Mr. Ebaugh Introduced Mr. Davis,.724 Winthrop-Road, San Bernardino, who elaborated on the plan of insurance as pro- posed. Considerable discussion followed relevant to the cost, time- wise, that would be incurred for clerical work to install and maintain such a plan; that the City would have no ob- jection to such a plan, but it would be more feasible for the insurance company or the employees association to handle any collections direct. COUNCILMAN LITTLEJOHN MOVED THAT COUNCIL REJECT THE PLAN OF PAYROLL DEDUCTIONS FOR THIS TYPE OF INSURANCE FOR CITY EM- PLOYEES. COUNCILMAN COLE SECONDED. There were no objec- tions, the motion carried and was so ordered by Mayor Bishop. 00- Mayor Bishop announced that it was 8:00 p.m. and the time and place for public hearing on Zone Exception Case No. ZE-42, being a request for exception to R-3 zone, Section 9100.216 of the Baldwin Park Municipal Code to establish a sign and to use a portion of Lot 43, Tract 718, for a new and used trailer sales lot, Utility Holding Corpor- ation, Ltd.,. applicant, Roy E. Whitaker, representative. City. Clerk Balkus stated that the required publications, mailings and postings had been accomplished. Planning Director Mansfield presented a resume of the case, located the area involved on the map on the wall and stated ttet the Planning Commission recommended approval of this request for zone exception, subject to the conditions set forth in Planning Commission Res- olution No. 706. Mr. Stanley L 4 Chandler, 14803 Thornwall Street, La Canada, repreaWt*tive of the applicant, stated that granting of this requested exception would prtevide a display area for new and used trailers, and stated that he would be happy to answer any questions of Council. Mr.-Roy E. Whitaker, 770 Avocado Crest Road, La Habra, stated that Utility Holding Corporation can bring to the City additional sources of revenue, through taxation of personal property, real estate and sales tax. Mr. Edwin Elko, 13057 Bess Avenue, Baldwin Park, stated Irdi4 It was his opinion that anything was better than j;denti•al, but questioned the feasibility of storage pro dose to the freeway in that there was the possibil- ity of its becoming a junk lot". ZE-42 BE APPROVED, AND THAT THE CITY ATTORNEY BE INSTRUCTED TO PREPARE A RES- OLUTION GRANTING THIS EXCEPTION. COUNCILMAN LITTLEJOHN SEC- ONDED. Planning Director Mansfield presented a resume of the vac- ation and located this area on the map on the wall for bene- fit of Council. Mayor Bishop asked if there was anyone in the audience de- siring to speak in behalf of Resolution No. 61-100. Mr. Albert Egglestone, 7 West Hellman, Alhambra, spoke in behalf of Resolution No. 61-100, as It affected some of the streets In Tracts 13079 and 13722 and an approved Tentative Tract Map No. 26579. Mr. James E. Lines, 3343 North Puente Avenue, Baldwin Park, questioned whether such action would conform with the Master Plan. City Engineer Young offered clarification of the vacation proceedings. COUNCILMAN LITTLEJOHN MOVED THAT RESOLUTION NO. 61-100 BE CARRIED OVER TO THE AUGUST 7, 1961 REGULAR MEETING OF COUN- CIL. COUNCILMAN BLOXHAM SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bishop. 00- Mr. John Taylor, employee of the Baldwin Park Police De- partment, appeared as spokesman for the newly formed City Employees Association, briefly relating their comtemplat- ed plans and activities. Discussion followed wherein Council commented that they were In accord with the employees having their own assoc- iation, and that it was to the interest of all employees to actively participate in their association by turning out to vote on any and all issues. Councilman Littlejohn reported that the City of West Covina was hosting a Library Advisory Council on July 21, 1961, at 1601 Service Road, which would last about I-I' hours, and requested that another member of Council be appointed to at- tend In his absence. He further reported that the own- ers have deposited $111.50 for checking fees and'$8,11O.00 for street signs, street lighting and inspection; that any parkway trees will be placed by the subdivider at their ex- pense; that this tract is outside the Baldwin Park County Lighting District and, therefore, will have to be annexed to the Lighting District; that this tract has been annex- ed to the Baldwin Park County Water District; that all the streets in the tract are forty feet face'to face of curb and have sixty feet of right-of-way•excepting the cul-de- sac streets which have fifty-six feet of right of way, thus making eight foot parkways on the cul-de-sac streets and ten foot parkways on all of the other streets; that drainage of the cul-de-sac is toward Merced Avenue and will enter through curb boxes; that the final map is in sulk- stantial accordance with tentative maps submitted and ap- proved by the Planning Commission, as per Planning Com- mission Resolution No. 616. Considerable discussion followed relative to the construc- tion of a block wall along the back of the property on Olive Street and consideration of dry sewer installation for future connection to the collector sewer line, and the costs thereof. City Attorney Saunders offered clarification rel- evant to the type of agreement that would be necessary in connection with the Planning Commission Resolution No. 616. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, COLE, BLOXHAM, LITTLEJOHN AND MAYOR BISHOP NOES: NONE ABSENT: NONE Councilman Littlejohn expressed the opinion that he would have liked to see industrial, rather than residential, in this area, as it would have greatly assisted the tax dollar. 00- City Engineer Young reported that, relevant to the reap- proval of Final Map, Tract 26579, he had received a tel- ephone call asking that it be taken off the Agenda, and that the original buyer had requested the bond be return- ed, which he had refused. Mr. Young further stated that this tract would be back on the Agenda at such time as there is a new buyer. 00- City Treasurer Pugh read the Treasurer's Report as of June 30, 1961. Except in the case of construction under contract with the City Where a faithful performance bond is posted which guarantees to the City the repair of any street, including construction financed in whole or in part by special assessments, each applicant applying for a permit in addition to payment of the issuance fee prescribed by law, shall deposit with the City Engineer a sum of money, in no event to be less than $10.00, which is twice the estimated cost to the nearest $5.00 of repairing the surface of the street which may be damaged or destroyed by the proposed excavation or obstruction. The cost shall be estimated by multiplying the number of square feet or sur- face area which may be damaged, as shown by the application and plat, times the number of inches of thicknesses, plus one inch, times such unit sum as the City Engineer determines to most adequately represent the actual cost. Such determination of actual unit cost shall in no event specify a unit sum greater than $.25. The City Council may by ordinance or resolution change or revise such maximum unit sum from time to time. In the absence of any deter- mination of unit cost it shall be $.15. Section 5. Section 740i:l of the Baldwin Park Municipal Code is amended to read: 7401.1 Same. If, in the opinion of the City Engineer, the work pro- posed to be done requires the making of plans, the setting of stakes, the es- tablishment of grades, or any of them, the City Engineer may require the ap- plication to be accompanied by the necessary plans which plans shall be pre- pared by a licensed engineer. The City Engineer may authorize personnel of his department to prepare plans, set stakes, or establish grades, or any of them, at the request of the applicant, however, if any grades are established by City personnel, including the setting of stakes, in addition to any fees or deposit required by this article, the applicant shall pay an additional fee in accordance with the schedule adopted by the City Council and shall pay the City a fee equal to the actual cost for the preparation of plans. City Attorney Saunders offered legal clarification and expressed the opinion that the City could not legally engage in such sponsorship, but suggested that he check this point further and submit a written report on his findings, to be presented to Council at an adjourned meeting, should they desire it.
