The City Council of the City of Baldwin Park met in special session at the above place at 4:00 p.m. Roll Call: Present: COUNCILMEN HOLMES, LITTLEJOHN ROLL CALL AND MAYOR BISHOP Absent: COUNCILMEN BLOXHAM AND COLE, CITY TREASURER PUGH AND PLAN- NING DIRECTOR MANSFIELD Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY SAUNDERS, ASSISTANT CITY ENGINEER MILAK AND CITY CLERK BALKUS 00- Mayor Bishop announced that this was a special meeting for SEWER REQUIREMENTS consideration of sewer requirements on Tract No. 26579. TRACT NO. 26579 Chief Administrative Officer Asmus stated that Lots 15 EXPLANATION OF through 18 of Tract No. 26579 have been approved with septic MISUNDERSTANDING tanks and cess pools; that the plans have been submitted BY C.A.O. ASMUS for the construction of the sewer lines in Jerry Avenue directly out to Merced Avenue; and that there is a mis- understanding concerning bringing the sewer line down Jerry Avenue and additional 165 feet at the estimated cost of $1400 and resurfacing of Lubicon Street which would be approximately $700. Councilman Holmes stated that it should be determined from the people involved what their understanding of this matter was and how they arrived at such an understanding. Mr. Frank Halterman, 1671 Fiske Avenue, Pasadena, stated FRANK HALTERMAN, that the Council had approved cess pools for this Tract; 1671 Fiske Ave., that the final map was brought back to the Council for a Pasadena change in name on the map and then the Council decided that there should be sewers in this Tract; that he agreed to sewers but the economics are such that the costs are way over what was anticipated; that they understood it was agreeable to the Council to run the sewer over an easement; RE EASEMENT that they purchased a five foot easement from Yoshie Kadota and the easement deed was issued to the City of Baldwin Park. Councilman Littlejohn asked if this easement was accepted by the Council. Chief Administrative Officer Asmus stated that the easement has not as yet been officially accepted and recorded in the customary manner. Councilman Littlejohn stated that he did not understand the Chief Administrative Officer accepting a deed that was not approved originally Council. Mr. Frank Halterman stated that he understood this was agreeable to the Council. Councilman Bloxham arrived at 4:13 p.m. COUNCILMAN BLOXHAM ARRIVED 4:13 P.M. Councilman Holmes stated that the agreement and instrtictions of the Council stated in the motion made at the Council meet- ing of September 18, 1961 should have been expedited before the final map was signed and recorded but this apparently was not done. ASMUS regarding Tract No. 26579 at the Council meeting of September RE MOTION AT 18, 1961 as follows: SEPT. 18, 1961 COUNCIL MEETING COUNCILMAN HOLMES MOVED THAT TRACT NO. 26579 BE REAPPROVED TO CLEAR UTILITY EASEMENTS AND SIGNATURES AND THAT SEWERS SHALL BE INSTALLED AND PROPER ARRANGEMENTS MADE TO TAKE THEM AS FAR AS RAMONA BOULEVARD AND MERCED, IF NECESSARY. COUNCILMAN BLOXHAM SECONDED. Roll call, unanimous vote and so ordered by Mayor Bishop." He stated that Mr. Paul Milak, Assistant City Engineer, Mr. Bill G. Barker, Assistant Chief Administrative Officer and himself were of the opinion that the motion indicated that the tract was to be sewered; however, there was definitely a statement made during the meeting indicating it was un- reasonable to sewer the four lots on Bresee Avenue. He further stated that he feels that in all of the discussions, although the motion as made in the motions and instructions is correct, that the actual idea of Council, maybe not of each member, was that these four lots fronting on Bresee Avenue were not to be sewered and that the sewer was to go out to this easement. Councilman Holmes asked if the differential figure was available between what the developer is now doing and what the Council wants. Mr. Halterman