on the safety message relayed by staff to contractors working throughout the
city. Council Member Avila thanked the residents for expressing their concerns and
extended an invitation to schedule a meeting with any Council Member for those wishing
to further discuss any matter.
Mayor Lozano directed the public to visit our website for more information on Measure H
and provided an apology to Interim Chief of Police Patino for the lack of introduction.
Mayor Pro Tem Garcia also thanked Lieutenant Adams for his service and addressed
comments made regarding independent decisions made by each Council Member in
relation to previous employee appointments/dismissals.
Mayor Lozano commented on false propaganda perpetuated by a group.
CONSENT CALENDAR
All items listed under the consent calendar are considered to be routine business by the
Council Members and were approved with one motion.
MOTION: It was moved by Mayor Pro Tern Garcia, seconded by Council Member Avila
to table Item No. 5 from the Consent Calendar. Motion carried by unanimous consent.
MOTION: It was moved by Mayor Lozano, seconded by Council Member Hernandez to
table Item No. 4 from the Consent Calendar. Motion carried by unanimous consent.
MOTION: It was moved by Mayor Lozano, seconded by Mayor Pro Tem Garcia to
approve the Consent Calendar including the corrections to Item No. 2 and the addition of
Subsequent Need Item No. A-1 and with the exception of Item No.'s 4 and 5. Motion
carried by unanimous consent.

1. Warrants and Demands
The City Council ratified the attached Warrants and Demands Register.
2. Meeting Minutes
The City Council received and filed the following Meeting Minutes:
A. Meeting Minutes of the Special City Council Meetings held on April 17, 2019
(corrected meeting minutes were approved).
B. Meeting Minutes of the Regular City Council Meetings held on April 17, 2019.
3. Rejection of Claims
The City Council rejected the following claim(s) and directed staff to send appropriate
notice of rejection to claimant(s):
Farias, Adrian The claimant is alleging injury to hand while
driving a Foothill Transit bus.
Monterosa, Jessica Cristina The claimant is alleging property damage to
her vehicle.
First Group America aso Joyce The claimant alleges dangerous condition of
Clark public property.
4. Approval of Use Agreement with the County of Los Angeles for Construction and
Maintenance of the San Gabriel River Class 1 Commuter Bikeway in Exchange
for the use of County Right-of-Way (Pulled from the Consent Calendar)
This item was not considered.
5. Renewal of Grant Writing Services Contract with California Consulting, LLC
(Pulled from the Consent Calendar)
This item was not considered.
6. Consideration of a Disposition and Development Agreement with MG
Development Group, LLC for a Proposed Industrial Development Project at
13057-13065 Garvey Avenue
The City Council provided direction in regards to a Disposition and Development
Agreement (DDA) with MG Development; and authorized the City Manager to execute
the agreement after a final review by the City Attorney; and approved Resolution No.
2019-017, entitled "A Resolution of the City Council of the City of Baldwin Park
Approving a Disposition and Development Agreement Between the City of Baldwin
Park and MG Development Group, LLC (aka MG Development) For a Proposed
Industrial Development Project at 13057-13065 Garvey Avenue."
7. Ratify and Adopt a Resolution to Amend the City of Baldwin Park Comprehensive
Pay Schedule in Accordance with CaIPERS established Guidelines
The City Council approved, ratified and adopted Resolution No. 2019-018 amending
the City of Baldwin Park Comprehensive Pay Schedule, retroactive to April 17, 2019.

A-1. Subsequent Need Item
Adopt Resolution No. 2019-019, "A Resolution of the City Council of the City of
Baldwin Park, California, Adopting the Fiscal Year 2019-20 Project List to be
Funded by Senate Bill 1 (SB1) —the Road Repair and Accountability Act"
The City Council adopted Resolution No. 2019-019, "A Resolution of the City Council
of the City of Baldwin Park, California, Adopting the Fiscal Year 2019-20 Project List
to be Funded by Senate Bill 1 (SB1) —the Road Repair and Accountability Act".
REPORTS OF OFFICERS
8. Review of Commission Applicants and Consideration of
Appointments/Reappointments to Fill the Scheduled Vacancies for the Housing,
Planning and Recreation Commissions
MOTION: It was moved by Mayor Lozano, seconded by Mayor Pro Tern Garcia to
bring this item back for Council's consideration in June. Motion carried by unanimous
consent.
CITY COUNCIL / CITY CLERK / CITY TREASURER / STAFF REQUESTS &
COMMUNICATIONS
None
Mayor Lozano requested an update on cleanup efforts made by the 99 cent store parking
lot owners.
Director of Community Development Benjamin Martinez stated staff had made contact
and would report back at a later time.
Mayor Lozano additionally requested staff alert street vendors, particularly on the Frazier
exit (corner of Main and Merced), of the new regulations and inform them that a permit is
required.
Council Member Avila inquired whether a warning would be issued and requested staff
report back on Hollywood Housing to assist in affordable housing/transitional housing via
a presentation.
Mayor Lozano confirmed a warning would be issued.
Council Member Hernandez recognized recreation staff for hosting past events
successfully, such as the Itsy Bitsy Soccer team awards, Easter Egg hunt Celebration,
and the Tree Ceremony where leaders were honored.

ADJOURNMENT
There being no other business to discuss, and all other matters having been addressed,
a motion was made by Mayor Lozano, seconded by Mayor Pro Tern Garcia, to adjourn
the meeting at 8:09 p.m.
