BALDWIN PARK CITY COUNCIL REGULAR MEETING
August 7, 2019, 7:00 P.M.

These minutes are presented in Agenda order. Various announcements or discussions
may have occurred before or after the title under which they are presented.
CALL TO ORDER
The meeting was called to order by Mayor Lozano at 7:10 p.m.
INVOCATION
The invocation was provided by Council Member Pacheco.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Lozano.

REPORT ON CLOSED SESSION
City Attorney Robert N. Tafoya announced that the City Council unanimously agreed to
settle the Augero v. City of Baldwin Park case for $25,000 to the plaintiff and the said
settlement had been executed and finalized.
ANNOUNCEMENTS
Mayor Lozano gave his condolence to for the recent mass shooting victims and their
families and requested to adjourn the City Council Meeting in memory of author Tony
Morson, African American writer who was denied the right to be recognized and mentored
a lot of African American writers; and also in memory of his aunt, Ms. Lozano Lopez.
PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS

PUBLIC COMMUNICATIONS
Mayor Lozano opened Public Communications at 7:13 p.m. and noted that each speaker
was permitted a total of three (3) minutes to speak.
Christina Larios, Library Manager, reminded attendees that the Library offered afterschool
homework assistance.
Judy Sakey, Donna Camou, Linda Oreteza, Jorge Pena, Julia Patron, Patricia, Jose
Mendoza, Frank Ebbiner, and Carol Davy spoke in opposition to the proposed Planned
Parenthood clinic opening within the City and expressed concerns on abortion.
Mr. Luna made comments regarding the interpreter's translation services, expressed
concerns pertaining to cannabis businesses, tax breaks, and assessments, and spoke on
the City Attorney's responsibilities.
Mr. Rios requested Council Member Avila provide translation services. Mr. Rios
expressed concerns with the smell of cannabis in the air, commented on the early closure
of the Morgan Park Center facility that has been designated as a cooling off center, spoke
on a previous request sent to Public Works staff concerning bulky item pick-up that had
not yet been addressed on Bess street, touched on the preferred parking by Mayor
Lozano's home, and stated staff was very responsive under the current Interim Chief of
Police's supervision.
Javier Vargas thanked the City Council and the Police Department for the National Night
Out and Concerts at the Park events and alerted the public to empty their pools and
fountains due to the West Nile virus.
Mayor Lozano closed public communications at 7:54 p.m.
Mayor Lozano commented on the approach they have taken in regards to Planned
Parenthood and the interest they have in converting that location into affordable housing.
The Mayor expressed concerns with eminent domain and requested legal counsel
provide further clarification on eminent domain.
City Attorney Tafoya explained that if the City evoked eminent domain, the City would
have to purchase the land, and the current laws in California relating to eminent domain
prohibit cities from purchasing property to offer to developer of their choice and would
require extensive work. Further, Mr. Tafoya replied that if there was a need for moderate
to low income housing an exception would apply.
Council Member Avila agreed on the potential to build low to moderate income housing.
Council Member Pacheco commented on Planned Parenthood's negative connotations
and agreed with Council Member Avila's desire to see that site as an affordable housing
development project.

