City Clerk Balkus presented two Applications for Transfer of
Alcoholic Beverage License, being: I) Brigham, B. Young to

Cannon The Retreat) 13114 East Ramona Boulevard.
Mayor Cole stated that this was a matter of information only
and that no action was required.

COUNCILMAN HOLMES MOVED THAT THE DATE OF FEBRUARY 6, 1961, AT

Chief Administrative Officer Asmus presented a request for
allocation, not to exceed $75.00, to attend the Spring Meeting
of the City Managers' Association in Fresno, California, Febru-
ary 15th through February 17, 1961. He stated that funds have
been allocated for this purpose in the 1960-61 budget, and sug-
gested that, during his absence, Council appoint Thelma L.
Balkus, City Clerk, as Acting City Administrator.

the City limits of Baldwin Park.

Chief Administrative Officer Asmus presented the matter of
investment of General Fund and Gas Tax Monies, recommending
that Council confirm the reinvestment of $50,000.00 In an
inactive account at the Bank of America for 90 days at 2?%
interest, effective January 3, 1961; that Council authorize
the redeposit of $50,000.00 in an inactive account at the
Bank of America for 180 days at 3% Interest, effective Feb-
ruary 5, 1961, when the present inactive account matures;
that Council authorize the redeposit of $206,877.98 in 60%
gas tax funds in an inactive 180 day account on February 2,
1961, at 3% interest, when the present inactive account
matures; that, if the above recommendations are accepted,
the City will retain on deposit $246,887.58 of gas tax funds
and $150,000.00 general fund monies.

COUNCILMAN HOLMES MOVED THAT COUNCIL CONCUR WITH THE RECOM-

Chief Administrative Officer Asmus presented the matter of
a proposed handbill ordinance, elaborating upon the content
to be incorporated in our code, as prepared by City Attorney
Gorlick. He called attention to Section 9 of the proposed
ordinance, suggesting that some determination should be made
by Council if acceptable, or if it should be rewritten in
order not to conflict with the Business License Ordinance
as it refers to permit and license fees.
Discussion ensued wherein City Attorney Gorlick gave further
clarification of the intent of the ordinance, suggesting that
study be given to ant-litter provisions for possible incor-
poration in our City Code.
MAYOR COLE DIRECTED THAT PREPARATION OF THE HANDBILL ORDINANCE
PROCEED, AND BE BROUGHT BACK BEFORE COUNCIL AT A LATER DATE.

Asmus expressed the opinion that more bids would have been
received were it not for the requirement of accompanying bid
bonds for 10% of total amount submitted; that the matter of
trade-ins" is a problem, also, which discourages dealers

Mayor Cole announced that it was now the time and place for
the public hearing on Ordinance No. 162, an Ordinance of the
City Council of the City of Baldwin Park Amending the Baldwin
Park Municipal Code to Prohibit Vehicles Exceeding 6,000 lbs.

