The City Council of the City of Baldwin Park met in ad- journed regular session at the above place at 11:00 a.m. RolI Cal I: Present: COUNCILMEN COLE, HOLMES, LITTLEJOHN AND MAYOR BISHOP ROLL CALL Absent: COUNCILMAN BLOXHAM, CITY TREASURER PUGH AND PLANN ING DIRECTOR MANSFIELD Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY SAUNDERS AND CITY CLERK BALKUS 00- S Chief Administrative Officer Asmus briefly discussed the RE TRUCK ORDINANCE. truck ordinance and City Attorney Saunders offered further elaboration, citing various cases pending decision before the Supreme Court. Considerable discussion followed relative to the entering DISCUSSION AND and exiting of trucks and the routes to be used, with OPINIONS. examples being cited by City Attorney Saunders; contempla- tion of the matter of multiple deliveries within the City; wherein the Chief Administrative Officer stated that it ap- pears the majority of Council feels that trucks should be permitted to come off the freeway at the nearest street to make the first delivery; wherein suggestion was made that a north-south route should be established....also key" streets should be set up; wherein suggestion was made that by raising the weight limit from 6,000 lbs. to 10,000 ibs. there would not be enough difference to damage the streets but would prevent the heavier trucks from using the City as a run-through"; suggestion that the matter of increased weight limit should be a separate study, considering a def- inite weight limit on some streets and no limit on others; wherein City Attorney Saunders stated that enforcement must be done reasonably and intelligently in the event it is questioned, as, under the present ordinance, many different and reasonable" interpretations are possible because of its being so general. At 11:18 a.m. Councilman Bloxham arrived. ARRIVAL OF COUNCIL- MAN BLOXHAM. Discussion continued wherein City Attorney Saunders ques- FURTHER DISCUSSION tioned Council regarding the deliveries to the San Gabriel & OPINIONS. Valley Daily Tribune and to McKnight's equipment yard; wherein suggestion was made by the City Attorney that ord- inance will have to be predicated on either weight limita- tion or direct routes; consideration was given relevant to the various public utilities and their use of the City streets, etc.; wherein mention was made that the City of La Habra uses multiple weights; wherein suggestion was made that Council complete their study on this problem within 30 days; wherein mention was made that the Chamber of Commerce felt they should be included in the study of this matter; wherein suggestion was made that the people be contracted in an effort to present the problem as it exists for their better under- standing and realization of the necessity to arrive at a workable solution; wherein the consensus of opinion was that this matter should be held for study on multiple weight limitations for 30 days, then come back with a final deci- sion next month; wherein the City Attorney was instructed to find out if the City of Montebello has a similar ordinance and its contents. 00- BIB] 39597-U01 1961-U02 10-U02 04-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO115490-U03 DO117404-U03 C4-U03 MINUTES1-U03 5/22/2008-U04 ROBIN-U04 CITY-U06 COUNCIL-U06 1961 10 04 CC MINHÄ—@¸—D3Í«408 Adjourned Regular Meeting of the Baldwin Park City Council Councilman Littlejohn stated that, relevant to the sewer situation, he was not totally clear as to the time element, etc. and asked for further clarification. Mr. Ivor Lyons. stated that he was under the opinion he had given a fairly concise outline of the entire program in a letter to the Chief Administrative Offcer dated September I, 1961 which crystallized previous conversations between them; that, in this letter, methods were set forth which could best be used for sewering the rest of the City; that by going to aerial survey, as opposed to the orthodox sur- vey field parties, the City could be saved thousands of dollars and months of time; that aerial photography would give them a complete photograph of every street on a transparency, and is cheaper than a field survey; that, with these methods they are working out with Fairchild, the City, if it saw fit, by the middle of next year would be in a position to take bids on its final construction pro- gram...being in July,!1962...with the entire City being sewered by Christmas of next year;that, fifteen to eighteen months from now, with securement of funds from the Gov- ernment, this City could be entirely sewered; that, if there is any bottle-neck", it will be in getting the money from the Government, as they take a hard look" at such a program to determine the sincerity in following through; that Stone & Youngberg have indicated to, him that it will be 60 days before getting the first increment; wherein he suggested that, as the first increment is going out to bid that we immediately start processing the next application In order to save time; that it will take 2-3 months to get the first increment done; that he„h,a,s no control over legal or financial situations. Considerable discussion followed wherein Chief Administra- tive Officer Asmus stated that a contract with Stone & Youngberg will be before Council at their next meeting, as a sample contract had not been received until September 25, 1961; that Mrs. Marianne Johnson brought in petitions this morning which covers two areas, which, when completed, will indicate whether the people want sewers and if any areas can be processed for 1911 Act; wherein Councilman Holmes expressed concern over whether those handling these petitions fully understand that they are not actually circulating a 1911 Act; wherein query was made regarding the formation of a 1911 Act District on Holly Street, with the suggestion being made that the people in that area get together and hire their own contractor, as the area is too little for a 1911 Act. 00- AT 12:25 P.M. COUNCILMAN COLE MOVED THAT COUNCIL ADJOURN TO THURSDAY, OCTOBER 5, 1961, AT 11:00 A.M. IN THE COUNCIL CHAMBER OF THE CITY HALL. COUNCILMAN BLOXHAM SECONDED.