Council Member Hernandez thanked and recognized the Recreation Department for a
fantastic Pride of the Valley 5K Race event; thanked the Police Department and the
Baldwin Park School District for the National Night Out event; thanked Mark Ramos for
all the work he does to ensure all cannabis businesses provide fair wages; and
announced the current revenue collected from cannabis businesses.
CONSENT CALENDAR
All items listed under the consent calendar are considered to be routine business by the
Council Members and were approved with one motion.
City Council Members pulled Item No. 5 from the Consent Calendar for separate
consideration due to a conflict of interest.
MOTION: It was moved by Council Member Pacheco, seconded by Mayor Pro Tern
Garcia to approve the Consent Calendar with the exception of Item No. 5. Motion carried
by unanimous consent.
1. Warrants and Demands
The City Council ratified the attached Warrants and Demands Register.
2. Meeting Minutes
The City Council received and filed the following Meeting Minutes:
A. Meeting Minutes of the Special City Council Meetings held on July 17, 2019.
B. Meeting Minutes of the Regular City Council Meetings held on July 17, 2019.
3. Adoption of Resolution No. 2019-037 "A Resolution of the City Council of the
City of Baldwin Park, California, Adopting the Recertification of the 2019 Title VI
Program"
The City Council adopted Resolution No. 2019-037 entitled "A Resolution of the City
Council of the City of Baldwin Park, California, Adopting the Recertification of the 2019
Title VI Program".
4. Adopt Resolution No's. 2019-039, 2019-040, and 2019-041 entitled, "A Resolution
of the City Council of the City of Baldwin Park, California, approving the
application for grant funds for the Statewide Park Development and Community
Revitalization Program Grant Funds" (Proposition 68) for the Big Dalton Walsh
Trails Park Project, Esther Snyder Community Center Expansion, and the Barnes
Park Dog Park.
The City Council adopted Resolution No. 2019-039, Resolution No. 2019-040 and
Resolution No. 2019-041 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK, CALIFORNIA, APPROVING THE APPLICATION FOR
GRANT FUNDS FOR THE STATEWIDE PARK DEVELOPMENT AND COMMUNITY
REVITALIZATION PROGRAM FUNDS" (Proposition 68), for the Big Dalton Walsh
Trails Park Project, Esther Snyder Community Center Expansion, and Barnes Park
Dog Park and authorize the Director of Recreation and Community Services to execute
any further documents.

5. Adopt Resolution No. 2019-042, "A Resolution of the City Council of the City of
Baldwin Park, California, establishing a Preferential Parking Zone on the 14000
through 14100 blocks of Ohio Street" (Pulled for Separate Consideration)
Mayor Lozano recused himself from this item at 8:05 pm.
Motion: It was moved by Mayor Pro Tem Garcia, seconded by Council Member
Pacheco to adopt Resolution No. 2019-042, "A Resolution of the City Council of the
City of Baldwin Park, California, establishing a Preferential Parking Zone on the 14000
through 14100 blocks of Ohio Street". Motion carried by the following roll call vote:
AYES: Council Members Avila, Garcia, Hernandez, Lozano, and Pacheco
NOES: None
ABSENT: Council Member Lozano
ABSTAIN: None
Mayor Lozano resumed to the City Council meeting at 8:07 pm.
REPORTS OF OFFICERS
6. Ratify and Adopt an Urgent Resolution to Approve the Appointment of a Retired
Annuitant for a Critical Vacant Housing Manager Position and Certify that the
180-Day Wait Period be Waived Under Section 7522.56 of the California Code of
Regulations
MOTION: It was moved by Council Member Pacheco, seconded by Mayor Pro Tem
Garcia to approve, ratify and adopt Resolution No. 2019-038 to authorize the
Appointment of an Interim Housing Manager and waive the 180-Day wait period, and
authorize the Chief Executive Officer to execute the Agreement and any Personnel
Action Forms related to the appointment; and authorized the Finance Director to
complete the budget amendments and appropriations and make any necessary
adjustments. Motion carried by unanimous consent.
7. Review of Commission Applicants and Consideration of
Appointments/Reappointments to Fill the Scheduled Vacancies for the Housing,
Planning and Recreation Commissions
MOTION: It was moved by Mayor Lozano, seconded by Council Member Hernandez
to table this item to the next City Council Meeting. Motion carried by unanimous
consent.

CITY COUNCIL / CITY CLERK / CITY TREASURER / STAFF REQUESTS &
COMMUNICATIONS
None Listed
Council Member Avila requested an update on the recent meeting staff held with
Hollywood Housing.
Benjamin Martinez, Director of Community Development stated staff had a productive
meeting where future projects were discussed concerning a variety of programs offered
by this organization and such options would be presented to the City Council in a study
session for further consideration.
Council Member Pacheco requested staff look at other developers; thanked the Police
Department for a fantastic National Night Out event; thanked the department of
Recreation for a wonderful job with the weekly street fair, and thanked all speakers for
voicing their concerns.
Council Member Avila also thanked the Police Department for a wonderful National Night
Out event; thanked Senator Rubio for presenting certificates; and thanked Assembly
Member Rubio for her support.
ADJOURNMENT
There being no other business to discuss, and all other matters having been addressed,
a motion was made by Mayor Lozano, seconded by Council Member Hernandez, to
adjourn the meeting at 8:14 p.m.