City Clerk Balkus again administered the oath.
Mayor Cole clarified the intent of the proposed ordinance,
with Chief Administrative Officer Asmus pointing out on a
map the streets on which trucks would be permitted, and those
on which they would be prohibited.
Mayor Cole asked if there was anyone in the audience desiring
to speak on behalf of proposed Ordinance No. 162.
Mr. John Aglor, 3163 North Baldwin Park Boulevard, Baldwin Park,
spoke in behalf of the proposed ordinance, questioning why the
area below Francisquito on Baldwin Park Boulevard was omitted
from the streets declared prohibited to the use of vehicle ex-
ceeding 6,000 lbs.; stated that everyone living south of Fran-
cisquito on Baldwin Park Boulevard to the Freeway is opposed
to the heavy truck traffic and feels that this section should
have also been precluded to truck travel; that it was his
understanding that Rivergrade Road had been constructed pri-
marily for trucks, with Baldwin Park Boulevard being used only
for trucks making deliveries into the town; that he is wakened
at 4:00 a.m. by the truck travel, and that it is almost im-
possible to watch T.V., etc.; that it was his hope that in the
future the routing of truck travel in this area can be eliminated.
Councilman Holmes offered clarification to Mr. Aglor, in that;
Francisquito is the only street that is capable of carrying the
heavy load limits at the present time; that this is the only
available access to the Freeway at this time; that Baldwin Park
Boulevard will be in a state of repair which will take about
one year to complete, thereby necessitating the elimination of
truck travel during that time.
Mrs. Scott, 3522 North Baldwin Park Boulevard, Baldwin Park,
spoke in behalf of the proposed ordinance, stating that she
works as a school-crossing guard at Stewart Avenue and Baldwin
Park Boulevard; that she has great difficulty in getting the
truck drivers to stop so the children can cross the street;
that dirt and rock flies from the trucks, thereby creating
another danger to the children.
Mr. Frank Schoenbachler, 3589 North Baldwin Park Boulevard,
Baldwin Park, spoke in behalf of the proposed ordinance,
stating that the heavy truck travel is a detriment to the
City; that there are other streets capable of handling this
heavy traffic; wherein he presented a petition containing 87
signatures opposing this heavy truck travel on Baldwin Park
Boulevard.
Mr. Forest Conklin, 3866 North Baldwin Park Boulevard, Baldwin
Park, spoke in behalf of the proposed ordinance stating that
a person cannot enjoy conversation, radio, T.V., etc. due to
the noise of the trucks; that it was dangerous for the children
to cross the street; that it was a deplorable condition.....
that the trucks should be stopped.
Mrs. Joseph Sykes, 3848 North Baldwin Park Boulevard, Baldwin
Park, spoke in behalf of the proposed ordinance, stating that
she has lived at this address for about 25 years; that some-
times the trucks slow down for the children to cross and other
times, continue at their usual speed; that truck travel was
detrimental to renting of property on Baldwin Park Boulevard;
that she would appreciate consideration being given to the
property owners paying taxes.
As there was no one else in the audience desiring to speak
in behalf of proposed Ordinance No. 162, Mayor Cole asked if
there was anyone wishing to speak in opposition to this
ordinance.

In opposition to the proposed ordinance, stating that he pays
a license fee of $403.00 on his truck in comparison to $11.00
for his 1952 Buick; that Rivergrade Road should be given to
the sole use of trucks, barring automobile travel; that they
all have the utmost respect for children; that their patronage
and support will be withdrawn if the trucks are forced out of
Baldwin Park.

Mr. Fred Imhof, Associate Executive Secretary of Southern Cali-
fornia Rock Products Association, 1811 Fair Oaks Avenue, South
Pasadena, spoke in opposition to the proposed ordinance, stating
that he was speaking on behalf of Mr. Robert Brierley, who is a
resident of the City and also President of the California Dump
Truck Owner's Association; stated that, according to the Los
Angeles Planning Commission book, published in 1929 by the Los
Angeles County Division of Highways, in the map approved by this
body, they recommended that Sierra Madre Avenue and Baldwin Park
Boulevard be Included as major arteries in the transportation
system of Los Angeles County; that a north-south route should
be seriously considered.
Mrs. Arthur Seymour, 5141 North Sleeker Street, Baldwin Park,
asked for clarification regarding truck travel on Joanbridge
Street and Sleeker.
Mr. Daniel Petrizze, 15009 East Ramona Boulevard, Baldwin Park,
owner of Danny's Sack Shack Cafe", spoke in opposition to the
ordinance, stating that business would suffer if the truckers
were not permitted travel on Ramona. Boulevard.
Mayor Cole informed Mr. Petrizze that Ramona Boulevard is a
truck route and, therefore, is not excluded to truck travel.
Mr. Francis Lenderman, 4213 North Bogart Street, Baldwin Park,
stated that he is a contractor'and builder, not a truck driver,
but felt that the city was over-stepping" by its proposed
restrictions to truck travel.
As there was no one else in the au-dience w-ishing to speak
either In behalf of or in opposition to, Mayor Cole declared
the hearing closed.
Discussion followed wherein Councilman Holmes expressed the
opinion that, after considerable study of the matter, and in
view of the scheduled studies regarding the flow of traffic,
this proposed ordinance, under the existing conditions, is the
most logical and practical at the present time; that it is in
the best interest of both the City and the truck operators.

