Roll Call: Present: COUNCILMEN BLOXHAM, HOLMES, MOREHEAD, TAYLOR AND MAYOR BISHOP Absent: CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ATTORNEY FLANDRICK, ACTING CITY ENGINEER WELCH, PLANNING DIRECTOR AND BUILDING SUPERINTENDENT KALBFLEISCH, FINANCE DIRECTOR DUNCAN AND CITY CLERK BALKUS 00- City Clerk Balkus administered the Oath of Office to Regular Officer Russell King. 00- City Clerk Balkus presented eight 8) applications for Charitable and Religious Solicitor's Permit as follows: Baldwin Park Irwindale Pony-Colt League, Light dedica- tion program at ball park; Retarded Children's Associa- tion of San Gabriel Valley, Selling advertisements to merchants; Landis P.T.A., Rummage sale, donuts and coffee; Margaret Heath P.T.A., Student welfare and organizational expenses; American Legion Auxiliary, Unit 241, Tickets for hat and jewelry party at 47251 North Maine Avenue; Eastside Little League Auxiliary, Potluck dinner, 3609 North Vineland; International Order of Job's Daughters, Bethel No. 193, 3956 North Vineland; and Baldwin Park Pop Warner Jr. Football, La Puente Woman's Club location), Dance. She recommended that all of the applications be approved. COUNCILMAN BLOXHAM MOVED THAT THE CITY COUNCIL CONCUR WITH THE RECOMMENDATION OF THE CITY CLERK WITH REFERENCE TO THE PERMITS FOR SOLICITATION. COUNCILMAN HOLMES SECONDED. The motion carried by the following vote: AYES: COUNCILMEN BLOXHAM, HOLMES, MOREHEAD, TAYLOR AND MAYOR BISHOP NOES: NONE ABSENT: NONE 00- Chief Administrative Officer Nordby reported on the con- tract with Moore's Electric for electrical repairs on the City Auditorium. He stated that Moore's Electric was not able to obtain the bond which the contract called for but was willing to deposit $850.00 cash and do the work in the three phases outlined in his original proposal. Mr. Nordby stated that the City Attorney recommended that the City not proceed with the contract. He stated that other work was necessary to put the auditorium in usable condition; that the panic hardware on the doors needed replacement. He further stated that, In his opinion, the public address system should be worked over by an electronics firm. City Attorney Flandrick stated that the contract required two bonds; that there was a letter In the contract file from Mr. Moore's Insurance broker Indicating Mr. Moore was unable to obtain these bonds because of Inadequate financial statement"; that Mr. Moore had indicated he was willing to put up a cash bond; that if the Council wished to proceed with the contract they should bear In mind that if something happened such as if the contractor secured a substantial amount of material to do the job and did not pay for it that there could be a lien filed against the property and the City would be responsible for it. City Clerk Backus stated that It was her understanding that this contractor had purchased some Items for the job and had other items on order. Discussion regarding requiring receipted bills plus signed waiver for labor involved before payment wherein City Attorney Flandrick stated that there could still be a purchase of material that was not paid for and City would not be are of it. Councilwoman Taylor stated she concurred in not proceeding with the Moore's Electric contract. City Attorney Flandrick stated that the bond provision could be handled by waiving the bond provisions in the agreement and requiring an $850.00 cash deposit; that the other point of the description of exactly what he was going to do was still open; that the description of the work to be completed was not clear to he or Mr. Welch. Discussion of the time delay involved if the City did not proceed with the contract wherein it was brought out that the City did not have to publish for bids on this work due to the amount involved. COUNCILMAN BLOXHAM MOVED THAT THE CITY COUNCIL CONCUR WITH THE RECOMMENDATION OF THE CHIEF ADMINISTRATIVE OFFICER FOR DENIAL OF THE PROPOSED CONTRACT. COUNCILWOMAN TAYLOR SECONDED. With the consent of the second Councilman Bloxham withdrew his motion. Councilman Holmes asked about the liability of the City If the contract was terminated. City Attorney Flandrick stated that In his opinion the City was not liable since the terms of the contract had not been complied with; but that this was not guaranteed since it had not been determined what work had been accomplished if anything. COUNCILMAN BLOXHAM MOVED THAT THE CITY COUNCIL TERMINATE THE EXISTING AGREEMENT WITH MOORE'S ELECTRIC COMPANY AND THE CITY OF SALON IN PARK FOR THE CONSTRUCTION OF THE ELECTRICAL SYSTEM AND APPURTENANCES IN THE AUDITORIUM AND NOTIFY THE CONTRACTOR OF THAT FACT BY MAIL TOMORROW MORNING. Mayor Bishop announced that the hour of 8:00 p.m. having arrived that it was the time and place fixed for a public hearing on Z-152, application submitted by Louis Ungar and Frank Crowhurst requesting a change of zone from R-1, R-3 and P to C-2 General Commercial) or more restrictive use located westerly of Maine Avenue between Clark and Palm. City Clerk Balkus stated that the required publication had been accomplished. Planning Director and Building Superintendent Kalbfleisch presented a resume of case and stated that the Planning Commission recommended approval of the zone change. City Clerk Balkus administered the oath to those in the audience desiring to be heard during the meeting. