CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Roll Call: Present: COUNCILMEN BLOXHAM, HOLMES, MOREHEAD, TAYLOR AND MAYOR BISHOP Absent: CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ATTORNEY FLANDRICK, ACTING CITY ENGINEER WELCH, PLANNING DIRECTOR AND BUILDING SUPERINTENDENT KALBFLEISCH, FINANCE DIRECTOR DUNCAN AND CITY CLERK BALKUS 00- COUNCILMAN HOLMES MOVED THAT THE MINUTES OF FEBRUARY 14, 1963, AND MARCH 5, 1963, BE APPROVED AND FURTHER READING BE WAIVED. COUNCILMAN BLOXHAM SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bishop. 00- City Clerk Balkus stated that copies of a letter from Mr. John Bellante, General Manager, Bell-Michael Builders, Incorporated, 13051 E. Garvey, Baldwin Park, dated March 14, 1963, regarding the validation of cesspool permits had been placed in the Council's folders; that the letter was received too late to be placed on the Agenda. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL BRING THE CONMUN ICAT ION FROM JOHN BELLANTE ON THE AGENDA AT THE END OF WRITTEN COMMUNICATIONS. COUNCILMAN MOREHEAD SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bishop. 00- City Clerk Balkus administered the oath to those in the audience desiring to be heard during the meeting. 00- The Council consented to hear Mr. Donald S. Bowman, 4012 Puente Avenue, Baldwin Park, regarding his Building Permit. Mr. Bowman submitted to the City Clerk a letter from the former Chief Administrative Officer Charles R. Allen dated September 14, 1962 regarding the Building Permit for property at 4012 North Puente Avenue. He stated that he agreed to redraw his plans to conform with the new Zoning Ordinance and the letter from Mr. Allen stated that at the time new plans have been submitted to the Building Department and checked for conformance with the new Zoning Ordinance, your original Building Permit will be reactivated without cost to you. Likewise, an additional Plan Check fee will not be required"; that it seemed the Chief Administrative Officer did not have the authority to grant this and now an additional plan check fee was being requested. City Attorney Flandrick questioned Mr. Bowman wherein Mr. Bowman stated that they started construction in August with- in the sixty 60) day time limit; that the permit was issued June II, 1962; that he did not suspend work until the letter was received from the City. Every permit issued by the Building Official under the provisions of this Code shall expire by limitation and become null and void, if the building or work authorized by such permit is not commenced within 60 days from the date of such permit, or if the build- ing or work authorized by such permit is sus- pended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommenced a new permit shall be first obtained so to do, and the fee therefor shall be one--half the amount required for a new permit for uch work, provided no changes have been made or will be made in the original plans and specifications For such work; and provided, further, that such suspension or abandonment has not exceeded one year." Discussion followed concerning City requesting plans to be changed in accordance with the Zoning Ordinance; the corrections necessary for the present plans; the fact that Mr. Kalbfleisch requested an additional plan check fee; that the present plans contained detail rather than basic construction. Mr. Bowman stated that the original plans were drawn for one parking space for one unit and the new zoning ordinance required I1 parking spaces per unit; that that was the reason the City stopped the work; that the permit had been issued after the Zoning Ordinance was in effect. City Attorney Flandrick stated that the City Council should appoint itself as the Board of Appeals before interpreting the Building Code. COUNCILMAN HOLMES MOVED THAT THE MATTER OF ESTABLISHING A BOARD OF APPEALS WITHIN THE MEANING OF THE BALDNIN PARK MUNICIPAL CODE THAT HAS TO DO WITH BUILDING PERMIT APPEALS BE BROUGHT ON THE AGENDA AT THIS TIME. COUNCILWOMAN TAYLOR SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bishop. COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL OF THE CITY OF BALDNIN PARK FUNCTION AS THE BOARD OF APPEALS WITHIN THE MEANING OF SECTION 8107 OF THE BALD.N IN PARK MUNICIPAL CODE. Mr. Bowman stated that he had a notarized statement concerning the demolition work which he had submitted to the former Chief Administrative Officer; and that there were several communications to Mr. Saunders, the City Attorney at that time. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL CONTINUE HIS MATTER AND THAT THE DOCUMENTED EVIDENCE AND CORRESPON- DENCE BE LOOKED UP AND BROUGHT BACK FOR A DECISION. COUN- CILMAN BLOXHAM SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bishop. 