Roll Call: Present: COUNCILMEN BISHOP, BLOXHAM, HOLMES, LITTLEJOHN AND MAYOR COLE Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY SAUNDERS, CITY ENGINEER YOUNG, ASSISTANT PLANNING DIRECTOR STEWART AND CITY CLERK BALKUS Mayor Cole announced that this special meeting was called for the purpose of passing a resolution adopting and submit- ting a budget for expenditure of funds allocated from the State Highway Fund to Cities and authorizing the proper of- ficials to sign. Chief Administrative Officer Asmus explained that this reso- lution authorizes the City Engineer to sign, on behalf of the City, a project statement showing the estimated expenditures for 4095 money street maintenance) to be used for next year only, and that there will be a similar authorization of this Council allocating 60% construction money, later, when the project has been determined for that. At the request of Mayor Cole, City Clerk Balkus read Resolu- tion No. 61-67 in full as follows: RESOLUTION NO. 61-67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPT- ING AND SUBMITTING A BUDGET FOR EXPENDITURE OF FUNDS ALLOCATED FROM THE STATE HIGHWAY FUND TO CITIES" WHEREAS, a Master Agreement has been executed by the City and the State of California on May 12, 1961, for ex- penditure of funds allocated from the State highway fund to cities; and WHEREAS, the City Council has prepared a project statement showing estimated expenditures of such funds recommended to be made during the 1961-62 fiscal year; and WHEREAS, the City Council has heard read said proj- ect statement and is familiar with the contents thereof; THEREFORE, be it resolved by the City Council of the City of Baldwin Park that said project statement be MAY 29, 1961 FLAG SALUTE ROLL CALL REASON FOR SPECIAL MEETING ANNOUNCED BY MAYOR COLE. City Clerk Balkus stated that the required publications and postings had been accomplished. Assistant Planning Director Stewart presented a resume of previous hearings, elaborating on the findings of both the Planning Commission and the City Council. Mayor Cole Introduced Mr. Arthur Shatz of Simon Eisner and Associates who was in attendance to answer questions and provide further clarification of the plan, if desired. Mr. Shatz stated that in the past two years he has been involved in the study and development of a plan to be used as a guide to the change and future development of the com- munity of Baldwin Park, and indicated that the various colors, shown on the General Plan Map on the wall, represent how land can best be used, the number of people the land can accomodate under these conditions and sets forth proposals to improve present industrial areas and rejuvenation of the central busi- ness district. He emphasized that this is a plan not a I.,=, and that it does not affect, in any way, the zoning ordinance now in effect....that It does not confer any new rights nor does it take away any rights" At this time, City Clerk Balkus administered the oath to those in the audience desiring to speak. Mr. Edwin Elko, 13057 Bess Avenue, Baldwin Park, questioned whether the streets and highways" portion of the plan could be adopted separately from the zoning portion" of it; where- in he expressed the opinion that this plan is not of the people but by the legislators, and that zoning as presently exists, would change over-night" and be down-graded". Mr. Shatz, in answer to Mr. Elko's queries, reiterated that the proposed General Plan is n a zoning ordinance"..... that its use is for guidance; that the plan, in its entire- ty being composed of four basic elements I) streets and highways 2) land use 3) public facilities 4) standards, should be adopted. He further endeavored to explain the issue made relevant to downward zoning". Discussion followed relative to the type of zoning along the freeway and its resultant uses, with Mr. Shatz and members of Council offering further clarification for the benefit of Mr. Elko. Mr. D. W. Asquith, 13138 Judith, Baldwin Park, expressed the opinion that, under the proposed General Plan, properties would be rezoned without proper notification, and broached the matter of the cost of this plan, with no specific recom- mendations being made for hospitals. He disputed Council's representation of the 35,000 citizenry as opposed to those in attendance objecting to the adoption of this proposed plan. Discussion ensued wherein the City Attorney stated that property cannot be rezoned without proper notifications, publications and postings being made and a public hearing being held, Councilman Littlejohn endeavored to further clarify the responsibility of members of Council to the populace of the City of Baldwin Park, and Mr. Shatz offered further clarification. She further stated, that in this particular area of Azusa Canyon Road they can sell their property as neither residential nor business. Mayor Cole stated that the City of Baldwin Park has no jurisdiction over this area as it is in the-City of Irwindale, and Councilman Holmes offered further elaboration of this problem. Mr. M. A. Erhardt, 14405 Garvey Avenue,. Baldwin Park, requested clarification from Council relevant to the matter of rezoning of property in Baldwin Park.at-the time of incorporation. He expressed the opinion that proper and sufficient notification was not made at the time of adoption of the Interim Zoning Ordinance,. and that zoning, as it was under the County, is what the people want. Discussion followed wherein Councilmen Littlejohn and Holmes endeavored to satisfactorily clarify the various points of issue made by Mr. Erhardt. Mrs. Marianne Johnson, 3825 North Foster, Baldwin Park, asked, as a matter of clarification, if the proposed Master Plan would be flexible, if adopted, being used only as a guide, and that they could be assured there Is no connection between the Interim Zoning Ordinance and this Master Plan. Mrs. Sarah T. Gilliam, 13138 E. Judith, Baldwin Park, re- quested that the zoning on Judith remain as it is, and expressed concern over the value of her parent's property. She also discussed and questioned the matter known as the Via" property and its proposed use. Discussion ensued with Mr. Shatz offering further clarifi- cation. Mr. James Q. Gibson, 13268 Francisqui-to, Baldwin Park, ex- pressed the opinion that the, proposed Master Plan is a very fine thing, and that progress cannot be attained without some definite goal being set. Mrs. Dorothy Soffee, 13013 Torch, Baldwin Park, questioned why a Council meeting Is held the eve before a holiday when the majority of people are away and expressed the opinion that the City needs a newspaper of its own and, also, a park- ing, area established. Discussion followed wherein the queries of Mrs.. Soffee were answered, in that four public hearings have been held on the matter of a Master Plan for the city; that Council meetings are held on the first and third Mondays of each and every month, as established by law. As there was no one else in the audience desiring to speak either in behalf of or in opposition to the proposed Master Plan, Mayor Cole declared the hearing closed. COUNCILMAN BISHOP MOVED THAT THE CITY ATTORNEY BE INSTRUCTED TO PREPARE A RESOLUTION ADOPTING THE GENERAL PLAN FOR THE CITY OF BALDNIN PARK, CONSISTING OF THE GENERAL PLAN MAP AND THE GENERAL PLAN REPORT, AS PRESENTED.- COUNCILMAN- BLOXHAM SECONDED.