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR BISHOP. Mr. Frank Crowhurst, 1585 Riviera Drive, Pasadena, California, stated he was the developer of the proposed shopping center between Palm and Clark and facing Maine Street; that he was asking for C-2 zoning for six and one-half 60 acres; that at the present time he had verbal committments on approximately sixty per cent 60%) of the acreage involved from triple A" tenants; that he had two department stores that showed an interest in coming in and he was trying to get another four and one-half 4) to five 5) acres; that with the additional acreage there would be 110,000 square feet of building area; that right now the proposed building would be 70,000 square feet. Mrs. Faye Hickey, 14322 Gage Street, Baldwin Park, stated she had called a meeting In her store to start the pro- motion of this area; that an advertisement had been placed in a newspaper for someone to plan the development; that Mr. Crowhurst had been chosen and had worked very hard on the proposed development. EVA ROCKEY, that Maine Street was a twofold purpose; bringing in a 4219 N. Maine, lovely shopping center for the people of this City and B.Pk. cleaning up a problem location on Maine Street. She further stated she would be giving up a location that had been her home since 1929 and requested that the City Council approve this rezoning. Mrs. Rockey said the shopping center would be her dream come true." City Clerk Balkus read in full a letter from Dr. Howard H. Z-152 In order for Councilman Holmes to ask Mr. Crowhurst some questions, Mayor Bishop asked for a motion to reopen the public hearing. PUBLIC HEARING Z-152) In answer to a question by Councilman Holmes, Mr. Crow- RE EXPANSION OF hurst indicated that he was attempting to negotiate to SHOPPING CENTER expand this shopping center further west; that there was FURTHER WEST a piece of property directly behind the proposed development that had several duplexes on it; that the owners Montgomery) were willing for the buildings to be relocated on the next property. He indicated that he had firm comnittments; that the lender and the leaser had one problem, that of contigent liability of another proposed shopping center. Councilman Holmes stated he did not want to see a hodge- podge" develop if the shopping center did not materialize. ZONE CASE NO. Z-152" The motion carried by the following vote: AYES: COUNCILMEN MOREHEAD, BLOXHAM, HOLMES, TAYLOR AND MAYOR BISHOP NOES: NONE ABSENT: NONE Councilman Morehead congratulated Mrs. Hickey, citizens responsible for promoting this development, and Mr. Crow- hurst for stepping out with one of the major developments of Baldwin Park up to this time. The Council concurred with Councilman Morehead's statement. Mr. Crowhurst stated that July 15th was the date scheduled for the ground breaking. Chief Administrative Officer Nordby recommended that a population survey be authorized by the State Department of Finance in order that the City might Increase its portion of Gas Tax Apportionment Funds. Discussion of census and whether it was permitted on a calendar year or fiscal year basis wherein the Chief Administrative Officer was instructed to check this matter. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL CONCUR WITH THE CHIEF ADMINISTRATIVE OFFICER'S RECOMMENDATION TO GET A SPECIAL CENSUS AND EXPEND A SUM NOT TO EXCEED $400.00 TO GET THE JOB DONE. BIB] 39556-U01 1963-U02 03-U02 06-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO115492-U03 DO116652-U03 C4-U03 MINUTES1-U03 4/17/2008-U04 ROBIN-U04 ADJOURNED-U05 CITY-U06 COUNCIL-U06 1963 03 06 CC MINHÄ—@¸—&¿ Í«Adjourned Regular Meeting of the Baldwin Park City Council Acting City Engineer Welch read a letter from Bell-Michael Builders, Incorporated, 13051 East Garvey Avenue, Baldwin Park, dated March 4, 1963,requesting the waiver of curb, gutter and sidewalk at 14018 Los Angeles Street. letter in official files) Acting City Engineer Welch stated that there were two huge eucalyptus trees in front of this property in the dedicated portion of the street; that Los Angeles Street was a budgeted project; that the trees would not interfere with the construction of the curbs, gutters and sidewalks but he had been told It would interfere with the traffic coming in. Discussion followed concerning possible removal of the trees, cash deposit, that sufficient dedication had been obtained at this location. City Attorney Flandrick stated that the City Council did have the power to conditionally approve such a waiver; that it could be waived upon the condition that he de- posit with the City an amount to be determined by the City Engineer to cover the cost of curbs, gutters and sidewalks and when the project is In progress it could be accomplished as part of that project at his cost, which the City would have cash at hand. Discussion of whether this could be charged back to Gas Tax money wherein City Attorney Flandrick stated it would have to be an approved project; that in his opinion a reim- bursement at a later time would not be looked on with favor; that the widening of Los Angeles Street should be accom- plished in less than a year with the necessary rights-of-way. COUNCILMAN BLOXHAM MOVED THAT THE CITY ENGINEER DETERMINE THE AMOUNT REQUIRED FOR THE CURBS, SIDEWALKS, GUTTERS AND DRIVEWAY APPROACH AND DEVELOPER BE REQUIRED TO PUT UP THAT AMOUNT OF MONEY ON DEPOSIT FOR FUTURE DEVELOPMENT OF THE CURBS, SIDEWALKS GUTTERS AND DRIVEWAY APPROACH. COUNCILMAN MOREHEAD SECONDED. The motion carried by the following vote: AYES: COUNCILMEN BLOXHAM, MOREHEAD, HOLMES, TAYLOR AND MAYOR BISHOP NOES NONE ABSENT: NONE Discussion regarding removing obstructions wherein Acting City Engineer Welch stated that on lot split sgreements and in other cases where trees have been removed they have been removed by the City from areas that have been dedicated as a condition of approval of a lot split or a Building Permit. At the request of Mayor Bishop, City Clerk Balkus read Resolution No. 63-32 by title as follows: RESOLUTION NO. 63-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ALLOW- ING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDNIN PARK" Finance Director Duncan stated that this resolution covered the payment to California Physician Service for the March Health and Accident Insurance.
