BALDWIN PARK CITY COUNCIL REGULAR MEETING
September 4, 2019, 7:00 P.M.

These minutes are presented in Agenda order. Various announcements or discussions
may have occurred before or after the title under which they are presented.
CALL TO ORDER
The meeting was called to order by Mayor Lozano at 7:09 p.m.
INVOCATION
The invocation was provided by Pastor Flores and Jackson.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Lozano.

REPORT ON CLOSED SESSION
The City Council recessed into closed session at 8:38 p.m. and reconvened at 8:40 p.m.
Mayor Lozano announced no reportable action was taken by the City Council.
ANNOUNCEMENTS
Mayor Lozano announce, as required by Government Code section 54952.3, members
of the City Council are also members of the Board of Directors of the Housing Authority
and Finance Authority, which are concurrently convening with the City Council this
evening and each Council Member is paid an additional stipend of $30 for attending the
Housing Authority meeting and $50 for attending the Finance Authority meeting.
Mayor Lozano requested the meeting be adjourned in honor of Jovanni-Rey V. de
Pedro who was an amazing musician and passed away due to a virus overseas. The
Mayor expressed his deepest condolences and provided the dates for funeral services.
The meeting was also adjourned in honor of David Casper a former teacher for Baldwin
Pak High School's electronic and cross country program; the mayor expressed his
deepest condolences to his family.
PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS
• 2019 Suicide Prevention Week Proclamation
The City Council presented the suicide prevention week proclamation to Ruth L. Padilla
King along and the students in the suicide outreach program known as NAMI. Angela
Salazar Assistant Superintendent for the Baldwin Park Unified School District, Dr.
Susan Coats, Ms. Padilla and the students thanked the City Council for bringing
awareness to the community and recognizing this illness.
PUBLIC COMMUNICATIONS
Mayor Lozano opened Public Communications at 7:29 p.m. and noted that each
speaker was permitted a total of three (3) minutes to speak.
Christina Larios Los Angeles Library Regional Coordinator introduced new Baldwin Park
Library Manager Katherine. Katherine stated she previously worked for the City of
Glendale with over 13 years of library experience and was excited to take this new
position.
Mr. Luna made comments regarding the agenda; stated no improvements have been
made since he last contact the Public Works Department; commented on the code
enforcement name change and parking violations; spoke on trash issues throughout the
city; and made comments regarding the lack of cleanliness at Walnut Creek Nature
Park.
Denica Mendoza representative from Susan Rubio's Office invited all to attend the
upcoming event citizenship clinic event scheduled to be held on September 14 in
Rosemead and served as a great opportunity for residents to complete their residency
app and get legal advice.
Unknown speaker, Dora, Frank Ebiner, and George Pena spoke against the proposed
Planned Parenthood Clinic in Baldwin Park and against abortion.
Margarita Rios reminded City Officials and staff of the dangerous street across City Hall
and the need to assess the intersection.
Mr. Rios commented on the cannabis smell lingering in the air on Bruce Street; provided
photographs of the construction on Walnut Creek Park; expressed concerns regarding
the mess near Kaiser Permanente and bus.Stops near Morgan; and spoke on the traffic
issues on Frazier near the High School.

Mayor Lozano thanked Christina Larios for all her work; commented on efforts to reach
an agreement with Planned Parenthood with no avail and spoke on an incident where a
women confronted him during his morning run regarding women's rights.
Council Member Avila shared the experience she had during a ride along with the
Baldwin Park Police Department in homeless encampments and stated the City needed
to do more outreach to assist those in need and requested staff research transitional
housing. Additionally, Council Member Avila stated that the City was in need of low to
moderate income housing.
Mayor Lozano commented on Prop HH and the funding the City was obtaining to assist
with the homeless issues and encouraged the community to attend a meeting in the
tristate area.
Council Member Avila acknowledged that the City was actively working on obtaining
measure H funding, but requested something more immediately be done to combat the
issues.
Mayor Pro Tern Garcia mentioned that Yuriko Esparza had been working diligently to
obtain funding and although the programs were not moving as quickly as they wished,
the City was at the forefront of measure H funding. Additionally, Mayor Pro Tern Garcia
stated they had been working on affordable housing projects and requested an update
be provided to the City Council on the development of the homeless initiative.
Council Member Pacheco commented on his meeting with LA Voce where he learned
about housing opportunities and the difference of how affordable housing was defined.
Council Member Pacheco stated that recently, the city had approved the construction of
affordable housing; however, they had not worked on low to median income housing
and felt the need for the city to evaluate its housing situation and hoped staff could
reach out to developers in order to obtain proposals. Furthermore, Council Member
Pacheco spoke on his disagreement with Planned Parenthood's approach and
requested the Code Enforcement provide a presentation in a future meeting to clarify
their new methods.
CONSENT CALENDAR
All items listed under the consent calendar are considered to be routine business by the
Council Members and were approved with one motion.
City Council Members pulled Item No. 1, 5, and 9 from the Consent Calendar for
separate consideration due to a conflict of interest.
MOTION: It was moved by Mayor Lozano, seconded by Council Member Hernandez to
approve the Consent Calendar with the exception of Item No.'s 1, 5, and 9. Motion
carried by unanimous consent.

