FLAG SALUTE The invocation was given by Reverend James Leovy of St. INVOCATION Matthew's Episcopal Church. Roll Call: Present: COUNCILMEN BISHOP, BLOXHAM, HOLMES, LITTLEJOHN AND MAYOR COLE Absent: CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY SAONDERS, CITY ENGINEER YOUNG, *PLANNING DIRECTOR MANSFIELD AND CITY CLERK BALKUS *(Not present at roll call but arrived later) 00- ROLL CALL COUNCILMAN HOLMES MOVED THAT THE MINUTES OF APRIL 12, 1961, BE MINUTES OF APRIL APPROVED WITH FURTHER READING WAIVED. COUNCILMAN BISHOP SECONDED. 12, 1961 APPROVED There were no objections, the motion carried and was so ordered WITH FURTHER READ- by Mayor Cole. ING WAIVED, 00- At this time City Clerk Balkus administered the oath to those in the audience desiring to be heard during the meeting. 00- Mr. Richard K. Knowlton, Attorney, representing the Santa Fe Railway, 121 East Sixth Street, Los Angeles, California, thanked Council for permitting him to present their side of the story te1eV.anf to the M61tgLe-it with Western Pacific Railway. He stated that there are three railroads serving industry and other in- terests on the West Coast, being I) Santa Fe 2) Southern Pacific 3) Great Northern-Northern Pacific; that, last October Southern Pacific filed an application to take over Western Pacific Railway, which action, in his estimation, would turn back the clock some 60 years, at which time Southern Pacific was a monopoly, controlling every carload of freight moving to California industry and that moved from California agri- culture; that, under this merger, the controlling railway would have the power to set rates, determine practices, make available such cars as it will and have a strangle hold" on the majority of freight which is still rail bound; that the Western Pacific is fighting for survival and the Santa Fe is fighting to remain a West Coast carrier instead of terminating in Southern California on an east-west route: that the items offered by the Santa Fe are: continued expansion to competitive rail service, lower rates that evolve from competition, expediter service which competes with the trucks piggy-back" service which the Western Pacific originated, further dieselization which both the Western Pacific and Santa Fe originated, the maintenance of the status quo" instead of a reversion to a Southern Pacific monopoly. Discussion followed wherein Mr. Knowlton stated that hearings will be commenced on July 17, 1961 and concluded approximately six weeks to three months thereafter. City Clerk Backus read a letter from Mr. Charles A. Spooler regarding a meeting to be held on June 20, 1961, in the City Hall at 7:30 p.m. as follows: June 5, 1961 Honorable Mayor and City Council City Halt Baldwin Park, Calif. Gentlemen: On June 20, 1961, 7:30 p.m. in the City Hall of our city, the Honorable Frank G. Boneili,'Firsf1District Chairman of the County Board of Supervisors, will honor us by appearing and speaking on The Obstacles on the Road to Progress" and ways to accomplish our objectives in relation to civic prob- lems. At my request, Councilman Littlejohn will officiate as spokesman on behalf of the City Council. The Mayor, all members of the City Council, City Clerk, the Chief Administrative Officer, the Administrative Staff, and the Police Department are all invited and urged tt attend this important meeting. It would.be most fitting for our own city officials to extend an Invitation to the officials of the surrounding cities and ask them to be with us. Thank you for your courtesy and times. There were no objedtions, the motion carried and was so ordered by Mayor Cole. 00- Councilman Bishop reported that two weeks ago he had attended the East San Gabriel Valley Planning Committee in lieu of Councilman Holmes who was unable to attend, whereat they elected a new chairman and secretary, both from the City of Covina. He also stated that the questlion as to whether Planning Directors will be permitted to serve on this com- mittee was discussed, and that the primary purpose of this committee was to formulate and inform adjacent cities with regard to zoning in order that actions taken can be on a compatible basis. He also stated that Mr. Asmus, Mrs. Balkus and Mrs. Shepard were in attendance and testified in opposition to such an installation, and that the zone exception had been denied by a 3-2- vote. 00- Mayor Cole reported that he had attended the Boy Scouts S. G. Valley Jamboree last Saturday night, June 3, 1961, at the Rose Bowl, and that II Mayors from surrounding cities were there. He also stated that some 8,000 Scouts were on the field at one time, and that Baldwin Park was represented. 00- City Clerk Balkus presented a resolution from the City of Duarte opposing legalized gambling in said City or anywhere in this Va`l ley. At the request of mayor Cole,,City Clerk Balkus read the resolu- tion as follows: RESOLUTION NO. 61-44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUARTE DECLARING ITS OP- POSITION TO LEGALIZED GAMBLING IN SAID CITY. WHEREAS, a proposal has been made to legalize a form of gambling, to wit, poker, in the City of Duarte; and, WHEREAS, legalized gambling brings into a community law-' less and undesirable elements; and, WHEREAS, legalized gambling Is destructive of the moral standards of the community and sets a bad example for the youth of the community; and, WHEREAS, the elements in control of legalized gambling soon take complete control of the community so that all else becomes subservient to the gambling