The City Council of the City of Baldwin Park met in special session at the above place at 6:00 p.m. Roll Call: Present: COUNCILMEN BLOXHAM, HOLMES, ROLL CALL MOREHEAD, TAYLOR AND MAYOR BISHOP Absent: CITY TREASURER PUGH, ASSISTANT CITY ENGINEER WELCH AND ASSISTANT PLANNING DIRECTOR BRITZMAN Also Present: CITY ATTORNEY FLANDRICK AND CITY CLERK BALKUS 00- Mayor Bishop announced that this was a special meeting with THREE ITEMS ON three items on the agenda: Discussion and revision of Chief AGENDA DISCUSSION Administrative Officer Ordinance, Appointment of temporary AND REVISION OF C.A. Chief Administrative Officer and Interviewing applicants ORD., APPOINTMENT for the Chief Administrative Officer position. OF TEMP. C.A.O. AND INTERVIEWING APPLI- CANTS FOR C.A.O. POSITION 00- i COUNCILMAN MOREHEAD MOVED THAT THELMA L. BALKUS, CITY CLERK, MOTION MADE THAT BE APPOINTED TEMPORARY CHIEF ADMINISTRATIVE OFFICER. THELMA L. BALKUS, COUNCILMAN HOLMES SECONDED. CITY CLERK, BE APPOINTED TEMP. C.A. With the consent of the second Councilman Morehead corrected MOTION CORRECTED TO his motion to read that THELMA L. BALKUS, CITY CLERK, BE READ THAT THELMA L. APPOINTED ACTING CHIEF ADMINISTRATIVE OFFICER. BALKUS, CITY CLERK, BE APPOINTED ACTING C.A.O. Discussion followed wherein Councilman Holmes asked Mrs. Balkus if she was willing to accept this position. City Clerk Balkus stated that she would be willing to accept the position on an Interim basis, however she asked that Council make every effort to fill the position within a month. The motion carried by the following vote: MOTION CARRIED AYES: COUNCILMEN MOREHEAD, HOLMES, BLOXHAM, TAYLOR AND MAYOR BISHOP NOES: NONE ABSENT: NONE COUNCILMAN HOLMES MOVED THAT THE CITY ATTORNEY BE INSTRUCTED TO DR414 THE PROPER RESOLUTION AND THAT THE PROPER OFFICIALS BE AUTHORIZED TO SIGN APPOINTING THELMA L. BALKUS, AS ACTING CHIEF ADMINISTRATIVE OFFICER. COUNCILMAN BLOXHAM SECONDED. Discussion followed re appointing Thelma L. Backus the Assistant Chief Administrative Officer in the same resolu- tion wherein it was decided not to include this matter in the resolution at this time. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, BLOXHAM, MOREHEAD, TAYLOR AND MAYOR BISHOP NOES: NONE ABSENT: NONE MOTION MADE THAT Cl" ATTY. ORD. BE UNDER 2904 al; MWITH THE APPROVAL OF THE CITY COUNCIL AMENDED PARAGRAPH APPOINT, AND WHEN NCCESSARY POR THE GOOD OF THE CITY, 2 UNDER 2904 a) SUSPEND OR REMOVE ALL OTHER OFFICERS AND EMPLOYEES OF THE CITY, EXCEPT THE CITY CLERK, CITY TREASURER, CItY ATTORNEY, AND OFFICERS OR EMPLOYEES WHOSE APPOINTMENT IS OTHERIJISE PROVIDED BY LAW." AND DELETE HE MAY DELEGATE TO ANY DEPARTMENT HEAD OR OFFICER APPOINTED BY HIM THE AUTHORITY TO APPOINT, SUSPEND, OR REMOVE SUBORDINATES SERVING UNDER SUCH DEPARTMENT HEAD OR OFFICER." MAYOR BISHOP SECONDED. I Discussion followed. At the request of Mayor Bishop City Attorney Flandrick COMMENTS BY CITY commented that under the Chief Administrative Officer's ATTY. FLANDRICK Ordinance as it now read as set out in Paragraph a) of Section 2904 the City Council delegated the power to appoint, suspend etc. to the Chief Administrative Officer; that the only direct control the City Council had was in another section that allowed removal of tte Chief Administrative Officer. Further discussion followed. The motion did not carry by the following vote: MOTION DID NOT CARRY AYES: COUNCILMAN MOREHEAD AND MAYOR BISHOP NOES: COUNCILMEN BLOXHAM, HOLMES AND TAYLOR ABSENT: NONE Discussion followed concerning Section 2904 i) of the RE SECTION 2904 1) Chief Administrative Officer's Ordinance. It was brought out that the $300.