Chief Administrative Officer Asmus presented the matter of a
new State Highway Agreement and Resolution to be adopted by
Council, which supersedes their previous Highway Agreement and
Amendments already executed, wherein it only revises the des-
cription of Route 170 to include the mileage in the territory
annexed by the city. He further stated that this section is
the 28 miles of the Francisquito Avenue annexation, and that
all other provisions for responsibility and authority of main-
tenance remain the same.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK APPROV-
ING AGREEMENT FOR MAINTENANCE OF
STATE HIGHWAY IN THE CITY OF BALDWIN
PARK"
WHEREAS, the State of California, through its
Department of Public Works, Division of Highways, has pre-
sented an Agreement for Maintenance of the State highway
in the City of Baldwin Park effective as of December I,
1960 and to remain in effect until amended or terminated.
WHEREAS, the City Council has heard read said
Agreement in full and is familiar with the contents thereof;
THEREFORE, be it resolved by the City Council of
the City of Baldwin Park that said Agreement for Maintenance
of the State Highway in the City is hereby approved and the
Mayor and the City Clerk are directed to sign the same on
behalf of said City.

Chief Administrative Officer Asmus presented the matter of a
major highway building set-back in an M-I zone, wherein build-
ing plans have been submitted by the Standard Oil Company of
California for the construction of a service station on the
southwesterly corner of Dalewood and Baldwin Park Boulevard;
he stated that, according to the City Engineer's report, the
pump island is proposed to be set back a distance of 10' from
the property line, which is a distance of 60' from the center
line of Baldwin Park Boulevard, and the canopy cantilevers to
the proposed property line, which does not comply with the set-
back requirement of Section 9100.466 of the Interim Zoning
Ordinance, wherein the building set-back line is established
at 70'.
Discussion ensued wherein City Engineer Young gave further
clarification, and maps were distributed for the perusal of
Council; wherein general remarks included the question as to
whether this action would set a precedent; that this is a
dangerous corner; the question was raised as to the practical
application of the set-back requirements of the Interim Zoning
Ordinance.
COUNCILMAN HOLMES MOVED THAT THIS EXCEPTION BE ALLONED, ONLY
FOR THE CANOPY AND THE GASOLINE PUMPS, AND FOR NO OTHER USAGE

Development Company. He distributed maps for Council's per-
usal, and reported that: it will be necessary for Council to
direct that vacation proceedings be initiated on that portion
of street dedication previously accepted under Lot Split
#165 but which does not conform to the street pattern in
this tract; that an endeavor had been made to work up an
agreement with the developer of this tract to have it sewered,
but the cost was somewhat prohibitive for the area involved;
that the plans and financing of the company are for septic
tanks, and any further delay for consideration of sewers would
eliminate this subdivision; that before recordation of this
tract, a copy of the executed Quit Claim Deed of the Water
District Easement must be received from the Baldwin Park County
Water District. Mr. Young further reported that in addition to
all the required documents of this subdivision, the owners
have deposited $2,340.00 in cash to cover the cost of street
lighting, street signs, trees and inspection fees, and that
this tract is within the Baldwin Park Lighting District, and
is in substantial accordance with tentative maps submitted
and approved, both by the Planning Commission and the City
Council.
Mr. Arthur C. Bowman, Westman Development Corporation, 109
North Santa Anita Avenue, Arcadia, California, stated that
they had received estimates for the installation of sewers
in this tract in an amount of $55,000.00 which is prohibi-
tive to them; that their option has expired now, and any
further delay would cost them the subdivision.
Considerable discussion followed wherein City Engineer Young
clarified the matter of costs of septic tanks, etc.; wherein
the question of a possible formation of a 1911 Act district
was debated; that, in all future subdivisions, every effort
should be exercised and every possibility explored in trying
to get sewers before a tentative map is approved.

