The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Bloxham led the salute to the flag. Special Counsel Schreiner stated that first was a request to approve for payment the statement rendered by Stone & Youngberg, the financial consultants; that this was a re- vised statement and did represent the correct amount due and owing under 61-A-I and should be approved for pay- ment. Special Counsel Schreiner stated that the second item was the matter of the construction contract regarding Sewer Assessment District No. 61-A-1; that he had prepared a letter and sufficient number of copies for the Council to review; that this letter represented their investiga- tion as to the law surrounding the contract that was awarded to Falcon Construction Company last June and as to the present state of circumstances between the City and Falcon. He read the letter in full after passing copies to the Council. Considerable discussion followed. The Council instructed that the City Attorney obtain the Health Letter from the City Clerk's Office and bring this matter back on the agenda after the public hearings. 00- At 8:17 p.m. City Clerk Balkus and City Attorney Flandrick left the Council Chamber. Mayor Bishop announced that the hour of 8:00 p.m. having arrived that it was the time and place fixed for a public hearing on Z-143, an application submitted by T. R. and Grace Crouse requesting a zone change from A-1 light agricuitural)to R-I for single family use of land at 13410 Francisquito Avenue. Minute Clerk Langseth administered the oath. Minute Clerk Langseth stated that the proper publica- tion had been accomplished. Assistant Planning Director Britzman presented a resume of the case and stated that the Planning Commission recommended approval. As there was no one in the audience desiring to speak either in behalf of or in opposition to Z-143, Mayor Bishop declared the public hearing closed. The motion carried by the following vote: AYES: COUNCILMEN HOLMES* BLOXHAM, MOREHEAD~ AND MAYOR BISHOP NOES: NONE ABSENT: COUNCILWOMAN TAYLOR Mayor Bishop announced that it was the time and place fixed for the continuation of a public hearing on Z-125, an application submitted by William Pickering requesting a change of zone from A-1 bnd M-i to R-1, R-3 and M-1, or more restrictive uses, for the area north of Los Angeles Street easterly of the City boundary and southerly of the westerly extension of Olive Street and westerly of Center Street. COUNCILMAN HOLMES MOVED THAT Z-125 PUBLIC HEARING) BE CONTINUED UNTIL PUBLIC HEARING IS COMPLETE ON THE MASTER PLAN AS WELL AS GET INFORMATION AND MAPS AS TO THE LAYOUT). Mr. Tracy Bousman had a map pertaining to Z-125 with him and stated he would furnish Council copies of the map, and that he would file a copy of the map in the Planning Department. At 8:30 p.m. City Clerk Balkus and City Attorney Flandrick returned to the Council Chamber. Mr. Lloyd L. Dancer, 14220 East Francisquito, Baldwin Park, reviewed his request for a change of zone to R-3 at 14220 East Francisquito stating that he had finally decided to build a parkway apartment without the street and had ask.for a variance; that he had not-been given a decision and he now understood that he had nothing"; that he wanted to develop his property. Assistant Planning Director Britzman stated that two cases were involved: the original zone change and later a zone variance. He stated that the zone change ordinance had had first reading only; that the zone variance had been denied by the Planning Commission, appealed to the City Council and referred back to the Planning Commission; that the architect had requested that the matter be dropped as they were not Interested in the plan submitted; that the plan had been reviewed eliminating the street entirely but before, this could be done the original zone change would have to be revised. There were no objections, the motion carried and was so ordered by Mayor Bishop. 00- City Clerk Balkus presented a letter from Able Realty, Incorporated dated January 29, 1963, regarding Z-147. Mr. Cletus J. Hanifin, 3515 Eastmont, El Monte, stated he was an attorney and representing Able Realty, Incorpor- ated. He pointed out that at the time this matter was brought before the Planning Commission they had asked for a zone change whereas this time a zone variance would be more suitable; that regarding the map on the we11, the lower dark area was the particular one in question and the upper one was covered in the letter; that they were interested in putting on the property ten 10) tri- plexes, two apartments above and one below with three covered garages as well as courts; that it was pre- sently zoned A-I but throughout that area there were a number of lots which had two or more homes; that they had the plan to submit and asked if the Council cared to,view the plan. Assistant Planning Director Britzman reviewed his report which indicated that the zone change applica- tion did not conform to the Master Plan at 3708 Vineland; that the Master Plan designated the area R-1. He stated that the Planning Commission recommended that the Master Plan not be changed in this area. Discussion followed. MOTION MADE AND CARRIED THAT CITY COUNCIL CONCUR WITH REC. OF B0. Mr. Ed Henderson, 3758 Vineland Avenue, Baldwin Park, stated there was proposed road down the back and asked if the zone change were granted if the road would be blocked off to the rest of the people who lived on Vineland. He asked if it was possible to run the proposed road out to Pacific. Mayor Bishop asked that Mr. Henderson contact the Planning Director and the City Engineer and discuss this matter with them. 00- City Clerk Backus presented a letter from Tracy R. Bousman dated January 31, 1963, regarding the access from Syracuse Street and Patritti Street to Rivergrade Road. Mr. Tracy Bousman, 212 South First Avenue, Arcadia, stated it was his suggestion to make an effort to ascertain from the Division of Highways the possibility of a proposed connection which would run from the present proposed closing of Garvey Avenue at Syracuse northwest to intersect Patritti Street and then by means of an access tie into the Schweitzer Road on Rivergrade Road. Councilman Holmes stated it was his understanding that the proposal was that Syracuse and Garvey would both dead end. Discussion followed regarding a Broker of Record, wherein RE BROKER CF RECORD Mr. Ebaugh stated this person would-be a consultant to the City regarding the City's insurance, to assist the City in specifications, to submit the approved specifications for bid, to collect the-bids from the City Clerk after they have been received, to give the Council a complete analysis of all bids, and to make a recommendation'to the Chief Administrative Officer; that the City had a right with one day's notice in writing to give the Broker cancella- tion notice, that the Broker also had this right; that bids could also be received from another Broker and if one of their bids was better the Council could cancel their present Broker of Record and accept the bid from the other Broker.