00- Mayor Bishop announced that the hour of 8:00 p.m. having arrived that it was the time and place fixed for a public hearing on AGP-9, an amendment to the Master Plan initiated by the City Council to change an area indicated as M-I light Industrial) to R-I single family residential) and R-3 multiple residential) for that general area easterly of the western City boundary, southerly of the westerly extension of Olive Street and westerly of the Los Angeles City Power Line right-of-way. Planning Director and Building Superintendent Kalbfleisch presented a resume of the case and stated that the findings of the Planning Commission were that since the adoption of the Master Plan there had been no change in the area that would warrant a change in the Master Plan. Mayor Bishop stated that the coniinuation of the public hearing on Z-125, application submitted by William Picker- ing requesting a change of zone from A-I and M-1 to R-1, R-3 and M-i, or more restrictive uses, for the area north of Los Angeles Street easterly of the City boundary and southerly of the westerly extension of Olive Street, and westerly of Center Street would also be handled at this time, City Clerk Balkus stated that the required publication had been accomplished. Councilman Holmes questioned whether these two hearings could be held at the same time. City Attorney Flandrick, upon returning to the Council Chamber after looking up the documents on the previous item, stated that they could be held together or separately. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR BISHOP. Mr.!Villiam Pickering, 4230 Peck Road, El Monte, stated, in his opinion, this was the best immediate use for the property; that it would be quite a long time before it would ever be used as industrial and it would make a fine residential neighborhood as single family residential; that the homes would be approximately 1350-1400 square feet. TESTIMONY N OPPOSITION TO THE REQUEST WAS CALLED FOR BY MAYOR BISHOP. City Clerk Balkus again administered the oath. Park and as soon as they were available the area would develop; that it would not be too long before the San Gabriel Freeway was completed and then there would be access within one-quarter of a mile of the freeway; that no matter where the freeways go in huge industrial develop- ments were put in. He further stated the request was for the property west of the power line and according to the map there was a portion of that property west of the power line that would remain M-I, why? He stated that this question had been asked at both the Planning Commission and City Council meetings and had not been answered by the applicants and, in his opinion, that should also be rezoned, if it was to be rezoned to R-I; that his neighboit to the south purchased the property because it was A-I and other property owners purchased In this area for the same reason; that he did not think the proper procedure was applied by the proposed developer who did not live in Baldwin Park and asked what good would this rezoning do for the people who owned property in the City and for the City as a whole; that the City needed good industrial area for taxes to help the City activities. Councilman Holmes asked Mr. Balkus why he had objection to outside money coming In to develop the City. Mr. Balkus stated he did not have any objection; that it was the method used he objected to. March 20, 1963 1097 Page 4 Mr. Jackson Baker, 13343 Benbow, Baldwin Park, stated he JACKSON BAKER, would like to know why R-3 and M-I was proposed on some 13343 Benbow, B.Pk. of this property instead of not having it all R-I; that he could not see leaving one property M-l, why not change it all? Mr. Tracy Bousman, Enginc.er representing Mr. Pickering, in TRACY BOUSMAN, rebuttal, regarding the question of why leave portion of ENGINEER REPRESENT- property fronting on Los Angeles M-1 stated that the answer, ING WM. PICKERING in his judgment, was that the property immediately west of that was being developed industrial and for that reason the REBUTTAL owner asked that his property remain M-l; that as far as the M-I in the upper corner it did not make too much material difference whether it was M-I or not; that it was an attempt to comply with good planning. Planning Director and Building Superintendent albfleisch stated that his opinion was that it might possilbly be desirable adjacent to the freeway to permit an industrial zone but he believed in this area development was slow and low density residential would be desirable; that south of the San Bernardino Freeway it was much more desirable for industry than this general area; that the City should have 5-6% industrial zoning; that the City now had less than 1% developed and that the 398 acres as proposed on the Master Plan would bring the industrial area up 10%. In answer to a question asked by Councilman Morehead, Mr. Bousman said that his statements were based on experience over a great number of years in engineering and projects he had worked on in Baldwin Park; that the property immediately to the north had been offered for sale for over ten years and less than 1% of that property was developed and that the development there was not in keep- ing with industrial development as it Is thought of. He further stated that the property did not have the utilities requred for industrial development; that by zoning this for restricted residential in this area the City could further the benefit they would receive as much as the supermarket would in another area; that there was rock, rough ground and no adequate water facilities available for industrial zoning In this area. Continued) BIB] 39556-U01 1963-U02 03-U02 20-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO115492-U03 