Councilman Bishop suggested that our policy on bids be changed,

the bids are opened and read, they still must be checked and
tabulated by the Chief Administrative Officer and brought back
to Council with a recommendation; wherein the matter of elimina-

Chief Administrative Officer Asmus reported that Webster's
Refuse Disposal Service has been paying for 12 licenses in
the City, but, as a result of the last census report, there
is one more license available. He further stated that no
additional licenses may be issued except by order of the City
Council; that Webster's has made application and sent in

Chief Administrative Officer Asmus presented the matter of
false arrest insurance, requesting instruction from Council.
He stated that City Attorney Gorlick has checked the policy
that the Los Angeles County Peace Officer's provide, and
that it does protect a police officer even though he may
willfully violate a State law; that the policy now in exist-
ence will not do that; that the Secretary of the Los Angeles
County Peace Officer's Association stated that they were in-
terested in deleting that provision from their coverage;
that It was his feeling that the City has provided ample
protection to our police officers under the general

Regular Meeting of the Baldwin Park City Council
comprehensive liability policy, and that they should not be
protected for willful violation of the City ordinance or the
State statute; that it was his recommendation that the City
not continue to carry its membership in the Peace Officer's
Association; that every officer, however, should be notified
will full explanation of the situation, in the event he
would wish to carry this at his own expense; that the City
pays $623.00 per year, which covers all employees, including
Council, officers, etc., against $429.00 for just the mem-
bership in the Police Department.
Considerable discussion followed wherein Councilman Bishop
expressed the opinion that the present coverage should be
kept, as a protective measure for all electives, heads of
departments, Planning Commission members, etc.; wherein
City Attorney Gorlick clarified the reason behind the start-
ing of this type of coverage for police officers.

Chief Administrative Officer Asmus reported that the plan to
hire a temporary engineering aide and a junior civil engineer
to develop plans, etc. to do our own work on the street proj-
ects, has not materialized, which means that all this work
will not be done this year, unless a consulting service is
utilized. He further stated that it would cost about $10,600.
to complete the Baldwin Park Boulevard project from the Freeway
to Merced if a consulting firm were employed; that we cannot
recruit the necessary personnel to do the work ourselves.
Discussion ensued wherein City Engineer Young elaborated on
the various problems confronting him and their possible
solution.
CHIEF ADMINISTRATIVE OFFICER ASMUS WAS INSTRUCTED BY COUNCIL
TO SECURE SOME FIRM QUOTATIONS ON THIS WORK, AND ACQUIRE IN-
FORMATION ON WHAT THE COST PER HOUR ON SURVEY PARTIES RUNS,
AND BRING BACK AT THE NEXT MEETING OF COUNCIL.

Councilman Holmes stated that, in reviewing the monthly
reports issued from the Engineering and Public Works Depart-
ment, the men's time does not tally with the figures shown
on the project recapitulation sheet. City Engineer Young
offered explanation in that the differential was probably
due to vacation and sick leave time off.

January 31, 1961.
I have found It a memorable as well as an educational
experience to have served our city the first five years
after incorporation. This period of service has afforded
me the privilege of meeting and working with many out-
standing fine people. I feel that Baldwin Park has made
many st°ride's toward becoming a topnotch city, and that
from here on, it is up to the citizens to get behind and
support the City Officials and Civic Groups which are all
trying to make our city a better place to live.

It is my opinion that each of us should take our turns
serving on civic boards and committees for a reasonable
length of time, and since I have served that period on
this commission, it is time for someone else to take their
turn. The submission of this resignation has been delayed
in hopes that the hearings on the Master Plan could have
been completed, but these hearings are taking so long, I
am forced to resign in order to adequately take care of
other personal matters.
