HomeMy WebLinkAbout1961 07 19 CC MIN1961 07 19 CC MINHÄ—@¸—C¬Í«ADJOURNED REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue The City Council of the City of Baldwin Park met in ad- journed regular session at the above place at 5:00 p.m. Roll Call: Present: COUNCILMEN BLOXHAM, COLE, HOLMES, LITTLEJOHN AND MAYOR BISHOP Absent: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY TREASURER PUGH AND PLANNING DIRECTOR MANSFIELD Also Present: CITY ATTORNEY SAUNDERS, CITY ENGINEER YOUNG, ASSISTANT CHIEF ADMINISTRATIVE OFFICER BARKER AND CITY CLERK BALKUS City Attorney Saunders offered a legal opinion regarding City sponsorship of the Pony League Baseball Tournament, and stated that the use of public funds must be for a pub- lic purpose, which is set forth in the Constitution of the State of California, Article 4, Section 31, and, therefore, a donation to the Pony League would be a violation of this constitutional provision. He further stated that he had investigated other cities activities In this regard and checked with four prominent attorneys who, without excep- tion, agreed with his opinion, and cited comparable exam- ples for both chartered and general law cities. Discussion followed wherein Councilman Littlejohn expressed the opinion that Council should take some action, as a mat- ter of record, in order to relieve future like situations. COUNCILMAN BLOXHAM MOVED THAT NO ACTION BE TAKEN ON THIS MATTER. COUNCILMAN COLE SECONDED. The motion carried by the following vote: AYES: COUNCILMEN BLOXHAM, COLE AND HOLMES NOES: COUNCILMAN LITTLEJOHN AND MAYOR BISHOP ABSENT: NONE Assistant Chief Administrative Officer Barker distributed copies of a report to members of Council wherein recom- mendation was made that Mr. Harold Johnson receive favor- able consideration as Acting City Engineer, Public Works Director and Street Superintendent, along with a letter from Mr. Johnson indicating his willingness to accept this position at the specified rate, and a proposed resolution for adoption. Considerable discussion ensued with Mr. Barker offering further clarification of the terms of employment, i.e., expenses, mileage, etc. COUNCILMAN LITTLEJOHN MOVED THAT RESOLUTION NO. 61-101 BE READ IN FULL AND THAT THE NAME OF HAROLD JOHNSON BE INSERTED, AND THE RATE OR $8.00 PER HOUR BE INSERTED. That HAROLD L. JOHNSON is hereby appointed Acting City Engineer, Street Superintendent and Public Works Director of the City of Baldwin Park, effective August I, 1961, and he shall perform the duties and carry out the responsibilities as outlined under the applicable provisions of the Baldwin Park Municipal Code, and any other applicable statute. Section 2. That said Acting City Engineer, Street Superin- tendent and Public Works Director shall receive compensation for his services at the rate of Eight Dollars $8.00) per hour. Section 3. That the Acting City Engineer, Superintendent of Streets and Public Works Director is appointed on a temporary basis and shall not be required to maintain definite office hours at the City Hall of the City of Baldwin Park, but shall make himself available upon call by the City Council, or Chie-f Administrative Officer, or Assistant Public Works Director. Section 4. That this appointment may be terminated on three 3) days' notice by the City Council. Backus, City Clerk Discussion continued with the suggestion being made to delete the words following City Council", in Section 3, and Inserting the words or Chief Administrative Officer", which, in turn, deletes the previous inclusion of Assist- ant Public Works Director. COUNCILMAN LITTLEJOHN WITHDREW HIS ORIGINAL MOTION, WITH THE CONSENT OF THE SECOND. COUNCILMAN LITTLEJOHN MOVED THAT-RESOLUTION NO. 61-101, BEING CORRECTED TO READ, IN SECTION 3, LINE 5, CITY COUNCIL OR CHIEF ADMINISTRATIVE OFFICER" AND DELETING THE WORDS ASSISTANT PUBLIC WORKS D-IRECTOR", BE ADOPTED. COUNCILMAN COLE SECONDED.