interests; and WHEREAS, legalized gambling injures the normal develop- ment of business and industry in the community and repels responsible businesses and industries from locating in the community; and WHEREAS,, legalized gambling causes financial disaster for many families in the area and materially to the burdens of public agencies in caring for destitute mothers and chil- dren; and WHEREAS, the City of Duarte is financially stable, imposes no city tax rate, and has no need for tainted money; NEW, THEREFORE, the City Council of the City of Duarte does RESOLVE AND DECLARE as follows: Section i. This City Council is unalterably opposed to any form of legalized gambling in the City of Duarte and will oppose by every method available to it, any attempt to in- stitute legalized gambling in the City of Duarte. Section 2. The City Council urges all of its citizens to join with it in opposing said proposal and urges said citizens to refuse to sign or support any initiative proposal which would have the effect of legalizing gambling in the City of Duarte. He further stated that this proposed form is one that many cities have adopted, being clearer in its explanation of what is and what is not a violation. Considerable discussion ensued relative to the procedures and time limits involved in the adoption of a new truck route ordinance. At the request of Mayor Cole, City Clerk Backus read Ordinance No 176 in full as follows: ORDINANCE NO. 176 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDJIN PARK MUNICIPAL CODE TO PROHIBIT MOTOR VEHICLES EXCEEDING 6,000 LBS. FROM USING CERTAIN CITY STREETS, AND REPEAL- ING AND RESCINDING ORDINANCE NO. 162 OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK" THE CITY COUNCIL OF THE CITY OF BALDNIN PARK DOES ORDAIN AS FOLLONS: SECTION I. Section 3377 of the Baldwin Park Municipal Code is hereby amended to read as follows: 3377. Commercial Vehicles Prohibited from Using Certain Streets. a) Whenever this Code designates and describes any street or portion thereof, as a street, the use of which is permitted by any vehicle exceed- ing a maximum gross weight limit of 6,000 lbs., the City Engineer shall install and maintain along and upon such streets, appropriate signs-,.giving notice of such restriction. Streets so designated shall be referred to as truck routes". b) When any such truck route or routes are es- tablished and designated by appropriate signs, the operator of any vehicle exceeding a maximum gross weight limit of 6,000 lbs. shall drive on such route or routes and none other, except that nothing in this section shall prohibit the operator of any vehicle exceeding a maximum gross weight of 6,000 lbs. coming from a truck route" having ingress and egress by direct route to and from restricted streets when necessary for the purpose of making pickups or deliveries of goods, wares and merchand- ise from or to any building or structure located on such restricted streets or for the purpose of delivering materials to be used on the actual and bona fide repair, alteration, remodeling or con- struction of any building or structure upon such restricted streets for which a building permit has previously been obtained therefor. c) The provisions of this section shall not apply to I) passenger busses under the juris- diction of the Public Utilities Commission, or to 2) any vehicles owned by a public utility while necessarily In use in the construction, installation or repair of any public utility. d) The following streets and portion of streets are hereby declared to'be truck routes for the movement of motor vehicles exceeding maximum gross weight of 6,000 lbs.; Continued) BIB] 39597-U01 1961-U02 06-U02 05-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO115490-U03 DO117386-U03 C4-U03 MINUTES1-U03 5/21/2008-U04 ROBIN-U04 CITY-U06 COUNCIL-U06 1961 06 05 CC MINHÄ—@¸—CPÍ«214 Regular Meeting of the Baldwin Park City Council June 5, 1961 Page 8 1) Rivergrade Road at all points within the City. 2) That portion of Ramona Boulevard lying northerly of the Pacific Electric Railroad-tracks between the easterly City limits and Maine Avenue. 3) That portion of Ramona Boulevard lying southerly of said Pacific Electric Railroad tracks between Maine Avenue-and the westerly City limits. 4) Badillo Street at all points within the City. 5) Puente Avenue between Merced Avenue and the southerly City limits. 6) Puente Avenue between Ramona Boulevard and Badillo Street. 7) Baldwin Park Boulevard between San Bernardino Freeway and southerly City limits. 8) Ramona Boulevard south of the Pacific Electric Railroad tracks between its intersection with Badi l to Street and Maine Avenue. 9) Francl ufito southeast of Puente Avenue to City limitsl. SECTION 2. Ordinance No. 162 of the City Council of Baldwin Park, adopted on February 6, 1961, is 4ereb-y repealed and rescinded as of the effective date of this ordinance. SECTION 3. The City Clerk shall-certify to the adoption of this ordinance and publish the same in the manner prescribed by law. Mr. B. Immordino, Trim Products Company, 14816 E. Ramona Blvd. Baldwin Park, questioned how customers can come into Baldwin Park to do business if there is no truck route open to them and stated that they had lost $10-15,000.00 this month because truckers refuse to come into the City. He also took issue over the 6,000 lb. weight limit and stated that a north-south truck route in Baldwin Park was a must". City Clerk Balkus, from an earlier conversation with C. H. Gleason, owner of Trim