•. in this section had been raised by ordinance to $1,000. but that the ordinance did not refer to a section of the Code therefore the Code was not changed. COUNCILMAN HOLMES MOVED THAT THE CHIEF ADMINISTRATIVE OFFICER'S ORDINANCE DESIGNATED AS CHAPTER 9 OF THE ADMINISTRATIVE CODE REMAIN AS IT IS. COUNCILWOMAN TAYLOR SECONDED. COUNCILMAN MOREHEAD MOVED TO AMEND THE MOTION TO READ MOTION MADE TO DELETE ARTICLE 2905 IN ITS ENTIRETY WHICH READS AS FOLLOWS: DELETE ARTICLE NEITHER THE. COUNCIL NOR ANY. OF ITS MEMBERS SHALL DIRECT OR RE-2905 IN ITS ENTIRETY QUEST THE APPOINTMENT OF ANY PERSON TO, OR HIS REMOVAL FROM OFFICE BY THE CHIEF ADMINISTRATIVE OFFICER OR ANY OF HIS SUBORDINATES, OR IN ANY MANNER TAKE. PART IN THE APPOINTMENT OR REMOVAL OF OFFICERS AND EMPLOYEES IN THE ADMINISTRATIVE SERVICE OF THE CITY, EXCEPT FOR THE PUR- POSE OF INQUIRY, THE COUNCIL AND ITS MEMBERS SHALL DEAL WITH THE ADMINISTRATIVE SERVICE SOLELY THROUGH THE CHIEF ADMINISTRATIVE OFFICER AND NEITHER THE COUNCIL NOR ANY MEMBER THEREOF SHALL GIVE ORDERS TO ANY SUBORDINATES OF THE CHIEF ADMINISTRATIVE OFFICER, EITHER PUBLICLY OR PRIVATELY." MayoreBishop declared that the amendment to the motion died AMENDMENT TO MOTION for lack of a second. COUNCILMAN HOLMES MOVED THAT THE CITY COUN- CIL ADJOURN. COUNCILMAN MOREHEAD SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bishop. January 2, 1963 Page 3 ADJOURNMENT AT 6:53 P.M. Discussion followed concerning interviewing applicants for the Chief Administrative Officer's position wherein City Attorney Flandrick stated he thought that the Council should adjourn to personnel session; that this could legally be done since no one had left the Council Chambers. I COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL RECONSIDER THE LAST MOTION. COUNCILMAN MOREHEAD SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bishop. AT 6:55 P.M. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL ADJOURN TO AN EXECUTIVE SESSION TO INTERVIE11 APPLICANTS FOR THE CHIEF ADMINISTRATIVE OFFICER POSITION. COUNCIL- MAN BLOXHAM SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bishop. MOTION MADE AND CARRIED THAT CITY COUNCIL RECONSIDER LAST MOTION ADJOURNMENT AT 6:55 P.M. TO AN EXECUTIVE SESSION TO INTERVIEW APPLI- CANTS FOR C.A.O. POSITION 00- The City Council reconvened from the Executive Session at 12:10 a.m. to the Special Meeting. 00- At the request of Mayor Bishop, City Clerk Balkus read Resolution No. 63-I in full which was entitled: RESOLUTION NO. 63-I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALCWIN PARK APPOINTING THELMA L. BALKUS ACTING CHIEF ADMINISTRATIVE OFFICER OF THE CITY OF BALDNIN PARK" COUNCILMAN HOLMES MOVED THAT RESOLUTION NO. 63-I BE APPROVED. COUNCILMAN BLOXHAM SECONDED. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, BLOXHAM, MOREHEAD, TAYLOR AND MAYOR BISHOP NOES: NONE ABSENT: NONE I AT 12:15 A.M. COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL ADJOURN. COUNCILMAN HOLMES SECONDED.