DO116654-U03 C4-U03 MINUTES1-U03 4/17/2008-U04 ROBIN-U04 CITY-U06 COUNCIL-U06 1963 03 20 CC MINHÄ—@¸—&ÌÍ«1O9€ I I Regular Meeting of the Baldwin Park City Council March 20, 1963 Page 5 Discussion followed concerning Littlejohn's Dairy wherein ALAIRE TEEPLES, Alaire Teeples, realtor, 4719 North Peck Road, El Monte, REALTOR, 4719 N. stated that several tracts such as the Arden Tract, Century Peck Rd., El Monte Square and others were built in El Monte near dairies and the homes sold; that the people knew when they bought that the dairy was there. In answer to a question asked by Councilman Morehead, Mr. ALBERT GABLER, Real Albert Gabler, Real Estate Broker, 11836 East Lower Azusa Estate Broker, 11836 Road, El Monte, stated he had checked with the rock company, E. Lower Azusa Rd., and they reported that the reason they pulled out was too El Monte much sand and not enough rock and gravel; that they did not look forward to digging there until their other sources were expended, and it was doubtful they would ever dig there again. He also mentioned that one of the owners of a portion of this property had died and if this did not go through the land would be tied up three to five years in Probate Court. In answer to a question by Councilman Bloxham, Mr. Bousman stated the subdivision would provide surface drainage across the entire property and into the new Flood Control Drain at Los Angeles Street; that this area was in Sewer District No. 2 and they had not given any consideration at the moment to the time element involved but very likely when the deve:cpers were ready for the sewers District No. 2 would be in progress. Councilman Bloxham asked Acting City Engineer Welch if he was familiar with this proposed development. Acting City Engineer Welch stated he had not seen the tract map. In answer to a question by Councilman Holmes, Mr. Bousman stated that all of the area involved in AGP-9 would be sewered through an easement in the M-I property and tie into the Los Angeles Street sewer; that there would be 6000 square feet per lot this would be the only tract in the City with 6000 square feet lots). Mrs. Faye Hickey, 14322 Gage Street, Baldwin Park, stated MRS. FAYE HICKEY, she was speaking for Mrs. Edna Jones who lived on Center 14322 Gage St., Street and was in Seattle; that Mrs. Jones had signed an B.Pk, option previously which did not mature and no money had been deposited for the option and Mrs. Jones had stated she would never sign again. Mrs. Hickey further stated, In her opinion this was a good manufacturing area; that in time the Irwindale area would develop as manufacturing too. Mr. Joseph Balkus asked If there was a rebuttal permitted for the negative. Mayor Bishop stated the ruling of the City Council was that there was no rebuttal for the negative. City Attorney Flandrick stated that he understood this was the City Council's ruling; that the Council set its own rules on public hearings. As there was no one else in the audience desiring to speak PUBLIC HEARING either in behalf of or in opposition to AGP-9, Mayor DECLARED CLOSED Bishop declared the public hearing closed. AGP-9 Mayor Bishop asked for new additional evidence on Z-125. PUBLIC HEARING CONTINUED Z-125 Discussion followed concerning evidence wherein Councilman Holmes stated, in his opinion, the Council should ask for now or additional evidence. Mr. Joseph Balkus, 4625 North Harlan, Baldwin Park, stated with proper planning and the anticipated sewers the area proposed for R-I south of Olive and west of Center could be developed into a very attractive M-I area; that it was true a great deal of the area did not have adequate utility- facilities; but that It did not mean that six months to one and one-half years from now the utilities would not be there; that a properly planned industrial center was an asset to any city regardless of its size or shape; that regarding the portion of M-I located In the area east of the power line since a portion of his property adjoined the property proposed to remain M-I he would like to go on record saying that if that M-I was necessary maybe his property next to it would be necessary also and he would like to retain that as M-i. As there was io one else in the audience desiring to speak either in behalf of or in opposition to Z-125, Mayor Bishop declared the public hearing closed. Mayor Bishop stated that the City Council would first make its determination on AGP-9. In answer to a question by Councilman Bloxham, Councilman Holmes stated two possible water sources were available, Valley View Mutual and the County Water District; that the developer would have a choice of requesting either one to serve the area since this area had not been developed by either of the two companies; and that quite an extensive water system would be necessary. Councilwoman Taylor asked aboul* the flooding and drainage problem wherein Councilman Bloxham stated the Engineer of the development said this would all be corrected if developed. In answer to a question by Councilman Morehead, Councilman Holmes stated the prime difference on supplying water for industrial or residential is that industrial usually required considerable more volume of water than