Councilman Bishop led the salute to the flag. The invocation was given by Reverend Father Flack of St. John's Roman Catholic Church. February 13, 1961 To the City Council of Baldwin Park, Calif. We, the undersigned, residents and property owners in the City of Baldwin Park, Calif., interested in the safety of children who will be required to cross the proposed route along Francisquito Ave. between Baldwin Park Blvd. and Ramona Blvd. protest the passing of Ordinance #162. We also respectfully request that the existing truck route Baldwin Park Blvd.) be maintained, as the traffic along Francisquito Ave. creates sufficient obstacle to the life expectancy of the children. The juvenile pedestrian count will include some seventy-five per cent of the total estimated school population of seven hundred who will either cross or parallel the truck route twice daily enroute to and from classes. At this time City Clerk Balkus administered the oath to those in the audience desiring to be heard during the meeting. Mrs. Marlin D. Hancock, 3445 North Remey, Baldwin Park, spoke in protest to the routing of trucks on Francisquito Avenue, stating that the safety of the children should be given more consideration, especially so with the opening of the new Sierra Vista High School in September of this year wherein an estimated 700 children will attend, 400 of which will cross Francisquito; that it was her opinion that Francisquito Avenue is not well patrolled; that reconsideration of Francisquito Avenue as a truck route would be appreciated. He further quest- ioned the sudden passing" of the ordinance, and wondered why truck traffic could not be continued on Baldwin Park Boulevard while being improved; inferred that a taxpayer's suit might be instigated if satisfaction were not derived. Councilman Holmes endeavored to explain and clarify the reason- ing behind the routing of truck travel as set forth in Ordinance No. 162, elaborating on the studies in process by various com- mittees in the San Gabriel Valley for an over-all plan for es- tablishing a definite route for truck travel. Mr. James Gibson, 13268 East Francisquito Avenue, Baldwin Park, expressed the opinion that it was not necessary to pass an ordi- nance re-routing traffic merely to alleviate a temporary street improvement condition; wherein he asked clarification regarding the availability of monies for this street improvement work and the status of the plans, etc; wherein he questioned the initia- tion of removing the trucks from Baldwin Park Boulevard; that it was his opinion the problem was not being solved by elimina- ting truck travel from one street and placing it on another. As a matter of further clarification, Councilman Holmes stated that the money is available for the improvement of Baldwin Park Boulevard but the plans are not, as yet, complete; that a resolu- tion authorizing the execution of an agreement with Walsh-Forkert, Civil Engineers, is on the Agenda for Council action tonight, which, if adopted, will hasten commencement of the work; that the removal of truck travel from Baldwin Park Boulevard was not due to any agitation by the residents, but that this is a street improvement project that has been under consideration for over a year. Mayor Cole announced that it was now the time and place for public hearing on Zone Exception Case ZE-38, a request for zone exception in Zone R-2 to permit grocery store opearion at 5026 North Maine Avenue for ten years, Arthur H. and Marion W. Cunningham. Planning Director Mansfield presented a resume and the findings and recommendations of the Planning Commission, wherein approval was recommended subject to the conditions set forth in Planning Commission Resolution No. 622, and located the area on the map for benefit of Council. City Clerk Balkus stated that the required publications, mail- ings and postings had been accomplished. Considerable discussion ensued relevant to the legal status of California Avenue. Mayor Cole asked if there was anyone in the audience desiring to speak in behalf of Zone Exception Case ZE-38. As there was no one else wishing to speak in behalf of the zone exception, Mayor Cole asked if' anyone wished to speak in opposition. Mr. Keith Criswell, 13260 East Francisquito, Baldwin Park, asked clarification of Council action regarding a previous zone exception, ZE-39, re curb, gutter and sidewalk installa- tion. Councilman Littlejohn offered clarification as to Zone Ex- ception Case ZE-39, Sterling Savings and Loan Association, in that they were required to post a cash deposit in an amount to be determined by the City Engineer guaranteeing installa- tion of improvements at a time to be determined by the City Council. City Engineer Young reported that California Street is listed as a private street and not on the tax rolls. Acting City Attorney Flandrick stated that, until the records are checked, there would be no way of determining whether this is a public or private street. Mr. Criswell wondered why, at this time, it was so Important to Council that California Street be Improved with sidewalks, being that it is such a narrow street. Councilman Littlejohn answered the query by stating that, if the street is a public street, it has been required, in the past, to install