Products Company, clarified the comments of Mr. Immordino, in that the company, Trim Products, brings into the City about three-quarters of a million dollars, and their trucks empty, weigh 7,500-10,000 lbs. and loaded weigh 15-20,000 lbs) could be prohibited the use of City streets due to the weight limit ordinance. Mr. Ray 0. Walker, 3202 North Puente, Baldwin Park, spoke in behalf of the ordinance, stating that this ordinance was in line with other cities progressing business-wise. Mrs. Ellyn Baldwin, 13170 Francisquito, Baldwin Park, ques- tioned if the proposed ordinance, as previously discussed by the City Attorney, would put the trucks back onto Francis- quito. City Attorney Saunders explained that the proposed changes were in form only, not in route. COUNCILMAN LITTLEJOHN MOVED THAT THE PROPOSED NEW ORDINANCE BE READ IN FULL. MOTION DIED FOR LACK OF A SECOND. City Attorney Saunders explained that the proposed new ordi- nance was not ready for discussion tonight. Discussion continued with Chief Administrative Officer Asmus and City Engineer Young offering further clarification. Mrs. William,E. Basham, 4829 North Azusa Canyon Road, Baldwin Park, expressed thanks to the resident owners of Azusa Canyon Road for the privilege of speaking for them in protesting the use of this raod for heavy routing of trucks, and read a poem entitled Let's Build it Better", which reflected suggestions as to the betterment of Baldwin Park. Mayor Cole explained that the City of Baldwin Park has no jurisdiction whatever on Azusa Canyon Road, and that the original zoning was at the solicitation of the property owners at that time. Mrs. Barbara Hancock, 3445 North Remey, Baldwin Park, stated that the primary objection to trucks being routed on Francis- quito was due to the danger to the school children and not because of the noise, and that-the necessity for a truck route was understandable and suggested an on and off ramp from Rivergrade Road on Ramona Boulevard. Mr. Michael Dargus, 13260 East, Francisquito, Baldwin Park, questioned regarding the posting of Baldwin Park Boulevard and why nothing has, as yet, been done relevant to the Francisquito and Ramona Blvd. intersection. He also stated that it takes longer to travel other routes and that the truckers pay more in taxes than car owners, yet are not permitted in certain areas. Councilman Holmes offered a point of information for the bene- fit of Mr. Martin as to the length of time Baldwin Park Blvd. has been used for truck travel. Mrs. Harold McKay, 13116 Franclaquito, Baldwin Park, stated that she did not object to the trucks, as such, but was con- cerned over the safety of her daughters in going to and from school, in that there are no sidewalks for them to walk upon. Mr. H. R. Stoke, 1215 Oak Lawn Road, Arcadia, representative of the Southern California Rock Products Association, stated that they, too, are concerned about the matter of.truck traffic, not only in the City of Baldwin Park, but also in other neigh- boringacities. He further stated that an east-west, north-south route must be supplied the truckers,'and cited cases as ex- amples. He requestdd the full conslderation'of Council, and reminded them of theft responsibility in complying with State laws. Discussion followed wherein Councilman Holmes offered clari- fication on the origination and use of Rivergrade Road. Mr. Stoke stated'that their concern was the area south of Baldwin Park and took issue regarding the directive content of the ordinance under discussion in that it was his opinion said ordinance was in conflict with State law. Clarification of the use of CJty streets for deliveries was given by members of Council, and Mr. Gibson stated that it was their intent to defend human life, placing it above the cost of a dollar". Mr. William J. Hanson, 3642 North Baldwin Park Boulevard, Baldwin Park, stated that he has a restaurant at the cornier of Baldwin Park Blvd. and Merced and that business has de- creased 50% since the posting of Baldwin Park Boulevard. He further spoke in defense of the truckers. Mr. Edwin Rqllins, 3947 N.'Big Dalton, Baldwin Park, stated that he has four trucks over the weight limit and expressed the opinion that people will always complain and that there should be another truck route through town, suggesting Big Dalton or Baldwin Park Blvd. It was his suggestion that the weight limit be at 20,000 lbs. He called Council's attention to Section 3100.1212 k) of the Municipal Code which limits the number of stands to be located in the City to eight 8), and stated that two of the organizations applying for permits were lo- cated outside of the City. Mr. Sam Turner, President of the Optimist Club of Bassett, City of industry, stated that his club had been sponsored, in prevtous•years, by the City of Baldwin Park, and that their membership included several citizens of this City. He further stated that the sale of fireworks wad their main means of raising funds, and elaborated on the distribution and use of moneys gained in this manner. He also expressed the opinion that no boundaries should exist where youth work is involved. Considerable discussion followed wherein clarification was given that each permit issued is for one location only, and with the general consensus of opinion being that local organi- zations should be given preference. Mr. Berney Weiss of the Bassett Pony League expressed the opinion that the De Molay should not be considered as they have not indicated a location for a stand as yet.