stated it would be an additional $2500. Chief Administrative Officer Asmus stated that the resur- LUBICON RESURFAC- facing cost on Lubicon Street would run approximately ING COST APPROXI- $700. MATELY $700. Mr. Morgan stated he would be glad to proceed by running the sewer in Lubicon Street if the City will help pay for the resurfacing. As matters stood he would have an additional $1200 to $1400 cost besides the $2400. Councilman Holmes asked the City Attorney for an opinion on whether or not the City is bound by actions of its employees. City Attorney Saunders stated the City would be bound by OPINION BY CITY any action made within the authority of the individual ATTY. RE CITY employee. City Attorney Saunders stated that the final map would have FINAL MAP TO BE RE- to be refiled with new title sheets; that the City's ordinance FILED requires that the sewers, storm drains, or both appear on the final map. COUNCILMAN HOLMES MOVED THAT COUNCIL HEREBY AMENDS THE SEWER MOTION MADE AND REQUIREMENTS ON THE FINAL APPROVAL OF TRACT NO. 26579 AS CARRIED THAT COUNCIL FOLLONS: THAT THE SUBDIVIDER SHALL INSTALL SANITARY SEWERS AMENDS THE SEWER SERVING LOTS I 14 ON SAID TRACT, RUNNING THE SEWER LINE REQUIREMENTS ON THE ALONG JERRY STREET TO LUBICON AND WEST ON LUBICON TO MERCED FINAL APPROVAL OF AVENUE: THAT THE CITY AGREES TO REIMBURSE THE SUBDIVIDER FOR TRACT NO. 26579 AS 50% OF THE COST OF REPAVING THAT PORTION OF THE SEWER LINE FOLLONS: THAT THE LYING WITHIN LUBICON AVENUE AND 100% OF THE COST OF THE SEWER SUBDIVIDER SHALL INSTALLATION AND REPAVING ON THAT PORTION OF THE SEWER LINE INSTALL SANITARY BETWEEN THE BOUNDARY OF THE SUBDIVISION AND LUBICON STREET SEWERS SERVING LOTS Continued) BIB] 39540-U01 1961-U02 11-U02 22-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO115490-U03 DO115496-U03 C4-U03 MINUTES1-U03 4/1/2008-U04 ROBIN-U04 SPECIAL-U05 CITY-U06 COUNCIL-U06 1961 11 22 CC MINHÄ—@¸— wÍ«4S5 I I Special Meeting of the Baldwin Park City Council November 22, 1961 Page 3 WITHIN JERRY STREET: THAT THE CITY AGREES TO'WAIVE ALL PER- I 14 ON SAID TRACT, MIT AND INSPECTION FEES FOR THAT PORTION OF THE SEWER LINE RUNNING THE SEWER ON JERRY STREET BETWEEN THE BOUNDARY OF THE SUBDIVISION AND LINE ALONG JERRY ST. LUBICON STREET: THAT THE CITY AGREES TO WAIVE SANITARY SEWER TO LUBICON AND WEST LINES FOR LOTS 15 18; THAT THE SUBDIVIDER SHALL FURNISH ON LUBICON TO MERCED THE CITY'WVITH INVOICES, COST SHEETS, AND ANY ADDITIONAL EX- AVE.: THAT THE CITY PENSE INFORMATION REQUESTED BY THE CITY ENGINEER: THAT COUNCIL AGREES TO REIMBURSE INSTRUCTS THE CHIEF ADMINISTRATIVE OFFICER AND THE CITY THE SUBDIVIDER FOR TREASURER TO PAY THESE FUNDS FROM THE GENERAL FUND TO THE 50% OF COST OF RE- SPECIAL SEWER FUND AND REIMBURSE FROM THE SPECIAL SEINER PAVING THAT PORTION FUND TO THE GENERAL FUND WHEN SUCH MONIES ARE AVAILABLE. OF THE SEWER LINE COUNCILMAN LITTLEJOHN SECONDED. The motion carried by LYING WITHIN LUBICON the following vote: AVE. AND 100% OF COST OF SEWER INSTALLATION AYES: COUNCILMEN HOLMES, LITTLEJOHN, AND REPAVING ON THAT BLOXHAM, AND MAYOR BISHOP PORTION OF SEWER NOES: NONE LINE BETWEEN BOUND- ABSENT: COUNCILMAN COLE ARY OF SUBDIVISION AND LUBICON ST. WITH- IN JERRY ST.: THAT THE CITY AGREES TO WAIVE ALL PERMIT AND INSPECTION FEES FOR THAT PORTION OF SEWER LINE ON JERRY ST. BE- TWEEN BOUNDARY OF SUBDIVISION AND LUBICON ST.: THAT CITY AGREES TO WAIVE SANITARY SEWER LINES FOR LOTS 15 18: THAT SUB- DIVIDER SHALL FURNISH CITY WITH INVOICES, COST SHEETS, AND ANY ADDITIONAL EXPENSE INFORMATION REQUESTED BY CITY ENGR.: THAT COUNCIL INSTRUCTS THE C.A.O. The motion carried by the following vote: AYES: COUNCILMEN LITTLEJOHN, HOLMES, BLOXHAM AND MAYOR BISHOP NOES: NONE ABSENT: COUNCILMAN COLE 00- MOTION MADE AND CARRIED THAT COUNCIL INITIATE PROCEEDINGS TO ABANDON EASEMENT OR EASEMENTS PERTAIN- ING TO THIS PARTICULAR TRACT NO. 26579 AT 5:06 P.M.