sidewalks at the time of development; that the intent of Council is to improve the streets as fast as possible. As there was no one else in the audience desiring to speak in behalf of or in opposition to this zone exception case, Mayor Cole declared the hearing closed. Discussion followed. Mr. Herbert D. McCarthy, 1240 San Marino Avenue, San Marino, stated that he has been a property owner in the State of California for over thirty years and has dealt in real estate, both industrial and commercial, for the last fifteen years, and represents the owners of the property, Mr. Duntley and Mr. Agajanian. He further stated that he was responsible for selling the property to Union Oil Company...that escrow was opened, and their funds have been with the Title Insurance and Trust Company, subject to approval of the zoning, for the last several months; that it was his feeling that the recom- mendation of denial by the Planning Commission was predicated upon a general over-all plan, and that this property was planned to remain as residential; wherein he complimented Simon Eisner & Associates, Planning Commission and Council on the proposed general plan; that it was his opinion that no one would develop this property as residential; that the City could accomplish, through commercial zoning of this property, definite advantages; that Union Oil Company would erect a modern service station, dedicate the property, have addition- al facilities, such as rest rooms for the use-of the general public, etc. Mr. Art Agajanian, 805 South Sierra Bonita, Los Angeles 36, California, original owner of the property, stated that it was his feeling that this property is definitely commercial; that he has been a resident of Baldwin Park for some time and hasdealt with the past three Planning Directors; where- in he presented several photographs of the property under discussion for Council's viewing. Mr. Joseph M. Roush, 246 Beaumont Street, Playa Del Rey, stated that he has appeared before the Planning Commission on behalf of his client, Mr. Duntley; that he has, for the past twelve years, dealt in plant location work; that it was his suggestion that Council give consideration in be- half of this case, as a help to the City, to Mr. Agajanian, Mr. Duntley and Union Oil Company. Mr. H. Glendenning, Union Oil Center, Los Angeles, California, stated that it was not the procedure of Union Oil Company to try to change residential property for service station use, but occasionally a site is found that has lost its value as a residential area..and that is the reason this particular prop- erty at Puente and Merced,,rvas selected; that the oil companies have to service and cater to the wants of the buyers, wherever that might be; that an outside appraisal was made of this property, with the determination being that the highest and best use for this parcel would be a service station. Mr. McCarthy stated that he was qualified to appraise proper- ties, being employed by others to do so, and concurred that the best use of this property would be for a service station; that although there are commercially zoned properties available, only a small percentage are on corners, which are best suited for service station purposes. Walker, 3202 North Puente Avenue, Baldwin Park, expressed the opinion that this particular piece of property was too narrow to be suitable for a service station; that C-2 zoning Was too heavy" for this location; that this prop- erty might, in the near future, have subdivision development potential. Mr. Agajanian, in rebuttal, stated that the present condition of this property is not sanitary, due to the files and debris; that the only way this property can be improved is to bulldoze" it and erect a modern service station with rest room facilities; that Union Oil Company, he felt, would install an adequate fence providing sufficient separation, and that their facl'lity would be an asset to the City. Mr. Glendenning, in rebuttal, stated that Union Oil Company has given that property much consideration and that it was sufficient in depth and width. Mr. Conrad Alds, 3671 Big Dalton, Baldwin Park, questioned whether their property would be affected; questioned whether any thought has been given to putting in streets from Pacific Avenue to Merced, as they are land-locked; stated that they were not against the request, but they would like to have houses near them rather than a hospital. Mayor Cole informed Mr. Aids that this would not be a hospital, in effect, that there would only be six patients plus the family and em- ployees. As there was no one else in the audience desiring to speak either in behalf of or in opposition to Special Use Permit Case No. Z-88, Mayor Cole declared the hearing closed. COUNCILMAN LITTLEJOHN MOVED THAT COUNCIL CONCUR WITH THE FIND- INGS OF THE PLANNING COMMISSION AND THAT THE CITY ATTORNEY BE INSTRUCTED TO PREPARE A RESOLUTION GRANTING THIS SPECIAL USE PERMIT, SUBJECT TO THE CONDITIONS AS SET FORTH IN PLANNING COMMISSION RESOLUTION NO. 624. The motion carried by the following vote: AYES: COUNCILMEN LITTELJOHN, HOLMES, BISHOP, BLOXHAM AND MAYOR COLE NOES: NONE ABSENT: NONE 00- Mayor Cole announced that Council would now return to the matter of the petition protesting passing of Ordinance No. 