Following are some of the reasons why tracts could not be finaled. a. Final acceptance and release of developer's REASONS NOT FINALED. agreement and bonds. b. Partial completion of improvements, grading, etc. c.. Improvements not shown on the plans. d. Lot line going through an existing building. e. Expiration of bond and agreement time limits. I R. A. Grindle, the developer, who explained they were awaiting PETITIONING COUNCIL the finalling of many tracts, for instance, Tract 24088 has FOR EXONERATION OF three sets of houses and three sets of out-buildings on dif- BOND ON TRACTS, ferent lots; Tract 26175 a problem on lots 18 and 19; Tract 22565, 26175, 24088, 22565 a building on a lot is holding up grading; Mr. Grindle 26475 & 26416. stated that his company is petitioning the City Council on Tracts 22565, 26175, 24088, 26475 and 26416 for exoneration of bond. Mr. Grindle stated that many original owners want their lots graded but the subdivider does not have permission to enter the property and grade the lots as he does not own the land, and further explained that when a subdivider buys a recorded map he has no knowledge of any previous unwritten agreement with the owners of lots that are not actually a part of the subdivision although they show on the map. These people want to be a part of a recorded map, with a division of land, and a free legal, however, there is no change of ownership. Assistant City Engineer Milak stated he had received letters DISCUSSION. from owners of lots in the tracts requesting that the grading be completed; that there is one tract where the lot line goes through the living room and grading anywhere near would inter- fere with the foundation of the house; however, on a lot where there is no structure, there is no reason why the lots cannot be graded. Maxine M. Belden, 2440 Stoner Avenue, Los Angeles, who owns Lot 22 in Tract 22565 a subdivision of Sun Ray Estates had written the City and R. A. Watt Construction Co. a letter requesting that her lot be leveled for proper drainage to correspond with adjoining lots, as this was her understanding of the work to be accomplished when she signed the plans for the subdivision. Mr. Milak explained the plans had been ap- proved by the engineer and a change would require a change order from the City Council however, Lot 22 can be graded. Chief Administrative Officer Asmus expressed the opinion that inasmuch as the City is concerned, some of the tracts had not been handled properly; that the City was not in a position to make any changes now, but the City Engineer should make rec- ommendations to the City Council. A tract map shows a division of land with the owners signing the title sheet and the map is so re- corded. Any obligation is on the original owner. These areas should be marked not a part of" on the tract map. Councilman Littlejohn further stated that in his opinion the City Attorney should clarify, as the City Council was not in a position to make a decision, and although this is a policy matter to be determined by the Council, change orders from the City Engineer and City Attorney are necessary. There was additional Council discussion as to preceding tracts being completed previously, wherein these problems did not occur, however, Mr. Johnson will not make these changes without Council approval. Formerly, the City Engineer felt this was a Building Department function. Under a subdivision undertaking the engineer determines what is necessary and all requirements are fulfilled be- fore signing out on inspections. Councilman Holmes commented that the engineer cannot change the subdivision, as such, but he. can change the grades, which is strictly an engineering matter. As a matter of information Chief Administrative Officer Asmus informed Council that in the Planning Commission Resolution it is stated that surface drainage on lots be determined by the engineer and this gives the engineer authority to make the change order. Assistant City Engineer Milak stated there was a drainage problem on Tract 22565...only Lot 22 should be graded, but Lot 30 does not need to be graded; the original tentative does not show this, but it should have. On Tract 26175, the owners of Lots 18 and 19, Mr. and Mrs. Eneck want the lots graded, but there is a swimming pool involved on Lot 18, but the grading is nearly corrected. There are grading problems on Tracts 26447, 26448, 26449 and 24088, but Mr. Nichols is an owner and would not allow grading and Mr. Grindle asked to be exonerated on the grading. Mr. Grindle further stated that Tract 26175 has been waiting 90 days; that he has a large investment and interest on bonds and has to hold up escrow on some tracts for as long as 90 days; that Tract 24088 has had the fence knocked down twice and he is liable, being the owner, that he cleans up the tracts, but when there is delay, they must be recleaned; that he does not wish to have the tract maps changed. Chief Administrative Officer Asmus suggested that the Eng- ineer, Attorney, Assistant Engineer Milak and the Chief Ad- ministrative Officer meet Monday and evolve some solution to the problem, which they will present to the City Council, with suggestions, on Monday night-or Tuesday. THE MOTION WAS MADE BY COUNCILMAN LITTLEJOHN THAT THE ATTORNEY, THE ENGINEER AND MR. GRINDLE BE HERE AT THE MONDAY MEETING BEFORE ANY DECISION IS RENDERED IN REGARD TO THE FIVE CASES. THE MOTION WAS SECONDED BY COUNCILMAN BLOXHAM. There were no objections, the motion was so ordered by Mayor Bishop. MOTION MADE AND CARRIED THAT THE ATTY., ENG. & MR.