residential. Councilman Holmes brought out that the State Division of Highway had indicated they would build an on and off ramp at Los Angeles Street; that if there was no service road connected to that this would mean that access to the Industrial development would have to be through the residential part of Baldwin Park. He further stated, in his opinion, the corners proposed for M-I would not be necessary or compatible; that building could not be under the power line and It would be a small area for any substantial structure; that the area of M-I adjoining Los Angeles Street should be-a C" type zone; that any accelerated M-l development in Baldwin Park would take the choice M-1 first which was south of the freeway and had trackage available not too far from the free- way and good access to the south; that the M-I property on Ramona Boulevard was considered choice also. He stated the land running southerly from Olive Street that involved the area in question was some thirty to forty acres; that all of it would be directly west of existing residential and the noise, sound, dust and dirt would be carried o this residential area; that, in his opinion, the proposed map was pretty good; that access could be improved on, roughly in the middle, from Center Street over. Discussion followed regarding freeway access; that State Division of Highway had indicated there would be an intcrchange at Ramona Boulevard and Los Angeles Streets; that the plans were not designed for the Live Oak and \rrow Highway vicinity. PUBLIC HEARING DECLARED CLOSED Z-125 DELIBERATION BY COUNCIL AGP-9 AVAILABILITY OF WATER RE ACCESS BIB] 39556-U01 1963-U02 03-U02 20-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO115492-U03 DO116654-U03 C4-U03 MINUTES1-U03 4/17/2008-U04 ROBIN-U04 CITY-U06 COUNCIL-U06 1963 03 20 CC MINHÄ—@¸—&ÌÍ«1100 Regular Meeting of the Baldwin Park City Council Acting City Engineer Welch stated the information he obtained from the State Division of Highway indicated the San Gabriel River Freeway would follow Rivergrade to Los Angeles; that after leaving Los Angeles Street the proposed right-of-way alignment would take a curve to the left away from the existing Rivergrade Road; that there would be an on and off ramp to the existing Rivergrade Road north of Los Angeles Street; that Rivergrade Road north of Los Angeles would remain as it was now; that the freeway now ends at the Walnut Creek Wash; that the interchange at the San Bernardino Freeway was started and the complete interchange would not be completed until the freeway was extended north which would be five to six years from now. Mayor Bishop and Councilman Bloxham Indicated that in their opinion this would be a good development. Councilman Morehead stated that more school facilities would be needed immediately if this developed residentially; that there was a junior high and a high school planned near this area for the immediate needs; that the tax rate on a $14,000 to $15,000 house would be approximately $380.00; that at the present time it cost $402.00 to educate each and every child in Baldwin Park; and that each house would average two children. Further discussion on tax rates and costs of education. At the request of Mayor Bishop, City Clerk Balkus read Resolution No. 63-33 by title as follows: RESOLUTION NO. 63-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDNIN PARK AMENDING THE GENERAL PLAN OF SAID CITY AGP-9) COUNCILMAN BLOXHAM MOVED THAT RESOLUTION NO. 63-33 BE APPROVED AND FURTHER READING BE WAIVED. COUNCILMAN HOLMES SECONDED. The motion carried by the following vote: AYES: COUNCILMEN BLOXHAM, HOLMES AND MAYOR BISHOP NOES: COUNCILMEN MOREHEAD AND TAYLOR ABSENT: NONE Mayor Bishop stated that the City Council would deliberate on Z-125. City Attorney Flandrick brought out to the City Council that under Section 9121.8 of the Zoning Ordinance if the decision of the City Council was In any way contrary to the action taken by the Planning Commission, the City Council shall refer its findings to the Planning Com- mission and request a further report of the Planning Commission on the matter. Discussion followed regarding leaving portions on Los Angeles Street and Arrow Highway M-I as this would be spot zoning. Ebaugh had made a supplemental report which was quite comprehensive and that a letter dated March 14, 1963 had been written to his office from Dale Adams, Presi- dent of the Baldwin Park City Employees Association stating the employees would prefer their carrier to be Aetna Insurance Company under the conditions set forth in their bid as Alternate Plan #1" Plan No. 2 in Mr. Ebaugh's report). Discussion followed. Mr. Ebaugh in his report recommended that the City con- sider Aetna Life Insurance Company's Plan No. 3 before choosing Plan No. 2 and also, to consider retaining the present program. He stated that Plan No. 2 would be far better than what the City now had for a stabilizing rate; that Plan No. 2 provided Life & AD & D insurance $1,000 per employee, Hospitalization $10,000 Major Medical comprehensive) $50.00 deductible calendar year, 80/20 company insurance; that the rates were a total of $7.11 for Employee, $15.22 for Employee and one dependent, $21.09 for Employee and two or more dependents.
