Pacific Avenue, Baldwin Park, 91706 These minutes are presented in Agenda order. Various announcements or discussions may have occurred before or after the title under which they are presented. CALL TO ORDER The meeting was called to order by Mayor Lozano at 7:02 p.m. INVOCATION The invocation was provided by Council Member Pacheco. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Lozano. ROLL CALL MEMBERS PRESENT: Council Member Alejandra Avila Council Member Paul C. Hernandez Council Member Ricardo Pacheco Mayor Manuel Lozano MEMBERS Absent: Mayor Pro Tem Monica Garcia REPORT ON CLOSED SESSION Mayor Lozano announced that direction was provided to staff to retain Richard Watson to conduct labor negotiations and was approved my unanimous consent. ANNOUNCEMENTS Mayor Lozano announce, as required by Government Code section 54952.3, members of the City Council are also members of the Board of Directors of the Housing Authority and Finance Authority, which are concurrently convening with the City Council this evening and each Council Member is paid an additional stipend of$30 for attending the Housing Authority meeting and $50 for attending the Finance Authority meeting. PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS • None Listed Mayor Lozano requested the meeting be adjourned in memory of Ms. Escalera. PUBLIC COMMUNICATIONS Mayor Lozano opened Public Communications at 7:06 p.m. and noted that each speaker was permitted a total of three (3) minutes to speak. Mr. Rios expressed concerns with staff not returning calls or resolving resident requests and stated staff should be resolving issues rapidly. Mayor Lozano requested the audience with signs remove the sticks. Teresa, Joni Quintana, Noreen Emener, Valera Pacheco, six unknown speakers, Carmen Camacho, Frank Eibner, Ann Heresy, Jose Mendoza, Hortensia and Nancy spoke in opposition of the Planned Parenthood clinic and in support of prolife. Catherine, Baldwin Park Library Manager announced upcoming events scheduled at the Baldwin Park Library. Shara Zad and Christine, Laura Santos, Russ Babot, and an unknown speaker spoke in support of Planned Parenthood. Mr. Luna provided the City Council with a letter from Roberts office pertaining to requests for public records; commented on the cannabis smell omitting from Puente Avenue; stated that Code Enforcement performed better under the Police Department; expressed concerns with bulky item pick up; and spoke on outside residents providing comments regarding this City. Mayor Lozano closed public communications at 8:16 p.m. Mayor Lozano clarified why the resolution in support of women's rights was brought forward and stated he stood by the comments he made pertaining to the proximity of the clinic to religious buildings. The Mayor further stated the City could not deny a clinic the right to conduct business and commented on the current presidents political views. Mayor Lozano spoke on the pledge he made to the United Stated Flag when he was elected and stated he had to be a voice for all. Council Member Pacheco also spoke on the resolution approved by the City Council supporting women's rights and clarified that the resolution did not state they were in support of Planned Parenthood and added that he would be opened to bringing a similar resolution forward. Council Member Pacheco expressed his opposition to Planned Parenthood and their views and articulated support for women's rights and commented on providing educational programs for expecting mothers. Council Member Avila thanked everyone for their attendance and commented on her meeting with Planned Parenthood where she requested they offer all services for the exception of abortion and was not unsuccessful in finding a compromise. Council Member Avila also expressed concerns with the proximity of the clinic to religious buildings and spoke in favor of women's rights. MOTION: It was moved by Council Member Pacheco, seconded by Council Member Hernandez to approve the Consent Calendar. Motion carried by unanimous consent. 1. Warrants and Demands The City Council ratified the attached Warrants and Demands Register. 2. Meeting Minutes The City Council received and filed the following Meeting Minutes: A. Meeting Minutes of the Special City Council Meetings held on September 4, 2019. B. Meeting Minutes of the Regular City Council Meetings held on September 4, 2019. 3. Treasurer's Report—July 2019 The City Council received and filed the Treasurer's Report for July 2019. 4. Accept and Authorize the Filing of a Notice of Completion for City Project No. 2018-0265, CIP No. 19-027 — Frazier Street Pedestrian and Bicycle Safety Improvement Project The City Council: 1. Accepted the construction improvements by PALP, Inc. DBA Excel Paving and authorized the recordation of a Notice of Completion; and 2. Authorized the payment of $47,323.42 in retention funds to PALP, Inc. DBA Excel Paving upon the expiration of the 35-day notice period. 5. Ratify and Adopt a Resolution to Update the City of Baldwin Park Job Classification Plan and approve Revisions to the Police Lieutenant Class Specification The City Council: 1. Approved, Ratified and Adopted Resolution No. 2019-045 authorizing an amendment to the job classification plan to include revisions to the Lieutenant class specification; and 2. Authorized the Finance Director to complete the budget amendments and appropriations and make any necessary adjustments. 6. Request Approval of an Agreement with Christiansen Amusements for Carnival Services The City Council: 1. Approved the agreement and authorized the Mayor to execute the necessary documents. Regular Meeting of 09/4/19 Page 3 of 5 7. Professional Services Agreement for Video Production and Cable Television Access Services Contract Amendment No. 5 The City Council: 1. Approved the Amendment No. 5 to the Professional Services Agreement for video production and cable television services; and 2. Authorized the Director of Finance to make an adjustment to the existing budget with the annual savings of $8,500 in the current FY 2019-20 and appropriate $21,500 from the PEG Channel Grant Fund for the 2nd FY 2020-21 to fund the remaining CMF Agreement Amendment No. 5; and 3. Authorized the Mayor to execute Amendment No. 5. CITY COUNCIL ACTING AS SUCCESSOR AGENCY OF THE DISSOLVED COMMUNITY DEVELOPMENT COMMISSION CONSENT CALENDAR All items listed under the consent calendar are considered to be routine business by the Board Members and were approved with one motion. MOTION: It was moved by Mayor Lozano, seconded by Council Member Pacheco to approve the Consent Calendar. Motion carried by unanimous consent. SA-a Successor Agency to the Dissolved Community Development Commission of the City of Baldwin Park Treasurer's Report—July 2019 The Board received and filed the Treasurer's Report for July 2019. PUBLIC HEARING 8. 5-Year Capital Improvement Project(CIP) Budget for Fiscal Year 2019-20 to 2023- 24 The Mayor opened the public hearing at 8:30 pm. Seeing no one wishing to speak, Mayor Lozano closed the Public Hearing at 8:30 pm MOTION: It was moved by Mayor Lozano, seconded by Council Member Pacheco to continue the Public Hearing to the next scheduled meeting. Motion carried by unanimous consent. REPORTS OF OFFICERS 9. Request Direction for Celebrate Baldwin Park Anniversary Parade MOTION: It was moved by Mayor Lozano, seconded by Council Member Pacheco to direct staff to proceed with the Celebrate Baldwin Park Anniversary Parade; and Authorized the Director of Finance to appropriate funds from the Community Enhancement Fund for the cost of the Celebrate Baldwin Park Anniversary Parade. Review of Commission Applications and Consideration of Appointments/Reappointments to Fill the Scheduled Vacancies for the Housing, Planning, and Recreation Commissions MOTION: It was moved by Mayor Lozano, seconded by Council Member Pacheco to table the item to the next regularly scheduled meeting. Motion carried by unanimous consent.
