SPECIAL MEETING OF THE BALDNIN PARK CITY COUNCIL AUGUST 30, 1961

The City Council of the City of Baldwin Park met in special
session at the above place at 12:00 noon.
Roll Call: Present: COUNCILMEN BLOXHAM, COLE,
LITTLEJOHN AND MAYOR BISHOP

Mayor Bishop announced that as this was a special meeting TRACT 26009
there was just one item on the Agenda, being that of the RE SEWERS.
matter of Tract 26009, relative to sewers.
Assistant Chief Administrative Officer Barker stated that Report and recom-
letters have been received from Monarc Estates, Inc. and mendations by Asst.
Harold L. Johnson, Engineer, regarding this matter, and C.A.O. Barker.
read his letter of recommendation to Council as follows:

SUBJECT: Tract 26009 Sewers
It is recommended:
1. That the City Council enter into an agreement with the
Monarc Estates, Inc. to purchase a sewer line to be installed by said
corporation along Merced Street north from Ramona Boulevard to Olive
Street.
2. That said line be ten inches 10") in diameter from Ramona
Boulevard to Los Angeles Street, a distance of approximately 2644 feet,
and eight inches 8") in diameter from Los Angeles Street to Tract 26009
located on Olive Street, a distance of approximately 3030 feet. The line
should be engineered and constructed, with required man holes, and wyes,
to meet the requirements of the City Engineer.
3. That said line, after it has been constructed become the
sole property of the City of Baldwin Park and that the City pay the Monarc
Estates, Inc. for this line the following consideration:
A. The City to replace all pavement along Merced
Avenue from Ramona Boulevard to Olive Street.
The Assistant City Engineer has estimated that
this work can be performed by City forces with
a material cost of approximately $3,000.00..
B. The City to pay the Monarc Estates, Inc. a sum of
money not to exceed $8255.00. The exact sum to be
determined as 50% of the cost in excess of
$61,490.00 which said developer pays for the
installation of all sewers and house connections
in Tract 26009 and the above described trunk line
along Merced Avenue from Ramona north to Olive
Street. The cost shall include the Engineering
fees for the Merced portion of the line only.
4. In addition to the above cost it is recommended that the
Council waive the usual plan checking, inspection and permit fees. This
recommendation is based on the premise that these changes would not be
applicable if the work was performed by the City.

The above recommendations are based on an analysis
of the following information:
1. The City Council approved the final map of this
tract with the stipulation that dry sewers be in-
stalled within the subdivision and that cess
pools only be constructed; however, the Los
Angeles County Health Department will not permit
pools only" unless the developer can guarantee
all hookups to a public sewer system within two
2) years. It has been estimated that this method
of disposing of sewage within the tract would cost
the subdivider:
Sewers $39,000.00
Pools Only 22,,490.00
TOTAL COST: $61,490.00
2. One other alternative would be for the Council to
waive the dry line requirement within the tract
and allow the subdivider to Install cess pools
and septic tanks. It has been estimated that
this alternative would cost the subdivider
$51,900.00.
3. The remaining alternative is for the subdivider to
construct a complete sewer system throughout the
tract and to run a line along Merced Avenue from
the Tract to the Sanitation District Line at
Ramona Boulevard. The estimated cost of this
method of disposing of the sewage is:
Tract Sewers $39,000.00
House Connections 9,000.00
Merced Line 27,000.00

TOTAL COST: $78,000.00
4. The contractor is currently constructing the third phase
of the Sanitation District Line and has indicated that
the outfall line along Ramona Boulevard will be com-
pleted in sufficient time so that the above system could
be connected prior to time of occupancy in the Tract.
5. If alternative No. 3 is approved the construction of
the Merced Line will make a sewer line available to
a large segment of the City and thus encourage
development of the over-all. sewer system.
The subdivider has agreed to the above arrangement providing:
1. Merced Avenue be closed to through traffic during construc-
tion.
2. All construction of the project be under private contract,
with copies of the-bid released to the City Engineer.
3. The City guarantee that the Sanitation District Line be
completed by the time this tract is occupied by the first
purchaser or the City pay for the pumping of the sewage from
the tract until the line is completed.
I would recommend that these arrangements be accepted with the
exception of Item 3. The City Attorney has some question as to whether
or not the City could legally expend public funds to pump the sewage from
a private tract. It appears, however, from consultation with the contractor
constructing the third phase of the district line, that the line will be
completed in ample time.

I urge the Council to take favorable action on the above
recommendations; to instruct the City Attorney to draw up the
necessary agreement, and to authorize the Mayor and proper City
officials to sign said agreement.

Considerable discussion followed wherein Mr. Tracy Bousman, DISCUSSION AND
Subdivider, in answer to queries of Council, stated that: OPINIONS.
Under normal conditions they would be able to run 4-500' of
line per day, with completion In about two weeks.... however,
the whole area would not be closed to traffic at one time;
that he planned to start right away. Mayor Bishop expressed
the opinion that it was the City's responsibility to furnish
the contractor with the information as to the exact location
of the Y" s to preclude any slip-ups; wherein Mr. Bousman
stated that there are 173 homes involved in this tract; where-
in discussion occurred relevant to the salability of homes
with sewers rather than cesspools; wherein discussion ensued
relevant to backfilling in the streets; wherein Mr. Barker
stated that, if figured on the front footage basis, where you have
approximately 5,700' under hook-up charge, for every $1.00 of
front foot you would get back approximately $11,000.00 from
hook-ups on Merced Street alone; wherein the opinions were
expressed that the contractor should do the complete job which
would Include the stub-outs, resurfacing, etc.; wherein it was
suggested that Item A be deleted from the recommendations to
Council; wherein Mr. Bousman suggested an amendment to the pro-
posed agreement.
Planning Director Mansfield arrived at 12:37 p.m.
COUNCILMAN LITTLEJOHN MOVED THAT, REGARDING TRACT 26009,
SUBJECT OF SEWERS, THE ADDED CONDITION UNDER SECTION 2,
PLANNING COMMISSION RESOLUTION NO. 616, BE AMENDED TO
READ THAT SEWERS SHALL BE CONSTRUCTED IN TRACT 26009 AND
THAT THE SUBDIVIDER SHALL PROVIDE $61,490.00 AS HIS PORTION
OF THE COST OF THE SEWERS AND THAT THE AMOUNT OF MONEY THAT
COULD BE IN EXCESS OF THIS FOR THE COMPLETE INSTALLATION OF
THE SEWERS, BE NEGOTIATED AFTER THE RECEIVING OF SEALED BIDS,
WHICH ARE TO BE OPENED BEFORE THE CITY CLERK WITHIN A TWO-
WEEK PERIOD OF TIME. COUNCILMAN COLE SECONDED. The motion
carried by the following vote:
AYES: COUNCILMEN LITTLEJOHN, COLE,
BLOXHAM AND MAYOR BISHOP
NOES: NONE
ABSENT: COUNCILMAN HOLMES

AT 1:18 P.M. COUNCILMAN COLE MOVED THAT COUNCIL ADJOURN.
COUNCILMAN BLOXHAM SECONDED. There were no objections,
the motion carried and was so ordered by Mayor Bishop.