162. Mrs. Harold MacKay, 13116 Francisquito Avenue, Baldwin Park, stated that her two daughters, in order to attend school, would be compelled to walk up Francisquito Avenue, which has no curbs, and that, at a point, the street becomes very narrow; that routing of trucks on this street will not slow down auto- mobile traffic; wherein she questioned whether this would be a permanent route; it was her suggestion that Ramona Boulevard, straight through to Peck Road, be utilized, which would give access to the Freeway; that, with the opening of another new school, the trucks would be an additional hazard. Mayor Cole stated, in answer to Mrs. MacKay's query, that Francisquito Avenue is a permanent route at the present time. Mr. James Gibson, on behalf of the citizens on Francisquito Avenue, welcomed the new Acting City Attorney and congratulated him on his appointment; wherein he questioned regarding the legality of a north-south route...what the status is and what is legally required. Mrs. Marlin Hancock, 3445 Remey, Baldwin Park, stated that it was her understanding the routing of truck traffic on Francisquito Avenue was a temporary measure; that the corner of Frazier and Francisquito will be utilized for student and faculty and school bus parking, which will create further traffic problems; questioned regarding a proposed park off of Francisquito; that it was her understanding the new school will not have a major athletic field. Discussion followed wherein Councilman Bishop proposed that the truck route be changed to route travel out Ramona Blvd. to Peck Road-that, eventually, there will be on and off ramps at Ramona Boulevard, and that Rivergrade Road will qualify from the standpoint of a north-south route. COUNCILMAN BISHOP MOVED THAT COUNCIL START NEW PROCEEDINGS ON ORDINANCE NO. 162, AMENDING IT TO ADD FRANCISQUITO AVENUE TO THE LIST OF RESTRICTED STREETS, AND BALDWIN PARK BOULEVARD NORTH OF THE FREEWAY, ADDING RAMONA BOULEVARD FROM FRANCISQUITO AVENUE. The estimated cost of Phase I was $9,707.00, with an estimated cost of $15,500.00 for the acquisition of right of way. It is possible the City can do its own inspection and thereby save the 2% fee for inspection and supervision of field work and final set of grades for construction. Considerable discussion followed wherein City Engineer Young expressed the opinion that, with the work-load he is carrying, there would be no available time for acquisition of right of way work, and, it was his suggestion that, to expedite the staking of grades and field inspections, the contractor be permitted to do this... otherwise, it would mean removing City crews from other projects. Councilman Bishop expressed the opinion that the City could-handle the acquisition of right of way work better than an engineering firm, and suggested that a person be hired to do this work only; wherein there were pros and cons as to whether the 2% fee should be deleted or not. Distributing Co. concerning Sears Roebuck advertisements, wherein the total amount involved, being City license fees owed since 1958, plus penalties, is $7,110.00. He further stated that the Woods Distributing Co. has been charged on a felony count by the District Attorney's office in El Monte, and charged with vio- lation of the business law in West Covina; that, in discussing the matter with the attorneys and an evaluation of the costs involved, it was their recommendation that we compromise the total amount due and accept $5,710.00, which would pay the license fees for 1958-59, plus the license fee and penalty for 1960. Discussion ensued wherein Acting City Attorney Flandrick gave legal clarification in that Council may waive any part of the penalty. Traffic counts in Janu- ary, 1960, showed an average daily traffic count of 5,200 vehicles per 24 hours on Ramona Bouel yard and 5,700 average daily traffic on Francisquito; a check with the Police Department showed no fatalities at this intersection, although many citations have been issued. Discussion ensued wherein Councilman Holmes expressed the opinion that stp signs should be installed on Ramona Blvd. and on either side of Francisquito. COUNCILMAN HOLMES MOVED THAT THIS PLAN BE ADOPTED AND THAT CITY ENGINEER BE INSTRUCTED TO,PROCEED PROMPTLY, WITH THE ADDITION OF STOP SIGNS ON RAMONA AND ON BOTH SIDES OF FRANCISQUITO AVENUE, INCLUDING BOTH LANES. COUNCILMAN BISHOP SECONDED. The motion failed to carry by the following vote: AYES: COUNCILMEN HOLMES, BISHOP, NOES: COUNCILMEN BLOXHAM, LITTLEJOHN AND MAYOR COLE ABSENT: NONE Further discussion followed wherein Councilman Littlejohn suggested that this plan be revised, incorporating the suggestions as presented and then brought back for Council action. CITY ENGINEER YOUNG INSTRUCTED TO INCORPORATE THE SUGGESTED REVISIONS IN AN EXACT PLAN AND REPORT BACK TO COUNCIL. 00- Chief Administrative Officer Asmus informed Council that a meeting with officials of the Sanitation District, with regard to a new trunk line, is scheduled for tomorrow, Tuesday, February 21, 1961, at 2:00 p.m. Considerable discussion ensued. Chief Administrative Officer Asmus stated that the people on Maine Avenue had approached him about Council institu- ting a 1911 Act by reverse procedure, and asked if Council would consider such action.