1. Warrants and Demands (Pulled from the Consent Calendar for separate
consideration)
The City Council ratified the attached Warrants and Demands Register.
Council Member Avila inquired about payments for the cleaning of restrooms and
requested a detailed report on payments to Gentry Brothers.
Director of Recreation and Community Services Manuel Carrillo provided clarification
on the payments.
MOTION: It was moved by Mayor Lozano, seconded by Council Member Hernandez
to ratify the attached Warrants and Demands Register. Motion carried by unanimous
consent.
2. Meeting Minutes
The City Council received and filed the following Meeting Minutes:
A. Meeting Minutes of the Special City Council Meetings held on August 7, 2019.
B. Meeting Minutes of the Regular City Council Meetings held on August 7, 2019.
C. Revised Meeting Minutes of the Regular City Council Meeting held on July 17,
2019.
3. Treasurer's Report—June 2019
The City Council received and filed the Treasurer's Report for June 2019.
4. Claim Rejection
The City Council rejected the following claim and direct staff to send the appropriate
notice of rejection to claimant(s):
5. Code Enforcement Division — Update (Pulled from the Consent Calendar for
separate consideration)
Council Member Hernandez gave the Director of Community Development Benjamin
Martinez the opportunity to elaborate on the item. Mr. Martinez stated they were very
pleased to hire a new code enforcement manager who has made positive
recommendations to the department including the name changes to reflect a new
resident friendly attitude. Mr. Martinez stated their goal was, to gain compliance and
with a clean and beautify city.
Council Member Hernandez applauded their efforts and requested the new code
enforcement manager provide a presentation in the near future to the City Council.
MOTION: It was moved by Council Member Hernandez, seconded by Mayor Pro
Tem Garcia to concur with the name change to Community Enhancement and
receive and file this report. Motion carried by unanimous consent.

6. Approve Memorandum of Agreement with the County of Los Angeles for the
Administration and Cost Sharing for the Implementation of the Coordinated
Integrated Monitoring Program (CIMP) for the Upper San Gabriel River
Enhanced Watershed Management Program
The City Council Authorized the Chief Executive Officer to execute a Memorandum of
Agreement (MOA) with the County of Los Angeles for the administration and cost
sharing for the implementation of the Coordinated Integrated Monitoring Program
(CIMP) for the Upper San Gabriel River Enhanced Watershed Management Program
(EWMP).
7. Accept and Authorize the Filing of a Notice of Completion for City Project No.
2018-0269, Various Street Improvements Project, CIP No. 19-037
The City Council accept the construction improvements by Gentry Brothers, Inc. and
authorized the recordation of a Notice of Completion; and authorized the payment of
$91,637.91 in retention funds to Gentry Brothers, Inc. upon the expiration of the 35-
day notice period.
8. Accept and Authorize the Filing of a Notice of Completion for City Project No.
2018-0272, CIP No. 19-62 and 19-107 — Morgan Park Improvements
The City Council Accepted the construction improvements completed by CWS
Systems Inc. (CWS) and authorized the recordation of a Notice of Completion; and
Authorized staff to release retention funds to CWS upon the expiration of the 35-day
notice period; and Authorized the Director of Finance to appropriate project unspent
funds in the amount of $23,094.81 to the Walnut Creek Nature Park, Phase 3 Project
— CIP No. 19-113, Acct. No. 270-50-520-58100-16185.
9. Authorize Purchase of Police Motorcycles (Pulled from the Consent Calendar for
separate consideration)
Council Member requested clarification from Interim Chief of Police Johnny Patino
regarding the acquisition of these new vehicles. Interim, Chief Patino stated they
collaborated with the City of El Monte to obtain BMW motorcycles at a very low cost.
MOTION: It was moved by Council Member Hernandez, seconded by Mayor Pro
Tern Garcia to waive the formal bidding process for the purchase of four (4) used
2016 BMW police motorcycles from the City of El Monte pursuant to §34.23 (C); and
Authorized the Police Department to purchase the new motorcycles through
procedures outlined above; and Directed the Director of Finance to appropriate the
$53,200.00 to Acct # 271-30-350-58110-17233 for the purchase, and remove the
current motorcycles from the fixed assets record once the auction is completed; and
Authorized the Chief of Police, or his designee, to complete all appropriate
documentation to complete the purchases.

10. Approve and adopt Resolution No. 2019-043, Revising the City-Wide Records
Retention Schedule
The City Council approved and adopted Resolution No. 2019-043 and directed staff
to implement the revised Records Retention Schedule.
11. Ratify and Adopt a Resolution Approving an Agreement between the City of
Baldwin Park and Adminsure, Inc. to Administer the City's Worker's
Compensation and Liability Program
The City Council Approved, Ratified, and Adopted Resolution No. 2019-044 to
authorize the City Council to approve an Agreement with Adminsure, Inc.
12. Contract Renewal with Los Angeles County Department of Animal Care and
Control
The City Council approved the contract renewal and authorized the Chief Executive
Officer, City Clerk, and City Attorney to execute the agreement.

The Board ratified the attached Warrants and Demands Registers.

The Board received and filed the Treasurer's Report for June 2019.
REPORTS OF OFFICERS
13. Review of Commission Applications and Consideration of
Appointments/Reappointments to Fill the Scheduled Vacancies for the
Housing, Planning, and Recreation Commissions
MOTION: It was moved by Mayor Lozano, seconded by Mayor Pro Tem Garcia to
table this item to the next regularly scheduled meeting.

ADJOURNMENT
There being no other business to discuss, and all other matters having been addressed,
a motion was made by Mayor Lozano, seconded by Mayor Pro Tem Garcia, to adjourn
the meeting at 8:40 p.m.
