HomeMy WebLinkAbout1961 04 12 CC MIN1961 04 12 CC MINHÄ—@¸—BùÍ«12 i I ADJOURNED REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue Roll Call: Present: COUNCILMEN BISHOP, BLOXHAM, HOLMES, LITTLEJOHN AND MAYOR COLE Absent: CITY ENGINEER YOUNG*, PLANNING DIRECTOR MANSFIELD AND CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY SAUNDERS, AND CITY CLERK BALKUS *(City Engineer Young arrived later) 00- Chief Administrative Officer Asmus stated that the first item intended to be on the Agenda was the approval of plans and specifications for the improvement of Baldwin Park Boulevard, however, they are still working with the County on this and there Is a good chance of doing the complete project all at one time; that, if this did not materialize within the next two weeks, then it was his intention to bring before Council our plans and specifications for the first phase; that the County reports now there is nothing definite, but that the engineering department has been working and getting estimates on relocating one of the houses; that he is proceeding through Mr. Templin's office to get the plans that are prepared approved, and then to Supervisor Bonelli for funds. Mr. Asmus further stated that Supervisor Bonelli was agreeable that this project should be approved, however, when the Puente Avenue project appeared, it took precedence.... but now it would be beneficial to again proceed with this project so it could be started this fiscal year. Considerable discussion followed relevant to the amount of time involved; wherein Chief Administrative Officer Asmus stated that this matter Will be back before Council for ap- proval of plans for that portion of Baldwin Park Boulevard, from Dalewood to the City Limits. 00- Chief Administrative Officer Asmus presented the matter of a request by Standard Oil Company, regarding waiver of the Code provision pertaining to setbacks, being 70' from the center line of a major highway; wherein Mr. Asmus recalled the fact that a plan for a service station had been before Council at a previous meeting, at which time Council would not grant an exception; that a building permit has been issued on the building and pumps, which all complies, the only problem now is that one leg of the sign will be setting about 31 inside the property line, but not back 201 from the property line; wherein indication from Council as to approval was requested by Mr. Asmus. Considerable discussion ensued wherein Chief Administrative Officer Asmus located this particular area as being at the southwesterly corner'of Dalewood and Baldwin Park Boulevard; wherein Councilman Bishop expressed the opinion that if this exception request is granted, then the City is obligated to do likewise on others that may come before them...that it would be better to change the Building Code to conform with Council's direction. COUNCILMAN LITTLEJOHN SECONDED. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, LITTLEJOHN AND MAYOR COLE NOES: COUNCILMEN BISHOP AND BLOXHAM ABSENT: NONE Mr. Blanshard Maynard, 2415 West Avenue 30, Los Angeles, California, one of the owners of the property stated that, originally, Standard Oil Company did not know about the setback requirement, and their surveyor did not catch it; that he was not an employee of Standard Oil Company; that the only.thing they are concerned over is the support for the sign, not for the actual location of the sign itself. 00- City Engineer Young and his assistant, P. Milak arrived.) 00- Chief Administrative Officer Asmus next presented the matter of a report from the City Attorney relevant to the J.B. Hanauer & Company contract wherein he set forth his opinion regarding. the City's liability under the contract; wherein tbeCity Attorney's report urged caution in proceeding in Initiating a 1911 Act; that the expiration date of this contract is July 6, 1961. Considerable discussion followed wherein Councilman Bishop expressed the opinion that it would be a waster of City Funds to try and set up a 1911 Act District at this time, but that he did feel that every effort should be exerted toward getting the trunk lines in; wherein Councilman Holmes elaborated on the matter of the water flow situation; wherein the Chief Administrative Officer urged that Council take no action relevant to the formation of a 1911 Act District until after July 6, 1961; and requested direction from Council regarding letters that have been prepared for-mailing, merely as a poll", to determine the interest toward a 1911 Act District formation. City Attorney Saunders gave legal clarification as to what constitutes the initiation of the formation of a 1911 Act District, and urged Council to abstain from any action until the expiration of the contract with J. B. Hanauer & Company. Members of Council stated that they would like to see a copy of the letter prepared by the Chief Administrative Officer before-its distribution. INSTRUCTION OF COUNCIL THAT ALL ACTION BE WITHHELD UNTIL AFTER JULY 6, 1961. 00- Chief Administrative Officer Asmu8 presented a request for an allocation In the amount of $158.84 for a side desk for assembling for the City Attorney's Office, and stated that this purchase will complete all the furniture needed for this particular office. COUNCILMAN HOLMES SECONDED. The motion carried by the fol- lowing vote: AYES: COUNCILMEN BISHOP, HOLMES, BLOXHAM, LITTLEJOHN AND MAYOR COLE NOES: NONE ABSENT: NONE Chief Administrative Officer Asmus reported that the tree removal program had been prepared by the Engineering Office and requested suggestions and direction from Council. Considerable discussion ensued wherein Councilman Bloxham stated that the people on North Maine, as a whole, were glad to see the trees removed If necessary to improve the side- wa'lks. Chief Administrative Officer Asmus stated that several letters of protest to the tree removals have been received; wherein the matter of public relations was discussed. It was stated that there are about 165 trees involved about 50% to be removed. City Engineer Young stated that these trees were taken out on the verbal consent of the property owner, and that he issues a work order on tree removals in compliance with the Municipal Code; a tree replacement program will be Included in the next budget in order to carry on these proj- ects. It was suggested that the tree program be planned for beautification rather than shade; wherein City Engineer Young stated that the men in the Street Department have been Instructed on the issues of good public relations. Councilman Bishop stated that, after reading.the Administrative Regulation pertaining to the City Attorney, there will have to be more lee-way" between the City Attorney and the Department Heads and City Clerk, as there will be numerous occasions when a legal interpretation will be needed immediately, with in- sufficient time to route through the Chief Administrative Officer. Discussion followed wherein Councilman Bishop stated that it was up to Council to make policy, not carry it out; wherein Councilman Littlejohn expressed the opinion that it is up to Council to make policy and instruct the Chief Administrative Officer as to their desires. The hiring of an Assistant Chief Administrative Officer was discussed with further clarification given by Chief Administrative Officer Asmus. Chief Administrative Officer Asmus stated that, if he is to be responsible for the administration in this City, he must have control over the matter that the City Attorney prepares in order to be wholly conversant with the subject matter; wherein City Clerk Balkus requested the opinion of Council regarding her status in this matter, to which Councilman Littlejohn offered clarification in that she is an elective of the City, and therefore, enjoys the same privileges,relevant to the City Attorney, as do they of Council; wherein the suggestion was made that a personnel session be set up to discuss this matter further, setting up a schedule of duties and responsibilities of the elect- ive officials and the Chief Administrative Officer. Discussion ensued wherein City Attorney Saunders gave further legal clarification. AT 1:23 P.M. COUNCILMAN LITTLEJOHN MOVED THAT COUNCIL ADJOURN. COUNCILMAN HOLMES SECONDED.
